The text was supported by all delegations with the exception of Austria, Belgium, Ireland, Lithuania, Luxembourg, Latvia and Sweden. Austria, Germany and Italy and the Commission made statements to these minutes (see Annex). 4. European Capital of Culture (a) Draft Council Decision on the European Capital of Culture event for the year /06 CULT /06 CULT 85 The Council designated Essen (Germany), Pécs (Hungary) and Istanbul (Turkey) as European Capitals of Culture for Cyprus made a statement to these minutes (see Annex). (b) Draft Council Decision appointing the two members of the selection panel in the context of the Community action "European Capital of Culture" - Adoption (Public debate) The Council formally appointed Mr Thomas ANGYAN (Austria) and Mr Seppo KIMANEN (Finland) as members of the "European Capitals of Culture 2011" selection panel representing the Council. 6. Council work plan for culture Economy of culture in Europe = Exchange of views (Public debate) 14468/06 CULT 93 The Council held an exchange of views on the economy of culture in Europe, on the basis of a working paper submitted by the Presidency (14468/06). This working paper drew on the recommendations formulated in the executive summary of the study on "the Economy of Culture in Europe", which was commissioned by the Commission /06 LL/ag 6

The Italian delegation, while not wishing to prevent consensus from being reached on these conclusions, formally stated its dissatisfaction with the content of the compromise text (see last sentence of paragraph 6 on page 6 of 15341/06) ultimately proposed by the Presidency. 11. 11 ANNEX Re. item 3 TELEVISION WITHOUT FRONTIERS 1. Statement by the Commission Article 3(f) "With regard to the proposal for a revised Directive of the European Parliament and of the Council on common rules in the field of audiovisual media services, the Commission is in favour of seeking the best possible compromise between the European Parliament and the Council in the forthcoming stages of the procedure and confirms that it is prepared to pursue efforts to reach this aim in a timely manner. However, at this stage the Commission does not consider it appropriate to amend its proposal until the European Parliament has delivered its opinion, particularly as regards the provisions on product placement. While the Commission can share the underlying aims of the general approach on product placement, it considers that the implementation of the provisions in paragraphs 1 and 2 would be greatly facilitated if Member States could opt out (which would be closer to its proposal) rather than opt in, thus reducing the risks of legal uncertainty and providing a sounder basis for support of European content, as stressed on several occasions at European level." 2. Statement by Germany Article 3(f) "Germany takes the view that the question of a prohibition on thematic placement is of great importance and that the Council should re-examine this issue, also in the light of the European Parliament's imminent decisions." 15168/06 LL/ag 11 ANNEX

12 3. Statement by Austria "In order to do justice to developments in the media sector, new services must be identified and described clearly at European level. The scope should therefore be defined in such a way that total legal certainty is ensured for the transposition and implementation of the Directive. The current definition of "programme" in Article 1(aa), according to which its "form and content is comparable to the form and content of television broadcasting", does not provide the clarity that would be needed in the light of current technological change and changing consumer patterns of behaviour. Austria concurs with the view that the production of and access to European works should be promoted in the on-demand area. The Member States should therefore encourage providers of such media services to include European works in what they provide. However, a strict requirement to promote such works, as currently laid down in Article 3h, would, on the other hand, hamper the development of this new media sector, and would in practice constitute an unjustifiable and barely sustainable burden for this branch. Possible problems in connection with jurisdiction over television broadcasters should be able to be resolved rapidly and without too much bureaucracy via bilateral cooperation. There would therefore appear to be no point in referring such matters also to the contact committee, as this could lead to delays and lack of clarity in procedures, thereby detracting from the effectiveness of the measures." 4. Statement by Italy "In Italy's view, the general approach arrived at in the Culture Council on 13 November 2006 includes provisions still giving rise to an undue increase in the various forms of advertising inserted. Italy intends to seek further consideration and discussion of the matter within the Council, including in the light of the opinion to be given by the European Parliament under the co-decision procedure." 15168/06 LL/ag 12 ANNEX

13 Re. item 5 EUROPEAN CAPITAL OF CULTURE Statement by Cyprus The Republic of Cyprus accepts Istanbul s designation as European Capital of Culture for 2010 and submits the following statement, to be included in the Council s minutes: It should be guaranteed that Turkey grants to all EU member states and their citizens the equal right to have access to and to participate in events, as well as the possibility of organizing events, during the period of time, in which Istanbul will be European Capital of Culture for DELETED 15168/06 LL/ag 13 ANNEX

Item 9 VOCATIONAL EDUCATION TRAINING (VET) Statement by Cyprus "Firstly, we would like to stress the fact that we accept the present document which refers to future priorities for reinforced European cooperation on Vocational Education and Training VET. We would also like to thank the Presidency for showing a comprehensive understanding of the problem we face as regards the obstruction of our participation in OECD and its various activities, which include research and statistics even in the filed of education. We hope that the proposal of the Presidency will contribute towards the solution of the particular problem, which results from the continued and unjustifiable stance taken by Turkey to obstruct any participation of Cyprus in OECD and its activities. Our exclusion from purely non political matters, such as educational research, is damaging, both to the targets posed by the EU in the area of Education and Training, as well as to our own national goals for the improvement of the system of Education and Training in Cyprus. We are all aware of the EU decision to base our educational policies on data and research evidence, which has been supported by us. We hope that positive actions, such as the present one taken by the Presidency, will contribute to changing Turkey s stance and to fully solving similar problems which we face for the same reasons." 15168/06 LL/ag 15 ANNEX
