Reports from Committees Property Manager s Report Our regular mowing season is underway. We have had two fertilization and weed treatments from Swingle. We managed to get the head-gate control away from the Ditch company as of Tuesday June 6 th. We need to install the metering system before the river water runs out. Garrett has ordered the parts and we anticipate having the metering installed before the end of June. Once we have this operational we plan to go back to the Ditch Company to see if we can swap some Class B shares for Class A shares. The ponds have been repaired and Garrett is filing the ponds this week. He is also completing repairs on several valves in both the lower and upper areas. We should be able to start watering Wednesday or Thursday. The waterfall will take a little longer as we need to replenish water in the Eagle pond. Once there is sufficient water we will start the waterfall.

2 GTL cleaned up a number of fallen limbs and downed trees from the spring storm. We have one pine tree on the sewer access lot that has died. Boulder Tree would like to inspect this tree as we take it down in an attempt to determine what killed the tree. The tall grass between the ditches has been cut as close to the ditch as possible. GTL still needs to complete the berm work for the trees around the water tank. Other: Several fence posts were replaced and a number of horizontal boards reinstalled or repaired in the development. The under drains at the cement swale on Pawnee as well as the Sawtooth outlot need to be cleaned our as there are now roots in the pipe again and the cleanouts are overflowing. Advanced Sewer and drain will be on site on the 14 th to clean these out. The Hwy 52 entry lights were repaired. A new transformer was installed to power the lights. There is one sconce light that needs to be repaired as it ids damaged. Demand payment letters have been sent to 3 delinquent accounts. One owner was sent an requesting a time frame to install the trees to the west of the trail behind his property. An owner was sent a violation letter for his dead shrubs and trees on his Greenwood property. He has responded. The vacant lot on Strawberry has also been mowed. Irrigation Report - Have been working on fixing leaks in the irrigation system at several locations thru out Somerset. The drain was cleaned out of tree roots behind Pawnee near the phone company parking lot. Garrett is recommending that the drain system there needs to be totally replaced. This has been a project that has been on the books for many years but we have not had the money to accomplish this. Treasurer s Report Income Statement May 2017 o Income: $2,866 o Expenses: $10,754

3 o Net Income: -$7,888 YTD May 2017 o Income: $109,979 o Expenses: $41,681 o Net Income: $68,297 Cash Balances at May 31, 2017 Checking: $116,921 Defense Fund: $20,154 Reserve Fund: $72,432 Accounts receivable (HOA dues) > 90 days outstanding: $2,891 - Elizabeth made motion to accept and Kay seconded it and it passed unanimously. ACC - One roof and 2 landscaping and one fence requests were made and approved. Working Meeting Agenda Indian Pond Some residents of Greenwood Drive want to look into donating the cost of repairing the Indian Pond. We discussed whether we could do this. Al suggested that the job could be done thru the regular HOA and then invoice the residents who would like to pay for getting this done. The HOA would need to get bids and run the job to make sure it is up to our standards and the association would maintain it in the future. We suggested that we get bids. Al will handle. Review Opinion & Recommendations from Legal We used to assume that we have one neighborhood (168) with one HOA that manages the entire neighborhood with equal shared assets, common area, etc. The judge decided that Somerset Estates and Cottonwood Hills common interest communities have separate common interest communities that have never been combined. But at a legal level the state only recognizes one HOA - Somerset and the assets are owned by the single HOA Somerset. The HOA has only one budget and one elected board. Two things have changed legally as a result of this decision. Any proposal to increase assessments needs 75% of residents of both Cottonwood Hills and Somerset Estates with separate voting. Then any amendments to declarations would need 67% approval from each neighborhood - Cottonwood Hills and Somerset Estates with voting separate.

4 Review Feasibility of Creating Separate HOA s for Cottonwood Hills and Somerset Estates or Trying to redo the Declarations & Assessments (Separation Committee #2 & New Declarations Committee #1) We can look at separating and becoming 2 neighborhoods with two homeowner association. We suggest 1 working committee to investigate how we break up the assets and form different neighborhoods and a second committee to see if we can redo the declarations and increase our assessments by voting again. Susan Reilly was asked to chair the New Declarations Committee#1. She agreed as long as the current board would be supportive. She will be talking to people who might like to be part of her group. The motion was made by Dave that she do this and passed unanimously. We can ask at the annual meeting if there is an interest in homeowners finding out more about separating the two neighborhoods and whether there are any volunteers to be a part of that. (Separation Committee#1) Anthony Chirikos and Brett Landin will get started crunching numbers. It was suggested that we send a letter to all the Somerset residents to announce the upcoming Annual Meeting and tell what s going to happen. We will send the announcement with the June bill. We were told by legal counsel (Mark Payne) that neither of the declarations for Cottonwood Hills or Somerset Estates require us to have a vote on our yearly budget so we will just present the budget as part of the annual meeting. Annual Meeting will be July 12th depending on where we can find a room. We will include a preliminary agenda. Meeting was adjourned at 9:00 p.m. Acting Secretary Kay Ingram
