In accordance with State Statute and Council Policy, one or more Council Members may be connected via speakerphone. Citizen Comments/Question Policy Time is made available for anyone in the audience to address the Council and/or Mayor concerning matters pertaining to City business. When a member of the audience addresses the Council and/or Mayor, he or she will come to the podium and state his or her name and address. Citizens will be asked to limit their remarks/questions to five (5) minutes each. In meetings during which numerous individuals wish to comment, the time for all citizen comments may be limited to three (3) minutes each, at the discretion of the conducting Council Member. The conducting Council Member shall have discretion as to who will respond to a comment/question. In all cases the criteria for response will be that comments/questions must be pertinent to City business, that there are no argumentative questions and no personal attacks. Some comments/questions may have to wait for a response until the next regular council meeting. The conducting Council Member will inform a citizen when he or she has used the allotted time. Grievances by City employees must be processed in accordance with adopted personnel rules.

28 OFFICE OF THE CITY ATTORNEY Memorandum TO: Mayor and City Council FROM: Hannah Vickery DATE: 10/19/2018 RE: A RESOLUTION OF THE CITY OF SOUTH SALT LAKE CITY COUNCIL GRANTING PERMISSION FOR THE POLICE DEPARTMENT TO APPROPRIATE CERTAIN PROPERTY IN ITS POSSESSION TO PUBLIC INTEREST USE. Accompanying this memo is a proposed resolution allowing the police department to appropriate bicycles held in its possession to public interest use, pursuant to U.C.A a-5. The bicycles have come into the possession of the police department as either lost/mislaid property or were held by the Police Department for safekeeping. After the property is held for three months, pursuant to state law the Police Department notices the public of the general description of the item and the date of intended disposition. The notice is posted in the paper, on city website, and through bulletin notification in the police department lobby. Under many circumstances, the majority of the property held by the Police Department is never claimed. Therefore, after reasonable time has passed as set forth in State law, the Police Department then petitions the City Council for approval to appropriate the property. State law allows the legislative body to approve the application of the property to a public interest, to sell the property at public auction and apply the proceeds of the sale to a public interest use, or to destroy the property if it is unfit for a public interest use or sale. Free Bikes 4 Kidz is a charitable organization registered with the state. A flyer detailing their mission is attached to this memo. Donation by the City in this regard meets the definition of a public interest use. Approval of the accompanying resolution is necessary prior to donation. Accompanying this memo is a proposed resolution allowing the police department to appropriate firearms and ammunition held in its possession to public interest use, pursuant to U.C.A a-101 et seq, U.C.A , and U.C.A The firearms and ammunition have come into the possession of the police department as either lost/mislaid property, as evidence of a crime, or were held by the Police Department for safekeeping. After the property is held for three months, pursuant to state law the Police Department notifies the public of the general description of the item and the date of intended disposition. The notice is posted in the paper, on city website, and through bulletin notification in the police department lobby. After a reasonable time has passed as set forth in State law, the Police Department then petitions the City Council for approval to appropriate the property. If the property being held is evidence, the prosecutor must affirm that it is no longer needed. State law generally allows the legislative body to approve the application of the property to a public interest use, to sell the property at public auction and apply the proceeds of the sale to a public interest use, or to destroy the property if it is unfit for a public interest use or sale. The process for appropriation of firearms is covered in a distinct section of the code but it is largely similar to the appropriation of any other type of property appropriated by the police. The Police Department has the option to sell or destroy the firearm or transfer it to the Bureau of Forensic Services for testing. If the firearm is sold or destroyed it must be sold to a state-approved and federally licensed firearms dealer for either resale or destruction. A firearm must be destroyed if it is deemed unfit for sale or it was associated with a notorious crime. As with other property, all proceeds from the sale of a firearm to a state-approved federally licensed firearms dealer must be applied to a public interest use. Each of the firearms and ammunition in the attached list has either not been claimed or is no longer needed as evidence. The Police Department intends to give all of the firearms and ammunition in the attached list to the Bureau of Forensic Services. 44 OFFICE OF THE CITY ATTORNEY Memorandum TO: FROM: RE: Mayor and City Council Hannah Vickery DATE: 10/19/2018 A RESOLUTION OF THE CITY OF SOUTH SALT LAKE CITY COUNCIL GRANTING PERMISSION FOR THE POLICE DEPARTMENT TO APPROPRIATE CERTAIN PROPERTY IN ITS POSSESSION TO PUBLIC INTEREST USE. Accompanying this memo is a proposed resolution allowing the police department to appropriate certain monies and other property held in its possession to public interest use, as per U.C.A & 77-24a-5. Money and other property may come into the possession of police officers when it is seized pursuant to an investigation or turned over to the police for safekeeping. Pursuant to state law, after receiving prosecutorial and investigator approval to dispose of property held in a case, the police department attempts to make contact with the owner, if the owner is known. In many cases, the owner of property is not identified and the police hold onto the money for a sufficient amount of time to allow that person to request the property s return. In addition, the police department seeks to identify the owner of property prior to appropriating by noticing in the paper, on city website, and through bulletin notification in the police department lobby. After reasonable time has passed as set forth in State law, the Police Department then petitions the City Council for approval to appropriate the property. State law allows the legislative body to approve the application of the property to a public interest, to sell the property at public auction and apply the proceeds of the sale to a public interest use, or to destroy the property if it is unfit for a public interest use or sale. As you can see, this request is for the appropriation of money and other property held by police to public use. The money which is appropriated by this resolution will be deposited into the City s general fund. The other property will be sold at auction. 45 ORDINANCE NO AN ORDINANCE OF THE CITY OF SOUTH SALT LAKE CITY COUNCIL AMENDING SECTION , CITY COUNCIL POWERS AND DUTIES AND ENACTING SECTION , CITY COUNCIL ADMINISTRATIVE SUPPORT STAFF WHEREAS, the City of South Salt Lake operates under a council-mayor form of government, which separates the duties and responsibilities of each; and WHEREAS, the City Council finds that it should have the ability to hire and direct administrative support staff to assist the council in formulating policy pursuant to State law and carrying out its legislative functions; NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of South Salt Lake as follows: SECTION I: Amendment. Amend selected provisions of SSLC Code Section as follows: Powers and duties. A. The city council shall act as the legislative body of the city government. It shall have the power to enact city policies, but the power of enforcement of such policies rests with the mayor. B. The city council shall pass ordinances, appropriate funds, review municipal administration, and perform all duties that may be required of it by law. C. The city council shall have power to pass resolutions and ordinances concerning matters such as: 1. Tax levies; 2. Adoption of the city budget; 3. Sewer, water, and other service rates; 4. Licensing fees and other fees set forth in the South Salt Lake Municipal Code; 5. Zoning and building regulations. D. The city council shall consider and give, where appropriate, its advice and consent to the mayor on all proposed appointments of city officers and appointments to commissions, committees or other bodies established to provide advice or assistance to the operation of the city government. E. Subject to South Salt Lake Municipal Code , the city council may appoint administrative support staff. F. E.The city council shall have power to make and enforce any additional rules and regulations for the government of the council, the preservation of order, and the transaction of the business of the council as may be necessary. G. F.The city council shall, by ordinance, provide for the manner in which: 1. Municipal property is bought, sold, traded, encumbered, or otherwise transferred; and 2. Subdivisions or annexations are approved, disapproved or otherwise regulated.

46 Ordinance Amending SECTION II. ENACTMENT. Enact SSLC Code Section as follows: City Council Administrative Support Staff. A. Any staff appointed by the city council to serve as administrative support staff shall be exempt from the protections of Utah Code (1)(a) and any successor provisions. B. The city council shall adopt a personnel policies and procedures manual governing city council and staff. If no manual is adopted prior to the appointment of the city council s first administrative staff, then the City s Personnel Policies and Procedures manual shall apply. C. The city council shall provide for the manner in which appointed staff is directed and supervised. D. The city council shall establish job descriptions, job functions, and provide by ordinance compensation for city council administrative support staff. E. Appointment of administrative staff shall be by a unanimous vote of the city council. F. Termination of administrative staff shall be by a two-thirds vote of the city council. SECTION III. Severability. If any section, subsection, sentence, clause, phrase, or portion of this ordinance is, for any reason, held invalid or unconstitutional by any court of competent jurisdiction, such provision shall be deemed a separate, distinct, and independent provision, and such holding shall not affect the validity of the remaining portions of this ordinance. SECTION IV. Conflict with Existing Ordinances, Resolutions, or Policies. To the extent that any ordinances, resolutions, or policies of the City of South Salt Lake conflict with the provisions of this ordinance, this ordinance shall prevail. SECTION V. Effective Date. This ordinance shall become effective upon Mayor s signature and publication, or after fifteen days of transmission to the office of the Mayor if neither approved nor disapproved by the Mayor, and thereafter, publication DATED this day of, BY THE CITY COUNCIL: ATTEST: Ben Pender, Council Chair Craig D.
