1 THE CORPORATION OF THE TOWNSHIP OF KING COMMITTEE OF THE WHOLE Appendix 6B Council of the Township of King met in Committee of the Whole on Monday, at 6:52 p.m. Members of Committee present were Mayor Black, Councillors Mortelliti, Laidlaw, Pabst, Cober, Underhill and Rupke. Councillor Pabst chaired the Committee of the Whole meeting. Members of staff present were Scott Somerville CAO, Chris Somerville Clerk, Stephen Kitchen Director of Planning, Jeff Schmidt Director of Finance and Treasurer, Rob Flindall Director of Engineering & Public Works, Bryan Burbidge Fire Chief, Catherine Purcell Director of Parks, Recreation & Culture, Diane Moratto Administrative Clerk Council/Committee, Jay Feehely Township Solicitor. C.O.W. # Sandro Soscia, P. Eng. Soscia Engineering Ltd. Re: Proposed Group Home at Jane Street, King City Mr. Soscia, P. Eng. of Soscia Engineering Limited advised that his firm has been retained by the property owners of Jane Street to act as Land Use Planners and Development Consultants and on behalf of the property owners, he is here tonight to advise Committee of a proposed Group Home on the subject property. Mr. Soscia explained that the property is approximately fifty acres situated north of King Road between Jane Street and Highway #400 with access at the extreme southern portion of the property off of Jane Street. Mr. Soscia commented that there is a large single detached dwelling of approximately 10,000 square feet which will be renovated to house 20 persons who would live as a single housekeeping unit with a large shrub/floral garden at the rear, tennis courts to the north of the building and the undeveloped land will be used for agricultural purposes. Mr. Soscia advised that the Group Home would be operated by Loft Community Services and would offer a supported communal living environment for adults who suffer from depression and other related illnesses and be staffed by two qualified social service workers. Mr. Soscia asked that Committee support a Group Home as a permitted use on the subject lands. Committee recommends that the Deputation by Mr. Soscia be received as information. C.O.W. # DRAFT Comments letter prepared by the Township Solicitor Re: Proposed Regulation under Section 70(h) of the Planning Act; Ministry of Municipal Affairs and Housing: EBR Registry No York Energy Centre Proposal for Simple Cycle Peaking General Facility at and Dufferin Street; File No. 6956JF06 Jay Feehely, Township Solicitor reviewed the Draft Comments Letter which Council will be asked to endorse and forward to the Ministry of Municipal Affairs and Housing as the Township

2 - 2 - Committee of the Whole Report of King s formal response to the Province s proposed Order-in-Council on the York Energy Centre Proposal for Simple Cycle Peaking General Facility. Mr. Feehely advised that the Draft Comments Letter provides the background of this application and the steps the Township of King has taken to date. The concerns expressed on all fronts are itemized and will be submitted as part of the comments. Mr. Feehely advised that the Township s response to the proposed Order-in-Council will be forwarded to Mr. Larry Clay, Regional Director, Minister of Municipal Affairs and Housing before July 12 th, DEPUTATIONS Jamie Reaume Mr. Reaume appeared on behalf of the Holland Marsh Growers Association and commented that the Holland Marsh provides $170 million of economic revenue for the Province each year and is one of two specialty crop areas in Ontario, with only seven in all of Canada. Mr. Reaume advised that it has become clear that the peaking plant project no longer will provide as-needed services to northern York Region, but will be running continuously and will provide electricity for the main grid. Mr. Reaume commented that he supports this Council who has been doing a good job of looking after the planning of the Township and knows what is best for the municipality. He remarked that the Province has stepped in and said that Council is no longer capable. Mr. Reaume suggested that Council should resign and tell the Province to take over running the municipality. He suggested that the Township warn other municipalities to be aware and watch that this doesn t happen to them. He commented that the industry has funds to spend on lobbyists whose sole job is to look at ways to overstep the Conservation Authority, and Provincial and Municipal Legislation. Mr. Reaume noted that the Province is ignoring history, the Conservation Authority was specifically charged with developing regulations to protect the Holland Marsh after the flooding caused by Hurricane Hazel, and approving this installation flies in the face of those regulations. He asked that the letter to the Minister of Municipal Affairs and Housing stress that the Council of the Township of King are not here at the Province s beck and call but rather to serve the residents of the Township. Committee recommends that the deputation by Mr. Reaume be received. Debbie Schaefer Ms. Schaefer asked that Council emphasize that the need for extra power in York Region is in question, and it is impossible to obtain current information from the Province or any other source. She asked that Council ensure there is a strong statement in the document that King Township is totally against this proposal. Ms. Schaefer noted that MPP Julia Munroe did make a comment in the Legislature on the last day of sitting before the summer break asking what is going on with this project in King Township, to which Minister Duguid responded the plant is needed because residences and businesses of Northern York Region are at risk of running out of electricity. Ms. Schaefer indicated that the records show that 2005 was a peak year for electricity use, and that demand for electricity began to decrease after that partly due to the construction of the Holland Junction Transformer Station and the upgrades to the Armitage Transformer as well as conservation practices and alternate energy sources. Ms. Schaefer opined that the proposed plant will no longer address that need. Ms. Schaefer reiterated that there is no recent

3 - 3 - Committee of the Whole Report information with respect to peak demand numbers for 2009 or any forecast for Ontario available. She concluded by asking that the Township warn other municipalities about the Province s actions and how easy it is for a municipality to lose control. She stressed that this is not just about a power generation plant anymore but rather the fact that the Province can step in anytime and overpower a municipal government. Committee recommends that the deputation by Ms. Schaefer be received. (c) Bob Martin Mr. Martin commented that the Conservation Authority declined to allow the transformer station on the site where the power generation plant is proposed to be built and asked that Council request a dossier from the Province on all of the paperwork related to this proposal. He noted that the Council resignation would achieve nothing as the Province would just hire a Commissioner to step in to run the municipality and he feels contacting other municipalities would be a waste of time. Instead it would be more beneficial to write to the Mayors and all Councillors in each municipality directly to gain support. Mr. Martin asked that Council send the response letter not only to Mr. Clay but to the Deputy Minister as well. Committee recommends that the deputation by Mr. Martin be received. Councillor Cober asked that staff prepare a file on the costs the Township has incurred on this application to date as Council meeting agendas have been hijacked and other projects have been delayed over the past year in order to work on this proposal. Councillor Cober asked that Council and staff seek substantial costs from the Province for the work that has been done and the associated costs incurred to deal with this application. Scott Somerville, CAO advised that staff is currently compiling a list of associated costs and will have a report to Council by the July 12 th meeting if possible. Committee considered the Draft Comments Letter from the Township Solicitor regarding the Proposed Regulation under Section 70(h) of the Planning Act; Ministry of Municipal Affairs and Housing: EBR Registry No York Energy Centre Proposal for Simple Cycle Peaking General Facility at and Dufferin Street; File No. 6956JF06 Committee recommends that the Draft Comments Letter prepared by the Township Solicitor be received, and: Council endorses the Draft Comments Letter received this evening and authorizes the Chief Administrative Officer and the Township Solicitor to finalize the comments by emphasizing the question of need for the facility, the potential economic impact to the Holland Marsh Agricultural industry, and taking into consideration the comments of the deputations heard this evening; The Comments Letter be forwarded to Mr. Larry Clay of the Ministry of Municipal Affairs and Housing as the Township of King s formal response to the Province s proposed Order in Council on the York Energy Centre Peaker Plant; and

4 - 4 - Committee of the Whole Report (c) A brief version of the Comments Letter be forwarded to the Association of Municipalities of Ontario (AMO) for circulation to all municipalities in Ontario advising of the recent events and requesting support with a copy to be sent to the Rural Ontario Municipalities Association (ROMA). C.O.W. # Clerks Department Report Number CL Re: Street Naming Additional Names for the King City Area for Council Approval King Station Inc., Phase 3, 19T-07K01, Part Lot 4, Concession 4 Submission for Street Name Approval Committee considered Clerks Department Report Number CL to provide additional names for Council approval for the King City Area Street name Inventory and to provide the submission from the EMC Group for street name approval for the King Station Inc. Development, under File 19T-07K01. Committee recommends that Clerks Department Report Number CL be received, and the recommendations therein be approved, as follows: (c) Report CL be received as information; Committee approve adding the names listed in Section 3.1 of this Report to the King City Area Street Name Inventory. Committee approve the naming of the Streets for the King Station Inc. Draft Plan of Subdivision, File 19T-07K01, as follows: Street A : Langdon Drive (Extension) Street B : Hogan Court Street C : John Tanner Court Street D : Tiero Court C.O.W. # Finance Department Report Number FR Re: Harmonized Sales Tax (HST) Update Committee considered Finance Department Report Number FR regarding information about the new Harmonized Sales Tax (HST). Committee recommends that Finance Department Report Number FR be received, and the recommendations therein be approved, as amended, as follows: a. Finance Report FR be received for information; b. Staff brings back a Resolution requesting the Province to apply a portion of the Harmonized Sales Tax to finance infrastructure and transportation.

5 - 5 - Committee of the Whole Report Town of New Tecumseth Re: Resolution re Harmonized Goods and Services Tax Committee recommends that the letter dated May 13 th, 2010 from the Town of New Tecumseth requesting support for its Council Resolution with respect to HST and children s recreation programs be considered at this time. Committee recommends that the Resolution from the Town of New Tecumseth that the Province of Ontario be requested to consider exempting children s recreation programs from the HST in order that Ontario families can afford to participate in athletic and recreation programs in their communities be endorsed. C.O.W. # Engineering and Public Works Department Report Number EPW Re: Single Source request for the purchase of one (1) 2010 Mercedes-Benz Sprinter Van for the Water Department Committee considered Engineering and Public Works Department Report Number EPW to request approval to issue a purchase order to supply one (1) Mercedes-Benz Sprinter van for the Water Department. Committee recommends that Engineering and Public Works Department Report Number EPW be received, and the recommendations therein be approved, as follows: 1. THAT staff be authorized to Sole Source Purchase one (1) Mercedes-Benz Sprinter van. 2. THAT Mercedes-Benz Barrie with a total bid in the amount of $51, (excluding H.S.T.) being the only bidder and meeting the terms and conditions of Request for Quotation 2010-Q06 be issued a purchase order to supply one (1) Mercedes-Benz Sprinter van for the Water Department. 3. AND THAT Engineering and Public Works receive authorization for an over expenditure in the amount of $18, to purchase and outfit the vehicle, with all costs of the purchase to be allocated against the Development Charge Reserve; 4. AND THAT the necessary By-law is passed at the June 14, 2010 Council meeting.

6 - 6 - Committee of the Whole Report C.O.W. # Parks, Recreation and Culture Department Report Number PR Re: Naming of King City Arena and Gord and Mary Orr Memorial Plaque Committee considered Parks, Recreation and Culture Department Report Number PR regarding the re-naming of the King City Arena to recognize the contributions towards the facility and community by the King City Lions Club and to place a memorial plaque honoring the commitment to community and volunteerism by Gord and Mary Orr. Committee recommends that Parks, Recreation and Culture Department Report Number PR be received, and the recommendations therein be approved, as follows: C.O.W. # a) That report Parks, Recreation & Culture Department Report PR be received as information. b) That Council authorize renaming King City Arena to King City Lions Arena and authorize staff to install a memorial plaque in honour of Gord and Mary Orr in Memorial Park, King City. Parks, Recreation and Culture Department Report Number PR Re: Naming of a Portion of the Road Allowance at Rebellion Way and Little Rebel Road to Jesse Lloyd Park Committee considered Parks, Recreation and Culture Department Report Number PR regarding naming a portion of the road allowance located at the intersection of Rebellion Way and Little Rebel Road Jesse Lloyd Park. Committee recommends that Parks, Recreation and Culture Department Report Number PR be received, and the recommendations therein be approved, as follows: C.O.W. # a) That report Parks, Recreation & Culture Department Report PR be received as information. b) That Council authorize naming a portion of the road allowance located at the intersection of Rebellion Way and Little Rebel Road Jesse Lloyd Park. Administration Department Report Number HR Re: Bill 168, Occupational Health and Safety Amendment Act (Violence and Harassment in the Workplace), 2009

7 - 7 - Committee of the Whole Report Committee considered Administration Department Report Number HR to obtain Council approval of the Township s new Violence Free Workplace Policy and Program and revised Harassment and Discrimination Free Workplace Policy and Program and to update on initiatives for ensuring the Township complies with the underlying Occupation Health and Safety Amendment Act (Violence and Harassment in the Workplace), 2009 by June 15 th, Committee recommends that Administration Department Report Number HR be received, and the recommendations therein be approved, as follows: NEW BUSINESS C.O.W. # ) That Administration Department Report H/R is received for information. 2) That Council approve the Township s Violence Free Workplace Policy. 3) And that Council approve the revisions to the Township s Harassment and Discrimination Free Policy. 4) And That Council approve the Township s Violence Free Workplace Program. 5) And that Council approve the Township s Harassment and Discrimination Free Program. 6) And that Council delegate authority to the CAO to approve any subsequent revisions to the two policies and/or programs. Toronto & York Region Labour Council FCM Resolution re: Improved Retirement Security for Canadians Councillor Underhill made a motion to have staff place the correspondence circulated by the Toronto & York Region Labour Council dated June 9 th, 2010 requesting support of the Federation of Canadian Municipalities Resolution entitled Expansion of Canada s Public Pension System to provide improved retirement security for Canadians on the next Agenda.
