The Addl. Principal Chief Conservator of Forests (Land Management) and Nodal Officer, Forest (Conservation) Act, 1980, State Government of Madhya Pradesh vide their letter No. F-3/84/2016/10-11/8/1125 Bhopal dated (Pg /c) submitted a proposal to obtain prior approval of the Central Government, in terms of the Section-2 of the Forest (Conservation) Act, 1980 for diversion of ha. of forest land in favour of Water Resources Department for Construction of Karam Medium Irrigation Project in Dhar District in the State of Madhya Pradesh. 2. Details indicated in the proposal submitted by the Government of Madhya Pradesh dated are as below: FACT SHEET 1. The District Collector, Dhar, Government of Madhya Pradesh has issued a FRA certificate vide his letter No dated certifying the information in respect of all clauses of the MoEF s advisory dated (Pg /c) i.e. diversion of ha. forest land for facilities managed by the Government and safeguarding the rights of Primitive Tribal Group and Pre-Agricultural Communities as required under the Scheduled Tribe and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006, discussion on the

4 17. Site Inspection Report of the Divisional Forest Officer in compliance to the conditions stipulated in the col. 7 (xi, xii) 8 and 9 previous approval. 18. Whether the project requires environment proposal in meeting of concerned Gram Sabha (s) maintaining the prescribed quorum, etc. The concerned Gram Sabha (s) of Bhesakhobujurg Bujurg Villages etc., Documentary evidences in support of settlements of rights under the Scheduled Tribe and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 may kindly be seen at (Pg /c). The Site Inspection Report carried out by the Divisional Forest Officer, Dhar, Madhya Pradesh, copy of the same may kindly be seen at (Pg. 86/c). Yes, and the same is under process vide its F. No. SIA/MP/RIV/10809/2016. clearance 19. Catchment Area Treatment Plan It is reported that the work is under process for CAT plan. (Pg. 72A-72B/c). However, the approved CAT plan has not been submitted with estimate cost by State Government / user agency. 20. Principal Chief Conservator of Forests (Land Management) and Nodal Officer, Forest (Conservation) Act, 1980, State Government of Madhya Pradesh vide its letter dated submitted following additional information pertaining to the proposal: (i) This project will provide irrigation to almost 25 villages which will solve their water demand. (ii) Concerned Tehasildars have certified that the project does not involve any Revenue Forest land. 4. The forest land proposed to be diverted has been inspected by Shri B. Abhay Bhaskar, Dy. Chief Conservator of Forests (Central), Regional office (Western Zone), Bhopal. Additional information furnished in the inspection report submitted by the Regional Office (Western Zone), Bhopal vide their letter dated07th August, 2017 (Pg /c) are as below: (i) Officers present during site inspection:- a) Shri B. Rathore, Range Officer, Dhamnod, Dhar. f) Field staff of Forest Department & WRD M.P. (ii) Date of Inspection: Legal Status of Forest land proposed for diversion. a) Reserved Forests ha. (RF- 504, 503,502,325,326,495,494 & 506) b) Protected Forest ha. c) Non-forest land ha. (iii) (iv) (v) (vi) How the land proposed for diversion is to be utilized? : Storage of water for irrigation project. Whether the proposal involves any construction of buildings (including residential): No. Total cost of Project. Rs. 30, Iakhs. Wild Life: Whether the forest area proposed for diversion: Proposal is not a part of any protected area. is important from Wildlife point of view or not (vii) Aerial distance from the nearest boundary of any protected area : 80 km from Kharmopore National Park. Effect of removal on the general ecosystem in the area: the irrigation project.

6 (ix) As per Part-II, Canopy Density is 0.2 to 0.4. The vegetation of area contains Tectona grandis, Azadiracta indica. Emblica officinalis. Acacia arabica, Terminalia beilirica etc were observed. The forest is mixed forest with teak as major species. During site inspection the similar situations were observed. Background note of the proposal:- The project is located on Karam river. The project is medium irrigation project with command area of 8750 ha over. The project will bring command area under double and triple cropping patter which will bring the uplifting of peoples. Majority of population belongs to tribal. The total catchment area of the project is sq. km and 8750 Ha. Area is proposed for irrigation purpose in Dhar district, Madhya Pradesh. The estimated cost of CAT Plan is 3.48 lakhs/ha. (x) Compensatory Afforestation: Applicable, non-forest land = Ha. A. Whether land proposed/ selected for CA is suitable for plantation and management point of view? B. Whether land for CA is free from encroachment of other encumbrances? C. Whether land for CA is importance from religious or archeological point of view? D. Land identified for raising CA is in how many patches? Whether patches area compact or not? (xii) Reclamation Plan: details and Financial Allocation: Applicable, during site inspection it was informed that 15 nos. of families were affected which are given land under FRA. (xiii) Cost benefit ratio : 1:1.53 (xiv) Utility of project: for water storage and irrigation in command area. (xv) Number of Scheduled Case and Scheduled Tribe involved in the Project: Nil. (xvi) Compliance of FRA 2006-DC Certificate: Provisions of the FRA have been complied with. FRA of 09/06/2016 from DC, Dhar for ha. During site inspection it was informed that 15 nos. of families were affected which are given land under FRA. (xvii) Whether the land being diverted has any socio-cultural f religious value: No. (xviii) Whether any sacred groves or very old growth of tree of forest exist in the area proposed for diversion?: No

Recommendation: a) The site inspection was carried out on 20.07,2017, The proposal will bring 8750 ha area under irrigation, b) The proposal is recommended for diversion of ha of forest land based on the irrigation in the vast area, drinking water facility, and food security and economic up liftment of people with following specific condition. c) The rights of the peoples allotted under FRA, 2006 shall be settled by following due procedure prescribed under The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, whichever applicable. Regional Additional Principal Chief Conservator of Forests, Western Zone, Bhopal has recommended grant of approval under the FC Act for diversion of the forest land for the following reasons: a) In view of the details mentioned in the site inspection report of Dy. Conservator of Forest (C), undersigned recommends the proposal for the for diversion of ha. Reserved forest and for construction of Karam medium irrigation project in flo Water Resource Department, Dhar District, Govt. of Madhya Pradesh under Forest (Conservation) Act, 1980 with above specific condition. It is proposed that the proposal along with site inspection report received from the Regional Office (Western Zone), Bhopal may be placed before the Forest Advisory Committee in its forthcoming meeting scheduled to be held on for its examination and appropriate recommendations. ****
