2 OBJECTIVES: The objective of this checklist is to verify compliance to the Criteria listed in the Sarawak Legality Standard as defined by STLVS Principles 1-4 (D8) for Sarawak dated 30 October Compliance is defined when all applicable criteria are observed to be compliant. A Minor Gap to any indicator does not constitute non-compliance to a criterion. A Major Gap to any applicable indicator does reflect non-compliance to a criterion. Compliance for a criterion where multiple minor gaps are identified in indicators under the criterion may reflect non-compliance to the criterion. All issues identified under this standard shall be considered appropriate to the scale and degree of forestry operations undertaken by the parties under the agreement. Overview of Licensee Summary Information Organization Information: The license holder Perbadanan Perusahaan Kemajuan Kayu Sarawak (Sarawak Timber Industry Development Corporation, STIDC) operates the licensed area through a Timber Extraction Agreement with Song Logging Company Sdn. Bhd. (Registration # K). Song Logging Company Sdn. Bhd. (Song Logging) is a 100 % subsidiary of WTK Holdings Berhad, Sibu (Registration # M), a public listed company on the Main Board of Bursa Malaysia. Song Logging Company Sdn. Bhd. was incorporated in Its principle business is extraction and sales of timber as well as sawmilling. The company has been operating in the licensed area since 1963 (under former Forest Timber License No. T/0250). The owner of Song Logging, WTK Holdings Berhad (formerly known as WTK Group of Companies) is a timber resource-based company based in Sibu, Sarawak, Malaysia. It was founded in 1997 (renamed from Samanda Holdings Berhad, in which WTK Group of Companies was a major shareholder). Over the years, WTK Holdings Berhad has developed a diverse corporate structure with the Timber Division as its core business, and further divisions in oil palm and forest plantations, oil & gas, property, as well as manufacturing of tapes and foils. The principal activities of WTK Holdings Berhad (WTK) focus on sustainable harvesting of timber resources and value adding downstream activities. WTK operates 17 forest timber licences comprising a total of 638,541 ha. WTK also operates another three Licenses for Planted Forests (LPF) in Sarawak, with a total licensed area of 152,665 ha. Song Logging Company Sdn. Bhd. is the sole contractor operating Forest Timber Licensed No. T/0518 with a gross area of 118,826 ha. The license is issued to Perbadanan Perusahaan Kemajuan Kayu Sarawak (STIDC). STIDC / FTL No. T/0518 Page 2

3 Key regulations: The legal framework is provided in the following laws (ordinances), rules and regulations: - Statement of Forest Policy (1954) - Forest Ordinance (2015) - Forest Rules (1954) - National Parks Ordinance (1956) - National Parks and Nature Reserves Ordinance (1998) - Wildlife Protection Ordinance (1958) - Sarawak Timber Industry Development Corporation Ordinance (1973) - Sarawak Timber Industry (Registration) Regulations (2008) - Sarawak Forestry Cooperation Ordinance (1995) - State of Sarawak Forest Timber License (FTL) - Inter-agency Standard Operating Procedures (SOPs) for Performance of Forestry Functions in Sarawak (Ministry of Resource Planning and Environment, 2012) - Minimum Wages (Amendment) (No.3) Order Sarawak Labour Ordinance (Cap.76) - Employment Act 1955 Description & Licenses: On 8 March 1976, STIDC entered into a long-term Timber Extraction Agreement (Principal Agreement) with Song Logging Company Sdn. Bhd. Under this agreement, Song Logging has the sole right to manage the concession area according to the prevailing rules and regulations of the Forest Department Sarawak and other regulatory government bodies. In exchange of this transfer of management rights, Song Logging pays a premium per hoppus ton for all timber harvested from the licensed area. The Principal Agreement was subsequently amended by two Supplementary Agreements made on 1 Jan 1988 and 21 Oct 2010 respectively, to account for changes in the license period, expiry, and make adjustments for payment of premium by Song Logging to STIDC. The name of the licensed area is Bukit Raya, which falls under the Stateland category. It is located in the Kapit District of the 7 th Division, Sarawak. Management / Land Tenure: The licensee, Perbadanan Perusahaan Kemajuan Kayu Sarawak (STIDC) holds FTL No. T/0518 issued by the Forest Department Sarawak (FDS), initially valid from 01 October 1975 to 30 September 2000 (Ref.#: MF/C/3-3/1 dd. 23 July 1975). The license was renewed to 30 September 2010 on 09 December 1996 (Ref. #: WPO (II)-68c). A second renewal for another 15 years to 30 September 2025 was made on 05 April 2010 (Ref. #: WPO (V)-83). The Forest Timber License No. T/0518 is managed directly by Song Logging Company Sdn. Bhd. (Song Logging). However, through the current assessment, a significant portion of Coupe 01AR has been transferred to Ta Ann for the development of oil palm plantations that is currently being established and planted. WTK / Song Logging has not received notification of the landuse change for Coupe 01AR from the Forest Department Sarawak to amend the revised General Harvesting Plan that was submitted in STIDC / FTL No. T/0518 Page 3

4 Management Planning (FMP / GP): The revised General Harvesting Plan (GP) for the licensed area was approved by FDS on 22 October 2015 (Ref.#: WPO (VI)-46). A revised GP was submitted on 4 January 2017 (Ref.#: DWK/al/FD(T/0518)-417). WTK has revised their GP for FTL No. T/0518 that has been recognized by the FDS on 1 August 2017 (Ref.#: WPO (VII) with an amended area of 118,826 ha in accordance to GIS mapping. FDS is in the process of formalizing the approval of the updated area for FTL No. T/0518. Longhouse communities defined in the EIA located within the licensed boundary and adjacent to FTL No. T/0518 are identified on the current GP map dated on October Operational activities: Coupe 07AR is under planning for year 2018, Song Logging is preparing the detailed plan (DP) for approval by FDS prior to pre-felling inventory. Social survey to attain agreements will be conducted. Coupe 06AR is currently being harvested in 5 blocks which started on 15 September Coupe 05AR (I) is currently being harvested under a 6-month extension (SFC 600-1/1/89.2(45) effective from 30 August 2017 and will expire on 28 February Coupe 05AR(II) harvesting activities are near completion. PEC permit for active blocks in Coupe 5AR (II) is valid through 22 November The company will need to reapply for another extension. Song Logging waiting on the PEC for the remaining 6 blocks that includes 75, 78, 81, 84, 86 & 89 due to delay in ensuring the agreements for each block have been completed and there are no overlapping land claims. Operations in Coupe 04AR (I) & Coupe 04AR (II) have been completed in 2017 with coupe clearance certificates issued by SFC. 5 Environmental context: Forest type and history of management: The area is dominated by Mixed Dipterocarp Forest, shifting agriculture areas and minor portions of Riparian Forest. No comprehensive Forest Management Plan has been developed. Instead, a simple Felling Plan had been written in 1975 to cover the initial license period of 25 years. The current total estimated net industrial stem wood volume for the productive area has not been determined. The allowable cut is regulated through a monthly volume production limit. Pre-felling tree enumeration data and timber inventory volumes are only available for individual blocks of currently worked Coupes. The yield regulation follows a simple area control method, with 11 annual harvesting coupes derived from the total productive (operable) area. - according to the Felling Plan, the minimum diameter cutting limit is 18 (45.7 cm). - with effect from 15 July 2010, DF Circular No. 4/2010 the Royalty Rates for individual timber species groups as per 1 st Schedule of the license agreement were changed to a single flat rate per m3. - through FDS Circular 03/2015 of 17 February 2015, FDS has imposed a ban on felling and export of Menggris species for all Forest Timber Licences. Principal commercial species: According to the EIA report, dominant commercial species occurring within the licensed area include Shorea spp. (Meranti puteh, Meranti kuning, Meranti paya bersisek, Meranti melantai, Selangan batu), Shorea parvifolia (Meranti sarang punai), and Dipterocarpus (Keruing). Specific biological values (e.g. rare or endangered species): The EIA Report identified some protected tree species, such as Dipterocarpus oblongifolius (Keruing, in Riparian Forest), at least 5 Ficus species, Koompassia malaccensis (Menggris) and Koompassia excelsa (Tapang). The fauna occurring in the licensed area includes totally protected birds such as the Great Argus pheasant (Argusianus argus) and the Rhinoceros Hornbill (Buceros rhinoceros), Helmeted Hornbill (Buceros vigil), the White-rumped shama (Copsychus malabaricus), Rufous-backed Kingfisher (Ceyx rufidorsa), and various other species of Kingfishers (Alcedinidae) and Woodpeckers (Picidae). Among the mammals found in the licensed area are the Borneon Gibbon (Hylobates muelleri), Pig-tailed and Long-tailed macaques (Macaca nemestrina, M. fascicularis), Giant squirrel (Ratufa affinis), Sunbear (Helarctos malayanus), the Clouded Leopard (Neofelis nebulosa), the Bear Cat (Arctitis binturong) and Porcupines (Hystricidae). All these mammals are either protected or totally protected species under the Wildlife Protection Ordinance Sarawak Other common species found include the Wild boar, (Sus barbatus), Sambar deer (Cervus unicolor), Barking deer (Kijang - Muntiacus muntjac) and Mouse deer (Pelanduk - Tragulus javanicus). Common reptiles found were Wagler s Pit Viper, Pit Viper, Whip-snake, include Pythons, Striped broncebacked tree snake, Elaphids, Craits, and Paradise tree snakes. Other reptile species located in the area include the spiny Hill Terrapin, flat-shelled turtle, brown tortoise, geckos, flying lizards, tree monitor lizards, tree skinks, and several common snakes. 6 Environmental services (e.g. critical watersheds, wildlife corridor, etc.) provided by the forest: Villages in and adjacent to the area are relying on gravity-feed water supply systems from clean streams at higher elevations on the hills, mostly within a distance of 1 km from the settlement. Critical watersheds of these water supply systems have been demarcated and mapped for conservation. According to the EIA Report prepared in year 2013, 19 gravity-feed water supply systems are located within the project area. Other sensitive sites include burial grounds of local communities along the riverbanks and within shifting agriculture areas. These sites have not all been marked and mapped yet by the company but will be identified prior to the commencement of any harvesting operations, following consultation with nearby communities. Existing EIA report: An Environmental Impact Assessment (EIA) is available, which has been approved by the Natural Resources and Environment Board Sarawak (NREB) on 03 December 2013, Ref.#: (10) NREB/6-3/2F/56. It covers the re-entry harvesting operations to be implemented in the whole licensed area of FTL No. T/0518, between Batang Rajang Sg. Pila and Batang Baleh Sg. Mujong, Kapit Division. On 11 December 2013, an Undertaking between Song Logging Company Sdn. Bhd. and the EIA Consultant, Ecosol Consultancy Sdn. Bhd. was signed in accordance with Section 6(b) of the Natural Resources and Environment (Prescribed Activities) Order, 1994 to develop and operate the licensed area in compliance with all terms and conditions prescribed in the EIA approval document. As part of the conditions, the company has to provide Environmental Monitoring Reports (EMR) to NREB on a quarterly basis. The EMR for the 1 st 2 nd & 3 rd Quarter of 2017 were presented. Social context: No specific social survey or assessment has been carried out in the licensed area. However, Chapter 3.3 of the EIA Report provides a brief description of the human environment. The licensed area of FTL No. T/0518 hosts a large number of settlements: Altogether, there are 130 settlements (mostly longhouses) within the licensed area (67 settlements) or within a 3-km range of the licensed boundary (63 settlements), comprising a total estimated population of about 23,505 inhabitants (2,891 longhouse doors). Typical activities of the population include farming (shifting cultivation, wet paddy, rubber, mixed fruit trees, pepper, and vegetables), livestock raising, fishing including some aquaculture, hunting and collection of jungle products. There are six medical clinics serving the area. In more serious cases, patients are brought to the Kapit Hospital. A total of 17 primary schools including pre-schools serve the region. For further education, two secondary schools are located in Kapit and Kg. Selirik. Most of the older people in working age practice their traditional activities like farming, fishing, hunting and collection of jungle products. The younger people, more educated household members, prefer to become engaged in non-farming activities, seeking employment with government agencies or the private sector, or contract works. The timber based sector is still a major employer in the project area. It is estimated that about 19% of the active workforce are working for Song Logging Company Sdn. Bhd. as mandores, truck drivers, security staff, machine operators or general workers. Others obtain employment in the oil palm and forest plantation sector. Based on the EIA report, the majority (65%) of the households interviewed by Ecosol Consultancy Sdn Bhd agree to the project operations implemented by Song Logging since it will bring along benefits in terms of employment, infrastructure development and general community support STIDC / FTL No. T/0518 Page 6

7 provided by the company. 25% are not sure about the project impacts and 10% do not agree to the forest project operations. Land / User Rights Clams Agreements: The company holds signed agreements with longhouse communities affected by forest operations prior to starting any logging operations within areas claimed by longhouses under a permitted annual harvesting coupe. The agreements are entered as a form of compensation of the claimed interest of local communities on the land and resources within the licensed area. The agreements regulate the cooperation and the type of compensation payable during the period of timber harvesting within a defined Coupe. Parties to the agreement are Song Logging Company Sdn. Bhd. and the community represented by JKKK members, and/or individual households of the community. Sub-agreements are also made with claims from individual doors (families) within a longhouse for specific areas claimed within the coupe or block areas. Records of agreements for longhouses are available and maintained including payments made. Social Monitoring: This is an ongoing activity of the company s CSR Team, which monitors the socio-economic conditions within and around the licensed area, through community visits and communication, and responding to any issues arising as necessary. The key person in this process is the Camp Manager. Scope of Assessment The scope of the evaluation is to verify compliance of Forest Timber License No. T/0518 licensed to Sarawak Timber Industry Development Corporation (STIDC) and operated by WTK / Song Logging Company Sdn. Bhd. (sole contractor) with the STLVS P1-4 Standard (Draft 08) 30 Oct Site evaluation to verify and report the level of compliance by STIDC and its appointed contractor Song Logging Company Sdn. Bhd. to the standard in respect to each of the criteria within this report. Compliance is defined when the auditee demonstrates that the indicators consist of only minor gaps or no gaps against any applicable criteria of the standard. Non-compliance to the Sarawak Legality Standard occurs when the auditee does not demonstrate adequate compliance to a criterion. STIDC has a Timber Extraction Agreement with Song Logging Company Sdn. Bhd. (Registration No K). Environmental Impact Assessment was approved by NREB on 03 December 2013, Ref.#: (10) NREB/6-3/2F/56. The EIA report Environmental Monitoring Report (EMR) is carried out quarterly. Song Logging has a system to store Scheduled Waste and hires contractors to dispose of scheduled waste. Oil trays for preventing oil spills in Ng. Bawai Logpond workshop was not properly used. The generator station included a drain hole that could prevent containment for spillage of diesel. (Observation 001) Song Logging has revised the General Harvesting Plan (GP) that covers 118,826ha of the licensed concession with a net operable area of 75,547 ha. The assessment team observed an area currently being planted into oil palm in Coupe 1 has not been quantified in respect to change in the current total operable area since the company has not received notification from the FDS on changes to the area of FTL No. T/0518 (Observation 002). The PEC operations approved by SFC for active Coupe 5AR(I), Coupe 5AR(II), and Coupe 6AR. Principle 2: Licensed boundary and coupe boundaries are mapped and marked. There are two main entry points leading to the FTL No. T/0518 area and are located inside the licensed area and controlled with check stations. Song Logging also conducted helicopter surveys for illegal activities, with the last survey STIDC / FTL No. T/0518 Page 8

9 Highlights of Assessment conducted on 28 July No signs of encroachment were identified. Gap 002/2016 (Minor) Closed Buffer zones checked during the assessment in Coupes 6AR and Coupe 5AR (I) & 5AR (II) were identified and marked with blue paint and signs. Buffer zones in Coupe 6 AR were adequately protected from disturbance. Observed two stream buffer zones in Coupe 5AR(I) disturbed from bridge repair whereby soil was pushed into the marked buffer area. Gap 003/2017 (Minor) Current rules and regulations as per FTL No. T/0518 are based on conventional harvesting practices which permits all-marketable trees over 45 cm (Non-Dipterocarp and Dipterocarp species) to be harvested. All stumps checked were within the permitted diameter limits. Logs with mid-diameters below 45 cm are not clearly documented to originate from trees above the cutting limit or from infrastructure. (Observation 003). Song Logging uses LPI tags to identify each log produced in each Block. All logs observed at the stumping had LPI tags. Log Specification Forms completed based on log batches for royalty assessment by Sarawak Forestry Corporation are then issued a Royalty Tag. Song Logging conducted safety and health training and field staff were observed to use PPE. Principle 3: Records of Timber Royalty (RM 65/m3), Hill Timber Premium (RM 0.80/m3), and STI Premium (RM 1.00/m3), Rehabilitation and Development Cess (RM 0.60/m3) are maintained monthly for all batches of logs produced. Principle 4: Map of longhouses located within and adjacent to the FTL No. T/0518 boundary is identified on the GP although the actual locations may not be current. Song Logging does not clearly map the Longhouses on the DP or PEC for Coupes 5AR (1) Coupe 5AR (II) or Coupe 6AR in regards to the location or claimed areas. Gap 004/2017 (Minor) Formal agreements are based on a standard agreement for compensation to longhouse communities for timber harvested within the specific portion of the licensed area affecting the land claims and livelihood of the concerned community. For agreements providing compensation on basis of production volumes, community representatives are given the opportunity to verify the volume produced by the company. However, the agreements do not clearly identify and define claimed areas as per block#(s) within the logging coupe nor the payment terms. (Observation 004) Song Logging has a documented Conflict Resolution system to address issues with local community longhouses. All issues raised by the longhouse are documented along with the actions taken to address the request or dispute. STIDC / FTL No. T/0518 Page 9
