MINUTES of a Regular Council Meeting of the MUNICIPAL COUNCIL OF THE CITY OF KAMLOOPS, held in Council Chambers at 7 Victoria Street West, Kamloops, BC, on Tuesday, October 3, 2017, at 1:30 pm. PRESENT: Deputy Mayor A. H. Singh, Councillors D. M. Cavers, D. W. Dudy, T. Lange, P. A. Wallace, and D. J. Walsh. 1. READING Chief Administrative Officer D. A. Trawin; Corporate Officer M. Mazzotta; Acting Parks, Recreation, and Cultural Services Director B. Berger; Public Works and Utilities Director J. Fretz; Finance Director K. Humphrey; Development and Engineering Services Director M. Kwiatkowski; and Legislative Assistant D. L. Anderson. The Corporate Officer gave a reading from the late Christopher Seguin. 2. APPROVAL OF THE AGENDA Council approved the agenda. 3. MINUTES Moved by Councillor Dudy, seconded by Councillor Wallace, that Council adopt the following minutes: September 12, 2017, Regular Council Meeting September 19, 2017, Regular Council Meeting 4. PUBLIC SUBMISSIONS Variance Application No Dog Responsibility and Control Bylaw No (5965 Dallas Drive) The purpose of this application is to permit the applicant to keep three dogs at the residence. Sherre LaPointe, Applicant, 5965 Dallas Drive: Advised that Rhodesian Ridgebacks are a unique breed of dog, and the third dog is a show dog that is co-owned with the breeder. Explained that the three dog variance is unlikely to be long term, as one of the dogs has required major surgeries. Stated that they are responsible dog owners, the dogs are well cared for, and arrangements are made for a dog sitter or doggy daycare in their absence. On question, advised there have been no complaints from any of the neighbours, and the property is 0.57 ac. in size.

2 208. Page 2 Trevor Douglas, 5975 Dallas Drive: Advised that he is the applicant s next door neighbour and he supports the application. The dogs are never loose, there is a dog sitter if the applicants are away, and he finds the dogs a pleasure to be around. There were no further submissions, and no correspondence was received with regard to this application. Development Variance Permit Application No. DVP00493 (2634 Valleyview Drive) The purpose of this application is to reduce the minimum lot street frontage in the RS-1 (Single Family Residential-1) zone from 15 m to 6 m to allow a panhandle subdivision. Correspondence was received opposing this application from: Cary Blue, 2614 Valleyview Drive Peter and June Neufeld, 2631 and 2639 Sunset Drive Correspondence was received expressing concern regarding this application from: Kathryn Wanamaker, 2640 Valleyview Drive Peter and June Neufeld, 2631 and 2639 Sunset Drive: Advised they are opposed to the application and feel that it is not in keeping with the design of the neighbourhood. Feel that the panhandle lot will negatively impact neighbours. Advised their issue is with the panhandle lot design and feel that a front-to-back design to create two equal parcels would be preferable. Tom Beyer, Applicant, 2634 Valleyview Drive: Advised that this development supports KAMPLAN by increasing density and encouraging infill. There will be a covenant on title of the panhandle lot to restrict the house to one storey. Asked Council to support the application. There were no further submissions, and no further correspondence was received with regard to this application.

Page 3 Development Variance Permit Application No. DVP00504 (2042 Sunnycrest Avenue) The purpose of this application is to reduce the minimum street frontage on the subject property from 15 m to 6 m to allow the creation of one panhandle lot, and to reduce the minimum front yard setback for an accessory building from 6 m to 1.6 m on the panhandle lot. There were no submissions, and no correspondence was received with regard to this application. Bylaw No , Permissive Tax Exemption Bylaw, 2017 (Not-for-profit Organizations) The purpose of this bylaw is to exempt from property taxation, 33% in 2018, 66% in 2019, and 100% in , the land and buildings for not-for-profit organizations for four years. There were no submissions, and no correspondence was received with regard to this application. Development Variance Permit Application No. DVP00503 (2135 Tranquille Road) Deputy Mayor Singh declared a conflict of interest with regard to a family member living adjacent to the subject property. (Deputy Mayor Singh left Council Chambers at 1:49 pm.) Deputy to the Deputy Mayor Cavers assumed the Chair. The purpose of this application is to reduce the minimum street frontage in the RS-1 (Single Family Residential-1) zone from 15 m to 6 m to allow the creation of two panhandle lots within a four-lot subdivision. There were no submissions, and no correspondence was received with regard to this application.

CONSIDERATION OF PUBLIC SUBMISSIONS Development Variance Permit Application No. DVP00503 (2135 Tranquille Road) Moved by Councillor Dudy, seconded by Councillor Wallace, that Council authorize the Corporate Officer to issue Development Variance Permit No. DVP00503 for Lot 91, D.L. 253, K.D.Y.D., Plan 1105 (2135 Tranquille Road), to vary Zoning Bylaw No , Division Seventeen, RS-1 (Single Family Residential-1), Section 1703, Regulations, to reduce the minimum street frontage for proposed Lots 3 and 4 from 15 m to 6 m, in accordance with Attachment A to the report dated August 31, 2017, prepared by the Development and Engineering Services Department. (Deputy Mayor Singh returned to Council Chambers at 1:50 pm.) Deputy Mayor Singh resumed the Chair. Variance Application Number Dog Responsibility and Control Bylaw No (5965 Dallas Drive) Moved by Councillor Lange, seconded by Councillor Cavers, that Council authorize a variance to Dog Responsibility and Control Bylaw No to permit three dogs to be kept at 5965 Dallas Drive subject to the conditions as set out in Section 5.1 of Council Policy No. GGA-30. Affirmative: Negative: Deputy Mayor Singh, Councillors Cavers, Dudy, Lange, and Walsh. Councillor Wallace. Development Variance Permit Application No. DVP00493 (2634 Valleyview Drive) Moved by Councillor Wallace, seconded by Councillor Cavers, that Council authorize the Corporate Officer to issue Development Variance Permit No. DVP00493 for Lot 15, Sec. 1, Twp. 20, Rge. 17, W6M, K.D.Y.D., Plan 8262 (2634 Valleyview Drive), to vary Zoning Bylaw No , Division Seventeen, RS-1 (Single Family Residential-1), Section 1703, Regulations, to reduce the minimum lot street frontage for interior lots from 15 m to 6 m to facilitate a panhandle subdivision, in accordance with Attachment A to the report dated September 1, 2017, prepared by the Development and Engineering Services Department.

Page 5 Development Variance Permit Application No. DVP00504 (2042 Sunnycrest Avenue) Moved by Councillor Wallace, seconded by Councillor Dudy, that Council authorize the Corporate Officer to issue Development Variance Permit No. DVP00504 for Lot 12, D.L. 253, K.D.Y.D., Plan 6845 (2042 Sunnycrest Avenue), to vary Zoning Bylaw No , Division Twenty-Four, RT-1 (Two Family Residential-1), Section 2403, Regulations, by reducing the following: a) the minimum lot street frontage from 15 m to 6 m for Lot 1 b) the minimum front yard setback for an accessory building from 6 m to 1.6 m for Lot 1 all in accordance with Attachment A to the report dated September 6, 2017, prepared by the Development and Engineering Services Department. Bonnie Klohn and Jeff McNeil, Working Group on Indigenous Food Sovereignty Re: Wild Salmon Caravan Project Bonnie Klohn and Jeff McNeil, Working Group on Indigenous Food Sovereignty, presented Council with a brief PowerPoint presentation regarding the Wild Salmon Caravan Project. This is the third year for the Wild Salmon Caravan, which will arrive in Kamloops October 11, The program begins with a sunrise ceremony at 7:00 am at Riverside Park and includes a 10:00 am parade in the downtown core, a feast, and entertainment. The presenters invited Council to attend the event. Jim Anderson, Executive Director, Venture Kamloops Re: Update on Activities and Promotions for the Developer Attraction Campaign Jim Anderson, Executive Director, Venture Kamloops, presented Council with a brief PowerPoint presentation regarding the Developer Attraction Campaign. The direction and strategy is to create awareness of the Kamloops market in the Lower Mainland and to target marketing efforts toward a clearly defined opportunity for growth. The Venture Kamloops website s landing page for this initiative has had 745 visits, of which 83.22% were new visitors, and Google ad words have reached 49,000 people since the launch of the campaign in March 2017.

RESPONSE TO DELEGATIONS Bonnie Klohn and Jeff McNeil, Working Group on Indigenous Food Sovereignty Re: Wild Salmon Caravan Project Moved by Councillor Dudy, seconded by Councillor Cavers, that Council authorize a letter of thanks be sent to Bonnie Klohn and Jeff McNeil, Working Group on Indigenous Food Sovereignty, for their presentation on the Wild Salmon Caravan Project. Jim Anderson, Executive Director, Venture Kamloops Re: Update on Activities and Promotions for the Developer Attraction Campaign Moved by Councillor Dudy, seconded by Councillor Lange, that Council authorize a letter of thanks be sent to Jim Anderson, Executive Director, Venture Kamloops, for his presentation on the Developer Attraction Campaign. 8. REPORTS - CHIEF ADMINISTRATIVE OFFICER The Chief Administrative Officer s Report was presented to Council as follows: Closed Council Resolution Brought Forward Award of Transit Supply and Maintenance Contract for Bus Benches Closed Council Meeting - September 12, 2017 Moved by Councillor Dudy, seconded by Councillor Wallace, that Council authorize the signing of the five-year Transit Bus Bench Supply and Maintenance Contract for black bus benches to Creative Outdoor Advertising with the option of 2 five-year extensions. Affirmative: Negative: Deputy Mayor Singh, Councillors Cavers, Dudy, Lange, and Wallace. Councillor Walsh. CARRIED (all of Council was present).

Page 7 Development Permit Application No. DPM00602 (690, 720, and 760 Kingston Avenue) Council received a copy of a report to the Chief Administrative Officer dated September 26, 2017, prepared by the Development and Engineering Services Department to issue a Development Permit to regulate the form and character of a three-storey moving and storage facility located in the Halston Entry Corridor area of the North Shore, in accordance with the North Shore Development Permit Area Guidelines and the I-1 (Light Industrial) zone. Moved by Councillor Lange, seconded by Councillor Wallace, that Council authorize the Corporate Officer to issue Development Permit No. DPM00602 for Lot 1, D.L. 257, K.D.Y.D., Plan (760 Kingston Avenue); Lot 2, D.L. 257, K.D.Y.D., Plan (720 Kingston Avenue); and Lot B, D.L. 257, K.D.Y.D., Plan KAP49278 (690 Kingston Avenue), in accordance with the site plan/landscape plan shown as Attachment A and building elevation shown as Attachment B to the report dated September 26, 2017, prepared by the Development and Engineering Services Department. Development Permit Application No. DPM00614 (1428 Lorne Street East) Council received a copy of a report to the Chief Administrative Officer dated September 26, 2017, prepared by the Development and Engineering Services Department to issue a Development Permit to regulate the form and character of a two-storey service commercial building and landscaping located in the City Centre neighbourhood, in accordance with the City Centre Development Permit Area Guidelines. Moved by Councillor Wallace, seconded by Councillor Dudy, that Council authorize the Corporate Officer to issue Development Permit No. DPM00614 for Lot A, D.L. 234, K.D.Y.D., Plan EPP73688 (1428 Lorne Street East), in accordance with the site and landscape plan show as Attachment A and building elevations shown as Attachment B to the report dated September 26, 2017, prepared by the Development and Engineering Services Department. Heffley Creek Bridge Construction Council received a copy of a report to the Chief Administrative Officer dated September 26, 2017, prepared by the Public Works and Utilities Department to seek Council s approval to award the Heffley Creek Bridge Construction contract.

RECESS Moved by Councillor Wallace, seconded by Councillor Dudy, that Council authorize: a) awarding the construction contract for the Heffley Creek Bridge Construction project to the lowest compliant tender, submitted by Acres Enterprises Ltd., in the amount of $1,830,909.80, excluding GST b) increasing Capital Project No , Heffley Creek Bridge Construction to $2,180,910, using the following funding sources: i) $725,000 (the original project cost) ii) $1,120,000, funded from the General Reserve Fund (to be reimbursed by Disaster Financial Assistance funding when received) iii) $135,910, transferred from Capital Project No Arterial Road Overlays iv) $200,000, transferred from Capital Project No Bridge Rehabilitation c) the Finance Director to update the Financial Plan accordingly The meeting recessed at 2:47 pm. 10. Page REPORTS - CHIEF ADMINISTRATIVE OFFICER (CONTINUED) KGHM Ajax Mine Public Comment Period and Ministers Package Council received a copy of a report to the Chief Administrative Officer dated September 27, 2017, prepared by the Public Works and Utilities Department to seek Council s approval of a formal letter to be sent to provincial and federal environmental assessment agencies during the public comment period currently underway for the proposed KGHM International Inc. (KGHM) Ajax Mine project and a cover letter that will accompany a package to provincial and federal ministers outlining Council s opposition to and concerns with the project. Moved by Councillor Dudy, seconded by Councillor Wallace, that Council authorize: a) a letter be sent to the BC Environmental Assessment Office and the Canadian Environmental Assessment Agency by Tuesday, October 10, 2017, that outlines concerns with the documents available for public comment and restates Council s opposition to the KGHM Ajax Mine project (Attachment A ) b) a cover letter (Attachment B ) and accompanying package of documents that outlines Council s position on the KGHM Ajax Mine project be sent to the BC Environmental Assessment Office; the Canadian Environmental Assessment Agency; the BC Minister of Environment and Climate Change Strategy; the BC Minister of Energy, Mines and Petroleum Resources; the federal Minister of Environment and Climate Change; the Prime Minister; the Premier of BC; the Kamloops-South Thompson Member of the Legislative Assembly (MLA), and the Kamloops-North Thompson MLA, by Friday, October 13, 2017 in accordance with Attachments A and B to the report dated September 27, 2017, prepared by the Public Works and Utilities Department. (KGHM) has not been signed due to the proponent s reluctance to sign the agreement and its choice to withdraw from negotiations with the City, in accordance with Attachment B to the report dated September 27, 2017, prepared by the Public Works and Utilities Department.
