Minimum rear yard setback 10.0m (gazebo). Staff Comments: Stop Work Orders and Orders to Comply: Order-to-Comply # has been issued for the construction of a shed without obtaining a building permit. Building Permits Issued: A building permit has been filed for the construction of a shed (# ), but has not been issued. Other Comments: 1. The subject lands may be subject to Ontario Regulation 166/06 (TRCA Toronto Region Conservation Authority). 2. The applicant shall be advised that additional variances may be required upon review of detailed drawings for building permit/site plan approval. 3. Please note that the maximum encroachment of eaves and gutters into a required yard is 0.5m. 4. Please note Section 4.1.1(b) that states the maximum height of an accessory building or structure measured from the average finished ground level at the front of the building to the highest point of the said building or structure shall be 4.5 metres. The nearest part of the roof shall not be more than three (3) metres above finished grade. Conditions of Approval: If the committee finds merit in the application, the following conditions of approval are recommended. 1. That the applicant applies for a building permit through the Building Standards Department for the gazebo (The Ontario Building Code requires a building permit for structures that exceed 10m 2 ). * Comments are based on the review of documentation supplied with this application.

The Planning Department recommends adjournment of the subject application until such time as the TRCA has commented, in order to evaluate the impact of the setbacks on the adjacent lands. A minimum rear yard setback 10.0 metres (shed) is required. 2. A minimum rear yard setback 10.0 metres (gazebo) is required. Comments: The Development/Transportation Engineering Department conducted a site visit on October 16, 2014 to 42 Thistle Ridge Drive in response to Minor Variance Application A278/14. Note the garden shed and the gazebo have been constructed. The shed is located 1.67 metres from the rear lot property line and does not appear to adversely impact with the existing drainage pattern of the subject lot. With respect to the Variance No. 2, the gazebo is located 0.56 metres from rear property line, and considering the subject lot backs on to a woodlot area, the location of the gazebo does not appear to adversely impact with the existing drainage pattern of the subject lot. Note photo documentation of the subject area(s) within the lot is attached. Accordingly, the Development/Transportation Engineering Department offers no further comments or objection Minor Variance Application A278/14. Conditions: None.

We have reviewed the proposed Variance Application and have no objections to its approval, subject to the following comments (attached below). We have reviewed the proposed Variance Application and have the following concerns (attached below). PowerStream has received and reviewed the proposed Variance Application. This review, however, does not imply any approval of the project or plan. All proposed billboards, signs, and other structures associated with the project or plan must maintain minimum clearances to the existing overhead or underground electrical distribution system as specified by the applicable standards, codes and acts referenced. In the event that construction commences, and the clearance between any component of the work/structure and the adjacent existing overhead and underground electrical distribution system violates the Occupational Health and Safety Act, the customer will be responsible for 100% of the costs associated with PowerStream making the work area safe. All construction work will be required to stop until the safe limits of approach can be established. In the event construction is completed, and the clearance between the constructed structure and the adjacent existing overhead and underground electrical distribution system violates the any of applicable standards, acts or codes referenced, the customer will be responsible for 100% of PowerStream s cost for any relocation work.
