Future Land Use Amendments with Zoning Applications 3.A.1 Boca Municipal Golf Course (LGA ). Planning Commission/LPA Recommendation. Approval with modified conditions (10% workforce onsite, offsite, or in lieu) as recommended by PLC BCC ACTION: Adopt with conditions, motion by Comm. Abrams, seconded by Vice Mayor Bernard, passed in a 6 to 1 vote (with Comm. Burdick dissenting) at the October 31 st public hearing. The amendment was presented at the hearing with the zoning applications. Board discussion included comments regarding concern for traffic, and comments regarding the support for workforce housing. A representative of the City of Boca Raton spoke in support. Three members of the public spoke regarding concerns for the loss of property value due to the removal of the golf course view. Ord A.2.a ABN/ZV/PDD/W (Boca Raton Golf Course) (Control ) ABN: To adopt a resolution approving a Development Order Abandonment to abandon a Special Exception (SE) to allow a Public Golf Course and Recreation Facilities and to abandon a SE to amend the Site Plan for a Public Golf Course and Recreation Facilities, to include a Commercial Radio, Television, Microwave, Transmission and Relay Station, and Tower. Board Decision: Approved a Development Order Abandonment by a vote of PDD: To adopt a resolution approving an Official Zoning Map Amendment to allow a rezoning from the Agricultural Residential (AR) Zoning District to the Planned Unit Development (PUD) Zoning District. Board Decision: Approved a Type 2 Waiver (with conditions) by a vote of 3.A.2.b PCN (Boca Raton Golf Course) (Control ) PCN: Administrative Inquiry Pursuant to the County's Unified Land Development Code, the developer, GL Homes, is required to provide a 3.86-acre public civic site. The developer has proposed to provide a 0.29-acre civic site in the southeast comer of the PUD on which the County intends to construct a 500-foot radio communication tower. The developer and PREM have negotiated a cash out payment of $200,000 in lieu of locating the balance of the civic site land requirement (3.57-acres) on the Master Plan. Board Decision: Approved the Boca Raton Golf Course PUD 3.57-acre a civic site cash-out payment in the amount of $200,000 with the funds allocated to the construction of a selfcollapsing communications tower. 3.A.2.c ABN/Z/CA/W (Boca Raton Cell Tower) (Control ) Z: To adopt a resolution approving an Official Zoning Map Amendment to allow a rezoning from the Agricultural Residential (AR) Zoning District to the Public Ownership (PO) Zoning District, with a Conditional Overlay Zone (COZ). Board Decision: Approved an Official Zoning Map Amendment with a Conditional Overlay Zone (with conditions) by a vote of CA: To adopt a resolution approving a Class A Conditional Use to allow a Self Support/Lattice Tower. Board Decision: Approved a Class A Conditional Use (with conditions) by a vote of W: To adopt a resolution approving a Type 2 Waiver to allow a reduction of the required setback. Board Decision: Approved a Type 2 Waiver (with conditions) by a vote of A.2.d DEV (Boca Raton Cell Tower) (Control ) DEV: to eliminate required landscape buffers and to allow a reduced access drive. Board discussion centered on the provision of workforce housing, the status of signalization of the intersection of Polo Road and Lake Worth Road, the sale of the property from FDOT, and need for continued efforts to secure a connection between the subject site and Polo Road through coordination with area land owners, including direction for staff to consider bringing back the development order for the Fields of Gulfstream site. Eight members of the public, including representatives from the Lake Worth Coalition, spoke in opposition to the density, inconsistency with the neighborhood plan, and traffic. A letter was submitted for the record. Ord A.4.a. PDD/CA (Lake Worth Royale) (Control ) PDD: to allow a rezoning from the Residential Transitional (RT) Zoning District to the Planned Unit Development (PUD) Zoning District. BCC Decision: Approved an Official Zoning Map Amendment (with conditions) by a vote of 3.A.4.b. Z/CA (Allie Polo Estates) (Control ) Z: to allow a rezoning from the Residential Transitional (RT) Zoning District to the Commercial General (CG) Zoning District. BCC Decision: Approved an Official Zoning Map Amendment (with conditions) by a vote of CA: to allow a Type 1 Restaurant with a Drive-thru, and a Day Care General. Board Decision: Approved a Class A Conditional Use (with conditions) by a vote of 3.A.5. Resort Lifestyle Communities (LGA ). Planning Commission/LPA Recommendation. 4 3.B. Future Land Use Amendments without Zoning Applications 3.B.1. Haley Farms Commercial (LGA ). BCC Action: Adopt with conditions, motion by Comm. Valeche, seconded by Vice Mayor Bernard, passed in a 7 to 0 vote at the October 31 st public hearing. Board discussion centered on the continued efforts to secure a connection between Hooks Road and Polo Road through coordination with area land owners. One member of the public representing Pulte Homes spoke in support of the addition of a condition of approval to require connectivity from Hooks Road to Polo Road on an adjacent property that is not within the amendment site but owned by the applicant. Ord B.2. Town Commons MLU (LGA ). 3.C. BCC Action: Adopt with conditions, motion by Comm. Abrams, seconded by Comm. Kerner, passed in a 7 to 0 vote at the October 31 st public hearing. There was minimal Board discussion and no public comment. Ord County Initiated Text Amendments 3.C.1 Residential Future Land Use Designations. Staff Recommendation. Approval Planning Commission/LPA Recommendation. Approval BCC Action: Adopt, motion by Comm. Berger, seconded by Comm. Burdick, passed in a 7 to 0 vote at the October 31 st public hearing. There was minimal Board discussion. Five members of the public representing the Pioneer Road Neighborhood Plan spoke in support of the amendment. Ord PUBLIC HEARING - Round 19-A Transmittal 4.A. 5 4.A.2. Banyan Ridge (LGA ). BCC Action: Transmit, motion by Comm. Burdick, seconded by Comm. Bernard, passed in a 7 to 0 vote at the October 31 st public hearing. Board discussion included comments regarding the importance of workforce housing within the project and the County. There was no public comment. 4.B. County Initiated Future Land Use Amendments in the Glades Tier 4.B.1. Canal Point Corrective (LGA to 010). Staff Recommendation. Approval Planning Commission/LPA Recommendation. Approval of staff recommendation BCC Action: Transmit, motion by Comm. Burdick, seconded by Comm. Berger, passed in a 7 to 0 vote at the October 31 st public hearing. Under Board discussion the upcoming meeting with area residents was mentioned. A property owner of one of the properties affected by the amendment spoke in support. 5. REGULAR AGENDA 5.A. Attainable Congregate Living. BCC Action: Direct staff to look at hiring a consultant for affordable congregate living facility (CLF) units. Motion by Comm. Burdick, seconded by Comm. Bernard, passed in a 7 to 0 vote at the October 31 st meeting. Board discussion centered on the previously approved CLF amendments with affordable unit conditions and questions regarding various funding mechanisms. County staff stated that if there was board direction to proceed, there is no money currently in place and would have to be addressed through the budgeting process. The Board stated that the scope of the project would be to try to figure out the private sector set aside for affordable CLF units with some incentive as a basis for the required affordable units. There were no public comments. 5.B. Proposed County Initiated Amendments. BCC Action: Initiate the proposed amendments, motion by Comm. Burdick, seconded by Vice Mayor Bernard passed in a 6 to 0 vote with Comm. Kerner absent at the October 31 st meeting. The motion included the addition of a workforce housing program item added at the meeting. There was minimal board discussion. Four members of the public representing the Pioneer Road Neighborhood Plan spoke in support of the Pioneer Road Overlay, and one member of the public spoke in opposition to the Overlay.
