1 MUNICIPALITY OF BLUEWATER REGULAR COUNCIL MEETING MINUTES HELD IN THE BLUEWATER COUNCIL CHAMBERS VARNA, ON MONDAY, MAY 16, :00 p.m. 1. ROLL CALL AND CALL TO ORDER Charlene Overholt, Manager of Corporate Services/Clerk conducted the roll call. Elected Officials Present: Mayor Tyler Hessel, Councillors John Becker, John Gillespie, George Irvin, Dave Roy, Bill Whetstone and Janisse Zimmerman. Regrets: Deputy-Mayor Jim Fergusson and Councillor Marnie Hill Staff Present: Kyle Pratt, Chief Administrative Officer; Charlene Overholt, Manager of Corporate Services/Clerk; Ansberth Willert, Manager of Finance and Jennette Walker, Manager of Public Works. The Mayor welcomed those in attendance and called the meeting to order at approximately 7:01 p.m. 2. APPROVAL OF THE AGENDA Additions to the agenda: Councillor Irvin requested to add discussion and clarification on the Huron County Health Unit survey regarding wind turbines under Councillor s issues. Moved by Councillor Roy, seconded by Councillor Whetstone that the agenda be approved as amended. Carried. 3. DECLARATION OF PECUNIARY INTEREST No declarations of pecuniary interest were made. 4. MAYOR S REMARKS Mayor Hessel provided Council with an update on meetings and conferences he has attended in the past month. 1

2 5. ADOPTION OF MINUTES Moved by Councillor Becker, seconded by Councillor Whetstone that the public Council meeting minutes of April 11, 2016 be approved as presented. Carried. Moved by Councillor Roy, seconded by Councillor Irvin that the special Council meeting minutes of April 14, 2016 be approved as presented. Carried. Moved by Councillor Zimmerman, seconded by Councillor Becker that the regular Council meeting minutes of April 18, 2016 be approved as presented. Carried. Moved by Councillor Gillespie, seconded by Councillor Whetstone that the Committee of the Whole meeting minutes of May 2, 2016 be approved as presented. Moved by Councillor Roy, seconded by Councillor Becker that the special Council meeting minutes of May 2, 2016 be approved as presented. Carried. Moved by Councillor Zimmerman, seconded by Councillor Irvin that the special Council meeting minutes of May 2, 2016 be approved as presented. Carried. 6. DELEGATIONS Post Traumatic Stress Disorder Fire Chief Dave Renner and Kyle Kruse Bluewater Fire Chief Dave Renner and Bluewater Firefighter Kyle Kruse presented Council with information regarding Post Traumatic Stress Disorder and how if affects first responders. They would like to form a Critical Incident Stress Management Program for Bluewater and Central Huron First Responders. They would like to train 3 people per station plus Kyle would act as the coordinator. There would be a one-time training cost of $4,550. They also asked that $250 per station be added for literature meeting etc. The cost for this was not included in the 2016 budget. Councillor Whetstone inquired if Victim Services or the Municipal Employee Assistance Program would offer this service. He also stated that he thinks that the County of Huron should take the lead on providing this service. Moved by Councillor Whetstone, seconded by Councillor Gillespie that staff come back with more information regarding options available and the financial implications of providing this service. Carried. Blue Community Group Ray Letheren Ray Letheren and Shelagh Sully co-chairs of the Blue Community Group presented Council with information regarding what a Blue Community is. They asked Bluewater to participate in becoming a Blue Community. Moved by Councillor Whetstone that staff prepare a report on the effects of Bayfield becoming a member of the Blue Community Group. No seconder was received. 2

Huron Food Action Network Nathan Swartz Nathan Swartz from the Huron Food Action Network (HFAN) presented Council with information regarding their organization. HFAN brings together a large number of food system stakeholders and community members from a diverse range of backgrounds. Anyone who supports the vision, mission and values of the HFAN and lives or works in Huron County, Ontario can participate. HFAN promotes networking and collaboration. All members are invited to join an Action Group or participate in projects and participate in quarterly network meetings which are open to the public. 7. MANAGEMENT REPORTS ADMINISTRATIVE SERVICES CAO K. PRATT Community Emergency Management Coordinator Shared Service Moved by Councillor Gillespie, seconded by Councillor Whetstone that the report entitled, Community Emergency Management Coordinator (CEMC) Shared Service be received; and, That the Municipality of Bluewater agree to participate in further discussions with the County and other interested Lower Tiers regarding a possible CEMC Shared Service. Carried. CLERK C. OVERHOLT Committee of the Whole May 2, 2016 Motions to be Ratified Moved by Councillor Zimmerman, seconded by Councillor Irvin that Council approve the four proposed items be added to the Housekeeping Zoning By-law Amendment. Carried. Moved by Councillor Becker, seconded by Councillor Whetstone that By-law being a by-law to designate locations in the Municipality of Bluewater as Community Improvement Project Areas be given first, second, third and final reading and finally passed this 16 th day of May Carried. Moved by Councillor Irvin, seconded by Councillor Roy that By-law being a by-law to adopt a Community Improvement Plan for Bluewater Community Improvement Project Area be given first, second, third and final reading and finally passed this 16 th day of May Carried. Moved by Councillor Roy, seconded by Councillor Zimmerman that Council approves the Ministry of Transportation s request for exemption to Noise By-law No from May 1, 2017 to October 31, 2017 to permit 24-hour continuous construction operations on London Road between Exeter and Kippen. Carried. Moved by Councillor Zimmerman, seconded by Councillor Becker that Council approves the Zurich Minor Hockey Association s request for exemption to Noise By-law to allow the amplification of music at 3

4 the intersection of Victoria Lane and Mill Avenue, Zurich on Friday, August 26, 2016 from 7:00 pm to 12:30 am on Saturday, August 27, Carried. Moved by Councillor Whetstone, seconded by Councillor Irvin that Council approve that staff continue to work with the Hensall Kinsmen on the development of a skateboard park in Hensall. Carried. Moved by Councillor Roy, seconded by Councillor Whetstone that Council have staff prepare a report showing the annual costs to maintain the Post Office in Bayfield. Carried. Moved by Councillor Becker, seconded by Councillor Gillespie that the March accounts in the amount of $3,861, be approved. Carried. Moved by Councillor Irvin, seconded by Councillor Gillespie that Council have staff prepare a breakdown of the levy and assessment by ward. Carried. Moved by Councillor Becker, seconded by Councillor Zimmerman that Council approve to change the September Council meeting from the 19t h to the 26 th. Carried. Moved by Councillor Gillespie, seconded by Councillor Zimmerman that Council support the resolution passed by the Municipality of South Dundas regarding the current intake of applications to the Rural Economic Development (RED) program with plans to integrate it into the restrictive Jobs and Prosperity Fund. Carried. Moved by Councillor Roy, seconded by Councillor Whetstone that Council proclaim the second week of June as Communities in Bloom Week (June 5 to 11, 2016) in the Municipality of Bluewater. Carried. Moved by Councillor Irvin, seconded by Councillor Zimmerman that Council approve registration of the Municipality of Bluewater in the 2016 Communities in Bloom Provincial Evaluated Program; and that, professional judges be invited to evaluate Bluewater from July 26 to 28, Carried. Moved by Councillor Zimmerman, seconded by Councillor Becker that Council direct staff to accept the proposed budget as amended with National Trust for Canada as a requirement of summer student funding under the Young Canada Works in Heritage Organizations program. Carried. FIRE D. RENNER Appointment of District Fire Chief s Moved by Councillor Becker, seconded by Councillor Roy that By-law , being a by-law to appoint Dave Long as the District Fire Chief of the Hensall Station be given first, second, third and final reading and finally passed this 16 th day of May, Carried. Moved by Councillor Roy, seconded by Councillor Becker that By-law , being a by-law to appoint Jeff Denys as the District Fire Chief of the Brucefield Station be given first, second, third and final reading and finally passed this 16 th day of May, Carried. 4

5 Exeter Fire Department Purchase of Pumper Truck Moved by Councillor Becker, seconded by Councillor Roy that Council receive the Exeter Fire Department, Purchase of Pumper Truck report for information purposes. Carried. TREASURY A. WILLERT Municipal Drain Petition Zurich, Hay East Ward Moved by Councillor Zimmerman, seconded by Councillor Irvin that Council accepts the request for drainage works in accordance with Section 78 for repairs and improvements of the Drainage Act R.S.O and that Council appoints Dietrich Engineering as engineer to investigate and prepare a report on the Brenner Drain. Carried. 1 st Quarter Variance Report Moved by Councillor Becker, seconded by Councillor Irvin that Council accept the 1 st Quarter Variance Report for information purposes. Carried. 8. COUNCILLORS Issues Mayor Hessel stated that in the Deputy-Mayor s absence he was asked to inform Council that the stairs giving beach access to residents at Glass Street has been closed due to safety concerns. The Deputy-Mayor would like to know if the repairs could come out of the parks reserve fund. Staff have investigated the work needed to be done to repair the steps and will bring the cost of the repairs and permits needed to a future meeting. Councillor Roy inquired when the paving at the beach by the marina would be completed. J. Walker stated that the pier work is now completed so the paving should be done in mid June. Councillor Roy stated that he has received complaints regarding the bump on Crystal Springs Road. J. Walker stated that a sign can be erected. Mayor Hessel stated that the Lions would like to use Clan Gregor Square as their start and finish point for their upcoming dog walk. Council had no issues with this. Councillor Irvin asked for clarification on the Huron County Health Unit survey for health issues regarding wind turbines. Mayor Hessel stated that the Board of Health would like to work in conjunction with Grey Bruce and the Province and make sure that there is no duplication of work being done. Councillor Irvin asked what Bluewater residents are to do if they are experiencing health issues related to wind turbines. Currently staff are directing residents to the Minister of the Environment and the Huron County Health Unit. 5

6 Councillor Gillespie stated that Council is waiting on a report from staff regarding who will track these issues. Moved by Councillor Gillespie, seconded by Councillor Irvin that Bluewater staff track health related issues caused by wind turbines. Motion Lost. Councillor Gillespie requested a recorded vote. In favour of the motion: Councillors Gillespie, Irvin and Roy. Opposed to the motion: Mayor Hessel, Councillors Becker, Whetstone and Zimmerman. Councillor Gillespie stated that he would take it upon himself to track these concerns. Councillor Becker asked when the street lights in Dashwood would be replaced. Staff stated that they have been told that this should be completed by the end of May. Councillor Becker stated that the Dashwood Fireman s Breakfast will be held this Saturday May 21, 2016 from 7:00 to 11:00 a.m. Mayor Hessel stated the Bayfield Lion s Club Breakfast will be this Sunday May 22, 2016 from 8:00 until noon. Councillor Gillespie stated that the province announced last week that they will be soliciting additional wind turbines coming to south western Ontario and mentioned Bluewater. Councillor Whetstone inquired if the south pier work is completed and open for use. J. Walker stated that it is open for pedestrian traffic. Councillor Whetstone noted that the first portion looks good but the last portion has a piece of rebar sticking up that should be cut down. J. Walker will look into this. New Business Councillor Roy stated that he received some very informative information regarding Speed Signs, Columbarium s and LED lighting at the OSUM Conference. He passed this information on to staff to look at. Moved by Councillor Becker, seconded by Councillor Roy that staff call and inquire when Bluewater can get the CHIP speed sign. Carried. Mayor Hessel stated that the RFP for Clan Gregor Square Playground Equipment was on the Municipal website. Shoreline Protection Management Plan Councillor Gillespie Councillor Gillespie gave Council an update from the Shoreline Protection Management Plan meeting held last week. Concerns were raised regarding how and where sludge from the marina is disposed of. The draft plan should be completed in June and it will include a component regarding shoreline protection along the lakeshore. 6

7 Correspondence Bayfield Vette Fest Council reviewed the request from the Bayfield Vette Fest wanting to host a beer bistro at the Vette Fest at Clan Gregor Square in Bayfield on July 9, Council agreed that they are not in favour of allowing alcohol at Clan Gregor Square in Bayfield. Bayfield Volk Fest Council reviewed correspondence from Ryan Somers regarding Volkfest being held on September 25, 2016 at Clan Gregor Square. Council is not in favour of allowing camping at the park. Councillor Whetstone stated that they are looking at having camping at a different location. AMO Delegations Mayor Hessel referred to correspondence regarding AMO delegation requests, the deadline for submissions is June 29, Clinton Public Hospital Foundation Council reviewed correspondence from Clinton Public Hospital Foundation asking for donations for their gala event being held on June 11, Moved by Councillor Whetstone that Council approve $2500 to be paid directly towards a hospital project. No seconder was received. Moved by Councillor Zimmerman, seconded by Councillor Becker that Council approve $2000 to be paid directly towards a hospital project. Carried. Moved by Councillor Zimmerman, seconded by Councillor Whetstone that Council support the resolution from the Town of Amherstburg regarding Bill 180 Workers Day of Mourning. Carried. Moved by Councillor Whetstone, seconded by Councillor Roy that Council support the City of Timmins regarding the regulation of gas prices in Ontario. Carried. 9. CONFERENCE, COMMITTEE AND BOARD REPORTS Mayor Hessel stated that he attended 3 great conferences within the last month. 10. IN CAMERA SESSION Moved by Councillor Zimmerman, seconded by Councillor Roy that Council move into an in camera session at approximately 9:20 p.m. to discuss a 2 personal matters regarding identifiable individuals with the CAO, Manager of Corporate Services/Clerk in attendance. Carried. Moved by Councillor Zimmerman, seconded by Councillor Gillespie that Council move into an open session at approximately 9:42 p.m. Carried. Moved by Councillor Zimmerman, seconded by Councillor Whetstone that the CAO bring back a report to the May 24 th Special Council meeting regarding bringing in temporary help in the absence of the Manger of Facilities. Carried. 13. CONFIRMATORY BY-LAW Moved by Councillor Gillespie, seconded by Councillor Roy that By-law being a Confirmatory bylaw be given first, second, third and final reading and finally passed this 16 th day of May Carried. 14. ADJOURNMENT Moved by Councillor Zimmerman, seconded by Councillor Gillespie that the meeting be adjourned at approximately 9:44 p.m. Carried. 8
