2 FENCES. (A) As used in this section, the terms FENCES and WALLS refer to structures erected for the purpose of enclosing a lot, yard, or a portion thereof; fences and walls do not include: (1) Retaining walls; (2) Decorative or landscaping walls that are 2 feet or less in height. (B) As used in this section, the terms FENCES and WALLS refer to structures erected for the purpose of enclosing a lot, a yard, or a portion thereof, retaining walls, and decorative or landscaping walls. A wall, fence or hedge may occupy part of the required front, side or rear yard. (1) Fences and walls are permitted in all use districts, subject to the provisions of these regulations. (2) No fence or wall shall be constructed without a permit from the Zoning Officer. (C) Fence and wall height. (1) Fences and walls located within the front yard of a lot in a residential district shall not exceed a height of 3 feet. (2) Fences and walls located within the rear or side yard of a lot in a residential district shall not exceed a height of 6 feet except when located within a sight triangle where the height is limited to 3 feet. (3) Fences and walls located in all other use districts shall not exceed a height of 8 feet, unless a higher fence is approved as part of a conditional use permit allowing the use. (4) If 2 different zones abut, the higher fence or wall requirements shall apply. (5) All heights shall be measured from the natural level of the ground, immediately below where the fence will be installed. For purposes of this section, NATURAL GROUND shall be defined as the top of the earth after the finish grading of the lot per the approved site plan or certificate of survey. Minor depressions or hills that do not exceed 1 foot change in elevation from the adjacent ground outside of the depressions or hills that are less than 10 feet in length along the line of the fence from edge to edge shall not be considered when measuring the height of the fence from the ground. Fences installed on a slope shall run parallel to the slope. (6) For purposes of this section, front yard is the area forward of the front plane of the house. (D) Fence materials. (1) Fences shall be constructed of wood, metal, plastic, or other durable material. All wooden fences, other than those constructed out of redwood or cedar, shall be stained or painted on both sides. Metal fences shall be made of non-rusting material or treated to prevent rust. (2) The use of creosote lumber as fencing or wall material is prohibited S-4 2

3 Sauk Centre - Land Usage (3) The use of chicken wire, cattle panels, wire mesh, or other non-durable, plastic or metal products as fencing or wall material is prohibited. (4) Fences shall not be constructed of hazardous materials that could affect the health and/or safety of the general public. (5) Barbed wire and electrical fences are prohibited, except as follows: (a) Properties actively used for agricultural operations may install barbed wire or electrical fences; (b) Security fences and walls in commercial and industrial districts may be topped with a barbed wire fence not exceeding 2 feet in height. (E) General fence and wall standards. (1) Fences and walls shall be constructed at least 3 feet inside the property line. (2) That side of any fence or wall considered to be its finished side (i.e., the side having no structural supports) shall front abutting property. (3) No fence or wall shall be constructed that is approximately parallel to an existing fence and creates an area between the fences or walls that has limited accessibility for purposes of maintenance. (4) All fences and walls shall be maintained in a safe condition. The landowner of the property on which the fence or wall is located shall be responsible for the maintenance and repair of the structure. (5) No fence or wall may be constructed or maintained in a location that obstructs the ability of a driver of a motor vehicle to see another motor vehicle or pedestrian on any street or alley or sidewalk. (6) Fences and walls are prohibited, and shall not be permitted, within the flood plain district. (7) In residential districts, fences and walls in the front yard shall be constructed with an opacity or opaqueness of less than 50%. (F) Fences and walls within easements. (1) Fences and walls are prohibited, and shall not be maintained, on or in an easement, except by written permit granted pursuant to the following procedures: (a) The landowner, together with the landowner's permit application, shall submit a written request describing the easement to be affected; 2011 S-3 3

4 Zoning (b) The Zoning Officer shall refer the permit application and request to the Public Works Director and Public Utilities Superintendent for review and recommendations; (c) Based upon the recommendations of the Public Works Director and Public Utilities Superintendent, the Zoning Officer shall approve or deny the request; (d) Any approval must be accompanied by specific conditions or modifications to the original request as deemed appropriate to protect the city's easement interests; the permit must contain the specific conditions stated in the approval. (2) If the request for the fence or wall is approved: (a) The city retains the right to require the landowner to remove or abate the fence or wall where the fence or wall interferes in any manner with the city's use of the easement; (b) If there is an emergency necessitating immediate access to the easement, the city reserves the right to remove the fence or wall to obtain access to the easement; (c) The landowner shall bear all costs for removal of the fence or wall in the event the landowner is required to remove the fence or wall for access to the easement, or in the event the city removes the fence or wall in the case of an emergency; (d) The landowner shall be responsible for, and bear all the costs of, restoration of the fence or wall in the event the landowner is required to remove the fence or wall for access to the easement, or in the event the city removes the fence or wall in the case of an emergency. (3) If the request for the fence or wall is approved, the city specifically reserves all rights of an easement holder afforded under the common law of the State of Minnesota. (Ord. 643, passed ; Am. Whether you are a professional excavator or homeowner, in accordance with Minnesota State law, you must contact Gopher State One Call (GSOC) before starting any excavation project if you are using any machine-powered equipment of any kind, or explosives. You may be simply installing a new mail box or planting a tree, whatever the project may be, contacting GSOC before starting your project may allow you to avoid costly damages to underground facilities. Protect yourself and those around you. Use GSOC this time and every time. Don t assume you know what s below! A good practice before digging is to check Gopher State One Call s Positive Response site respond to determine if each utility company check for positive response Once you have submitted your dig information it is created as a ticket which is sent to any utilities that may have underground facilities in the area of excavation. Those utilities will send a locator to the site to either paint or flag the area in question. get your underground facilities marked When you contact GSOC with a locate request, a series of questions will be asked. What is your name, address and phone number? What type of work will you be doing? (i.e. planting a tree, installation of fence) What is the dig location s address, city, county and nearest intersecting street? At the dig location, where will you be digging? (i.e. east side of house, within 5 ft radius of white stake.) When will you be digging? (i.e. 3 days, next week) be prepared (651) or- (800) When you have a project that requires digging, your first step is to contact Gopher State One Call. You can do this by using GSOC s Homeowner Online Locate Request system or by calling the One Call Center. the one call process After contacting GSOC, you must wait. Utilities have 48 hours (excluding weekends and holidays) to locate their facilities. That means if you plan to dig on Saturday, call on Wednesday. WaIT FOR LOCATES Before you contact GSOC, you must outline your dig area with white markings. This helps the locator know exactly where you will be digging. Some good examples of white marking tools include white paint, flags, laths or stakes. Outline the dig area Things to keep in mind! In accordance with Minnesota, you must wait 48 hours (excluding weekends and holidays) after you ve submitted your dig information to begin your digging project. 7 for information on private locating companies. org/contract-locators-directory Physically inspect the jobsite. Ask the property owner. See what equipment or power may serve out buildings. Contact the original installer of the facilities for any maps of the lines. Excavate with caution and be aware of any warning signs of underground facilities. Visit If private facilities are suspected, the excavator should: HOMEOWNERS: Tell your excavator about any private underground lines you know of. Not everything gets marked when you call Did You Know? Prepare maps of any new underground facilities. Bury tracer wire with the new facilities. Use above ground markers or signs to indicate the buried facilities. Visit for more information about protecting private facilities. If you are installing private facilities consider doing the following: Customer-owned lines usually include any that serve outbuildings, hot tubs, security lighting, pools, and natural gas grills. Private underground facilities, such as private utility lines and private distribution networks, do not get marked by facility operators. When a property owner or tenant has any type of private underground facility, they are responsible to locate those facilities or hire someone to locate them.! The contact information for a number of locating companies who will locate privately owned underground facilities on your property can be found in the industry directory at private-facility-locators. SEWER WATER PHONE AND CABLE GAS, OIL, AND PROPANE ELECTRIC After calling GSOC, wait 48 hours (excluding weekends and holidays) before you begin your excavation! Remember to check for facility operator responses. DON T FORGET! THOSE UTILITIES MARKED BY DOTTED LINES ARE TYPICALLY OWNED BY THE PROPERTY OWNER. Private locating services will mark these for a fee. Those lines will NOT be marked by contacting GSOC. The free locating service available through Gopher State One Call (GSOC) applies ONLY to public facility operators. The diagram below shows a variety of utilities, some owned by the utility and some by the homeowner. Respect the marks! Never use mechanized digging tools when you are digging within 24 inches of the markings. Only use hand tools. RESPECT THE MARKS! 8 8 Work Being Done For Your name, the customer s name, or the general contractor s name is sufficient. Duration An estimate of how long you plan on being at the job site. A locate ticket is valid for 14 calendar days. If the duration of the work will extend beyond 14 calendar days, you must request an update on the ticket at least 48 hours, excluding weekends and holidays, prior to the expiration of the 14 day period (unless arrangements are made with the affected operators to periodically remark). If the project will exceed 6 months, a new ticket must be sought prior to the expiration of the 6 month period. Explosives GSOC must ask whether explosives will be used in an effort to assist gas and pipeline facility operators area on, below, or above a public roadway, highway, street, cartway, bicycle lane, and public sidewalk in which the government unit has an interest, including other dedicated rights-of-way for travel purposes and utility easements of government units. Make sure you are familiar with the ROW in the area you are working. Please note that the ROW is not the same as an easement. 11. Right of Way (ROW) GSOC defines the ROW as the means of tunneling horizontally without disturbing the ground above, also known as trenchless construction. 10. Tunneling & Boring You must advise if you will use any Type of Work The specific reason for the work as compared to the work method. For example, installation of a sanitary sewer lateral is much more helpful than digging a sewer line. Avoid default to mark entire lot unless the nature of the work requires this designation. Please note: This does not relieve the excavator from using white markings to define the excavation site. From (Dig Street) travel (N-S-E-W) for (###) (feet, meters, yards, miles) on (driveway, service/gravel/ farm road) into the property to (pre-marking). From (Cross Road) travel (N-S-E-W) for (###) (feet, meters, yards, miles) on (Dig Street) to the (location, Flag, Lath, etc.) on the (N-S-E-W) side of the road. V2017 the TRSQ numbers of the excavation site if available. This information can be found on GSOC s ITIC website: www. gsocsubmit.org or on most property tax statements from your county. To provide TRSQ information, indicate the township, range, and section by their numeric designations and quarter sections by their directional qualifier (NE, NW, SE, and SW). Example TRSQ: Township: 108N Range: 28W Section: 12-NE 18. Township, Range, Section and Quarter Section Provide site. Please identify if the GPS coordinates, if available, represent the center or four corners of location. 17. GPS Coordinates Provide the GPS points of the excavation to the work site from a known intersection. 16. Driving Directions (if needed) Describe clearly how to get Work area is located (describe property orientation front, back, side(s), inside/ outside fence, etc.). Please note: (dog onsite, gates locked, guard/ restricted access, hazards, etc.). Here are some examples of how to effectively use marking instructions. 15. Marking Instructions Identifies the specific portion to the excavation site. If you are a subcontractor and you are excavating, protect yourself and your company by processing a ticket. The general contractors ticket does not apply to anyone except for the general contractor. GSOC recommends a homeowner not to obtain a ticket for an excavator doing work on their behalf. The Excavator should obtain its own ticket. describe the following. 13. All identified information is also made available to facility operators, excavators, and government agencies. Beginning online using ITIC, over the phone by calling GSOC, or from a mobile device using ITIC Mobile, you can file a locate request. Remember to wait 48 hours (excluding holidays and weekends) after submitting the locate request. Check facility operator response using positive response on ITIC and inspect the work site for marks. Contact the facility operator if you have questions regarding their marks. Specific information about the work site and the surrounding area, as well as marking instructions for the work site must be provided. Other information can also be included. GSOC processes the provided information, and the area gets mapped out using specialized software that detects possible conflicts with underground utilities. GSOC then contacts each underground facility operator in the excavation area identified in the locate request. The underground facility operators that requested notification in the excavation area dispatch locators to the described excavation site. Locators use specialized equipment to determine the underground utilities in the excavation area. They locate and mark the horizontal location of underground facilities within the excavation site with different colored flags and paint that correspond to the specific underground facility. Ticket Types LOCATE REQUEST EMERGENCY MEET Use this for standard excavation projects. Locate requests are the most common type of request processed at GSOC. This type of ticket must be requested by the excavator at least 48 hours (excluding weekends and holidays) and up to 14 calendar days from the planned start of excavation. The ticket is valid for 14 calendar days from the start date and time stated on the ticket, unless the locate markings become obscured or obliterated. Excavator Responsibilities PLAN FOR YOUR EXCAVATION You are required to use white markings to define the entire area where excavation will occur, unless it can be shown it is not practical. Include a safety buffer when marking the area. NOTIFY GSOC All Minnesota excavators, including homeowners and farmers, are responsible for notifying GSOC of their proposed excavations so facility operators with underground facilities near the excavation site can be informed of pending excavation. WHITE PINK RED YELLOW ORANGE BLUE PURPLE GREEN When a call is placed to a one call center, there is less than a 1% chance for the underground excavation to result in damage. Area of Proposed Excavation Temporary Survey Markings Electric Gas, Oil, Steam, Propane Communication, CATV, Fiber Water Reclaimed Water, Irrigation Sewer - The Common Ground Alliance s (CGA) annual DIRT report provides a summary and analysis of the events submitted into CGA s Damage Information Reporting Tool (DIRT) for the year As defined by Minnesota Statute Chapter 216D.01 subdivision 3, emergency locates are used for a condition that poses a clear and immediate danger to life or health, or a significant loss of property. GSOC reminds you to first call 911 whenever there is a release of flammable, toxic or corrosive gas or liquid, or a dangerous situation is created. Next, contact the facility operator involved in the emergency, then contact GSOC. - Know the Basics! LOCATION TOLERANCE ZONE 20 ALWAYS USE THE CORRECT WORK TYPE ON YOUR TICKET 20 TELEPHONE LARGE PIPE OR MULTIPLE DUCTS Use this ticket type to request the facility operator to physically meet at the excavation site. A meet should only be requested when it is difficult to precisely define the location of the excavation site in a routine locate request. The use of white markings to clearly identify the excavation area can generally be used to avoid the time and cost of a meet. CHECK FOR ACCURACY OF THE INFORMATION ON YOUR TICKET ALWAYS CHECK THE STATUS OF YOUR TICKET BEFORE YOU EXCAVATE HAND DIG WITHIN THE TOLERANCE ZONE

10 CALL THE 811 PROCESS BEFORE YOU DIG FOR HOMEOWNERS 1Notify your local one-call center by calling 811 or making an online request 2-3 days before work begins. Click here for information about your local one-call center and online service availability. The one-call center will transmit information to affected utility operators. NOTIFY 3Confirm that all affected utility operators have responded to your request by comparing the marks to the list of utilities the one-call center notified. State laws vary on the process for confirmation; please check with your local one-call center for more information. CONFIRM DIG CAREFULLY 5Dig carefully. If you can t avoid digging near the marks (within inches on all sides, depending on state law), consider moving your project to another part of your yard. If you must dig near the marks or use machinery of any kind, please click here to read The 811 Process for Contractors WAIT Wait 2-3 days (varies by state; please click here for state law information) for affected utility operators to respond to your request. On average, between 7-8 utility operators are notified for each request. 4 RESPECT Respect the marks. The marks provided by the affected utility operators are your guide for the duration of your project. If you are unable to maintain the marks during your project, or the project will continue past your request s expiration date (varies by state), please call 811 to ask for a re-mark.
