CALL TO ORDER Deputy Mayor Fast called the meeting to order at 2:04 p.m. 2. DELEGATIONS Redekop that, in consideration of the delegations present, reconsideration of a motion served by Councillor Fast at the July 9, 2001, Executive Committee meeting of Council, regarding the construction of a B.C. Gas Pipeline, or any other natural gas pipelines in the City of Abbotsford, be considered as the last item of business. E CARRIED..I Use of Alternate Fuels and Co-generation in the Greenhouse Industry ( ) Jacqueline Reznick, 1893 View Grove Place, spoke to her submission dated September II, 200 I, regarding the use of alternate fuels and co-generation in the greenhouse industry, and their negative impact on air quality. She noted the recent regulatory bylaws proposed by the Corporation of Delta in this regard, and requested the City of Abbotsford pursue similar by-laws. Wiebe, that the delegation of Jacqueline Reznick, 1893 View Grove Place, regarding the use of alternate fuels and co-generation in the greenhouse industry, and the by-laws proposed by the Corporation of Delta, be received and referred to staff to investigate similar regulatory by-laws for the City of Abbotsford. Councillor Peary joined the meeting at 2:23 p.m., during the following discussion.. 2 Fraser River Management Plan from Hope to Mission ( ) Jim Vanderwal, Fraser Basin Council, presented information regarding the Fraser River Management Plan from Hope to Mission. He outlined the pro-active approach developed for flood and erosion control, gravel removal and habitat protection efforts, with costs estimated at $17.5 million. Dyking strategies are being reviewed and funding sought from the local, provincial, and federal levels of government, and first nations. A public meeting is scheduled for October 2,2001, in Chilliwack.

3 held September 17,2001, at 2:04 p.m. in the Matsgui Centennial Auditorium Page 3 Questions and comments from Councillors included discussion of sediment removal for flood control; the need for cooperation between jurisdictions in managing, maintaining and repairing flood protection dykes; and involvement of the Fraser Valley Regional District on the steering committee. 5. REPORTS Moved by Councillor Gill, seconded by Councillor Gibson, that the delegation of Jim Vanderwal, Fraser Basin Council, regarding the Fraser River Management Plan from Hope to Mission, be received. 5.1 ADMINISTRATION E CARRIED..1 Taxi Driver Regulation By-law No ( ) Report No. ADM dated September 11, 2001, from the Director of Administration, updated the Taxi Driver Regulation By-law No A public information meeting was held on August 89, 2001, providing an opportunity for local transportation companies to comment before adoption of the by-law. Correspondence in support of the by-law was received from Tourism Vancouver, dated September 6, 2001, and from the B.C. Coalition of People with Disabilities, dated August 28, Verbal support was also communicated from the Abbotsford Chamber of Commerce. G. Steeves, on behalf of the Canadian Council of the Blind, spoke in favour of the proposed by-law. Noting that her experience with local taxi drivers was favourable, she believed the by-law would enhance the service provided to persons with disabilities. S. Sumra, General Manager, Central Valley Taxi Ltd., opposed the adoption of the by-law because of the cost to train full time and part time drivers; loss of income while attending the courses; and travel time and expense to New Westminster. He advised they hire experienced, well qualified drivers, and use part time drivers for peak periods. Based on the size of the City and the number of cars in the fleet, compared to larger centres, he believed it would be more appropriate for the City and local taxi companies to design a test for taxi drivers. H. Johal, on behalf of Abbotsford Taxi Ltd., also opposed to the by-law, noted the time involved, expense and availability of courses, and that part time drivers may not wish to invest time and money in a short term job. He advised that Abbotsford Taxi Ltd., would be prepared to offer more in-house testing and training to its drivers, and questioned the relevance of the Taxihost program to the City of Abbotsford's drivers.

Weir, representing the Seniors' Advisory Committee to the Provincial Taxi Advisory Committee, also spoke in support of the proposed by-law. J. Sandhu, Manager, Taxihost Program, Justice Institute ofb.c., explained the two levels of the Taxihost program, and noted that Level I is mandatory in the City of Vancouver and at the Vancouver International Airport. He explained that the program improves service to the community, including tourism; increases gratuities to drivers and revenues to their employers; teaches road safety and assault avoidance; helps decrease collisions and reduces insurance claims and costs; and improves safety for drivers and passengers. Training could be offered in Abbotsford and the cost of the course is tax deductible. In response to questions from Councillors, it was noted that the failure rate for Level I is approximately one-third, however, tutoring and an opportunity to write the test a second time would be provided. The exams may also be challenged, for a nominal fee. Gibson, that Report No. ADM dated September 11, 200 I, be received from the Director of Administration and Taxi Driver Regulation By-law No , proceed for adoption at the next Regular meeting of Council. E CARRIED. 5.2 DEVELOPMENT SERVICES.1 Hallmark of Abbotsford Corp., Charlotte Avenue - Discharge of LUC No. 52 and Rezoning Application ( R0I-029l Report No DEV dated September 5, 2001, from the Senior Planner, recommended the discharge of Land Use Contract No. 52 and an amendment to Abbotsford Zoning By-law, 1996, to rezone the Hallmark of Abbotsford Corp. property located at 31636/31638 Charlotte Avenue to Special Housing Zone (P4), to allow the development of a 61 unit congregate housing facility for seniors.

5 ) ;..., I'...,J held September 17, 200 l, at 2:04 p.m. in the Matsqui Centennial Auditorium Page 5 Moved by Councillor Wiebe, seconded by Councillor Ross, that as recommended in Report No. DEV dated September 5, 2001, from the Senior Planner: (1) staff prepare and present a discharge to Land Use Contract No. 52 and an amendment to Abbotsford Zoning By-law, 1996, to rezone the Hallmark of Abbotsford Corp. property located at 31636/31638 Charlotte Avenue to Special Housing Zone (P4), when lot consolidation with Charlotte Avenue has taken place, and funding for works and services upgrades not budgeted for by the City have been resolved; and (2) that the Mayor and Director of Administration be authorized to execute all documentation relating to this matter.. E CARRIED.. 2 D. and S. Froese (Bullseye Enterprises Ltd.), Delair Road - Rezoning Application ( R Report No. DEV dated September 10, 2001, from the Senior Planner, recommended an amendment to Abbotsford Zoning By-law, 1996, to rezone the D. and S. Froese (Bullseye Enterprises Ltd.) property located at Delair Road to Tourist Accommodation Commercial Zone (CTA), to permit construction of a hotel/convention centre. Ross that, as recommended in Report No. DEV dated September 10, 200 1, from the Senior Planner: (1) staff prepare and present an amendment to Abbotsford Zoning By-law, 1996, to rezone the D. and S. Froese property located at Delair Road, to Tourist Accommodation Commercial Zone (CTA), when access controls for Sumas Way and Delair Road are obtained by Restrictive Covenant and funding for items not budgeted for by the City have been resolved; and (2) the Mayor and Director of Administration be authorized to execute all documentation relating to this matter. C. Noftle, Focus Architecture, on behalf of the applicant, D. and S. Froese (Bullseye Enterprises Ltd.), questioned the designation of Delair Road as a major collector and cautioned that the future of the project could be jeopardized by the City's requirements; however, negotiations are continuing. Inclusion of the small parcel of land, owned by the Province, at 1814 Sumas Way, in the development was acknowledged, but an agreement has not been finalized.

Other Councillors were opposed to the designated bicycle lane, as a condition of development, observing that it may prevent an attractive development in an important gateway. Redekop, that the main motion be amended to reflect the inclusion of a designated bicycle lane on both sides of Delair Road. E DEFEATED. Opposed: Councillors Gibson, Peary, Redekop, and Wiebe The main motion was then put and E CARRIED. Opposed: Councillor Warawa B.C. Ltd., Ranch Avenue; Merom Fanus Ltd., 2244 Lefeuvre Road - Agricultural Land Reserve Commission Subdivision Application ( / AO 1-004, / AOI-OOS) Report No. DEV dated August 31, 2001, from the Acting Senior Planner/Deputy Approving Officer, recommended: (1) a subdivision application for the B.C. Ltd. property located at Ranch Avenue; and the Merom Farms Ltd. property located at 2244 Lefeuvre Road, be forwarded to the Land Reserve Commission for approval; and (2) the widening of the west side of Cottonwood Street to accommodate pedestrians, be included as a condition of permitting permanent access to Cottonwood for the greenhouse operation at 2244 Lefeuvre Road. The applicants wish to subdivide the property at Ranch Avenue into two equal-sized parcels to build two greenhouse operations and two houses; and the property at 2244 Lefeuvre Road into two parcels to accommodate the existing greenhouse operation and two houses for the owners and one for a full-time employee. Questions were raised regarding the widening of Cottonwood, and the need for public input.

Voth of Merom Farms, 2244 Lefeuvre Road, stated the applicants hoped the widening of Cottonwood Street would be unnecessary, since pedestrian traffic was minimal; believed traffic flows would not significantly increase; and will continue to work with the Engineering Department to mitigate its concerns as much as possible. 5.3 ENGINEERING Moved by Councillor Redekop, seconded by Councillor Wiebe, that Report No. DEV dated August 31, 200 I, be received from the Acting Senior PlannerlDeputy Approving Officer, and: (I) Application /AOI-004 to subdivide the property at Ranch Avenue into two separate parcels, be forwarded to the Land Reserve Commission, with Council's support; (2) application / AO to subdivide the property at 2244 Lefeuvre Road into two separate parcels, be forwarded to the Land Reserve Commission, with Council's support; and (3) that the Mayor and Director of Administration be authorized to execute all documentation relating to this matter. Opposed: Councillors Gill and Ross..1 Latecomer Charges Centre Street C /R92-043) Moved by Councillor Wiebe, seconded by Councillor Gill that, as recommended in Report No. ENG , dated September 7, 2001, from the Director of Engineering: (I) the owner/developer, BC Inc., of the property located at 2435 Centre Street, otherwise known as the Frontender, be required to provide the extended service shown in "Exhibit I"; (2) the cost of providing services, as shown on "Exhibit I" be paid by the Frontender; (3) Latecomer charges be imposed on benefiting parcels that connect to, or use, the extended services paid for by the Frontender; and (4) the owners of the benefiting parcels be advised, in writing, of the Latecomer charges to be imposed upon connection to, or use by their lands, of the extended services. Gas Pipeline ( ) Deputy Mayor Fast asked Councillor Warawa to assume the Chair for the reconsideration of a motion regarding the construction of a B.C. Gas pipeline, or any other natural gas pipelines in the City of Abbotsford. Moved by Councillor Fast, seconded by Councillor Ross that: WHEREAS the Council of the City of Abbotsford is in the process of developing a Community Charter, which is intended to ensure the City' s orderly growth and development by placing the health and quality of life of residents first; AND WHEREAS recent power plant proposals for locations in Washington State along the international border next to the Fraser Valley and Lower Mainland have highlighted the fragile nature of our air shed and surrounding environment; AND WHEREAS B.C. Gas and other natural gas purveyors propose to construct new, or expand existing natural gas pipelines through and across Abbotsford to the international boundary at Huntingdon; AND WHEREAS B.C. Gas is unable to provide the City of Abbotsford with sufficient assurances that the increased supply of natural gas through its new pipeline will not: (a) attract additional polluting power generating plants into the air shed of the Fraser Valley/Lower Mainland; and (b) compromise the health and quality of life of the residents of our region; THEREFORE BE IT RESOLVED THAT the Council of the City of Abbotsford will not approve or support the construction of the proposed B.C. Gas pipeline or any other new or expanded natural gas pipelines into the through the City of Abbotsford, until such time as: (1) the Energy Facility Site Evaluation Council and the Governor of the State of Washington have rendered their decision on the application to construct the Sumas Energy 2 gas-fired co-generation plant in the Town of Sumas, Washington; (2) Council of the City of Abbotsford has completed the development of its Community Charter; (3) the City of Abbotsford is satisfied that the additional supply of natural gas through any such new pipelines will have no negative impact on the quality of the air in our regional air shed, and more specifically, the quality of the air in and about the City of Abbotsford; (4) proponents of any new natural gas pipelines have satisfactorily addressed

ADJOURNMENT E CARRIED. Opposed: Councilor Wiebe. Moved by Councillor Gill, seconded by Councillor Redekop, that the September 10, 2001, Executive Committee meeting, be closed to the public to consider matters related to Section (I) (e) and (h) of the Local Government Act (4:37 p.m.).
