1 Manhattan Greenway Harlem River Project 7394 / Contract Questions & Answers September 13 th, 2018 In connection with the Request for Proposals relating to the Manhattan Greenway Harlem River released by NYCEDC on 8/20/2018, the questions from potential Respondents and answers provided by NYCEDC are below. 1. Q: The RFP anticipates that the design team should have a Security Design Engineer. Is there a Security Program? Is it a requirement that the Security Design Engineer have local professional experience with the following: Hostile Vehicle Mitigation (Anti-ram design), Physical Security (Blast and Ballistic Design), and Operational and Technical Security. A: The design team should include a Security Design Engineer to work with Parks and EDC to determine the required security program for this space. It is not a requirement to have local experience with Hostile Vehicle Mitigation (Anti-ram design), Physical Security (Blast and Ballistic Design), and Operational and Technical Security. 2. Q: Please provide the inspection report which served as the basis for development of project costs of the subproject between 125th Street and 132nd Street. A: The inspection report has been provided as Exhibit 7 and included as part of Addendum #2. 3. Q: Is the allowance for the Public Art, Task 10, $200K (per appendix C-4) or $400K (per exhibit 2-3)? A: The allowance for the Public Art, Task 10 is $200k per Appendix C-4. This discrepancy has been addressed in Addendum #2. 4. Q: Has a CEQR, EA or EAS been completed for any of the three design packages? If so which ones. If not would that be part of the Environmental Permitting? A: CEQR, EA, or EAS have not been completed for any of the three sub-projects. As part of the scope of work, the consultant will be tasked with environmental review and permitting. 5. Q: Is the future pedestrian bridge over the FDR Drive definitely part of this project, or is it dependent on the available funding once the bulkhead repair costs are evaluated? A: The scope of work does not include a pedestrian bridge. Access to the adjacent neighborhood will be at grade, and beneath the elevated Harlem River Drive. 1

2 6. Q: Are the three sub-projects fully funded and does each sub-project have its own budget? Why are they separated? A: The three sub-projects are considered fully funded for the scope of services listed in the RFP. The project budget for 125 th Street 132 nd Street is ~$101M. The project budget for 132 nd Street 145 th Street is ~$38M. The project budget for 155 th Street Swindlers Cove is ~$88M. The total project budget is ~$227M. The funding for the sub-projects needs to be separate and cannot be reassigned to different sub-projects. 7. Q: Are there federal funds? A: There are no federal funds anticipated for this project. The project funding is entirely City Capital. 8. Q: Will the master concept plan be available to everyone or just the selected consultant? A: As part of the RFP, an excerpt of the concept plan is shared in Exhibit 2. The selected consultant will receive the full master plan. 9. Q: Do resumes count toward the proposal page limit? A: Yes, the resumes count toward the proposal page limit. We suggest including the resumes of only the key members of the design team. 10. Q: The RFP references a sound engineer. What would their role be? A: The Harlem River Drive is adjacent to the Harlem River Greenway Link section of the project. The sound engineer would be responsible for mitigating that noise as part of the park design. 11. Q: Do the funds need to be allocated per each sub-project or can they be reassigned to different sub-projects as need. A: Please see the answer to Question # Q: The contract duration in the RFP does not cover the anticipated construction administration period. Will there be an amendment to the contract or will construction administration be a separate contract. A: The design contract will be amended in the future to cover the time associated with the construction duration. 13. Q: The RFP addresses sustainable engineering design. Can you please clarify if this refers to resiliency measures or sustainable materials? A: As part of the design, it is anticipated that the Consultant will be using standard Parks and DOT specifications and materials while also considering sustainable design practices. It is anticipated that the consultant will provide a resilient design that complies with all local, state, and federal regulatory requirements. 14. Q: Please clarify which MWBE laws apply for EDC projects. 2

3 A: EDC adheres to Local Law 1, which is an amendment to Local Law Q: For Phase 1 and Phase 2 Remedial Action Plan, is that applicable to all three subprojects or just for the Harlem River Greenway Link of 125th to 132nd? A: It is anticipated that the Phase 1 and Phase 2 Remedial Action Plan could apply to other sub-projects as there is a variety of bulkhead types. 16. Q: Do Asian Owned Professional Services count toward the MWBE goal? A: Yes, EDC counts Asian Owned Professional Services towards the MWBE goal. 17. Q: As part of this RFP, does the Consultant need to complete new inspections? A: As per the scope of services, the Consultant must complete the existing conditions task which includes new inspections. The new inspections will inform the current condition of the site and provide the basis for the design moving forward. 18. Q: Is there existing geotechnical information or will the Consultant be required to complete geotechnical investigations? A: There is no existing geotechnical information available. As per the scope of services, the Consultant will complete geotechnical investigations. 19. Q: Please clarify how the public art component will be involved in the design and describe the process. A: As per the scope of services, a public art consultant should be part of the design team. It is envisioned that the public art consultant, in coordination with EDC, Parks, DCLA, and the Community Board, will conduct outreach for the request for proposals from artists to provide an art concept for the Harlem River Greenway Link section of the project (125 th 132 nd ). The public art consultant, EDC, Parks, DCLA, and the Community Board will work together in narrowing down the proposals and select an art concept. It is envisioned that the group is selecting an artist with an art concept designed and not an artist who will then submit a proposal for an art piece. It is envisioned that the art concept should be integrated into the landscape of the park and have little to no maintenance. The allowance for the design, fabrication, and installation of the art is $200,000 as per Task 10. Please note that the artist will be required to provide the labor for the installation of the art. It is recommended that the artist work with the future contractor on site to avoid additional mobilization costs. The design team should also include in their proposal any costs associated with facilitating additional engineering associated with the installation of the art piece, i.e. foundations. 3

4 20. Q: ULURP is listed as an optional task within the scope of services. Can you please clarify how that will work? A: ULURP is an optional task for which, if required, a fee will be negotiated at a future date. 21. Q: Is a licensed surveyor required? A: Yes, a licensed surveyor is required. 22. Q: The full concept plan includes a comfort station and potentially other elements not mentioned in the anticipated elements of the Harlem River Greenway Link section. Can you please clarify how the consultant should determine the scope of the Harlem River Greenway Link? A: The scope of work for the Harlem River Greenway Link includes the design of the necessary bulkhead repairs and reconstruction, as well as components of the concept plan. Based on the current funding and anticipated costs of the bulkhead repairs, at a minimum it should be anticipated that the Harlem River Greenway Link will include bike and pedestrian pathways, minimal plantings, lighting, esplanade railings, and utilities. Please refer to Task 3 Section 1.A as per Addendum #2 for more detail. It is envisioned that the minimal additional components of the concept plan could be additional furnishings or landscaping. The comfort station will not be included in the scope of this project. 23. Q: Does the Lead Project Consultant need to be a licensed Civil Engineer or can the Lead Project Consultant be a NYS licensed Landscape Architect? A: A licensed Engineer is required to be the Lead Project Consultant. 24. Q: Appendix B-5 states that EDC intends to procure a construction manager ( Construction Manager ) that will coordinate with the Design Team during the pre-construction phases for tasks including additional cost estimating, value engineering, and construction documents and specifications review for constructability, staging, and phasing. The Construction Manager shall provide independent oversight and review of the Design Team s work and will assist the Corporation in project controls, preparing bid packages and, ultimately, managing and overseeing Project construction. Please advise if this will be a competitive solicitation and when it is anticipated to be awarded. A: The procurement of the construction manager will be a competitive solicitation and is anticipated to be awarded Summer Q: How may I get a copy of the sign-in sheet? A: The sign-in sheet is posted on NYCEDC s website. 4

5 26. Q: Task 2 is entitled Environmental Review and Permitting, but no mention is made of the CEQR process. Would a CEQR compliant environmental review be required, or has it already been completed for the project? Further, Exhibit 2 to the RFP and Appendix C of the Contract both list EA as a subtask under Task 2, Environmental Review and Permitting. Has it been predetermined that an Environmental Assessment will be the review process? Is it intended that proposers provide the scope for that subtask, since it does not appear to be defined in Appendix B? A: CEQR compliant environmental review will be required and has not already been completed. It will be the Consultant s responsibility to determine if an Environmental Assessment is required. 27. Q: Exhibit 2 to the RFP, the Sample Fee and Cost Schedule, includes subtasks for Constructability Review and Constructability Report under Task 1: Existing Conditions. These subtasks are not described under the primary task in the Scope of Services given in Appendix B of the Contract Draft. Is it intended that proposers provide a scope for these items? A: No, proposers should not provide a scope for Constructability Review and Constructability Report in Task 1. A revised Sample Fee and Cost Schedule is reflected in Addendum # Q: Under the description of Task 5 in in Appendix B, Part IV Article E.12 it is noted that Consultant shall prepare, submit, assemble and reproduce the documents required for construction of the Project to the extent provided below. How many copies of the documents should be assumed? A: It is anticipated that the required documents will be submitted electronically for review and comment, and, when final, will be issued electronically for bid and construction. 29. Q: Appendix B Description of Task 8, Construction Administration includes a requirement (Part IV Article H.12) not mentioned elsewhere that the Consultant to attend weekly meetings throughout design and construction. Is it intended that the design meetings will be included in Task 8? A: Design and other meetings are to be included in each task as appropriate to that task. 30. Q: The Description of Task 8 lists responsibilities of the Contractor for As-Built/Record Drawings. Is that intended to refer to the construction contractor or the Consultant? Reference is also made to the requirements of the Agency. Is that intended to refer to NYCDPR, or something else? 5

6 A: The Construction Contractor will be responsible for the As-built drawings. Requirements of the Agency refers to NYCDPR. 31. Q: Please confirm that the Task 2 ESA/site investigations are applicable to all sub-projects. A: Task 2 ESA/site investigations are applicable to all sub-projects. 32. Q: Have any of the structures in Serious or critical condition been repaired? A: None of the structures in serious or critical condition have been repaired. 33. Q: What existing permits might we have to modify? A: There are no existing permits. 34. Q: Should we assume that the EDC general permit will be renewed? A: The EDC General Permit was renewed in August Q: If a subconsultant has M/WBE certification in another state, and has started the certification process in New York, will that be accepted for purposes of the selection criteria? A: We will not count certifications from other states. If a firm is pending NYC certification and they can submit proof of submission of their application, we will count the firm toward the goal as part of the RFP response. If they are not able to get city certified before execution of the contract we will not count the firm toward the goal, and it will remain the Consultant s responsibility to reach their proposed MWBE goal. 36. Q: Are we bound by the titles in RFP Exhibit 2/Contract Appendix C, or can we modify/expand on those? For instance, there will be graphic artists, surveyors, archeologists and other technical staff that don t fit neatly in the given titles. A: The proposer may modify and expand on the titles in RFP Exhibit 2/Contract Appendix C. 37. Q: We understand that ULURP Application under Task 2 is an optional (Add Alternate) task. Appendix B to the Contract Draft states that this will be paid as an Allowable Additional Cost. Does that mean that the labor hours for that effort should not be included in the staffing tables in Exhibit 2 of the RFP? A: Please see the response to Question # Q: Appendix B to the Contract is clear that the Program Development subtask under Task 3 is applicable only to 125 th Street to 132 nd Street. Is it correct that the other 2 subprojects will be included in the Schematic Design submissions, or will those go directly to Preliminary Design? 6

7 A: Subprojects 2 (Bulkhead Structure East 132 nd Street West 145 th Street) and 3 (Bulkhead Structure West 155 th Street Swindlers Cove) are not to be included in the Schematic Design submissions. 39. Q: RFP Part I, Article could be read to mean that the 60-page limit applies to the entire proposal, including M/WBE Participation Plan, fee table, etc. Please clarify which items count toward the 60-page limit. A: All items listed in RFP Part I, Article , are to be included in the 60-page limit. 40. Q: At the pre-proposal meeting, EDC offered to provide the funding breakdown by park section. Please provide that information if available. A: Please see the answer to Question # Q: Addendum 2 reduced the public art budget from $400K to $200K. Please confirm that this budget includes design, fabrications and installation. A: Please see the answers to Questions #3 and # Q: What is EDC s desired design life for new and rehabilitated bulkhead structures? A: Where reconstruction is suitable, we seek a minimum of a 50 year design life. For areas where repairs are more suitable given the project budget, the consultant should still seek to maximize the design life as much as possible. 43. Q: Was this project subject to the capital project scope development process administer by the OMB? If so, please make the final report(s) available. If the reports are not available, are firms that contributed to the development of those reports precluded from bidding on this project? A: No, this project was not subject to OMB s capital project scope development process. 44. Q: Which of the options outlined in the inspection report are included in the project budgets? For example, has the project been scoped assuming that all identified conditions are to be addressed or some subset such as critical conditions or priority repairs only? A: NYC Parks assumed the most significant repairs in their cost estimates which determined the project budgets. 45. Q: Will the selected firm be required to perform hazardous materials surveys associated with building and/or structures associated with the Manhattan Greenway Project? A: Yes, the selected firm will be required to perform hazardous materials surveys associated with buildings and/or structures as it relates to the scope of work of this project. 7

8 46. Q: What is the criteria that governs whether or not Phase I ESA is performed for a specific location within the project? A: It will be the Consultant s responsibility to determine if a Phase I ESA is required for a specific location. 47. Q: What specific standard is required to be followed for a Phase I ESA (i.e. ASTM). A: It will be the Consultant s responsibility to determine what standard is to be followed for EDC and NYC Agency reviews and approvals. 48. Q: The RPF lists one of the Required Consultant Team Members is an "Archaeologist." However, Exhibit 2: Sample Fee and Cost Schedule does not list "Archaeologist." Does this mean respondents do not need to include costs for the archaeological work as part of their proposals? OR Does EDC want respondents to add the archaeologist(s) as a line item in their Cost Schedule Rate Table? If added, should the respondents include three levels of archaeological personnel, as is done with the other professionals? If just one line to be added, should it be the most senior, most junior, or a range of rates? A: The proposer can add and remove titles from the Sample Fee and Cost Schedule. The proposer should include all titles required to perform the project. 49. Q: Do resumes and schematics (including the organizational chart and schedule) count towards the 60-page limit count? A: Please see the answer to Question # Q: The area between 125 th Street and 135 th Street is currently under construction. Is it possible to obtain a map of the final street/highway plan? A: The selected consultant will be provided construction drawings and as-builts from NYCDOT. 51. Q: Do we know what community groups might be involved [for the Manhattan Greenway Harlem River project]? A: Community groups that were involved in the concept planning process included but were not limited to Manhattan Community Board 10, Friends of Harlem River Park, and Friends of the East River Esplanade. 52. Q: Can anything be attached to the bridge overpass structures? A: The Consultant should not anticipate attaching anything to the bridge overpass structures. 8

9 53. Q: Should plans include concepts for bridging the parkway, in addition to existing crossings? A: Plans should not include concepts for bridging the parkway. 54. Q: Has sea level rise been accounted for in the master plan? A: For 125 th to 132 nd, Parks may want to consider elevating up to approximately 4 above existing grade. The selected consultant would work with EDC and Parks to provide options for alternatives. 55. Q: Are there opportunities for landscape/soft edges where sections of bulkhead have to be entirely replaced? A: Where sections of the bulkhead have to be entirely replaced they should be replaced with a hard bulkhead. 56. Q: Is it possible to get an update on the plans for the Sunnyside Yards project across the river? Where are they with design? A: It is not possible to get an update on the plans for Sunnyside Yards. 57. Q: Can the scope of the security design requirements be more clearly defined? A: Please see the answer to Question # Q: Do resumes count towards the 60-double-sided page maximum? A: Please see the answer to Question # Q: Current documents reflect various budgets for the Public Art (Task 10). Please confirm the total amount of this allowance. A: Please see the answer to Question # Q: Do Veteran-Owned Businesses satisfy M/WBE participation goals for this project? A: No, Veteran-Owned Businesses do not satisfy M/WBE participation goals for this project. 61. Q: Have there been any revisions to the Manhattan Greenway brand or guidelines since 2004? A: We are not aware of any revisions to the Manhattan Greenway brand or guidelines. 62. Q: Can the existing greenway map artwork be repurposed? Will the selected consultant be able to use the original map work file? 9

10 A: NYC DOT maintains the greenway map. The selected proposer and EDC can request from DOT access to the greenway map artwork. 63. Q: One page 116, it states that the Consultant shall prepare existing documentation reports, and drawings as may be required. Elements to be inspected shall include retaining walls, railing, paving, utilities, planted beds, and site furnishings. Does this section need to also include the investigation of existing signage? A: Yes, existing signage should be included in the site inspections. 64. Q: Is public art signage assumed to be included within task 10? A: Yes, public art signage is included within task Q: Is design team responsible for any part of the as-builts listed in Task 8: Construction Administration? A: No, the design team is not responsible for the as-builts listed in Task Q: Will the project be constructed in phases? If so, how many and duration? A: It is anticipated that the project will be constructed in one phase. 67. Q: How many construction documentation packages does NYCEDC envision? A: It will be the Consultant s responsibility, in consultation with EDC and EDC s Construction Manager, to determine the most efficient number of construction documentation packages. 68. Q: Has the Concept Plan for the Harlem River Greenway Link Project (East 125th-East 132nd Streets) in 2018 been approved by NYCDPR? A: Yes, NYCDPR has approved the Concept Plan for the Harlem River Greenway Link Project. NYCDPR initiated and managed the creation of the concept plan. 69. Q: Was there any public outreach performed during the Concept Plan for the Harlem River Greenway Link Project (East 125th-East 132nd Streets) in 2018? A: Parks presented the concept plan to Manhattan Community Board 11 Parks Committee in January Q: Is NYCEDC aware of any hazardous materials in or in close proximity to the project? A: It will be the Consultant s responsibility to determine if there are any hazardous materials in or in close proximity to the project. 10

11 71. Q: Is the whole project being handed over to NYCDPR after construction? A: Yes, NYCDPR will own and operate the project site postconstruction. 72. Q: When is NYCEDC planning to hire the Construction Manager for this project? A: Please see the answer to Question # Q: What is the scope (or base assumptions) relating to the Optional ULURP listed in Task 2? A: Please see the answer to Question # Q: Please clarify the 60 double-sided pages limit in A recent proposal from our firm used 36 double-sided pages for resumes and 20 for team project experience. We would suggest excluding the cover letter, executive summary, and resumes from the page limit and limiting the remainder of the proposal to 45 double-sided pages. A: Please see the answer to Question # Q: What will DPR s involvement be in the consultant selection? A: DPR will have a representative on the selection panel. 76. Q: What will NYCDOT s involvement be in the consultant selection? A: NYCDOT will not be involved in the consultant selection. 77. Q: Who will be on the selection committee? A: The selection committee will consist of staff from NYCEDC and NYC Parks. 78. Q: How should the proposed fee for the optional ULURP task be treated in calculating MWBE participation? A: Please see the answer to Question # Q: Please confirm that drawings, specifications and construction cost estimates will be to EDC standards, not to DPR or NYCDOT. A: Drawings and specifications will be to DPR and DOT standards as applicable. Construction estimates will be reviewed by EDC. 80. Q: North/south extents of Project Site/study area are understood. Please confirm upland extents from bulkhead. A: For 125 th to 132 nd, the extent is up to the Harlem River Drive, except for around 127 th St, where it extends into the landscape triangle west of the Harlem River Drive and which will function as a future at-grade entrance to the park. The full project extents are detailed in the inspection reports in Exhibits (3-5 and 7). 11

12 81. Q: Appendix B states that NYCEDC is working in partnership with NYC Parks. Exhibit 6 lists NYC DOT as a partner agency. Please clarify NYC Parks and DOT s role in the project. A: NYC Parks is the client agency that will own and operate the site post-construction. NYC Parks will participate in the project throughout design and construction. NYC DOT will participate in the project for review and approval of project elements as required. 82. Q: The pre-proposal presentation project team member list and the Appendix B (II.A.1) list do not match. Please clarify the required team members. A: The required team members are listed in Appendix B (II.A.1). 83. Q: Please confirm that we can add and delete titles as necessary in the Sample Fee and Cost Schedule (Exhibit 2). A: Please see the answer to Question # Q: Please confirm that we can provide an average hourly rate for positions with multiple people in the Sample Fee and Cost Schedule (Exhibit 2). A: During the selection process, points for fee will be awarded based on the total fee submitted. The final fees will be negotiated with the selected contractor and will be a lump sum fee based on the fee proposal submitted. It is the Consultant s responsibility to decide which rates best reflect the services that are requested. 85. Q: Please provide a common allowance for all proposers to use for bathymetric survey, site survey, and geotechnical borings so these reimbursable costs do not become a consideration in comparing the design costs of different proposers who may make differing assumptions. A: It is the respondents responsibility to prepare a bathymetric survey, site survey, and geotechnical borning plan. The cost of the bathymetric, site survey, and geotechnical borning should be included in the lump sm proposal. This contract does not have allowable additional costs. All allowable additional costs must be included as part of the proposed costs of the Task. 86. Q: Are all three subprojects subject to a Phase II ESA subsurface investigation and Remedial Action Plan (RAP)? If yes, should these documents be prepared as separate deliverables given these are three separate subprojects? A: All three subprojects are subject to a Phase II ESA subsurface investigation and Remedial Action Plan (RAP). The Consultant may combine these documents into one deliverable. 12

13 87. Q: Will a Remedial Action Cost Estimate be required as part of the RAP deliverable? A: Yes, a Remedial Action Cost Estimate will be required. 88. Q: Can we anticipate a future additional scope of work to account for topside esplanade design elements that are not within the current at-aminimum scope i.e. footbridge and comfort station? A: No additional monies will be allocated to the project. After the initial estimating phase, it will be the Consultant s responsibility, in consultation with NYCEDC and NYC Parks, to determine what balance of topside esplanade design elements and bulkhead repair work can be accomplished with the project budget. 89. Q: Should stakeholder engagement surface additional design elements, is NYCEDC amenable to augmenting or shifting from the existing concept plan? A: Yes, NYEDC is amenable to shifting from the existing concept plan if the client and/or community desire it. 13
