4 1.0 INTRODUCTION On January 9, and January 10, 2019, WRA, Inc. (WRA) conducted an arborist survey at the San Felipe District Office and South Bay Academy Facilities (Project Area), located southeast of the intersection of San Felipe Road and Paseo de Arboles (APN # s: , and ) in the City of San Jose, Santa Clara, California. The survey was conducted by ISA-Certified Arborists, Scott Yarger (ISA #WE-9300A) and Gavin Albertoli (ISA #WE-12027A), for the purpose of identifying and documenting the presence of protected trees per Chapter 13.32, Tree Removal Controls (Tree Ordinance), of the San Jose Municipal Code within the Project Area. GPS locations for all trees surveyed within the Project Area and information regarding the species, size in diameter at breast height (DBH; as measured 4.5 feet above grade), estimated crown radius, estimated height, and health, condition, and structure ratings were collected and are included in this report. A table with all the relevant information pertaining to surveyed trees is provided in Appendix A. A tree survey location map is provided in Appendix B. Representative photographs are provided in Appendix C. 1.1 Project Area Description The site of the San Felipe District Office and South Bay Academy facilities is approximately acres, and is located on two separate parcels in the City of San Jose. Fixed and relocatable structures currently occupy the eastern and western portions of the Project Area. Paved parking areas and parking components run between the eastern and western structures. Paved walkways run adjacent to the eastern and western structures and on the southern edge of Paseo de Arboles. Non-paved areas within the Project Area are landscaped with low lying shrub and groundcover or are dominated by non-native grasses. The San Felipe District Office and South Bay Academy Demolition Project (Project) proposes to demolish all structures and remove all concrete, sidewalks, curbs, parking components, signage, light poles, bollards, poles, footings, trash cans, and dumpsters from the Project Area. The Project also includes rough-grading post-demolition to encourage positive drainage to existing storm drains, and subgrade excavation to demolish certain underground utilities including gas, water, and storm drains. 1.2 Regulatory Background City of San Jose Tree Ordinance San Jose Municipal code Chapter 13.32, Tree Removal Controls, establishes regulations controlling the removal of certain trees on private properties in the city to preserve and protect the economic, aesthetic, and environmental values trees provide to the citizens of San Jose. The San Jose City Council adopted changes to the Tree Ordinance on January 9, 2018, which have come into effect as of February 9, An ordinance-size tree is defined as: Single Trunk 38 inches (12.1 inches diameter) or more in circumference at 4.5 feet above ground. Multi-trunk The combined measurements of each trunk circumference (at 4.5 feet above ground) add up to 38 inches or more. 1

5 A permit is required for tree removals of any size on multifamily, commercial, and industrial properties. For ordinance-size trees, a tree removal permit application form is required, whereas for non-ordinance-size trees, a permit adjustment application is required. Tree removal permit conditions of approval may require replacement trees to be planted at a ratio determined by the City. 2.0 METHODS On January 9, and January 10, 2019 the Project Area was traversed on foot to inventory all trees located within the Project Area. WRA s ISA-Certified Arborists surveyed the area and recorded relevant tree information for each surveyed tree including species, DBH, estimated crown radius, estimated height, and health, condition and structure ratings. A photo of each tree was collected to document condition at the time of the survey. 2.1 Tree Inventory Locations of all trees with an aggregate diameter of 4 inches or greater within the Project Area were recorded using a handheld GPS unit with sub-meter accuracy. Each tree was given an aluminum tree tag with unique identification number. Diameter at Breast Height (DBH) was calculated for surveyed trees by measuring the trunk diameter at 4.5 ft. above grade. DBH for multi-trunked trees was calculated by measuring each individual trunk and calculating the sum total of trunk diameters. Circumferences were extrapolated by multiplying DBH by In cases where multi-trunked trees had more than five main trunks, only the five largest trunks were measured. In cases where an irregular buttress or bulge occurred at two feet above ground or DBH, measurements were taken above or below the irregular feature in order to best represent the size of the tree. 2.2 Tree Assessment General notes on the condition of trees were taken, including health, structure, and overall condition. Assessment of the health, structure, and overall condition of each tree was conducted according to the narratives listed in Table 1. 2

Tree shows some symptoms of disease or stress including twig and small branch dieback, evidence of fungal / parasitic infection, thinning of crown, or poor leaf color. Tree shows symptoms of severe decline. Structure Good Fair Poor Tree is free from major structural defects. Tree shows some structural defects in branches but overall structure is stable. Tree shows structural failure of a major branch or co-dominant trunk. General Condition Good Fair Poor Tree shows condition of foliage, bark, and overall structure characteristic of the species and lacking obvious defect, or disease. Tree shows condition of foliage, bark, and overall structure characteristic of the species with some evidence of stress, defect, or disease. Tree shows condition of foliage, bark, and overall structure uncharacteristic of the species with obvious evidence of stress, defect, or disease. 2.3 Tree Impact Assessment Potential impacts to existing trees were analyzed using the most recent proposed Project schematic drawings (Aedis 2018). Tree locations were used to determine proximity to demolition activities to identify potential impacts. Trees directly intersecting or adjacent to demolition activities were identified as being potentially impacted. The results of the impacts analysis is provided below and shown in Appendix A. 3.1 Tree Inventory 3.0 RESULTS A total of 217 trees were identified within the Project Area. A complete list of all trees surveyed is presented in Appendix A. The GPS locations of surveyed trees are shown in Appendix B. Of the 217 trees surveyed, 137 trees are considered ordinance-size trees according to the City of San Jose Tree Ordinance. Trees present within the Project Area include American sweetgum (Liquidambar styraciflua), Canary island pine (Pinus canariensis), cork oak (Quercus suber), red oak (Quercus rubra), holly oak (Quercus ilex), valley oak (Quercus lobata), coast live oak (Quercus agrifolia), cherry plum (Prunus cerasifera), Chinese pistache (Pistacia chinensis), coast 3

7 redwood (Sequoia sempervirens), Deodar cedar (Cedrus deodara), English walnut (Juglans regia), European white birch (Betula pendula), glossy privet (Ligustrum lucidum), Mayten tree (Maytenus boaria), Myoporum (Myoporum laetum), orange (Citrus sinensis), pine (Pinus sp.), Raywood ash (Fraxinus angustifolia Raywood ), red-leaf Photinia (Photinia glabra), sycamore maple (Acer pseudoplatanus), toyon (Heteromeles arbutifolia), white alder (Alnus rhombifolia), and witchhazel (Hamamelis sp.). The surveyed trees range in size from 4 inches to 46.5 inches in diameter (measured at 4.5 feet above ground). The largest tree surveyed was a 46.5-inch coast redwood (tree #424). Approximate canopy radii averaged from 4 to 38 feet. Approximate height ranged from 7 to 65 feet. 3.2 Tree Assessment The overall condition, health, and structure of trees inventoried during this assessment ranged from poor to good, with most trees ranking fair in health, structure, and general condition. A total of 115 of the trees surveyed within the Project Area ranked fair in general condition with most trees displaying limited signs of maladies or decline in vigor. Sixty-two (62) percent of the trees ranked fair in health with 31 percent ranking good and the remaining 7 percent ranking poor. Fiftyeight (58) percent of trees received a fair structure ranking and showed strong growth formations and minimal mechanical injuries. Trees given a poor structure ranking displayed codominant trunks, narrow stem and branch connections with included bark, poor growth formation, and signs of poor pruning practices. Table 2 below summarizes the assessment results for all heritage trees surveyed. Table 2. The 91 trees identified as potentially being impacted is a conservative estimate, although the actual total number of trees being impacted will depend on specifications of proposed plans. Of the 91 trees that have been identified to be potentially impacted, 61 trees are considered ordinance-size trees. Potential impacts to the canopy or root system could include damage to branches or trunk during construction, ripping or tearing roots during subgrade excavation, or smothering roots due to soil compaction or grade fills. These types of injuries can lead to reduced tree vigor, increased susceptibility to pathogens or pests, or in severe cases eventual tree decline or death. Potential permit, mitigation, and tree protection requirements as required by the Tree Ordinance are provided below. 4

8 4.0 SUMMARY AND RECOMMENDATIONS As described above, the Project will potentially impact 61 ordinance-size trees. As described above, a permit is required for tree removals of any size on multifamily, commercial, and industrial properties. For ordinance-size trees, a tree removal permit application form is required, whereas for non-ordinance-size trees, a permit adjustment application is required. Tree removal permit conditions of approval for ordinance-size trees may require replacement trees to be planted typically at a 1 to 1 ratio (one replacement tree for one removed tree) or at another ratio determined by the City s Planning Division. There are no tree replacement requirements for nonordinance-size trees. Potential impacts to trees were analyzed by comparing the locations of surveyed trees to demolition activities shown on the Project site plans (Aedis 2018). Trees were assessed as potentially-impacted or no impact based on the trunk location in proximity to Project improvements. The proposed project will likely remove 91 trees, including 61 ordinance-size trees and 30 non-ordinance-size trees. Tree removal permits shall be obtained for the removal of existing trees. As described above, mitigation may be required as a condition of approval for the tree removal permits. Assuming a 1 to 1 tree replacement ratio for ordinance-size tree removals, the Project may be required to plant 61 replacement trees. Additional fees associated with the tree removal permit application likely apply. The current permit fee for ordinance-size tree removals on non-residential properties is $2268. Fees associated with the permit adjustment application for non-ordinance-size tree removals are $146 per application, and a separate application for each APN is required. In order to avoid and minimize damage to existing trees which are designated for preservation and not proposed for direct impact by project activities, the Project shall follow all tree protection guidelines outlined in Section , Safeguarding Trees During Construction of the City Code as excerpted below: A. Prior to the issuance of any approval or permit for the construction of any improvement on the building site, all trees on the site shall be inventoried by the owner or contractor as to size (including diameter/circumference), species and location on the lot and the inventory shall be submitted on a topographical map to the director; and B. Damage to any tree during construction shall be immediately reported by a person causing the damage, the responsible contractor, or the owner to the director, and the contractor and/or owner shall treat the tree for damage in the manner specified by the city arborist; and C. No construction equipment, vehicles or materials shall be stored, parked or standing within the tree dripline; and D. Drains shall be installed according to city specifications so as to avoid harm to trees due to excess watering; and E. Wires, signs and other similar items shall not be attached to trees; and 5

9 F. Cutting and filling around the base of trees shall be done only after consultation with the city arborist and then only to the extent authorized by the city arborist; and G. No paint thinner, paint, plaster or other liquid or solid excess or waste construction materials or wastewater shall be dumped on the ground or into any grate between the dripline and the base of the tree or uphill from any tree where certain substances might reach the roots through a leaching process; and H. Fencing shall be installed outside the canopy of the tree to the dripline unless otherwise directed by the certified arborist to prevent injury to trees making them susceptible to disease causing organisms; and I. Wherever cuts or soil disturbances are made in the ground near the roots of trees, appropriate measures shall be taken to prevent exposed soil from drying out and causing damage to tree roots as prescribed in a certified arborist report. Additional recommended Best Management Practices (BMPs) in order to minimize damage to existing trees during construction are provided below. A specific and detailed tree protection plan is being prepared for the Project and is forthcoming. All construction activity (grading, filling, paving, landscaping etc.) shall respect the root protection zone (RPZ) around all trees within the vicinity of the Project Area that are selected for preservation. The RPZ should be a distance of minimum 1.0 times the dripline radius measured from the trunk of the tree. Exceptions to this standard could be considered on a case-by-case basis, provided that a tree permit is obtained, and it is demonstrated that an encroachment into the RPZ would not critically damage the root system or the health of the tree, and is authorized by an ISA Certified Arborist or comparable specialist. Temporary protective fencing shall be installed around the dripline of existing trees designated for preservation prior to commencement of any construction activity conducted within 25' of the tree canopy, of a tree designated for preservation. The fence shall be clearly marked to prevent inadvertent encroachment by heavy machinery. If grading takes place within the RPZ of a preserved tree, roots should be exposed using the least injurious method possible, and selective root pruning is the preferred method of removal. Roots exposed, as a result of construction activities shall be covered with wet burlap to avoid desiccation, and should be buried as soon as practicable. Construction materials or heavy equipment shall not be stored within the root protection zone of preserved trees. Only an ISA Certified Arborist or tree specialist shall make specific recommendations as to where any existing trees can safely tolerate some level of fill within the drip line. Trenches which are required within the root protection zone of existing trees to be retained shall be bored (tunneled) under the root(s) using an auger or drill, rather than trenched, to avoid root disturbance. 6
