1 Bright Wood Corp. 335 NW Hess St. PO Drawer 828 Madras, OR Ph: (541) Fax: (541) IMPORTANT NOTICE- RESPONSE REQUESTED 2014 California Proposition 65 Requirements for Wood Product Warnings to Consumers Dear Customer: In 2010 wood dust was added to the California Proposition 65 (Safe Drinking Water and Toxic Enforcement Act of 1986) list of chemicals known to the State of California to cause cancer. More recently, additional chemicals associated with wood products, Titanium Dioxide (in 2011) and naturally occurring wood Methanol (in 2012) have been added to the Prop 65 list of chemicals known to the state of California to cause cancer or reproductive harm. According to no person in the course of doing business shall knowingly and intentionally expose an individual to wood dust or other chemicals without first providing a clear and reasonable warning. The warning requirement applies to any company who manufactures, produces, sells, distributes, or otherwise transfers a wood product into the stream of commerce in California. The California Attorney General s Office has indicated wood product manufacturers and distributors have a duty to inform their retail customers of the warning requirement and to take reasonable steps to ensure their customers are providing the warning to the ultimate purchaser of the wood products at retail outlets. The California Attorney General s Office has indicated the following warning, if properly displayed at the retail outlet, satisfies the clear and reasonable warning requirement of the statute: Drilling, sawing, sanding, or machining wood products generates wood dust and other substances known to the State of California to cause cancer. Avoid inhaling dust generated from wood products or use a dust mask or other safeguards to avoid inhaling dust generated from wood products. Wood products emit chemicals known to the State of California to cause birth defects or other reproductive harm. This warning should be posted at the retail point of sale or display of the wood products so it will be seen by the purchaser of the wood products.

2 Finally, Bright Wood is required to obtain confirmation from its customers that they will comply with the Proposition 65 requirements and post the warning sign. 4 To comply with your duties under Proposition 65, you must post the warning sign at the retail outlet at the point of display of the wood products or at the checkout counter so that it is likely to be seen and read by the purchaser of the wood products. Please reply using the attached reply postcard to let us know your company will carry out your duty to provide the Proposition 65 warning stated above. Alternatively, you may us at [manufacturer/distributor address here] to indicate that your company will comply with the Proposition 65 requirements. If we do not hear from you within 21 days from the date of this letter, we will call you to follow up on this reply request. The Attorney General has advised us to send out a copy of this letter on a yearly basis hereafter or to obtain confirmation verbally or in writing that you are continuing to provide the Proposition 65 warning. In addition to properly posting the warning sign in your store, you may also choose to include a warning on any invoices for wood products as additional warning to your customer. If you choose to provide an invoice warning in addition to the warning sign, the following invoice warning language can be used: : Drilling, sawing, sanding, or machining wood products generates wood dust and other substances known to the State of California to cause cancer.
