1 CITY OF COLLEGE PARK MAYOR AND CITY COUNCIL REGULAR SESSION NOVEMBER 19, 2018 MINUTES Present: Mayor Jack P. Longino; Councilmen Ambrose Clay, Derrick Taylor, Tracey Wyatt, and Roderick Gay; Acting City Manager Mercedes Miller; Interim City Clerk Shavala Moore; City Attorney Winston Denmark. Absent: City Manager Terrence Moore and City Attorney Steve Fincher. 1. Opening Ceremonies. A. Pledge of allegiance to the flag. B. Invocation by Mr. Walker. 2. Additions, Deletions, Amendments, Or Changes To The Agenda. Acting City Manager Mercedes Miller said she would like to take 7a and 11c off the agenda. ACTION: Councilman Clay moved to remove Items 7a, Public Hearing to consider a Conditional Use Permit (CUP) request by Elite Preparatory School of Atlanta, Inc. The CUP request is for a portion of the property located at 3549 Main Street, currently zoned Downtown Commercial (DC); and 11c, Consideration of and action on a request to adopt an ordinance authorizing the sale of alcoholic beverages on Sunday s beginning at 11:00 a.m. until 12:30 p.m., seconded Councilman Taylor and motion carried. (All Voted Yes). 3. Presentation Of Minutes Of City Council. A. Regular Session held November 5, ACTION: Councilman Clay moved to approve Regular Session Minutes dated November 5, 2018, with corrections, seconded by Councilman Taylor and motion carried as follows: (All Voted Yes). Workshop Session held November 5, ACTION: Councilman Clay moved to approve Regular Session Minutes dated November , with corrections, seconded by Councilman Taylor and motion carried as follows: (All Voted Yes). Packet page 38, line change sports to spots 4. Proclamations, Resolutions, Plaques, And Announcements. None 5. Remarks Of Citizens. a. Reverend Albert E. Love came forward and reminded everyone to go out and vote on Tuesday, December 4, 2018 for the Secretary of State and the Public Service Commissioner. Councilman Wyatt asked, what are we doing to notify the citizens of the runoff election? Interim City Clerk Shavala Moore said we can put something out on the website. 6. Other Business. A. Update on the status and condition of the College Park Police Department's Body Camera Program. Interim Police Chief Ferman Williford came forward to give an update on the body cameras. Councilman Clay said so far we have only paid for the initial cameras. Interim Police Chief Ferman Williford said yes, sir. Mayor Longino asked, when will the warranty run out? Interim Police Chief Ferman Williford said the warranty will run out in about a year. Councilman Wyatt asked, what is the total amount we paid them? Interim Police Chief Ferman Williford said $147, was the original price. If we see that fail rate again, we will be looking for another vendor. Mayor Longino said we need to watch that Winston, as far as what legal obligation we have before we make any change. City Attorney Winston Denmark said okay. Regular Session 11/19/18 Page 2 of 11

3 Mayor Longino asked, are all the other car cameras working? Interim Police Chief Ferman Williford said yes, sir. Mayor Longino directed staff to provide an update to Mayor & Council in February Public Hearings. A. Public Hearing to consider a Conditional Use Permit (CUP) request by Elite Preparatory School of Atlanta, Inc. The CUP request is for a portion of the property located at 3549 Main Street, currently zoned Downtown Commercial (DC). This item was removed from the agenda. 8. Bids, Change Order Requests And Contracts. A. Consideration of and action on a request for approval of a Mutual Aid Agreement between the City of College Park and the City of Atlanta to provide and receive additional emergency response coverage between agencies. Fire Chief Wade Elmore came forward to explain the request. We are requesting approval of a Mutual Aid Agreement between the City of College Park and the City of Atlanta for additional emergency response coverage between agencies. Councilman Clay asked, are there any significant changes from the previous agreement? Fire Chief Wade Elmore said no, sir. Mayor Longino asked, is there a reason why we are the first to sign? Fire Chief Wade Elmore said I just like to get ours out of the way. ACTION: Councilman Clay moved to approve a request from Fire Chief Wade Elmore on approval of a Mutual Aid Agreement between the City of College Park and the City of Atlanta to provide and receive additional emergency response coverage between agencies, seconded by Councilman Taylor and motion carried. Consideration of and action on a request for approval to purchase replacement Self Contained Breathing Apparatus (SCBA) AirPaks used to provide respiratory protection for firefighters in hazardous environments. Councilman Wyatt asked, why wasn t this item budgeted? Fire Chief Wade Elmore said it was budgeted. Regular Session 11/19/18 Page 3 of 11

4 Councilman Wyatt said Mercedes, I would like to take a look at this. I just wondered why it didn t come out of the Fire Department s budget. Councilman Gay said $ , but it is not bidded out. Fire Chief Wade Elmore said with the breathing apparatus, it is only a national contract. MES is a sole source. Councilman Gay said Chief Meadows told us the same thing on the body cameras. I think you should at least attempt to go out to bid. Fire Chief Wade Elmore said we received the cheapest price around the country. ACTION: Councilman Clay moved to approve a request from Fire Chief Wade to purchase replacement Self Contained Breathing Apparatus (SCBA) AirPaks used to provide respiratory protection for firefighters in hazardous environments, seconded by Councilman Taylor and motion carried. (All Voted Yes). C. Consideration of and action on a request for approval to purchase a replacement Life PAK Cardiac Monitors used on medical scenes for the Fire Department. ACTION: Councilman Clay moved to approve a request from Fire Chief Wade Elmore on approval to purchase a replacement Life PAK Cardiac Monitors used on medical scenes for the Fire Department, seconded by Councilman Taylor and motion carried. (All Voted Yes). D. Consideration of and action on bids received for the purchase of furniture for the College Park Gateway Center facility. Acting City Manager Mercedes Miller explained the item. Councilman Clay said I saw one thing in the packet that you sent to GBAC to put out on their website. Acting City Manager Mercedes Miller said we put it on the College Park s website. Councilman Clay reading an excerpt from packet page 85 that references the packet having been sent to the Georgia Black Contactors Association. Acting City Manager Mercedes Miller said we sent it to them, but it did not get posted. Councilman Clay asked, why did they not post it? Acting City Manager Mercedes Miller said I don t know. 5 Councilman Gay asked, can you explain what options 1-3 are? Acting City Manager Mercedes Miller said this is the furniture for the locker rooms and the office space. When they give a bid, then we go back to negotiate with them because that is not the final price. Councilman Gay asked, are we awarding the 3 options for nearly $400,000.00, or 1 of the 3 options? Acting City Manager Mercedes Miller said it is either of the 3. Councilman Wyatt said all 3 are pretty much similar. Councilman Gay asked, which option are we awarding? Acting City Manager Mercedes Miller said we have not decided yet. ACTION: Councilman Gay moved to approve a request from Executive Director Mercedes Miller on bids received for the purchase of furniture for the College Park Gateway Center facility, seconded by Councilman Clay and motion carried. (All Voted Yes). E. Consideration of and action on bids received for pool maintenance services for the Hugh C. Conley Recreation Center and the Tracey Wyatt Recreation Complex pools. ACTION: Councilman Clay moved to approve a request from Director of Recreation and Cultural Arts Emmanuel Rainey on bids received for pool maintenance services for the Hugh C. Conley Recreation Center and the Tracey Wyatt Recreation Complex pools, seconded by Councilman Wyatt and motion carried. (All Voted Yes). F. Consideration of and action on a request for approval to move forward with the Harvard Avenue Alleyway Improvement Project. Director of Public Works Mike Mason came forward to explain the item. We are seeking approval from Mayor & Council tonight. Councilman Clay said we have had flooding in that block of some of the businesses. We need to increase the capacity of the sanitary sewer. It is currently very old and is running under one of the buildings. We need to do work on the alley at some point. It doesn t make sense digging up the alley for various things. Another thing would be to eliminate the power wires overhead. Councilman Gay said this is for $363,385.00, correct? Director of Public Works Mike Mason said yes, sir. 6 Councilman Gay said so we are justifying spending this because of what, again? Director of Public Works Mike Mason said as stated in the packet, it is for runoff, to expand the sewer to accommodate restaurants and the apartment complex that is being constructed back there. Councilman Gay asked, did we do a title search? Did we purchase title insurance? Director of Public Works Mike Mason said we did a Quit Claim to the property for all the business owners. Councilman Gay asked, do we pay for title insurance, or for the third party attorney? City Attorney Winston Denmark said I do not know. Director of Engineering William Moore came forward and said Fincher Denmark did do a title search, and they did not find any owners. All of them signed the Quit Claim but Paul Dorn. Councilman Gay asked, does the City pay title insurance? City Attorney Winston Denmark said yes. You are entitled to do it, none the less. Outside of an abundance of caution, yes, you are. Councilman Wyatt said I didn t see a bid in the packet. Director of Public Works Mike Mason said there was one included by Mr. Willis Moody. Acting City Manager Mercedes Miller said you will find that on packet page 101. Councilman Wyatt said I don t know if we scored these bids. Director of Public Works Mike Mason said we looked at all the responsive bidders. Mayor Longino asked, when will they get started on this, Mike? Director of Public Works Mike Mason said they will get started after the holidays, first of the year. Mayor Longino asked, how long will it take? Director of Public Works Mike Mason said it will take 90 to 120 days. Mayor Longino said one of those buildings is under contact; is it not Artie? Regular Session 11/19/18 Page 6 of 11

7 Director of Economic Development Artie Jones came forward and said yes, it is. Mayor Longino asked, do you know the closing date on that? Director of Economic Development Artie Jones said no, sir. The information was not available to me. Mayor Longino said I will try and find out. ACTION: Councilman Clay moved to approve a request from Director of Public Works Mike Mason to move forward with the Harvard Avenue Alleyway Improvement Project, seconded by Councilman Wyatt and motion carried. (All Voted Yes). G. Consideration of and action on proposals received for the Voice over IP (VoIP) Phone System and Wi-Fi requirements for the College Park Police Precinct located at 2330 Godby Road. Interim Police Chief Ferman Williford came forward to explain the item. ACTION: Councilman Wyatt moved to approve a request from Interim Chief of Police Ferman Williford on proposals received for the Voice over IP (VoIP) Phone System and Wi-Fi requirements for the College Park Police Precinct located at 2330 Godby Road, seconded by Councilman Clay and motion carried. (All Voted Yes). 9. Travel Requests Consent Agenda. A. Consideration of and action on a request from Director of Power Hugh Richardson for authorization to attend the 2018 Electric Cities of Georgia Annual Meeting. ACTION: Councilman Clay moved to approve a request from Director of Power Hugh Richardson for authorization to attend the 2018 Electric Cities of Georgia Annual Meeting to be held December 10-11, 2018 in Greensboro, Georgia, seconded by Councilman Wyatt and motion carried. (All Voted Yes). 10. Unfinished (Old) Business. None. 11. New Business. A. Consideration of and action on a request to approve City Holidays for Calendar Year ACTION: Councilman Clay moved to approve a request from Director of Human Resources and Risk Management William Benifield on City Holidays for Calendar Year 2019, seconded by Councilman Wyatt and motion carried. Consideration of and action on a request for approval of the City of College Park Mayor and City Council Meetings schedule for calendar year ACTION: Councilman Clay moved to approve a request from City Manager Terrance R. Moore on the City of College Park Mayor and City Council Meetings schedule for calendar year 2019, seconded by Councilman Wyatt and motion carried. (All Voted Yes). C. Consideration of and action on a request to adopt an ordinance authorizing the sale of alcoholic beverages on Sundays, beginning at 11:00 a.m. until 12:30 p.m. This item was removed from the agenda. 12. City Attorney s Report. A. Consideration of and action on an Ordinance to amend the Code of Ordinances, City of College Park, Georgia, by amending Article I (In General) of Chapter 10 (Municipal Utilities and Services) in its entirety. City Attorney Winston Denmark said you have a memo from Serena Nowell to simplify the process. There was not a straight correlation between failure to pay account balances and the City s ability to discontinue service. We have to clarify that. ACTION: Councilman Clay moved to defer a request from City Attorney Serena Nowell on an Ordinance to amend the Code of Ordinances Article 1 (In General) of Chapter 10 (Municipal Utilities and Services), until the next regular session of Mayor and Council to be held December 3, 2018, seconded by Councilman Wyatt and motion carried. (All Voted Yes). B. Consideration of and action on a Resolution to adopt a Utility Service Fee Schedule for all fees arising pursuant to Article I (In General) of Chapter 10 (Municipal Utilities and Services) of the Code of Ordinances, City of College Park, Georgia. City Attorney Winston Denmark said this item is the resolution with regard to the fee schedules. ACTION: Councilman Wyatt moved to defer a request from City Attorney Serena Nowell on a Resolution to adopt a Utility Service Fee Schedule for all fees arising pursuant to Article I (In General) of Chapter 10 (Municipal Utilities and Services) of the Code of Ordinances, seconded by Councilman Gay and motion carried. (All Voted Yes). 13. City Manager s Report. A. Discussion and update on top ten delinquent property tax payers. Regular Session 11/19/18 Page 8 of 11

9 There were no comments made on the top ten delinquent property tax payers. B. Discussion and update on top ten delinquent utility customer accounts. Councilman Clay said I don t have anything on the accounts. Mayor Longino said it amazes me as to how much commercial past due accounts we have. Some of them are making money. Is there a reason why we are leaving all these people on? Ms. Lane came forward and said all of these are current accounts. Councilman Clay said we have to find a better way to show this. Councilman Wyatt said at the time they pulled this, it was a week and a half out. So, I would suggest that prior to the council meeting that they re-pull the report and give it to us as an add-on. Mayor Longino said the brand new one on page 208, second one down, they have a balance. Why? Ms. Lane said they do have a balance. Mayor Longino asked, is there a reason? Ms. Lane said she made a payment. She has 2 different accounts. She is not current. It is higher than what you see on the report. Mayor Longino said the company on this list, we pay him big money. Councilman Clay said send me an electronic copy. Councilman Wyatt said I am tired of hitting this every council meeting. If we set a policy to turn them off, tell me why they are not turned off. Director of Administration Services & Communication Charles Cook came forward and said I have asked for the list ahead of time so those are things I have been working on. Councilman Wyatt said the next time we meet, I want to know why people on this list have not been cutoff. Director of Administration Services & Communication Charles Cook said absolutely. C. 10 ACTION: Councilman Clay moved to approve an Employee Contract for Police Chief Ferman Williford, seconded by Councilman Gay and motion carried. (All Voted Yes). 14. Report Of Mayor And Council. Councilman Gay said I want to wish everyone a Happy Thanksgiving and be safe. Councilman Wyatt said Happy Thanksgiving. I am looking forward to another one. Councilman Taylor said I have nothing to report. Councilman Clay said Happy Thanksgiving, and enjoy this one peaceful period during the year that I think is still not totally overwhelmed by advertising and the rush to sales. Mayor Longino - said Happy Thanksgiving. I want to thank the employees for what you do do. Each department needs to do their part, and sometimes get help from their counter parts. If we work together we will be a Super Bowl City, and we will win the Super Bowl. Mayor Longino said we only have 1 more meeting this year, so don t try to cram it all in. You may have to push some items to January Happy Holidays. The meeting is adjourned. 15. Executive Session. There was no Executive Session at the end of the Regular Session Meeting. 16. Approval of Executive Session Minutes. (After Workshop Session) ACTION: Councilman Clay moved to approve Executive Session minutes for November 19, 2018, as presented, seconded by Councilman Taylor and motion carried. (All Voted Yes). 17.
