1 District of Metchosin Minutes Council Meeting January 22, 2018 at 7:00 p.m. Council Chamber Metchosin Municipal Hall Present: Mayor Ranns in the Chair; Councillors Gramigna, Milne, Kahakauwila and MacKinnon. Also present was L. Urlacher, Chief Administrative Officer and T. Van Swieten, Deputy Corporate Officer The meeting was called to order at 7:00 p.m. Closed Portion, Exclusion of the Public Moved and Seconded by Councillors Gramigna and Milne that the public be excluded under 1(c) labour relations or other employee relations; 1(l) discussions with municipal officers and employees respecting municipal objectives, measures and progress reports for the purposes of preparing an annual report under section 98 [annual municipal report]; 1(g) litigation or potential litigation affecting the municipality; 1(k) negotiations and related discussions respecting the proposed provision of a municipal service that are at their preliminary stages and that, in the view of the council, could reasonably be expected to harm the interests of the municipality if they were held in public. The closed portion of the meeting called to order at 6:00p.m. The open portion of the meeting was called to order at 7:00p.m. 1. Agenda, Additions and Approval Moved and Seconded by Councillors Gramigna and Milne that Council approve the agenda as amended with the addition of Rise and Report under New Business and the supplemental information, disposal policy, to the report on 7b) Purchase of New Dodge 5500 Crew Cab Chassis. 2. Public Participation Patti Whitehouse, resident, stated she likes that the minutes of meetings are posted on the website and asked if Wi-Fi could be available in the Council Chambers for real time fact checking. Gail Dalzell, property owner, stated that short term vacation rental owners do not claim Home Owner Grants, so do pay more property taxes than people that live in their homes and also stated that less damage is done to homes that do short term rentals rather than long term rentals. Ms. Dalzell also expressed concerns over the costs involved with the CRD Bylaw No. 4093, Transportation Services Establishment and urged Council to not support it. Ken Farquharson, resident, stated that there should be a Regional Transportation Plan to share expenses for regional infrastructure and commented that the Johnson Street Bridge costs should have been shared regionally because it is a regional asset. There should be some recognition of sharing of the regions infrastructure.

2 District of Metchosin January 22, Adoption of the Minutes Moved and Seconded by Councillors Gramigna and MacKinnon that Council adopt the minutes of the Council meeting January 8, Receipt of Minutes Moved and Seconded by Councillors Milne and Kahakauwila that Council receive the minutes of the Finance and Environment Committee, January 8, Moved and Seconded by Councillors Kahakauwila and MacKinnon that Council receive the minutes of the Highways & Public Works Committee, January 8, Moved and Seconded by Councillors Gramigna and Milne that Council receive the minutes of the Special Planning Committee, January 8, Councillor Gramigna thanked the recording secretary for the extra details put into the Planning Workshop minutes, January 8, 2018, on Short Term Vacation Rentals. 5. Mayor s Report Mayor Ranns asked Councillor Gramigna to report on the Planning Workshop on Short Term Vacation Rentals. Councillor Gramigna stated it was a very good turnout, different views were expressed and the minutes reflect those views. The Planner was given direction from the Committee and will report back at a future Planning meeting. Councillor Gramigna also stated that it was very clear from the workshop that there is a problem with short term vacation rentals on Sandgate Road. Mayor Ranns reported that New England is once again in the Super bowl, and if they win, we can anticipate Councillor Gramigna will be wearing his Patriots jersey to the following meeting. Mayor Ranns stated his disappointment on the CRD decision made last Wednesday to cease the Integrated Resource Management (IRM) Program and go ahead with a composting facility at Hartland to deal with the biomass and kitchen scraps. 6. Business Arising a) SIRC Service Agreement Renewal Moved and Seconded by Councillors Milne and Kahakauwila that Council authorize the Mayor and CAO to execute the SIRC Service Agreement for the period of January 1, 2018 to December 1, 2021, as amended. b) AVICC Resolution to Reinstate Three Year Term Moved and Seconded by Councillors Milne and MacKinnon that Council endorse the following resolution to go to AVICC in 2018.

3 District of Metchosin January 22, 2018 WHERE AS four year terms are onerous for many in small communities, where being an elected official is not a well-paid position, even though the demands of the position can be stressful, time-consuming, and of great consequence to their communities, and; WHERE AS three year terms allow greater accountability to residents, who are able to show, through elections, their regards for the directions their local governments are taking; THEREFORE be it resolved that the provincial government reinstate three year local government terms. c) Purchase of New Dodge 5500 Crew Cab Chassis A discussion ensued as to documentation of expenditures. It was agreed that the detailed amounts for the other two quotes for the new vehicle would come forward at the Budget Workshop on January 25 th, Moved and Seconded by Councillors Kahakauwila and Milne that Council direct staff to replace Unit 43, a rebuilt Dodge ton flatbed, crew cab truck with a new vehicle of comparable size and capacity, at a total cost and not exceeding (including custom-built deck, etc.) $80,000, not including GST. And that staff adjust the 2018 Capital Budget by moving 2018 Item Single Axel Dump ($150,000) to 2019 and moving 2019 Item PW 2 ½ Ton PU ($80,000) up to d) Disposal of Unit 43, Rebuilt Dodge 5500 Moved and Seconded by Councillors Kahakauwila and Gramigna that Council approve the disposal by sale, of Unit 43: a rebuilt Dodge 5500, on an as is, where is basis, at a price of not less than $6, Reports for Action a) Proline Property Management Agreement Moved and Seconded by Councillors Gramigna and Kahakauwila that Council authorize the Mayor and CAO to execute the Proline Property Management Agreement. 8. Reports for Information a) District of Metchosin Public Communication Reports, December 2017 Moved and Seconded by Councillors Kahakauwila and Gramigna that Council receive the District of Metchosin Public Communication Report, December b) District of Metchosin Building Inspection Department Report, December 2017 Moved and Seconded by Kahakauwila and Gramigna that Council receive the District of Metchosin Building Inspection Department Report, December 2017.

4 District of Metchosin January 22, 2018 c) CRD Monthly Bylaw and Animal Care Services Report, December 2017 Moved and Seconded by Councillors Kahakauwila and Gramigna that Council receive the CRD Monthly Bylaw and Animal Care Services Report, December Correspondence a) West Shore RCMP Detachment Re: 2017/18 Annual Performance Plan/Priorities Council discussed priorities and objectives for the 2017/18 year, including moving property crime up higher on the list of priorities and the school zone by Hans Helgesen School. Moved and Seconded by Councillors Kahakauwila and MacKinnon that Council invite Insp. Larry Chomyn from West Shore RCMP Detachment to a future Council meeting to further discuss Metchosin s policing priorities. 10. Bylaws a) CRD Bylaw No. 4093, Capital Regional District Transportation Services Establishment Bylaw No. 4093, 2018 Mayor Ranns opened the subject for discussion. Council discussed the following: Supportive of transportation Concerns over regional trails going from the Parks Board to the Transportation Service Facilitating a good discussion and moving forward with better transportation modes Another layer of CRD trying to control the West Shore The West Shore has changed and matured and needs to be looked at more fairly There are already bodies in place that are not utilized to their full potential. No need for another layer to come up with the same or worse options. Seems to be more about studies than moving forward and the budgeting seemed arbitrary Supportive of some of the ideas but not the right way to move forward Parks need to be seen under a parks lens not a transportation lens. Parks don t belong in engineering. CRD was going to pave Lochside Trail to facilitate bike traffic. That would have cut out equestrian element. This was a huge concern. Director Mike Hicks went out and looked at it through a parks lens and stopped CRD from paving it. Transportation Grant Submissions CRD absorbing all the grants, taking them from individual municipalities. Losing confidence in the CRD s ability to administrate this There would not be a density problem if the density went to the core, not spread out, there wouldn t be as much of a transportation problem. As long as the outlying municipalities continue to densify as fast as they are doing, there will always be a transportation issue. Moved and Seconded by Councillors Kahakauwila and Milne that Council oppose the Capital Regional District Transportation Services Establishment Bylaw No. 4093, 2018 due to the following reasons: Trails should stay under Parks jurisdiction. CRD Parks should not be administering this program. Do not agree with the AAP process. It should be done on a municipality to municipality basis.

5 District of Metchosin January 22, New Business a) West Shore Parks and Recreation (WSPR) Governance Study (Released from closed meeting) Mayor Ranns stated that a motion was passed by the WSPR Committee to hire J.R. Huggett Company Corp. in a sole source contract to do a preliminary study to help resolve the functioning of WSPR. Sole sourcing was deemed appropriate because it was within the discretionary authority of each municipality. This is a preliminary study to determine whether it is worthwhile spending considerably more for a full study. Moved and Seconded by Councillors Milne and Kahakauwila that Council approve the hiring of J.R. Huggett Company Corp. in a sole source contract to review the governance and management of the recreational facilities operated by the West Shore Parks and Recreation Society contingent upon; a) Mr. Huggett meeting with all Mayor s, Chief Administrative Officers and Chief Financial Officers as part of item 3 in the work program; and b) The draft (item 6) and final (item 7) reports being presented first to the owners Group with the Chair of the West Shore Parks and Recreation Society (Ed Watson) in attendance prior to presentation to the West Shore Parks and Recreation Society Board of Directors. And that Council approve our portion of the costs in the amount of $2,744.00, plus our portion of reasonable travel costs. Council agreed to send the letter to the other participating municipalities. 12.
