1 HEBRON CITY COUNCIL PROCEEDINGS JANUARY 3, 2018 Hebron City Council met on Wednesday, January 3, 2018 at 6:30 p.m., at the Hebron Secrest Library Basement. Mayor Shane Day presided and the proceedings were recorded by City Clerk Marcy Welch. Upon roll call, the following Councilmembers were present: Timothy Pickering, Denese Sudbeck, Kurk Wiedel and Robert Dodes. Also, present: City Administrator Chris Fangmeier. Absent: Larry Fangmeier and Douglas Huber. Notice of this meeting was given in advance by posting. Notice of this meeting was simultaneously sent to the Mayor and Council and a copy of their acknowledgement of receipt of notice is attached to these minutes. Availability of the agenda was communicated in the advance notice and in the notice to the Mayor and Council of this meeting. All proceedings hereafter shown were taken while the convened meeting was open to the attendance of the public. ANNOUNCEMENT-OPEN MEETINGS LAW Mayor Shane Day informed the public of the location of the posted information concerning the Open Meetings Law. PLEDGE OF ALLEGIANCE Mayor Shane Day lead the Council and guests in the Pledge of Allegiance. FIRE DEPARTMENT TOOL UPGRADES Fire Chief, BJ Linton reported on upgrades that the department needed. Councilmember Pickering made a motion second by Wiedel to Approve the Equipment Upgrades for the Fire Department. AYES: Pickering, Wiedel, Sudbeck, Dodes NAYS: None Absent: Fangmeier, Huber Motion carried BJ also reported that the pumper truck will be ready in approximately 1 ½ months. GENERAL DISCUSSION Randy Hergott, Representative for the Thayer County Economic Development Alliance Board of Directors, presented a letter to the Council of Resolution of Support regarding LB840 Election RESOLUTION OF SUPPORT

2 Whereas, the City of Hebron has placed on the election ballot an issue to decide whether to designate certain sales tax dollars collected toward a Local Option Municipal Development Fund for economic development purposes (LB840); and Whereas, this designation will result in NO NEW TAXES but rather a specific earmarking of current sales taxes now being collected; and Whereas, the Thayer County Economic Development Alliance exists to promote economic development in Thayer County, Nebraska; and Whereas, a Local Option Municipal Development Fund will provide the City of Hebron and therefore Thayer County as a whole, an effective economic development tool to promote Business Retention, Business Expansion and Business Attraction specific to projects within the City of Hebron; Be it hereby resolved that the Board of Directors of Thayer County Economic Development Alliance enter in its record to be in support of this ballot issue and to offer publicly its support for the approval of this ballot issue. Randy reported that this will help businesses within the one (1) mile radius of City of Hebron. Randy also offered the TCEDA Loan Committee to be the Loan Committee for the LB840. DILAPIDATED HOUSES/BUILDINGS NUISANCE PROPERTY 150 N. 10 TH STREET City Attorney, Joseph Murray reported this is a Formal Notice. No one was present to represent the property. Discussion on the property and improvements and what still needs to be done took place. Resolution # WHEREAS, on December 4, 2017 at 6:30 p.m., at a regular meeting of the Mayor and City Council of Hebron, Nebraska, the City Council, considered that a public nuisance appeared to be maintained on the following described real estate: The North 50 of Irregular Tract No. 144 in Section Six (6), Township Two (2) North, Range Two (2) West of the 6 th P.M. in Hebron, Thayer County, Nebraska (148/150 N 10 th Street),

3 By Glenn E. Anderson and Aaron Zeleny, owners, in violation of the nuisance provisions (Section through Section 05-20) of the Hebron Municipal Code; and WHEREAS, on December 6, 2017, the City Attorney issued to the above named owners, a notice describing the condition of the property; stating that a public nuisance appeared to exist thereon; and requiring the owners to remedy the condition at once or to appear at a formal hearing to be held January 3, 2018 at 6:30 p.m. to determine whether a public nuisance does exist on the property; and WHEREAS, pursuant to the notice referred to above, the owner was notified that a hearing would be held on this determination and was requested to attend; and WHEREAS, neither Glenn E. Anderson nor Aaron Zeleny appeared at the public hearing held January 3, 2018 failing to show cause why a nuisance does not exist; and WHEREAS, the Council reviewed photographs taken January 3, 2018 of the property and the condition thereof and determined, by unanimous vote, that the conditions existing upon said property do constitute a public nuisance and should be remedied and abated; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Hebron, Nebraska, as follows: 1. After considering all of the evidence, the City Council does hereby find that a public nuisance exists upon the above described property and that this nuisance shall be remedied by the owners thereof at once. 2. Unless the owners, within thirty (30) days of the passage of this resolution, abate the nuisance, the City of Hebron shall enter into a contract with an independent contractor for the purpose of abating the same. 3. Specifically, the owners, to abate this nuisance, shall remove and properly dispose of the junk, salvage and miscellaneous debris located thereon. Failure of the owners to take this action, will result in the City hiring a contractor to do so and charging the cost thereof to the owners. 4. The Mayor is authorized to employ and contract with a qualified contractor to accomplish the above nuisance abatement, in the event that the owners do not do so within the specified time frame. Councilmember Wiedel made a motion second by Dodes to make a Resolution to Declare this Property a Nuisance. AYES: Wiedel, Dodes, Pickering, Sudbeck

4 NUISANCE PROPERTY 1223 & 1225 LINCOLN AVENUE City Attorney, Joseph Murray reported that the Board of Health will inspect these properties, and this is all they can do on these properties at this time. Did advise owner that the dog at 1225 Lincoln Avenue is still being leashed in front yard and that needs to stop. NUISANCE PROPERTY 104 N. 13 TH STREET/140 S. 13 TH STREET City Attorney, Joseph Murray reported that City Administrator, Chris Fangmeier was working with owners on these properties. Chris reported that at this time they have done all they can do until Spring. Will reevaluate this property in May No further action NUISANCE PROPERTY 212 S. 13 TH STREET City Administrator, Chris Fangmeier reported that owner has cleaned up the North side of the property. Waiting on fence between property line, however can t do that till Spring. Trailer needs to be moved before Spring. Reevaluate in May NUISANCE PROPERTY 249 S. 13 TH STREET City Administrator, Chris Fangmeier reported that this property is making progress. Will reevaluate with others in May NUISANCE PROPERTY 250 S. 13 TH STREET City Administrator reported he has been working with the owner and with Bruning State Bank as they are willing to cost share a portion of a fence like the existing fence. Chris reported that at this time they will not be able to do anything further till Spring. Reevaluate in May CHAMBER UPDATE Chamber Director, Jana Tietjen reported on new/renewing membership pricing and gave an over view of the years progresses. Coffee Talk still going well, reported a new general manager at 81 Express will be Perry Gunn.

5 SUB DIVISION BRAD ELTING Discussion on sub division on property on South 2 nd Street. RESOLUTION # WHEREAS, Glenn Walk is the owner of the following described real estate: The North 70 of Lots Eleven and Twelve (11 & 12), Block Eighteen (18), original Town of Hebron, Thayer County, Nebraska; and WHEREAS, he wishes to subdivide the above described tract by conveying the following described real estate: To Brad Elting; and The North 70 of Lot Twelve (12), Block Eighteen (18), Original Town of Hebron, Thayer County, Nebraska, QHEREAS, this subdivision is required to be approved by the Mayor and City Council of the City of Hebron, Nebraska; and WHEREAS, Chris Fang Meier, City Administrator, has reviewed the proposed subdivision and has no objection to the same or the approval thereof by the Mayor and City Council; NOW, THEREFORE, BE IT RESOLVED by the mayor and City Council of the City of Hebron, Nebraska, as follows: The conveyance of the following described real estate: The North 70 of Lot Twelve (12), Block Eighteen (18), Original Town of Hebron, Thayer County, Nebraska, By Glenn Walk to Brad Elting, which effectively subdivides the original tract owned by Glenn Walk is here by approved by the Mayor and City Council of the City of Hebron, Nebraska, and the parties are authorized to complete the proposed conveyance. Councilmember Sudbeck made a motion second by Pickering to Approve the Sub Division on South 2 nd Street. AYES: Sudbeck, Pickering, Wiedel, Dodes APPROVE TRASH HAULING PERMITS

6 City Clerk reported that the City needs to Approve The Garbage Company South and Bel- Con Sanitation as the Trash Haulers for the City of Hebron for Councilmember Sudbeck made a motion second by Pickering to Approve The Garbage Company South and Bel-Con Sanitation as the Trash Haulers for the City of Hebron for AYES: Sudbeck, Pickering, Wiedel, Dodes OPEN BIDS- WATER TRUCK REPLACEMENT Mayor Day opened the sealed bids. They were as follows: 1. Melton Motors, Bellville KS $29, Kass Ford, Hebron NE $27, Friesen Chevrolet, Sutton NE $28, Friesen Ford, Aurora NE $27, APPROVE BID WATER TRUCK REPLACEMENT PENDING INSPECTION City Administrator, Chris Fangmeier will look over bids and make sure they meet all specifications. Councilmember Wiedel make a motion second by Sudbeck to Approve Kass Ford pending Chris going over paperwork. Will send letters to businesses Thanking them for the bids. AYES: Wiedel, Sudbeck, Pickering, Dodes APPROVE NEW BARTENDER WAGES City Administrator, Chris Fangmeier reported that we are not being competitive with other halls around. Discussion on raising the scale $1.00 from what we have now. Councilmember Wiedel made a motion second by Pickering to Approve New Bartender Wages $12.00 for first four (4) events and, $13.00 for next four (4) events, $14.00 after next four (4) events and completion of the online bartender course. AYES: Wiedel, Pickering, Sudbeck, Dodes APPROVE SWIMMING POOL STUDY

7 JEO is asking us to fill out survey of what we are wanting/needing for our pool and they will put a proposal together. EXECUTIVE SESSION Councilmember Pickering made a motion second by Sudbeck that Council go into Executive Session at 7:32 p.m. AYES: Pickering, Sudbeck, Wiedel, Dodes Councilmember Pickering made a motion second by Sudbeck that Council go back into Open Session at 7:56 p.m. AYES: Pickering, Sudbeck, Wiedel, Dodes EMS SERVICES TO OTHER COMMUNITIES Councilmember Pickering made a motion second by Wiedel to Discontinue EMS Services to Bruning, Gilead, Belvidere effective February 10, AYES: Pickering, Wiedel, Sudbeck, Dodes GENERAL DISCUSSION Jana Tietjen is the interim manager for the Stastny Community Center and we will reevaluate this after a couple months. We will keep a log of calls and times, and get this changed on the website. Mowing properties- discussion on this was held as bids were due Have received a few bids and will be looking them over. Archery Range is still in process, we are using this area to pile snow too, but will be able to be used for both. Policy Manual- Fang Meier, Sudbeck, Dodes with Pickering being an alternate for meetings, to get this process of reviewing it done.

8 Strategic Planning Meeting- Councilmember Wiedel reported that they will schedule another meeting on February 28, 2018 and will meet with each board every 15 minutes. Committee Meeting next week over lunch. List of Properties City owns to scoop sidewalks, as we need to be getting these scooped if we expect everyone else to scoop theirs. AYES: Sudbeck, Pickering, Wiedel, Dodes APPROVE CLAIMS Councilmember Wiedel made a motion second by Pickering to Approve Claims.
