Town of New Hampton Selectmen s Office 6 Pinnacle Hill Road New Hampton, NH Forester s Telephone: cell On Monday, December 12, 2016 an area of selectively marked standing timber will be shown by Shaun Lagueux, 70 Overlook Drive, Bristol, NH (603) MEETING AT: 8:30 A.M., at the New Hampton Public Safety Building, 26 Intervale Drive located at the junction of NH Routes 132 South and 104, west of I-93, exit 23. Look for a black Toyota Tacoma Pickup with NEFCo signs. Timber will be shown rain or shine! Only one showing of the timber will be made, but a prospective buyer may obtain a private showing by paying for the Forester's time and travel expenses (office to office). Property of Town of New Hampton, Managed by Conservation Commission: Located on Kelley Pond Road. Tax Map R-4, Lot 49. Timber to be sold is marked in blue paint. TOTAL FOREST AREA TO BE CUT: (60 acres ). LOGGING CHANCE: Good. Individual tree volumes are based on local tables that take into account: diameter, merchantable length, and average taper. Softwood is figured to a merchantable top diameter of 8 inches; hardwood, 10 inches. SCALE: Volume estimated from computations based on International 1/4" Rule, Log Scale, Cordwood volumes are non-tallied estimates. Upon completion of sale, landing area will be smoothed and cleaned to the agent s satisfaction. Purchaser will be responsible for the 10% timber yield tax 1. The Seller, without penalty to the Purchaser, may suspend removal operations if the Forester determines that unreasonable damage to access roads, skid roads, and logging roads is resulting from use of these roads during periods of excessive ground wetness. 2. Only designated trees shall be cut and removed. Merchantable trees not otherwise designated, if unnecessarily destroyed, shall be paid for at the rate of three times the agreed contract price. 3. All marked timber shall be cut and removed, but no re-entry shall be permitted. When operating in any one area, all marked timber shall be removed. 4. All trees shall be utilized in their tops to the lowest possible diameter for commercially salable material. Stumps shall be cut no higher than the top of the root swell, except in the case of butt rot or iron in the wood, and shall be cut so as to leave the Forester's paint marks plainly visible on the stumps. In the case of butt rot or iron in the wood, the affected portion shall be cut and left in the woods at the discretion of the Forester. 5. The Purchaser shall either remove or leave on the ground all trees that are broken, damaged, or leaning as a result of the Purchaser's activities in the building of roads or the cutting of marked or designated timber. All tops shall be lopped so as not to extend more than two (2) feet above the ground and lopping shall not fall behind felling. 6. Slash disposal shall be in strict compliance with State of New Hampshire law. 7. The Owner reserves the right to restrict the size and type of log skidding equipment and the manner in which the equipment is operated if the Forester determines that unreasonable damage is being caused by either.

3 3 8. Care must be exercised with fire at all times when in the woods. Any building or structure erected and / or used by the Purchaser during the operation must be removed; and all lunching and service areas shall be cleaned up within the time limit of the agreement. 9. The location and construction of all roads and landings shall be approved by the Forester. In the construction of logging roads, access roads, skid roads or landing locations, all trees more than three (3) inches in diameter shall be severed at the stump and not pushed over by logging equipment. All roads and any existing hiking or riding trails used as skid roads shall be left in proper repair, as approved by the Forester, at the completion of logging. 10. Existing recreation trails, where used, will be left clear of debris and smooth upon completion of sale. 11. The Purchaser will be required to maintain Public Liability Insurance and Worker's Compensation Insurance (if applicable) satisfactory to the Agent of the Owner, and will be required to file certificates with the Town of New Hampton. 12. The Purchaser shall be responsible for obtaining a temporary driveway permit and constructing the access from Old Bristol Road as directed by the Town Public Works Director. 13. The Purchaser shall not ford any brook, stream, or watercourse, but may cross where necessary, provided that the Purchaser constructs a temporary crossing structure, approved by the Forester, which minimizes the disturbance of the stream bed insofar as practicable. The PURCHASER shall be responsible for obtaining all required wetlands permits from The Town of New Hampton and the State of New Hampshire. 14. At log loading and landing areas, all forms of waste, including unmerchantable logs or portions of logs shall be disposed as directed by the Forester. Areas shall then be smoothed and leveled to conform to the original topography by the Forester. 15. The Purchaser shall provide the Forester weekly with a copy of the Purchaser's scale at the mill for sawlogs, veneer logs, boltwood, or pulpwood, and a copy of the Purchaser's truck scale for firewood. 16. All operations must be completed by March 15, The preferred payment schedule for the marked timber is: 25% of estimated stumpage due upon signing contract. 25% due 2 weeks after start of operations. Remainder due as to stay ahead until final volumes are accounted for. 18. The agreement shall be prepared by the New England Forestry Consultants, Inc. and must be signed within 7 days of notice of acceptance of the proposal to the Purchaser by the Forester.

4 4 BID/PERFORMANCE DEPOSIT: Each proposer is required to make a deposit of $1,000 with the submission of their proposal. This deposit will be returned to unsuccessful proposers within 20 days of the award of the contract. Should the successful proposer fail to sign the Timber Sale Agreement and make the initial payment within 20 calendar days of notice of acceptance then his proposal deposit shall be forfeited. Upon completion of the sale and full compliance with the terms of the agreement this deposit will be returned to the Purchaser. The deposit will be forfeited if the obligation to restore the property is not met. This deposit is made in lieu of a performance bond. PROPOSAL PROCEDURE: Proposals shall be on a PER MBF BASIS for sawtimber and a PER TON BASIS for pulpwood or boltwood. Separate prices for individual species may be given. The volume shown is estimated, and any overage will be paid for at the agreed proposal rate weekly as cut, and any shortage may be recovered by additional marking or a refund at the proposal rate. Each proposer must use the final proposal form which will be supplied at the time of the showing. PROPOSALS MUST BE ON THE INTERNATIONAL RULE, LOG SCALE: Conversion factors for the use of other Log Rules in actual scaling must be predetermined in advance of proposal. ACCEPTANCE OF THE HIGH PROPOSAL WILL BE BASED LARGELY ON ABILITY OF THE LOGGER TO PERFORM QUALITY WORK. THE LOGGER WHO WILL DO THE ACTUAL LOGGING SHOULD BE DESIGNATED ON THE PROPOSAL SHEET. PREFERENCE WILL BE GIVEN TO WINTER 2017 AVAILABILTY. Sloppy logging will not be tolerated!! The landowner expects careful felling and skidding of marked trees and closely lopped slash in accordance with the conditions outlined above. All proposals must be RECEIVED BY Town of New Hampton Selectmen s Office, 6 Pinnacle Hill Road, New Hampton no later than: 4:00 PM Friday, December 16, 2016! Request for Proposals shall be provided in a sealed envelope and clearly marked PROPOSAL: Town of New Hampton Timber Sale 2016 Kelley Drake Lot and accompanied by a $1,000 proposal deposit. Proposals will be opened at 4:01 pm the same day. Proposers are welcomed to be present at the opening at the New Hampton Town Office, but no information will be given out by telephone. The New England Forestry Consultants, Inc., as agent for the Owners, reserves the right to reject any or all proposals.
