2 Page 2 Introduction Bruce Tree Expert Company Ltd. was retained by NAK Design Group in February 2016 to complete an Arborist Report and Tree Protection Plan for 219 and 231 Dundas St. East, Toronto. The report was requested relative to the construction of a condominium tower with ground-floor retail space, and an underground parking garage. Currently, 219 Dundas St. East is an asphalt surface parking lot; 231 Dundas St. East is an unoccupied 3-storey brick house. The north side of the subject site fronts Dundas St. East. To the south and east of the subject site is the schoolyard of école Gabrielle Roy (14 Pembroke St.), and to the west are residential dwellings with backyard parking. The purpose of this report is to: Establish species, size and condition of trees protected by the City of Toronto Private Tree Bylaw (City of Toronto Municipal Code, Chapter 813, Article III) and City Street Tree Bylaw (City of Toronto Municipal Code, Chapter 813, Article II). Provide a prescription for the protection or removal of trees based on the current site plans. Provide a Tree Protection Plan showing required tree protection measures to minimize damage to trees during construction that are to be preserved on/adjacent to the site. Key Item A total of 16 trees were inventoried for this report. Of the inventoried trees, 1 tree was located on the adjacent municipal road allowance, protected by the City Street Tree Bylaw; 11 trees were located on private land, protected by the Private Tree By-law. The remaining 4 trees measured less than 30cm in diameter at breast height (DBH) and were located on private property, therefore, not protected by City of Toronto tree protection bylaws. The proposed design will affect the following trees: Tree 2, a cm DBH American elm, is proposed for removal to accommodate the underground parking garage ramp and above-ground building. Tree 3, a 39.5cm DBH honey locust, is proposed for removal to accommodate excavation for the underground parking garage and above-ground building.

3 Page 3 Trees 4, 5, and 13 are proposed to be injured due to removal of the existing asphalt parking lot and excavation for the proposed underground parking garage inside the minimum tree protection zones (TPZ) of these trees. The client is required to submit a permit application to Urban Forestry, Tree Protection & Plan Review for review. If approved, the proposed tree removals and injuries may proceed. Method 1. The subject site was assessed on Feb by the consulting arborist. 2. Photos were taken at the time and the most representative are attached as Appendix I. 3. The methods used to collect data and the information provided below comply with the details and instructions provided in the City of Toronto Urban Forestry document entitled Tree Protection Policy and Specifications for Construction Near Trees, March Urban Forestry requires that trees within the following five categories be reported on in arborist reports for development applications: Ownership Category Description 1 - Private Trees with diameters of 30 cm or greater, situated on private property on the subject site. 2 Private Adjacent Trees with diameters of 30 cm or greater, situated on private property within 6 meters of the subject site. 3 - City Parkland Trees of all diameters situated on City owned parkland within 6 meters of the subject site, or within 10 meters of proposed development. 4 - Ravine Trees of all diameters on lands designated under City Municipal Code, Chapter 658, Ravine Control By-law. 5 City-owned Trees of all diameters situated within the City road allowance adjacent to the subject site. 5. All trees within the above categories found on the subject site and within 6m of property lines were included in the inventory. In addition, some smaller diameter trees, not protected by the City s tree bylaws were included if they were close to 30cm DBH and/or to inform removal or injury considerations during construction.

4 Page 4 6. Trunk diameter was measured using a calibrated diameter tape. The measurement was taken at 1.4 meters above ground level, generally referred to as the diameter at breast height (DBH). Permission to access 14 Pembroke St. was obtained by staff at école Gabrielle Roy. Trees 2 and were not accessible at the time of the inventory (located behind an 8 chain link fence and 5 wooden fence), therefore, DBH was estimated. 7. Trees were assessed in consideration of overall health and structural integrity and assigned a condition rating ranging from good to fair to poor. The assessment may be characterized as an external visual assessment from the ground. Assessment of Tree 2 and Trees was limited to viewing from subject site parking lot. 8. The tree inventory is attached as Appendix II. 9. Bruce Tree Expert Company Ltd. created a Tree Protection Plan by adding tree protection comments to a site plan prepared by Turner & Fleischer Architects Inc. dated Dec and based on a topographic survey prepared by Rady Pentek & Edward Surveying Ltd. dated Oct The Tree Protection Plan is attached as Appendix III. 10. Examples of tree protection hoarding approved by the City of Toronto are attached as Appendix IV. Tree Inventory See Appendix II. Tree Protection Prescription Pre-Construction PROPOSED TREE REMOVALS AND INJURIES 1. The client is required to submit an application to Urban Forestry, Tree Protection & Plan Review for a permit to remove/injure the following trees:! Tree 2, a cm DBH American elm is proposed for removal. This tree appears to be growing on the property boundary between 231 and 235 Dundas St.

Due to the design of the underground parking garage ramp, which would require excavation up to the property line, this tree is proposed for removal (excavation proposed to the base of the tree).! Tree 3, a 39.5cm DBH honey locust located on the adjacent private property at 14 Pembroke St. is proposed for removal. The trunk of the tree is growing on a bend over the subject site and within the overhead wires. There is no good opportunity to prune this tree away from the proposed building due to its form. Excavation for the underground parking garage will require excavation up to the property line (within 1m of the tree).! Tree 4, a 51.5cm DBH honey locust located on the adjacent private property at 14 Pembroke St. is proposed for injury. Removal of the asphalt surface parking lot and excavation for the underground garage will require excavation up to the property line (1.5m from the tree). Three 5cm diameter branches will require removal for aboveground clearance.! Tree 5, a 38cm DBH honey locust located on the adjacent private property at 14 Pembroke St. is proposed for injury. Removal of the asphalt surface parking lot and excavation for the underground garage will require excavation up to the property line (within 2m of the tree). One 15cm diameter branch will require removal for aboveground clearance.! Tree 13, a 40-50cm-diameter Siberian elm located on the subject site is proposed for injury. Removal of the asphalt surface parking lot and excavation for the underground garage will require excavation within a small portion of the TPZ, 2.5m from the tree. One 10cm diameter branch will require removal for aboveground clearance. 2. Tree 2 extends over the property line between 231 and 235 Dundas St. East and therefore qualifies as a boundary tree. A boundary tree is defined as a tree in which any part of the trunk (between the roots and where it branches) extends over a property boundary. Boundary trees are common property of both property owners. 3. Under the Forestry Act, the client must obtain permission from the co-owner of any boundary trees prior to their removal or injury. Urban Forestry will notify co-owners if a permit application has been submitted to remove/injure a boundary tree. Permit approval by Urban Forestry does not preclude civil action.

6 Page 6 4. Trees 3 12 are located on 14 Pembroke St. property. The client is to obtain permission from the owner of these trees prior to any removals (Tree 3), injury (Trees 4 and 5) or access for pruning (Trees 4, 5, and 12). 5. If approved by Urban Forestry, all proposed tree removals and pruning is to be carried out prior to work on the site. TREE PROTECTION HOARDING 6. The following tree protection measures must be read in conjunction with the Tree Protection Plan, Appendix III. Both documents must be provided to the site supervisor prior to any work commencing on the site. 7. No disturbance is allowed within the Tree Protection Zone (TPZ) of protected trees without permission from the City of Toronto. Disturbance includes soil compaction from foot traffic and construction materials, excavation, grade changes, or storage of materials. The minimum TPZ radius is specified by the City of Toronto, Urban Forestry. The Tree Protection Zone radius must be measured from the outside edge of the base of the trunk. 9. Tree protection barriers are required under the Private Tree Bylaw and City Street Tree Bylaw to be installed at the minimum distances noted in the table above for all trees 30 cm DBH or greater on private property and trees of all sizes located on municipal property.

7 Page Protective hoarding is to be installed as shown on the Tree Protection Plan (Appendix III). The barriers are to be 1.2m (4 feet) high and built to the standards set out in the City of Toronto, Urban Forestry Division document entitled Tree Protection Policy and Specifications for Construction Near Trees, Detail TP-1 Tree Protection Barriers, March On municipal property, barriers are to be constructed of plastic snow fencing on a wooden 2x4 frame; on private property, barriers are to be constructed of sheets of plywood on a wooden 2x4 frame. 11. Urban Forestry requires signs to be mounted on the construction-facing side of the tree protection barriers for the duration of the project. The signs are to be a minimum of 40 cm x 60 cm and made of white gator board or equivalent. The text of the signs should read: Tree Protection Barrier: No grade change, storage of materials or equipment is permitted within this TPZ. The tree protection barrier must not be removed without the written authorization of City of Toronto, Urban Forestry Services. For information call Urban Forestry Services at 311. Signs are available from Urban Forestry offices. 12. For this project, the existing 8 high chain link fence must remain in place between the subject site and the adjacent schoolyard. The tree protection hoarding may be securely fastened to the chain link fence. Tree protection signage is to be attached to the hoarding. 13. It is the responsibility of the site supervisor to inspect the condition of the tree protection measures outlined on the plan and within this report each morning. If disturbance is observed, it is to be repaired prior to work commencing on site that day. To not do so is a breach of the tree protection bylaw and could result in an immediate stop-work order being issued for the site. EXCAVATION INSIDE TREE PROTECTION ZONES Prior to any demolition or construction work on the site: 14. Removal of the existing asphalt parking lot and excavation for the underground parking garage falls within the TPZs of Trees 4, 5, and 13. Inside the TPZs of these trees, removal of the asphalt and excavation of the top 1m of soil to construct the parking garage must be overseen by a Certified arborist. 15. The asphalt may be carefully removed using a non-toothed bucket inside the TPZs of these trees. There is to be no disturbance to the subgrade or soil below during removal

8 Page 8 of the asphalt. The excavation below the asphalt must be carried out by hand, air spade, or hydrovac to a depth of 1 metre under arborist supervision. 16. Roots up to 5cm (2 ) are to be cleanly pruned, pending arborist approval that pruning will not foreseeably affect the longterm health or stability of the tree(s). If larger roots are encountered, or roots in significant quantity, the tree(s) may require removal subject to Urban Forestry approval and approval by the owner of the trees. Construction Phase 17. During construction, if any tree roots are exposed or disturbed outside the tree protection fencing, care is to be taken to minimize their disturbance. If roots must be removed outside the TPZ, they must be cleanly pruned. Tearing roots hinders wound closure and can increase risk of disease and root rot. Post-Construction 18. Urban Forestry is to be notified prior to removal of the tree protection fencing on the site. With approval, the fencing may be dismantled. 19. It is strongly recommended that Tree 4 and 5 be thoroughly watered once per week, from spring to fall, over the course of construction. Root disturbance diminishes the stored energy reserves of trees, impacts the tree s ability to absorb water and elements, and can increase chance of disease. Watering will help the trees cope with any stress that the work may have caused. Watering is to be carried out below the drip line of the trees using a soaker hose of garden hose for a 1-hour period. 20. It is recommended that Trees 4 and 5 be monitored by an arborist for signs of stress every 4 weeks over the course of the project. If the trees appear to be exhibiting signs of stress, the most appropriate action is to be taken to remedy the situation. 21. If a tree security deposit was held by Urban Forestry, a written request must be provided to initiate release of the deposit. Compensation Urban Forestry requires compensation in the form of tree planting for the removal of protected trees. For the removal of private trees, replacement usually involves replanting at a ratio of 3:1. Plantings are to be large-growing trees, a minimum of 50mm in calliper at planting.

9 Page 9 Replacement trees are protected under Toronto s tree protection bylaws and may not be injured or removed without permit approval. Urban Forestry may accept cash in lieu of planting on sites with limited space. Cash in lieu is typically $583 per replacement tree. TREES ARE TO BE PRUNED USING PROPER ARBORICULTURAL METHODS, DROP-CROTCH PRUNING. TREE 4 WILL REQUIRE THE REMOVAL OF THREE 5CM DIAMETER BRANCHES TO BRING THE CROWN TO THE CHAIN LINK FENCE LINE. TREE 5 WILL REQUIRE THE REMOVAL OF ONE 15CM DIAMETER BRANCH THAT EXTENDS OVER THE FENCE, BACK TO THE MAIN TRUNK. TREE 12 WILL REQUIRE THE REMOVAL OF ONE 5CM DIAMETER BRANCH EXTENDING NORTH OVER THE FENCE. TREE 13 WILL REQUIRE THE REMOVAL OF ONE 10CM DIAMETER BRANCH EXTENDING TO THE WEST. 9. ALL PRUNING IS TO BE COMPLETED PRIOR TO WORK ON THE SITE TO AVOID ACCIDENTAL DAMAGE TO BRANCHES. EXCAVATION INSIDE TREE PROTECTION ZONES THE FOLLOWING MUST BE CARRIED OUT 10. THE TREE PROTECTION ZONE RADIUS IS TO BE MEASURED FROM THE OUTSIDE EDGE OF THE BASE OF THE TRUNK. 7. THE SITE SUPERVISOR IS RESPONSIBLE FOR ENSURING TREE PROTECTION FENCING IS MAINTAINED AS SHOWN ON THIS PLAN. TO NOT DO SO MAY RESULT IN A 'STOP-WORK' ORDER BEING ISSUED. 12. EXCAVATION BELOW THE ASPHALT MUST BE CARRIED OUT BY HAND, AIR SPADE, OR HYDROVAC TO A DEPTH OF 1 METRE. EXPOSED ROOTS UP TO 5cm IN DIAMETER ARE TO BE CLEANLY PRUNED, PENDING ARBORIST APPROVAL. All other information was provided on a site plan prepared by Turner & Fleischer Architects Inc. dated Dec and based on a topographic survey Rady Pentek & Edward Surveying Ltd. dated Oct TREE PROTECTION BARRIERS FOR CITY-OWNED TREES: Tree protection barriers for trees situated on the City road allowance where visibility must be maintained, can be 1.2m (4ft.) high and consist of chain link, or orange plastic web snow fencing on a 2 x4 wood frame. All supports and bracing used to secure the barrier should be located outside the TPZ. All supports and bracing should minimize damage to roots outside the TPZ. Where some fill or excavate has to be temporarily located near a tree protection barrier, plywood must be used to ensure no material enters the TPZ. If the TPZ needs to be reduced to facilitate construction access, the tree protection barrier must be maintained at a lesser distance and the exposed TPZ protected with plywood and wood chips. This must first be approved by Urban Forestry. LEGEND TREE PROPOSED FOR REMOVAL 5. TREE PROTECTION BARRIERS FOR TREES ON PRIVATE PROPERTY SITUATED ON OR ADJACENT TO CONSTRUCTION SITES: Tree protection barriers must be installed around trees to be protected using plywood clad hoarding or an equivalent approved by Urban Forestry. All supports and bracing to safely secure the barrier should be outside the TPZ. All such supports and bracing should minimize damage to roots outside the TPZ. TREE PROTECTION FENCE MINIMUM TREE PROTECTION ZONE AS PER THE CITY OF TORONTO RECOMMENDED TREE PROTECTION ZONE FOR TREE UNDER 30cm DIAMETER AT BREAST HEIGHT 6. TREE PROTECTION HOARDING IN THE RAVINE & NATURAL FEATURE PROTECTED AREAS: The applicant/owner shall protect all trees in the protected area that have not been approved for removal or injury, throughout development works to the satisfaction of Urban Forestry. Plywood (or chain link fence, if agreed to by Urban Forestry) tree protection hoarding shall be installed in the locations as indicated in the Urban Forestry approved tree protection plan. Tree protection hoarding shall be installed to standards as detailed in the City s Tree Protection Policy and Specifications for Construction near Trees and to the satisfaction of Urban Forestry. The sediment control fencing must be installed to Ontario Provincial Standards (OPSD ) and to the satisfaction of Urban Forestry. 7. General Note: Prior to the commencement of any site activity the tree protection barriers specified on this plan must be installed and written notice provided to Urban Forestry. The tree protection barriers must remain in effective condition until all site activities including landscaping are complete. Where required, signs as specified in Section 4 Tree Protection Signage must be attached to all sides of the barrier. Written notice must be provided to Urban Forestry prior to the removal of the tree protection barriers. 8. ARBORICULTURAL WORK: Any roots or branches which extend beyond the TPZ indicated on the is plan which require pruning, must be pruned by a qualified arborist or other tree professional as approved by Urban Forestry. All pruning of tree roots and branches must be in accordance with good arboricultural standards. Roots locate outside the TPZ that have received approval from Urban Forestry to be pruned must first be exposed by hand digging or by using a low pressure hydro vac method. This will allow a proper pruning cut and minimize tearing of the roots. The arborist/tree professional retained to carry out crown or root pruning must contact Urban Forestry no less than 48 hours prior to conducting any specified work. BTEC FILE
