32 APPENDIX C: TREE PROTECTION PLAN The following measures should be taken to protect trees before, during and after construction. During the approval process, the permitting authority may add requirements to this tree protection plan so check the conditions of approval. Always follow the conditions of approval issued by the permitting authority. PRECONSTRUCTION 1. Provide a copy of this protection plan to the contractor. 2. A copy of the protection plan should be available on site throughout construction. 3. Contractor to schedule a Pre-Construction Meeting: The owner s landscape architect shall attend a pre-construction meeting with the general contractors superintendent to review the tree protection plan and confirm that the protection fences and signs are in place prior to any work being done on the site. At the meeting review any off-site trees needing pruned to allow for construction of new walls, fences or structures. Notify the owner which trees need pruned. The owner shall notify the owner(s) of the trees prior to doing any pruning. 4. Tree Protection Fencing is not needed. 33 5. Root pruning is needed for the following trees: #71. See tree protection plan for locations. The root pruning contractor shall provide an arborist to supervise the root pruning. The contractor s arborist shall have a current certification from the International Society of Arboriculture. After pruning the roots, the contractor s arborist shall report to the owner whether the work was performed according to the protection plan and whether unexpected damage occurred and any recommended treatment for the damage. If unexpected damage occurred the owner shall notify the permitting authority in writing within 72 hours. Follow the industry standard ANSI A300 Part 5 Managing Trees During Construction. Comply with ANSI Z133.1 safety standards of practice for tree care Root prune the following trees after the Pre-Construction Meeting: 71 Coast Live Oak (off-site) 5.2. One week prior to root pruning soak the root zone of all trees to be root pruned to a depth of 18. The soaking compensates for water loss as a result of the root loss so give the tree at least a few days to take up the water Prune where indicated on the plan using hand tools, compressed air tools, pressurized water tools or a machine specifically designed to prune roots Prune all roots cleanly to a depth of Roots exposed to the air start to dry out and die immediately so you may need to cover exposed roots with wet burlap in situations where the roots are exposed more than a few hours. Soak the rootzone the day before and right after root pruning. 6. Not used 7. 34 or fences is planned beneath the canopies of these off-site trees or if the trees block a fire access lane. The owner, landscape architect and general contractor shall review any off-site trees that need pruned to allow for construction of new walls or fences or vehicular clearance. The owner shall notify the owner(s) of the off-site trees prior to doing any pruning. The tree trimming contractor shall provide an arborist to supervise the pruning. The contractor s arborist shall have a current certification from the International Society of Arboriculture. After pruning, the contractor s arborist shall report to the owner whether the work was performed according to the protection plan and whether unexpected damage occurred and any recommended treatment for the damage. If possible the contractor should prop up the low canopy to do any work under the canopy of this tree. If branches from this tree will conflict with proposed walls or structures then prune the canopy for clearance of Pruning objective: provide 3 clearance for new structure/fence/wall Pruning Method: reduce the canopy on the northwest side of the canopy Remove branches using thinning cuts Remove no branches over 4 inch diameter Remove the minimum amount of foliage to achieve the objective, limit 0 to 20% of the living foliage. If possible the contractor should prop up the low canopy to do any work under the canopy of these five tree. If branches from these trees will conflict with proposed walls or structures or vehicular access then prune the canopy for clearance Pruning objective one: provide 3 clearance from new structure/fence/wall Pruning objective two: provide 13.5 clearance if needed for vehicular access Pruning Method: raise the canopy on the south side of the canopy Remove branches using thinning cuts Remove no branches over 3 inch diameter Remove the minimum amount of foliage to achieve the objective, limit 0 to 20% of the living foliage Podocarpus, off-site trees 74 through 77 growing along the east edge of the site. If possible the contractor should prop up the low canopy to do any work under the canopy of these four tree. If branches from these trees will conflict with proposed walls or structures then prune the canopy for clearance of Pruning objective: provide 5 clearance for new structure/fence/wall Pruning Method: raise the canopy on the west side of the canopy Remove branches using thinning cuts Remove no branches over 3 inch diameter Remove the minimum amount of foliage to achieve the objective, from 0 to 10% of the living foliage. 37 CONSTRUCTION 1. Once a month soak the rootzone of trees that required root pruning. 2. Tree Protection Zone Restrictions: 2.1. Stay out of the fenced area without the approval of the job site superintendent Any trenching, grading or excavating, within the fenced areas shall be approved before hand by the owner s landscape architect. Any such work approved shall be monitored by a party selected by the owner and approved by the City Planner. The monitor shall observe trenching, grading or excavating and report whether the work was performed according to the protection plan and whether unexpected damage occurred and any recommended treatment for the damage Before trenching, grading or excavating, under the protect tree canopies, check to make sure root pruning has been done No equipment, soil, or construction materials shall be stored in the TPZ No oil, gasoline, chemicals, paints, solvents, or other damaging materials may be dumped within the TPZ Grade changes outside of the TPZ shall not significantly alter drainage to protected trees. 3. Report any inadvertent damage to the trees to the appropriate official at the permitting authority. 4. Monitor the health of the trees and report obvious health decline to the appropriate official at the permitting authority. 5. A qualified arborist or landscape architect selected by the owner and approved by the permitting authority shall do a health assessment all the protected trees at the end of construction. 38 POST-CONSTRUCTION Monitor the trees for three (3) years. 1. Annual monitoring reports shall be prepared by a qualified arborist or landscape architect selected by the owner and approved by the permitting authority, for three (3) years after construction Report any changes in tree health or risk rating based on the initial post-construction health assessment. 2. 90 1196 Patricia Avenue Residential Project Noise Study 1196 PATRICIA AVENUE RESIDENTIAL PROJECT NOISE STUDY This report is an analysis of the potential noise impacts of a proposed 65-unit multi-family residential project with an outdoor courtyard in the City of Simi Valley. The report has been prepared by Rincon Consultants, Inc. under contract to and for use by. The purpose of this report is to analyze the proposed residential project s exposure to the ambient noise created by the adjacent car wash and assess potential noise impacts on residents using the proposed interior courtyard area and residential units facing the car wash. In summary, noise levels on parts of the project site, including noise exposure from the adjacent car wash, are within the City s adopted conditionally acceptable exterior noise range for multiple-family residential land uses of decibel A-weighted sound pressure level (dba) Community Noise Equivalent Level (CNEL). Because noise exposure in the western portion of the project site falls within the conditionally acceptable range, a noise reduction measure is recommended for indoor residential uses in these areas. The noise attenuation of up to 20 dba that would be achieved by this measure could be achieved with modern residential construction materials and techniques, reducing the project site s interior noise levels to an acceptable noise exposure range. PROJECT DESCRIPTION The proposed project would involve the construction of a 65-unit multi-family residential project on an approximately 2.10-acre site at 1196 Patricia Avenue in the City of Simi Valley. The project would consist of seven unit types on three floors, within five separate buildings. The unit types vary between one-bedroom units at 550 square feet up to two-bedroom units at 970 square feet. The first floor would consist of eight two-bedroom units and 13 one-bedroom units. The second floor would consist of 20 two-bedroom units and two one-bedroom units. The third floor would consist of 20 two-bedroom units and two one-bedroom units. The project density is about 31 dwelling units per acre. The proposed project would include 116 parking spaces, 94 parking stalls along the outside perimeter of the project site and 22 garage spaces. There would be approximately 42,740 square feet of paved area, and approximately 30,200 square feet of unpaved landscaped area on the site. The project also includes an outdoor courtyard in the center of the residential buildings with a fountain, outside kitchen/bar, table games, and fire pit. The residential building in the lower center of the proposed group of buildings would include outdoor patios. See Appendix A for Site Plan. SETTING Overview of Sound Measurement Noise level (or volume) is generally measured in decibels (db) using the A-weighted sound pressure level (dba). The A-weighting scale is an adjustment to the actual sound pressure levels to be consistent with that of human hearing response, which is most sensitive to frequencies around 4,000 Hertz (about the highest note on a piano) and less sensitive to low frequencies (below 100 Hertz)

91 1196 Patricia Avenue Residential Project Noise Study Sound pressure level is measured on a logarithmic scale with the 0 db level based on the lowest detectable sound pressure level that people can perceive (an audible sound that is not zero sound pressure level). Based on the logarithmic scale, a doubling of sound energy is equivalent to an increase of 3 db, and a sound that is 10 db less than the ambient sound level has no effect on ambient noise. Because of the nature of the human ear, a sound must be about 10 db greater than the ambient noise level to be judged as twice as loud. In general, a 3 db change in the ambient noise level is noticeable, while 1-2 db changes generally are not perceived. Quiet suburban areas typically have noise levels in the range of dba, while areas adjacent to arterial streets are in the dba range. Normal conversational levels are in the dba range, and ambient noise levels greater than 65 dba can interrupt conversations. Noise levels typically attenuate (or drop off) at a rate of 6 db per doubling of distance from point sources (such as industrial machinery). Noise from lightly traveled roads typically attenuates at a rate of about 4.5 db per doubling of distance. Noise from heavily traveled roads typically attenuates at about 3 db per doubling of distance. Noise levels may also be reduced by intervening structures; generally, a single row of buildings between the receptor and the noise source reduces the noise level by about 5 dba, while a solid wall or berm reduces noise levels by 5 to 10 dba. The manner in which older homes in California were constructed (approximately 30 years old or older) generally provides a reduction of exterior-to-interior noise levels of about 20 to 25 dba with closed windows (Federal Transit Administration [FTA] 2006). In addition to the instantaneous measurement of sound levels, the duration of sound is important, since sounds that occur over a long period of time are more likely to be an annoyance or cause direct physical damage or environmental stress. One of the most frequently used noise metrics that considers both duration and sound power level is the equivalent noise level (Leq). The Leq is defined as the single steady A-weighted level that is equivalent to the same amount of energy as that contained in the actual fluctuating levels over a period of time (essentially, the average noise level). Typically, Leq is summed over a one-hour period. Lmax is the highest RMS (root mean squared) sound pressure level within the measurement period, and Lmin is the lowest RMS sound pressure level within the measurement period. The time period in which noise occurs is also important since noise that occurs at night tends to be more disturbing than that which occurs during the day. Community noise is usually measured using Day-Night Average Level (Ldn), which is the 24-hour average noise level with a ten dba penalty for noise occurring during nighttime (10:00 PM to 7:00 AM) hours, or Community Noise Equivalent Level (CNEL), which is the 24-hour average noise level with a five dba penalty for noise occurring from 7:00 PM to 10 PM and a ten dba penalty for noise occurring from 10:00 PM to 7:00 AM. Noise levels described by Ldn and CNEL usually do not differ by more than 1 db. Sensitive Receptors Noise exposure goals for various types of land uses reflect the varying noise sensitivities associated with each of these uses. The City of Simi Valley Municipal Code (SVMC) describes sensitive receptors as residences, schools, health care facilities, or places of public assembly. These uses are considered sensitive because the presence of excessive noise may interrupt normal activities typically associated with their use. The project would involve residential uses, which are considered noise sensitive receptors

92 1196 Patricia Avenue Residential Project Noise Study Project Site Noise Setting The project site is located in an urban environment adjacent to a car wash to the northwest, but also in an area with noise-sensitive receptors such as residences and churches. The car wash operates from 8:00 AM to 6:00 PM, Monday through Sunday, with an Express Exterior Car Wash open until 8:00 PM daily (Simi Auto Spa & Speed Wash website, August 2016). Based on a Google search, the peak hours of the facility are between one and three PM on Saturday. See Appendix B for a copy of the search. Figure 1 depicts the project site location, proposed new residential building footprints, and noise measurement locations. The primary off-site noise source in the vicinity of the project site is the adjacent car wash. Secondary off-site noise sources include motor vehicles (e.g., automobiles, buses, and trucks) along Patricia Avenue, East Los Angeles Avenue (to the north), and First Street (to the west). The car wash is of a concern due to the noise associated with the use of vacuums and dryers, as well as noise from vehicles moving through the site. These noise sources are of concern because they are characterized by a high number of individual events, which often create a sustained noise level, and because of their proximity to noise sensitive uses. The City of Simi Valley General Plan EIR (2012) provides noise contours for existing and future noise exposure in the City. These noise contour maps provide a visualization of sound levels from major noise sources in the community. As shown on Figure and Figure of the General Plan EIR, the project site does not appear to lie within the 60 dba CNEL contour under either existing (circa 2011) or future (2030) conditions. The accompanying tables in the EIR, Table (Existing Roadway Noise Levels at Selected Locations) and Table (Future [2030] Roadway Noise Levels Compared to Ambient Future Noise Levels), list roadway noise levels along specific roadway segments. The tables show that the current noise level along First Street from Los Angeles Avenue to Royal Avenue is 64.6 dba at 100 feet, while the future noise level at that distance is 65.7 dba. The distance from the western edge of the project site to the centerline of this segment of First Street is approximately 330 feet. Because noise from heavily traveled roads attenuates at 3 dba for every doubling of distance (as discussed above), according to the noise level estimates contained in the General Plan EIR, the noise level at the western edge of the project site would be approximately 59.4 dba under current conditions and 60.5 dba under future conditions (see Appendix C for technical data related to this report, including noise attenuation worksheets). Three weekend afternoon peak-hour 15-minute noise measurements were taken at the project site on August 20, 2016 during the peak use period of the car wash using an EXTECH A integrating sound level meter. These noise measurements provide existing on-site sound levels, which are primarily due to the adjacent car wash, but also roadway noise from Patricia Avenue, East Los Angeles Avenue, and First Street. Table 1 identifies the noise measurement locations and measured noise levels. Noise levels were higher along the northwestern boundary of the project site due to the proximity to the car wash. As shown in Table 1, peak hour Leq on the project site ranged between approximately 62 dba Leq and 53 dba Leq. Because these noise measurements were taken during the peak noise period, daily CNEL value should be roughly equal to or less than these Leq levels

Regulatory Setting Plans and policies that pertain to the noise conditions affecting and affected by the proposed project include the State of California Department of Health Services, Environmental Health Division, Guidelines for Noise and Land Use Compatibility; the City of Simi Valley General Plan; and the City of Simi Valley Municipal Code (SVMC). In 1976, the California Department of Health, State Office of Noise Control published a recommended noise/land use compatibility matrix which many jurisdictions have adopted as a standard in their general plan noise elements. This matrix indicates that residential uses generally should be located in areas where outdoor ambient noise levels do not exceed 70 dba (Ldn or CNEL). Chapter 8 of the Simi Valley General Plan, Safety and Noise, identifies noise sources, noise sensitive land uses, and noise compatibility standards; as well as goals and policies designed to include noise control in the planning process to maintain compatible land uses with acceptable environmental noise levels. In accordance with Table N-1 of the Noise Element of the General Plan, reproduced as Figure 2 below, an exterior noise exposure of up to 65 dba CNEL or less is the normally acceptable 5 254

Noise levels above 70 dba CNEL are normally unacceptable for residential land uses. The Noise Element also contains existing and future, year 2030, noise contours for the City and states that the 60 dba CNEL contour is the noise level for which noise considerations should be included when making land use policy decisions that affect existing and proposed noisesensitive developments. The 65 dba CNEL contour describes the area for which new noisesensitive developments will be permitted only if appropriate mitigation measures are included such that the standards are achieved. Goal N-3 of the City of Simi Valley s General Plan, Stationary Noise Sources, is as follows: Non-transportation-related noise impacts on sensitive receptors are minimized. The policies in relation to this goal are as follows: N-3.1 Protection from Stationary Noise Sources. Continue to enforce interior and exterior noise standards to ensure that sensitive noise receptors are not exposed to excessive noise levels from stationary noise sources, such as machinery, equipment, fans, and air conditioning equipment. (Imp A-1, A-2, LU-12, LU-18) N-3.2 Regulation of Sound-Amplifying Equipment. Continue to regulate the use of soundamplifying equipment. (Imp A-1, A-2, LU-18, N-1) N-3.3 Enforcement of Hours of Construction Activity. Continue to enforce restrictions on hours of construction activity so as to minimize the impacts of noise and vibration from the use of trucks, heavy drilling equipment, and other heavy machinery to adjacent uses, particularly in residential areas. (Imp A-1, A-2, LU-18, N-1) The City also has interior and exterior noise standards considered acceptable based on noise levels generated by adjacent mobile sources, such as automobiles, trucks, and trains. As shown in Table N-2 of the General Plan, residential land uses have a dba CNEL interior standard of 45 and exterior standard of 63. The Simi Valley Noise Ordinance governs noise from nontransportation sources and does not specify maximum noise levels, but identifies various noise generators, such as construction equipment, amplification and mechanical devices, and provides certain restrictions on these generators (City of Simi Valley, June 2012). The City of Simi Valley s Noise Ordinance ( of the SVMC) describes public nuisances and sets hours of operation for these noises, such as: a. Other unlawful noises (any loud, unnecessary or unusual noise other than those listed below that would disturb the peace and quiet of a reasonable person) b. Radios, electronic and amplification devices c. Band and orchestral rehearsals d. Engines, motors, and mechanical devices in and near residential districts e. Noises by animals, birds, and fowl f. Amplifying devices for hawkers and peddlers g. Motor vehicles h. Pile drivers, hammers, and the like i. Construction and repair of buildings, and j. Yelling, shouting, and the like 7 256

97 1196 Patricia Avenue Residential Project Noise Study Per the Ordinance, if any of these public nuisance noises are maintained or exist in or on an individual s premises, whether as an owner, lessee, or otherwise, that person shall be deemed guilty of a misdemeanor for each day the nuisance is continued. However, the car wash does not violate this ordinance, for the following reasons. The potential public nuisances the car wash could violate include: (a) and (d). The car wash does not currently violate (a) because the noise does not disturb the peace and quiet or causes discomfort or annoyance to a reasonable person of normal sensitivities in an adjacent residence or business affected by the noise; and does not violate (d) because the facility operates between 8:00 AM and 8:00 PM daily, as described in the Project Site Noise Setting section of this report, not during the restricted hours of 11:00 PM and 7:00 AM on Friday or Saturday and between the hours of 10:00 PM and 7:00 AM on Sunday through Thursday. IMPACT ANALYSIS Methodology and Significance Thresholds Ambient noise levels were monitored at selected locations within the project site (see Table 1) using the EXTECH A Integrating sound level meter, which satisfies the American National Standards Institute for general environmental noise measurement instrumentation. Noise levels associated with existing traffic along area roadways were indirectly measured by taking noise measurements on the project site at varying distances from the car wash facility, which is immediately adjacent to the northwestern boundary of the project site. Motor vehicles were present on the nearby cross streets of First Street and East Los Angeles Avenue, as well as Patricia Avenue, during the noise measurements. Airplanes were observed overhead as the measurements were being taken. On-site Exterior Noise Environment The proposed residences would be most exposed to noise from the adjacent car wash at the northwestern boundary of the project site. Additional noise exposure would be from motor vehicle traffic on First Street, East Los Angeles Avenue, and Patricia Avenue, as well as noise from air traffic and other natural sources such as wild birds. According to the Noise Element of the City of Simi Valley General Plan, a normally acceptable noise level for multi-family residential land uses is 65 dba CNEL or less and between dba CNEL is the conditionally acceptable range. Noise levels above 70 dba CNEL are normally unacceptable for residential uses. The City also has an exterior noise standard for residential land uses of 63 dba CNEL. The CNEL adds a five dba penalty for noise occurring from 7:00 PM to 10:00 PM; but because the on-site noise measurements described above were taken during the peak noise period, daily CNEL value should be roughly equal to or less than the Leq levels shown in Table 1. As shown in Table 1, none of the four outdoor ambient noise measurements exceed the City s normally acceptable noise threshold of 65 dba CNEL for multi-family residential land uses or the exterior noise standard for residential land uses of 63 dba CNEL. However, the noise level measured at Location #1, where proposed residential buildings would be located closest to the car wash facility, falls within the City s conditionally acceptable range of dba CNEL for multiple-family residential land uses

98 1196 Patricia Avenue Residential Project Noise Study On-site Interior Noise Environment Noise levels on the project site range between approximately 62 dba CNEL near the northwest boundary, closest to the car wash, and approximately 53 dba CNEL in the southwest area of the project site. The area near the northwestern boundary falls within the conditionally acceptable range of dba CNEL for multi-family residential land uses. For new residential development to occur, the exterior-to-interior noise attenuation provided by the buildings would have to be 17 dba or greater to ensure that interior noise levels would be below the City s interior noise standard of 45 dba CNEL. Assuming an estimated 20 dba reduction due to exterior-to-interior attenuation associated with modern residential construction materials and techniques (FTA 2006), the interior noise level in all residences would be reduced to between 42 dba CNEL and 33 dba CNEL, which would not exceed the City s interior noise standard of 45 dba CNEL. This reduction, however, would only occur with implementation of modern residential construction materials and techniques, and with the ability to close windows when necessary. Rincon therefore recommends that the following measure be required in order to ensure that future residents of the proposed project would not be exposed to unacceptable interior noise levels. 1. Interior Noise. Residential units directly facing the car wash facility should include the following or equivalent feature to achieve an acceptable interior noise level of 45 dba CNEL or lower: Equip all residential units with forced-air mechanical ventilation, as required by the California Building Code, to adequately ventilate the interior space of the units when windows are closed to control noise. Incorporation of the above design measure would achieve an interior noise level reduction of approximately 20 dba, and would ensure that the future residential units facing the car wash facility on the project site would not be exposed to interior noise levels in excess of the City s 45 dba CNEL interior noise standard

(a) The project is consistent with the applicable general plan designation and all applicable general plan policies as well as with applicable zoning designation and regulations. (b) The proposed development occurs within city limits on a project site of no more than five acres substantially surrounded by urban uses. (c) The project site has no value as habitat for endangered, rare or threatened species. (d) Approval of the project would not result in any significant effects relating to traffic, noise, air quality, or water quality. (e) The site can be adequately served by all required utilities and public services." The proposal, to construct a new 65-unit apartment building, is consistent with the General Plan land use designation of Residential High Density and the zoning designation of RH (CZ). The proposed project does not conflict with applicable policies of the General Plan or regulations in the Development Code. The area to be disturbed is 2.23 acres and is surrounded on all sides by urban development. Due to its location in a highly developed area, the site does not have any value as habitat for endangered, rare, or threatened species. The City Traffic Engineer determined that the project would not cause any intersection to operate below level of service C and would not result in a 10-fold increase in traffic volumes on adjacent streets. Therefore, the project would not cause a significant increase (10 dba) in noise levels. The project will not result in a significant impact on air quality in that it will not generate reactive organic compounds or oxides of nitrogen in excess of 25 pounds per day. The project is required to implement a Storm Water Pollution Control Plan in compliance with the National Pollutant Discharge Elimination System by the Simi Valley Municipal Code. Therefore, the project will not result in significant impacts on water quality. Due to the site's location in a developed portion of the City, all required utilities and public services currently serve the area and are available to serve the project. Based on all of the above facts, the project is categorically exempt from further CEQA review as a Class 32 Exemption.
