1 BIRCHDALE TOWNSHIP REGULAR MEETING MINUTES TUESDAY, APRIL 25, :00 P.M. 1. Call to Order/ Pledge of Allegiance/Roll Call Chair Jim Carstens called to order the regular meeting of the Birchdale Township Board at 8:00 p.m. on Tuesday, April 25, 2017 at the Birchdale Town Hall. The Pledge of Allegiance was recited. Present were Supervisors Jim Carstens, Larry Bebus, Arnie Berscheid, Dale Ahrens and Marc Brinkman, Treasurer Marlene VanHavermaet and Clerk Jackie Bauer. Also in attendance were Pat Karnes, Rod Karnes, Laura Boucher and Erv Herdering. 2. Approval of Agenda A motion was made by Supervisor Berscheid, seconded by Supervisor Ahrens, and unanimously carried to approve the agenda. 3. Approval of Minutes - A motion was made by Supervisor Ahrens, seconded by Supervisor Brinkman, and unanimously carried to approve the March 28, 2017 regular meeting minutes as amended. 4. Approval of Treasurer s Report - Treasurer VanHavermaet presented the April Treasurer s Report. A motion was made by Supervisor Brinkman, seconded by Supervisor Ahrens, and unanimously carried to accept the Treasurer s Report. 5. Approval of Bills - Next presented was the list of bills for the month of April to be considered for payment. A motion was made by Supervisor Brinkman, seconded by Supervisor Berscheid, and unanimously carried to approve payment of the bills in the amount of $6, (See attached list of bills). 6. Residents Comments 7. Reports/Requests/Presentations 8. Township Road Report 9. Unfinished Business a. Morning View Cartway Request Supervisor Carstens reported on a meeting that he attended or the Todd County Board of Adjustment regarding residents who are seeking to put in a cartway for access to property that is along Birch Lake. The residents are seeking an easement

2 so that they can add a new cartway. Currently, there is property that has no road access so by adding a new cartway, all residents will have access. The residents approached Supervisor Carstens asking about the upkeep of the cartway or any possible funding to assist with plowing or grading. Clerk Bauer did consult with the Township Attorney Troy Gilchrist and he strongly advised that the Township not become involved in any type of upkeep of a cartway. Cartways are access roads that are not township roads but are considered private and maintained by the residents who live along the cartway. Supervisor Carstens will be meeting with the residents again to assist them with any questions or concerns regarding adding a new cartway. He will update the board at the next meeting. b. Angler Drive and 275 th Reclaiming Project Clerk Bauer presented the contract for entering into an agree with Grey Eagle Township and Todd County Engineering for the 2019 Reclaiming Project for Angler Drive. Additionally, the Township could also include tarring 275 th Avenue in Birchdale Township and Grey Eagle Township has been awarded a $200, grant from the MN Department of Natural Resources State Road Account to complete this work. Todd County will assist the Township with this project. Engineering costs will be the responsibility of the townships. A small part of Angler Drive also runs into Grey Eagle Township so this is why they are also included in this agreement. A motion was made by Supervisor Berscheid, seconded by Supervisor Brinkman and carried to approve signing this contract to go ahead with the reclaiming of Angler Drive by Todd County in Due to living along Angler Drive, Supervisor Larry Bebus abstained from voting. The Board then discussed the possibility of tarring 275 th Avenue. This road does get a lot of traffic. Supervisor Carstens stated that he would like to see how Angler Drive goes first with Todd County completing the work before going forward with 275 th Avenue. The Board agreed. 10. New Business a. The Board then opened the quotes received from Herdering, Inc and Central Minnesota Dust Control for 2017 Dust Control. Quote information had been sent to three companies (Herdering Inc., Tri-City Paving and Central MN Dust Control) and a notice was posted on the Township s website and Town Hall bulletin board. The Herdering, Inc. quote was as follows: Magnesium Chloride Dust Guard at $.67/per foot Central MN Dust Control quote was as follows: Magnesium Chloride at $.57/per foot

3 Liquid Magnesium Chloride at $.60/per foot Supervisor Berscheid stated that Mr. Erv Herdering has been applying dust control on the township roads over the last few years and has been adding more and more gravel roads in the township. The Board has been very happy with his work. A motion was made by Supervisor Berscheid, seconded by Supervisor Brinkman, and unanimously carried accepting the quote from Herdering, Inc. for 2017 Dust Control at the cost of $.67/foot for magnesium chloride product as quoted. Supervisor Berscheid stated that he will work with Mr. Herdering on what additional roads the Township would like dust control applied to. b. The Board then opened the quotes received from Astech Corporation and Midwest Asphalt Maintenance for 2017 Crack Filling. Quote information had been sent to two companies (Astech Corporation and Midwest Asphalt Maintenance) and a notice was posted on the Township s website and Town Hall bulletin board. Astech Corporation: $1.65 per pound Midwest Asphalt Maintenance: $1.50 per pound Supervisor Berscheid stated that Midwest Asphalt Maintenance had contacted him to view the roads and they stated that they would bring all of the materials for crack filling at one time. Supervisor Carstens stated that they have a good reputation also. A motion was made by Supervisor Brinkman, seconded by Supervisor Ahrens, and unanimously carried accepting the quote from Midwest Asphalt Maintenance for 2017 Crack Filling at the cost of $1.50 per pound. Also, Supervisor Berscheid stated that crack filling will not be done on Angler Drive as we will be doing the reclaiming work in b. Clerk Bauer presented the proposed quote information and form regarding Brush Cutting. A motion was made by Supervisor Brinkman, seconded by Supervisor Bebus and unanimously carried to approve the quote information and form and authorize seeking sealed quotes for Brush Cutting. Clerk Bauer was directed to send the quote information and form to Cutting Edge Tree Service LLC, Central Applicators Inc., Minnesota Clearing, Hoffman Tree Service and Carr s Tree Service and to post the information on the Township website and Township bulletin board. Quotes to be received until 8:00 p.m. Tuesday, May 30, 2017 and the quotes to be opened at the 8:00 p.m. Board meeting. c. Clerk Bauer presented the proposed quote information and form regarding Ditch Mowing. A motion was made by Supervisor Carstens, seconded by Supervisor Berscheid, and unanimously carried to approve the quote

4 information and form and authorize seeking sealed quotes for Ditch Mowing. Clerk Bauer was directed to send the quote information and form to Mid-Minnesota Excavating, and High Road and to post the information on the Township website and Township bulletin board. Quotes to be received until 8:00 p.m. Tuesday, May 30, 2017 and the quotes to be opened at the 8:00 p.m. Board meeting. d. Clerk Bauer presented the proposed quote information and form regarding Brush/Weed Spraying. A motion was made by Supervisor Carstens, seconded by Supervisor Ahrens, and unanimously carried to approve the quote information and form and authorize seeking sealed quotes for Brush/Weed Spraying. Clerk Bauer was directed to send the quote information and form to Carr s Tree Service and Central Minnesota Applicators and to post the information on the Township website and Township bulletin board. Quotes to be received until 8:00 p.m. Tuesday, May 30, 2017 and the quotes to be opened at the 8:00 p.m. Board meeting. 11. Informational Items a. Clerk Bauer presented a copy of letter that she drafted per Supervisor Berscheid that was requested by Resident Ray Olchefeski seeking the Township s approval for him to cut the curb area on Angler Drive to construct a drive-way. The Board had approved that Mr. Olchefseski could do this at the March, 2017 Annual Meeting. Supervisor Berscheid directed Clerk Bauer to develop the letter and send it to Mr. Olchefeski which she did. b. Clerk Bauer presented correspondence regarding a Special Assessment Request Forms for Main Street Title & Closings LLC,Angie Tschida, County Road 98, Grey Eagle, MN Clerk Bauer responded that there were no assessments from Birchdale Township. c. Clerk Bauer presented a Cornerstone Gift Card Donation from Dan and Julie Johnson for the Big Birch Lake Association Residents Dan and Julie Johnson contacted Supervisor Jim Carstens with a donation for the Big Birch Lake Association. Supervisor Berscheid will give this to the Association. 12. Officers Comments a. Supervisor Ahrens stated that a culvert along Almond Drive which is past the cemetery needs to be cleaned out. The Board asked if Mr. Herdering could complete this work. A motion was made by Supervisor Ahrens, seconded by Supervisor Berscheid and unanimously approved to authorize Mr. Herdering to clean out the culvert along Almond Drive at a cost not to exceed $

5 b. Resident Rod Karnes, who was in attendance, asked how the Board determines which roads receive dust control. Supervisor Berscheid explained that the Board is currently attempting to have dust control applied to all township roads. Resident Karnes also asked if 275 th Avenue was going to be tarred. He stated that one of the Todd County Commissioners had stated that 275 th would be tarred by Birchdale Township. Supervisor Brinkman stated that we are going to wait until Angler Drive is completed in 2019 and then will determine if 275 th Avenue should be tarred. Resident Karnes stated that 275 th Avenue does have some areas that might need some repair work. 13. Adjournment Resident Laura Boucher stated that there is a lot of gravel in the road ditches from snow plowing. Supervisor Carstens stated that it was a difficult year because of the thawing and freezing that had occurred due to the weather. Resident Boucher also stated that it seems like the middle part of the road doesn t always get plowed as much and that maybe the blade angle should be changed depending on the road. Mr. Erv Herdering, who was in attendance and was the contractor who handled the 2016 snow plowing season for the township listened to her concerns. The Board asked Clerk Bauer to add this concern under the Calendar of Events when the Board reviews the Birchdale Township Snow Plow Policy. With no further business, a motion was made by Supervisor Brinkman, seconded by Supervisor Ahrens, and unanimously carried to adjourn the meeting at 9:07 p.m. Respectfully Submitted, Jackie Bauer Birchdale Township Clerk
