1 Forestry Development Authority of Liberia (FDA) Growing Forest Partnerships of Liberia (GFP) FACILITATING ORGANIZATIONS Information to present proposals under the Growing Forest Partnerships Liberia The Compilation of a Regulatory Framework to Align Chain Sawing Activities with Existing Forest Policy Growing Forest Partnerships (GFP) Objectives The Growing Forest Partnership (GFP) aims to reinforce sustainable management of forests and respond to newly emerging financing opportunities by facilitating partnerships through multistakeholder, bottom-up processes that will help the rural poor to improve their livelihoods and support the maintenance of ecosystem services. In addition, it also aims at being a platform to give a voice to the marginalized, forest-dependent groups, to develop national dialogues as well as to link local needs and concerns with international dialogue on forests. GFP is expected to work through locally-based institutions and build on existing partnership structures based on a demanddriven approach. Facilitating organizations of the initiative include the Food and Agriculture Organization of the UN (FAO) through nfp Facility, the International Union for Conservation of Nature (IUCN), World Bank and the International Institute for Environment and Development (IIED). During the first round, the Reference Group of the GFP selected Guatemala, Ghana and Mozambique. Liberia, Bolivia and Nepal were selected in the second round. In Liberia it would thus be feasible for the GFP to strengthen the nfp (National Forest Programme) by focusing on those forest stakeholders who are not yet involved in the process and facilitate their organization and participation in the programme. The stakeholders referred to include: the unorganized groups (such as the marginalized, voiceless and minority groups); those who can influence or are influenced by the forest sector issues as well as those who have a stake, claim or vested interest in the sector. At the launching of the GFP in Liberia in February, 2010, priority issues and gaps in the forestry sector were identified in addition to suggestions of the necessary measures required to address them. The determination of the priority issues were based on the findings of the Strategic Environmental (SEA) study undertaken by the IUCN (2009) in addition to the priority issues identified during the nfp launching workshop in September, 2009 (See Annex 1). The GFP task force, which is a subgroup of the nfp National Multi-stakeholder Steering Committee, elaborated a Concept Note and work plan for the implementation of the GFP activities. 1
2 Eligibility The applicant 1. Must be located in Liberia; 2. Must be an organization registered in Liberia (NGOs, consultancy firms, research institutions/organizations, etc); 3. Should be willing to use the nfp platforms at national and county levels for the implementation of the activities; See the Terms of Reference and the selection criteria in Annex 1 and Annex 2 respectively. Financial contribution through GFP & RRI The proposal can be supported with a total maximum of 131,000 USD. The GFP & RRI funding is provided directly to the selected implementing organisation in three separate instalments. Project duration The proposals should be designed to be completed within 5 months. It is expected that the stakeholder consultations would be undertaken from August, 2010 to October, 2010 while the drafting and the vetting of the regulatory framework will be done from November, 2010, to December, 2010 (see Annex 4).. 4 Annex 1 TERMS OF REFERENCE The Compilation of a Regulatory Framework to Align Chain Sawing Activities with Existing Forest Policy 1. Background In 2009, Liberia was selected as a GFP pilot country, which will catalyze ongoing national efforts by setting up and nurturing a nfp platform to give a voice to the marginalized, forest-dependent groups, to develop national dialogues. GFP is expected to work through locally-based institutions and build on existing partnership structures based on a demand-driven approach. The Liberia GFP Task Force prioritized the following issues for the forestry sector: i. To identify priority capacity building needs of the Forestry sector, facilitate the formulation of a comprehensive strategic plan to address the identified needs and coordinate the necessary support towards the implementation of the plan. ii. iii. iv. To ensure that stakeholders - most especially the forest dwelling community - are aware of the extent, economic value, appropriate harvesting techniques and efficient marketing of commercially viable Non-Timber Forest Products (NTFPs) To provide relevant information concerning decisions on forest and forest-related activities to the local communities through the established County Forest Fora; To develop a regulatory framework in order to ensure that Chain sawing is properly regulated and controlled to align the activity with sustainability and legality principles; v. To design and organise a multi- stakeholder consultation process at the Clan and District levels to link up with the County Forest Fora so as to deepen multi-stakeholder dialogue processes on forestry and forest-related issues; 2. Objective This GFP ToR is calling for proposals to undertake activities related objective iv above. That is to develop a regulatory framework in order to ensure that Chain sawing is properly regulated and controlled to align the activity with sustainability and legality principles. With respect to the above objective, a Call for Proposals from qualified consultancy/ civil society organizations/groups to undertake the related activities is hereby issued. 3. Description of Activities The recipient organisation will work in close consultation with the Managing Director - Forestry Development Authority (FDA), the Liberia GFP Task Force, and the National Multi-Stakeholder Steering Committee (NMSC) of the National Forestry Programme (NFP), the Voluntary Partnership Agreement (VPA) Secretariat as well as liaise closely with the civil society in Liberia to undertake the following activities: i. Review of the Chain Sawing Study(2009) report Chainsaw Logging in Liberia: An Analysis of Chainsaw Logging in the Natural Forests of Liberia towards a more Sustainable Production
5 (2009) -and its findings to produce an options papers and the necessary materials (in simple English) to support multi-stakeholder consultations (MSDs) ii. iii. Disseminate the options papers and other relevant materials through the appropriate communication channels to announce a public dialogue on the activity. The latter materials include: a. FDA s contribution to the MSDs Proposed Regulatory Framework for Chain Sawing Operations in Liberia and b. the summary of the Chain Sawing study report compiled by the IUCN Liberia Chain Sawing Summary Brief Organize multi-stakeholder consultation processes at County, Regional and National levels to obtain consolidated inputs on issues identified in the above-cited chainsaw study report as well as other relevant themes that will facilitate the drafting of an appropriate regulation for the activity including: a. Areas that may be suitable for chain sawing b. the appropriate means of ensuring the production of chain sawn lumber in a sustainable and legal manner in Liberia - including compliance with the legality and chain of custody elements of the Voluntary Partnership Agreement (VPA) as is expected of the Timber Sales Contract (TSC) and Forest management Contract (FMC) holders c. how to improve marketing and production efficiencies so as to reduce waste and improve revenue d. how the benefits from chain sawing should be equitable distributed e. suggestions for the modalities of the involvement of the forest communities with regards to allocation of areas for chain sawing; monitoring of allocated areas/trees, and possible participation in revenue collection f. appropriate and practical forms of regulation and taxation that promote a higher return and value chain, maximize employment, while ensuring revenue to the state g. potential alternate livelihood schemes for especially those marginalised and vulnerable groups who mainly depend on the activity as their source of income and employment A suggested framework to guide the multi-stakeholder consultations can be found in Annex 4. iv. Work closely with the local Legal Specialist to be employed by Fauna and Flora International Liberia (FFI), to ensure that all essential findings during the above MSDs are incorporated into the draft regulatory framework to bring Chain sawing in compliance with existing timber harvesting laws and regulations including chain-of-custody; v. In conjunction with the FFI Legal Specialist, ensure the validation of the draft regulations at the County, Regional and National levels to produce a final regulation(s) on chain sawing; vi. Work closely with any Consultant/Specialist that may be contracted by the GFP during the project period for the purposes of: a. providing training to Chain sawyers to improve their productivity and reduce waste and/or b. undertaking capacity building of the existing Chain Sawing organization(s) in the necessary organisation skills including negotiations The proposed activities have to be harmonised with the existing development programmes that may be supported by internal and external sources on Chain-sawing.

Budgets The applicants should submit for each activity detailed costs by type (consultancy, transport, fees, per diem, reproduction costs, etc.) that the proposing organization deem necessary to successfully complete the activities. 5. Expected Outputs An options paper and information materials produced to support multi-stakeholder dialogue on Chain sawing A report on the stakeholder consultations undertaken that includes comments on the study recommendations in addition to inputs from the various stakeholders on the relevant chain sawing issues as listed under iii above A draft regulation on Chain sawing that is aligned to existing forest policy and includes implementation procedures, which takes into account the views expressed during the stakeholder consultations, the FDA's mandate, the on-going VPA processes in Liberia and the appropriate lessons learned from other countries with similar chain sawing experience including those being discussed in the West Africa sub-region in particular as well as elsewhere in Africa in general. A report on the vetting of the draft regulations to produce the final regulations
7 Annex 2 ELIGIBILITY AND SELECTION CRITERIA TO SELECT THE ORGANIZATIONS FOR THE IMPLEMENTATION OF THE GFP ACTIVITIES Eligibility 1. Must be located in Liberia 2. Must be an organization registered in Liberia (NGOs, consultancy firms, research institutions/organizations, etc); 3. Should be willing to use the nfp platforms at national and county levels for the implementation of the activities Broad criteria to select the organizations for the implementation of the GFP activities The key selection criteria include: (a) How the application reinforces the nfp process and use the nfp platform (National Forest Forum and County Forest Fora) for the implementation of the proposed activities. (b) How the proposal stress the bid specifications (mainly the objective and outputs of the bid) (c) Clarity of the proposal in describing the objectives, the intended results and the implementation arrangement. (d) Technical soundness and feasibility of the proposal. (e) The bidder s capacity to undertake the proposed activity. (f) If the proposed methods and approaches innovative in terms of (i) cost effectiveness, (ii) potential for greater impact, (iii) proposed partnerships and complementarities (g) If the budget (i) realistic and (ii) the cost within the estimated budget range (h) Quality of the application in terms of: Design: logical structure, technical soundness, feasibility, cost-effectiveness; Competency and capacity of the applicant(s) to undertake the proposed activities; Complementarities and coordination with the existing and / or foreseen development programmes supported by internal and external sources on Chain-sawing study. (i) Impact of the proposal (Social, economic, and environmental benefit)
