1 SECTION 1 APPLICATION TO FELL OR PRUNE TREES CODE NO DESCRIPTION OF PROPOSAL TERMS OF DECISION CHE/11/00089/TPOEXP TPO CHE/11/00086/TPOEXP The removal of one Beech reference T13 on the Order map for Mr Craig Lynch of Brampton Manor Country Club. The tree came over during the recent high wind blocking the footpath between Old Road and Manor Drive. The removal of one dead silver Birch and one twin stemmed Ash tree within G1 on the Order map for Mr & Mrs Platt of 4 Treeneuk Close, Slack Lane, Ashgate. The two trees were found to be dangerous during the recent high winds. Tree debris from the Birch fell into the highway and an inspection of Consent is granted to the removal of one Beech tree which can be removed by virtue of Part VIII, Chapter 1, Section 198, paragraph 6(a) of the Town and Country Planning Act 1990, which has provision for dead, dying and dangerous trees, Section 206, paragraph 1(b) of the same Act requires any dead tree to be removed under Section 198 to be replaced to the satisfaction of the Borough Council. The replacement tree is to be one Oak planted as close to the original tree as is reasonably possible and staked and tied. Consent is granted to the removal of one Birch and one Ash tree which can be removed by virtue of Part VIII, Chapter 1, Section 198, paragraph 6(a) of the Town and Country Planning Act 1990, which has provision for dead, dying and dangerous trees, Section 206, paragraph 1(b) of the same Act requires any dead tree to be

3 CHE/11/00002/TPO TPO CHE/11/000/68/TPO TPO The pruning of three Beech trees reference T1, T2 & T3 on the Order map for Richard Swaine on behalf of Mr D Price of 408 Chatsworth Road. The trees are allegedly blocking light to the skylights, excessive leaf fall causing blocked gutters and close to the industrial units. The felling of one dead Elm tree (identified on the first schedule as a Maple) reference T16 on the Order map for Jon Rawlinson 12 Ash Tree Close, Ashgate. Consent is granted to a light crown thinning and pruning away from the industrial units to give a maximum clearance of 3 metres. Consent is granted to the felling of one dead Elm tree which can be felled by virtue of Part VIII, Chapter 1, Section 198, paragraph 6(a) of the Town and Country Planning Act 1990, which has provision for dead, dying and dangerous trees, Section 206, paragraph 1(b) of the same Act requires any dead tree to be removed under Section 198 to be replaced to the satisfaction of the Borough Council. The duty to replace the tree has been dispensed with on this occasion due to insufficient room and a suitable planting location.

4 TPO CHE/11/00016/TPO TPO CHE/11/00070/TPO TPO CHE/11/00108/TPO TPO The thinning of 30-40% of the high canopy trees in Ashgate Plantation. (See attached report). The pruning of one Sycamore tree reference T15 on the Order map for Derek Harrison on behalf of Derbyshire County Council at Norbriggs Primary School. The tree is allegedly overhanging the neighbouring property at 16 Worksop Road. The pruning of two Maple trees reference T2 & T3 on the Order map for Mr Stuart Harcourt of 8 Westfield Close, Brampton. The felling of three trees reference T64 Pine and T33 & T40 Birch on the Order map for Ken Portas Landscapes on behalf of Ashgate Croft School, Ashgate. The Pine tree has suffered snow damage to the main branch framework and if pruned out would leave the tree with a poor crown, unbalanced and unsightly with little amenity value. The two Birch trees are dying and are unlikely to survive another season. Consent is granted to reduce three branches growing towards 16 Worksop Road back to the boundary line and pruning to suitable replacement branches. Consent is granted to crown clean the two trees to remove dead and crossing branches which will improve the crown structure of the young replacement trees. CHE/11/00102/TPOEXP TPO The removal of one windblown tree reference T10 London Plane on the Order map for Mr John Hill of Springbank House Nursing Home, Ashgate Road. The owner was advised to have the ivy removed and the tree checked for its safety prior to it blowing over in the recent high winds. Consent is granted to the removal of one London Plane tree which can be removed by virtue of Part VIII, Chapter 1, Section 198, paragraph 6(a) of the Town and Country Planning Act 1990, which has provision for dead, dying and dangerous trees, Section 206, paragraph 1(b) of the same Act requires any dead tree to be removed under Section 198 to be replaced to the satisfaction of the Borough Council. The replacement is to be a Lime tree planted as close to the original tree as is reasonably possible and staked and tied.

6 SECTION 2 English Woodland Grant Scheme for Ashgate Plantation, Ahgate, Chesterfield. On the 21 st February 2011 Chesterfield Borough Council Planning Services received notification from the Forestry Commission on behalf of Ian Trueman Tree Specialist Tree Services Ltd, Chesterfield that an application had been submitted for a Woodland Improvement Grant for Ashgate Plantation, Ashgate, Chesterfield. Ashgate Plantation is a mixed woodland of 15.88ha to the west of Chesterfield and is covered by a Chesterfield Borough Council Tree Preservation Order reference W1 and a Derbyshire County Council Tree Preservation Order No 52 reference W1. Ian Trueman Tree Specialist Tree Services Ltd has acquired a five year lease on the above woodland to manage it for the owners and work is due to start ahead of the bird nesting season This mixed woodland was clear felled about 60 years ago during or shortly after the second world war and they will be thinning out the trees and selling the extracted timber for firewood. To facilitate the above operation and long term sustainable management of Ashgate Plantation they will need to install a metal security barrier and access roadway approx 100m in length at the start of the operation on an existing track off Ashgate Road next to the existing telephone mast access. They will also be providing habitat piles and windrows (biodegradable composting piles) as part of the works to improve biodiversity in the wood. Access and amenity value to the public will also be improved by these works. Ashgate plantation has little ground cover due to the high canopy of the trees and the aim of the thinning is to create a more natural woodland structure. This will be achieved by removing on average 30% to 40% of the canopy trees to promote crown development of the retained trees and the growth of a mixed understory of shrubs and natural regeneration.

7 Thinning will favour native species and the approved works in the contract contributes to the East Midlands Declining Woodland Bird Project. The thinning will benefit Lesser Spotted Woodpecker, Pied Flycatcher and Spotted Flycatcher and disturbance to breeding nesting birds will be avoided during 1 st April to 31 st July. Any existing tree regeneration or understory will be retained and favoured in the thinning operation. Old and damaged trees will be retained and all standing and fallen deadwood will be left in situ where practicable. Prior to the start of thinning work two thinning sample plots of [0.5 ha] will be marked and the thinning intensity agreed with the Forestry Commission Woodland Officer before work commences. An application is usually required to fell trees which are covered by a Tree Preservation Order however; the Local Planning Authority s consent is not required for cutting down trees in line with a plan of operations agreed by the Forestry Commission under one of their grant schemes. After consultation with the Forestry Commission, Derbyshire County Council and Chesterfield Borough Council there are no objections to the proposal which are in line with good silvicultural practices and will benefit the woodland structure and wildlife of the wood.
