Cooper Media Present: Abbotsford News and Rogers Cablesystems Public Present: CALL TO ORDER The Chairman called the meeting to order at 4:05 p.m. 2. ADOPTION OF MINUTES.1 Regular Meeting of Council Minutes - May 27, 1996 Moved by Councillor Wiebe, seconded by Councillor Sweeney, that the minutes of the Regular meeting of Council held May 27, 1996, be adopted. R CARRIED. 3. BUSINESS OUT OF MINUTES.1 C.P. Ediger Limited, 1639 and 1645 Gladwin Road - Development Variance Permit No (D96-11) Report No. DEV dated June 3, 1996, from the Assistant Planner, recommended approval of Development Variance Permit No The permit would allow construction of an accessory home occupation use 1.5 m from an interior lot line and construction of a residence 1.9 m from an interior lot line, rather than the required 3 m. The owners have agreed to the contents of the permit, and owners and occupiers of surrounding properties had been notified that they may comment on the proposal.

Moved by Councillor Warawa, seconded by Councillor Funk that, as recommended in Report DEV No dated June 3, 1996, from the Assistant Planner, Development Variance Permit No be approved for issuance. R CARRIED. Opposed: Councillor Boyes.2 Avex Construction Ltd West Railway Street - Development Permit No (D96-D6) Report No. DEV dated June 5, 1996, from the Senior Planner, recommended approval of Development Permit No The permit would allow construction of an auto service centre containing four one-storey buildings including a gas barf convenience store, reduce the interior lot line setback to 0.0 m, allow a gas bar canopy to have a 21 m setback, and relax the 1.0 m wide landscaping requirement to 0.0 m for a three parking space width. The owners have agreed to the contents of the permit, and owners and occupiers of surrounding properties had been notified that they may comment on the proposal. There were no comments or questions. Moved by Councillor Boyes, seconded by Councillor Funk that, as recommended in Report No. DEV dated June 5, 1996, from the Senior Planner, Development Permit No be approved for issuance, subject to provision of the required security of $11,500. R CARRIED.

3 4:05 p.m. in the Matsqui Centennial Auditorium Page 3.3 Chard Developments, 1100 Sumas Way - Development Variance Permit No (D95-38) Report No. DEV dated June 5, 1996, from the Manager, Current Development, recommended approval of Development Variance Permit No The permit would: (1) reduce the required lot line setbacks of 7.5 m to: (a) 3.0 m along the south side of the proposed Zellers building; (b) 2.1 m along the north side of the Anchor C building; and (c) 0.0 m along the south side of the CRUD building; (2) reduce the drainage ditch setback to 9.1 m, rather than the required 15 m; (3) eliminate the required 3.0 m landscaping screen between the parking lot and the adjacent road allowance; (4) increase the permitted primary sign height to m and the secondary sign height to 10 m, rather than the required 7.5 m; and (5) increase the permitted primary sign area to 114 m 2 and secondary sign area to 50 m 2, rather than the required 20 m 2 and 10 m 2, respectively. The owners have agreed to the contents of the permit, and owners and occupiers of surrounding properties had been notified that they may comment on the proposal. There were no comments or questions. Moved by Councillor Boyes, seconded by Councillor Funk that, as recommended in Report No. DEV dated June 5, 1996, from the Manager, Current Development, Development Variance Permit No be approved for issuance, subject to provision of the required security of $148,172. R CARRIED. 4. DELEGATIONS.1 S. Pincott - Minister's Environmental Award Nominee The Mayor congratulated S. Pincott on being selected by the Minister of Environment, Lands and Parks to receive a 1996 Minister's Environmental Award.

4 :05 p.m. in the Matsqui Centennial Auditorium Page 4 Mrs. Pincott thanked the Mayor and Council for nominating her for the award, and gave an account of her trip to Victoria to accept it. She said that the award really belonged to all the members of the Backyard Habitat Program, who are working hard to provide a refuge for wildlife within the City. Moved by Councillor Wiebe, seconded by Councillor Warawa, that the delegation of S. Pincott be received. R CARRIED. 5. CONSENT AGENDA 5.0 BY-LAWS TO BE ADOPTED The City Clerk noted that By-laws Nos and have been deferred due to unresolved servicing issues. Moved by Councillor Warawa, seconded by Councillor Boyes, that adoption of the following by-laws be dealt with individually. R CARRIED..1 Moved by Councillor Funk, seconded by Councillor Sweeney, that By-law No. 3870, cited as "Zoning By-law, 1985, Amendment By-law No. 510", now be adopted. R CARRIED. Councillor Boyes declared a conflict of interest and left the meeting at 4:20 p.m.. 2 Moved by Councillor Warawa, seconded by Councillor Wiebe, that By-law No , cited as "Matsqui Official Community Plan, Amendment By-law No. 190", now be adopted. R CARRIED.

Councillor Boyes returned to the meeting at 4:24 p.m..4 Moved by Councillor Funk, seconded by Councillor Wiebe, that By-law No , cited as "District of Abbotsford Zoning By-law No , Amendment By-law", now be adopted. R CARRIED. Opposed: Councillors Boyes and Warawa.5 Moved by Councillor Warawa, seconded by Councillor Boyes, that By-law No , cited as "Matsqui Zoning By-law, 1985, Amendment By-law No. 556", now be adopted. R CARRIED..6 Moved by Councillor Wiebe, seconded by Councillor Warawa, that By-law No , cited as "Matsqui Official Community Plan, Amendment By-law No. 198", now be adopted. R CARRIED.

Transit enclosing the year-end financial and ridership performance summaries for the Central Fraser Valley Conventional, including the year-end financial and ridership performance summaries for the Central Fraser Valley Conventional and Custom Transit systems;.12 Correspondence from the B.C. Utilities Commission advising that an inquiry will be undertaken with respect to gasoline pricing;.13 Correspondence dated May 27, 1996, from the Fraser Valley Regional Library advising that newly-elected Council members will have the opportunity to vote on the 1997 F.V.R.L. budget;.14 Correspondence dated May 29, 1996, from the Abbotsford Chamber of Commerce expressing appreciation for the City's support of the "Supplier Opportunities Forum '96";.15 Correspondence dated May 28, 1996, from the Abbotsford Gaiters Running Club thanking the City for assisting the Club in its fund-raising run held May 11, 1996;.16 Correspondence from U.B.C.M. regarding: (1) Contaminated Sites Regulation - Expert Review Panel; (2) Gaming Expansion Update; and (3) Update from the U.B.C.M. Aboriginal Office; and.17 F.C.M Consolidated Response Book. R CARRIED.

8 :05 p.m. in the Matsqui Centennial Auditorium Page 8 With regard to item , one Council member pointed out that net municipal shares for transit are increasing and the transit systems appear to be under-utilized. He suggested that perhaps transit fares should be increased. 6. REPORTS (STAFF/COMMITTEES) None. 7. BY-LAWS.1 By-law No , Development Cost Charges Imposition By-law, 1989, Amendment By-law No.7 - Amends Rural Road Development Cost Charges Moved by Councillor Sweeney, seconded by Councillor Warawa, that By-law No , cited as "Development Cost Charges Imposition By-law, 1989, Amendment By-law No.7", now be introduced and read a first, second, and third time. R CARRIED. Opposed: Councillor Funk.2 By-law No , Abbotsford Zoning By-law, Creates New Zoning By-law for the City of Abbotsford Moved by Councillor Sweeney, seconded by Councillor Lee, that By-law No , cited as "Abbotsford Zoning By-law, 1996", now be introduced and read a first time. One Council member suggested that the definitions of "Slaughterhouse" and "Poultry Processing Use" be further clarified to avoid confusion. He opposed the combining of Neighourhood Pub Use with Cabaret Use and the removal of the 1/ 2-mile from a major road requirement from Section 620. The motion was then put and R CARRIED. NEW BUSINESS.1 Matsqui Trail - Greater Vancouver Regional District ( and ) Moved by Councillor Sweeney, seconded by Councillor Lee that, as recommended in Report No. P&R dated June 5, 1996, from the Director of Parks and Recreation, an assignment of the Matsqui Trail agreement to the Greater Vancouver Regional District be approved, and the Mayor and Clerk be authorized to execute all documents related to this agreement. R CARRIED. Opposed: Councillor Funk.2 Smoking Ban - Referendum ( ) Moved by Councillor Funk, seconded by Councillor Boyes, that correspondence dated May 21, 1996, from the District of Mission, urging the City of Abbotsford to conduct a referendum on a proposed smoking ban in conjunction with the 1996 local government election, be received. R CARRIED..3 The Royal Canadian Legion/The Royal Westminster Regiment 1922 Army Cadets - Request for Funds ( ) Moved by Councillor Funk, seconded by Councillor Boyes, that correspondence dated May 29, 1996, from The Royal Canadian Legion, on behalf of The Royal Westminster Regiment 1922 Army Cadets, requesting a donation of $5,000 to help defray costs of repairs to Aberdeen Hall, be received. R CARRIED.

10 :05 p.m. in the Matsqui Centennial Auditorium Page 10.4 Canada Day Committee - Parade ( ) Moved by Councillor Wiebe, seconded by Councillor Sweeney that, as requested in correspondence dated June 4, 1996, from the Canada Day Committee, permission be granted to conduct the annual Canada Day Parade on July 1, 1996, subject to submission of insurance documents naming the City as an additional insured. R CARRIED..5 Mt. Lehman Community Association - Canada Day Parade ( and ) Moved by Councillor Boyes, seconded by Councillor Funk that, as requested in correspondence dated May 30, 1996, from the Mt. Lehman Community Association: (1) permission be granted to conduct the annual Canada Day Parade on July 1, 1996, subject to submission of insurance documents naming the City as an additional insured; (2) the Abbotsford Police to supervise and lead the parade; and (3) Mayor Ferguson to participate in the parade. R CARRIED. Opposed: Councillors Sweeney and Wiebe The request had included a $500 donation which was paid in Abbotsford Police Challenge Run - September 28, 1996 ( ) Moved by Councillor Warawa, seconded by Councillor Boyes that, as requested in correspondence dated February 2, 1996, from the Abbotsford Police Department, permission to conduct the Abbotsford Police Challenge Run on September 18, 1996, be granted, subject to submission of insurance documents naming the City as an additional insured. R CARRIED.

11 :05 p.m. in the Matsqui Centennial Auditorium Page 11.7 Treaty Advisory Committee Meeting ( ) Councillor Boyes gave a brief report on the U.B.C.M. Workshop for Treaty Advisory Committee members he attended recently. He suggested that roles and relationships needed to be identified in order to maintain the credibility and integrity of the process.. 8 Trek for Unity Councillor Boyes advised that, on behalf of the City, he met with the Trek for Unity, sponsored by the Town of Gambo, Newfoundland, birthplace of J.R. Smallwood, and by the Gambo Lions Club. Mr. Lawrence Lush is riding a bicycle across Canada to raise funds for the erection of a sculpture of Smallwood. He will be departing Victoria on June 8, 1996, and travelling along the TransCanada Highway. Donations of $500 or more will be recognized on a plaque. Councillor Boyes stressed the impact that Quebec separation would have on Newfoundland.. 9 John Pool Construction/Kruk Subdivision, th Avenue, Huntingdon ( S94-836) The Mayor advised that some difficulties have arisen with the Pool Construction development at th Avenue, Huntingdon. Moved by Councillor Gibson, seconded by Councillor Sweeney, that the matter be referred to staff for a report at the next Executive Committee meeting. Moved by Councillor Funk, seconded by Councillor Sweeney, that the motion be amended by adding that the matter be resolved in accordance with the wishes of Council. Timing was stressed as an important factor, and Council members indicated that they would like to see this matter finalized once and for all. The mover and seconder agreed to withdraw the amendment. The motion was then put and R CARRIED.
