3 1 WATER FRAMEWORK DIRECTIVE (2000/60/EC) JUNE 2004 REPORT 1. Information to be reported in 2004 Article 3 of the Water Framework Directive (2000/60/EC) (also known as the WFD) requires: 1. Member States shall identify the individual river basins lying within their national territory and, for the purposes of this Directive, shall assign them to individual river basin districts. Small river basins may be combined with larger river basins or joined with neighbouring small basins to form individual river basin districts where appropriate. Where groundwaters do not fully follow a particular river basin, they shall be identified and assigned to the nearest or most appropriate river basin district. Coastal waters shall be identified and assigned to the nearest or most appropriate river basin district or districts. 2. Member States shall ensure the appropriate administrative arrangements, including the identification of the appropriate competent authority, for the application of the rules of this Directive within each river basin district lying within their territory. 3. Member States shall ensure that a river basin covering the territory of more than one Member State is assigned to an international river basin district. At the request of the Member States involved, the Commission shall act to facilitate the assigning to such international river basin districts. Member States shall ensure the appropriate administrative arrangements, including the identification of the appropriate competent authority, for the application of the rules of this Directive within the portion of any international river basin district lying within it s territory. Article 3 goes on to require: 7. Member States shall identify the competent authority by the date mentioned in Article Member States shall provide the Commission with a list of their competent authorities and of the competent authorities of all the international bodies in which they participate at the latest six months after the date mentioned in Article 24. For each competent authority the information set out in Annex I shall be provided.

4 2 Article 24 states: Member States shall bring into force the laws, regulations and administrative provisions necessary to comply with this Directive at the latest 22 December They shall forthwith inform the Commission thereof. It can therefore be concluded that Member States are required to inform the European Commission of the identification of river basin districts and competent authorities by 22 June An outline structure for the 2004 report, which the Member States must report to the European Commission by 22 June 2004 (Article 3 and Annex I of WFD) is shown in Table 1.1 below: Section WFD Reference 2. Geographical coverage of the river basin district According to the Guidance on Reporting under the WFD the required information should be provided as a single national map for each layer of geographical information, as shown in the Table provided in Appendix A. All the required information is included on the CD - ROM attached in Appendix B. Please note that no layer is provided for Main Lakes (> 100 km 2 ) and National Border. Cyprus has no lakes > 100 km 2 while the national border is not applicable since Cyprus is an island. The regions given are administrative regions. An additional layer showing the coastline of Cyprus is also provided. One River Basin District has been identified. Hydrographically the island of Cyprus is subdivided into 9 hydrological regions made up of 70 watersheds. There are no rivers with perennial flow. Thus, the whole island is considered as one River Basin District, made up of all the watersheds.

Competent authorities According to the Guidance on Reporting under the WFD Member States should provide: and address of competent authority/ies; Legal status of the competent authority/ies; Digital map of the area of jurisdiction of the competent authority/ies. 6 4 3.2 Legal status of the competent authority A short description/summary of the legal status of the competent authority is provided below: The legislation establishing the competent authority and the legislation laying down the duties of the competent authority in relation to the WFD is the Water Protection and Management Law of 2004 (N.13(I)/2004). The relevant Articles of the Law establishing the competent authority and the River Basin District with effect from 22 December 2003, are articles 4, 5 and 34. The above Law was passed by the House of Representatives on 5 February 2004 and published in the Official Government Gazette on 20 February 2004 (No 3812, pages 85, I(I) - 180, I(I)), with effect from 22 December The Law may be downloaded from the web-site of the Water Development Department at The legislation laying down other duties of the competent authority relevant to the WFD is the Water and Soil Pollution Control Law of 2002 (N.106(I)/2002) and the Nature and Wild Life Protection and Management Law of 2003 (N.153(I)/2003). Both Laws may also be downloaded from the web-site of the Water Development Department at the same address as above. 3.3 Map showing geographic area of jurisdiction of competent authority The competent authority has responsibility over the whole River Basin District. Please note, however, that according to the provisions of Article 1 of Protocol No 10 on Cyprus, the application of the acquis is suspended in those areas of the Republic of Cyprus in which the Government of the Republic of Cyprus does not exercise effective control. Furthermore, the Memorandum of Understanding between the Government of the United Kingdom of Great Britain and Northern Ireland and the Government of the Republic of Cyprus concerning responsibility for the implementation of the Protocol on the Sovereign Base Areas of Akrotiri and Dhekelia in Cyprus provides for the application of the WFD in the Sovereign Base Areas of Akrotiri and Dhekelia in Cyprus. An additional layer showing the Sovereign Base Areas referred to above is included on the CD - ROM attached in Appendix B. 3.4 Responsibilities of the competent authority In accordance with the Water Protection and Management Law of 2004 (N.13(I)/2004) the competent authority (MANRE) is responsible for all the roles specific to the WFD in the River Basin District except for the establishment of the programme of measures and the production of the river basin management plans. According to articles 4(3), 19 and 22 of the Law the establishment of the programme of measures and the production of the river basin management plans

7 are coordinated by the competent authority and approved by the Council of Ministers of the Republic of Cyprus (CoM). Table 1.3 below lists the roles that are to be carried out by the competent authority and the Council of Ministers. In case any of the above responsibilities are assigned according to the Law to another competent authority, the Commission will be informed within three months of the change coming to effect, in accordance with Article 3(9) of the WFD and Article 4(4) of the Law. 3.5 Details of memberships and international relationships This requirement is not applicable for Cyprus. 5
