5 TOEPASLIKE WETGEWING/ APPLICABLE LEGISLATION THE CONSTITUTION OF THE REPUBLIC OF SOUTH AFRICA, Chapter (1) Public Administration must be governed by the democratic values and principles enshrined in the Constitution including the following principles: (a) A high standard of professional ethics must be promoted and maintained; (b) Efficient, economic and effective use of resources must be promoted;

6 TOEPASLIKE WETGEWING/ APPLICABLE LEGISLATION PUBLIC FINANCE MANAGEMENT ACT To regulate financial management in the national government and provincial governments; To ensure that all revenue, expenditure, assets and liabilities of those governments are managed efficiently and effectively; To provide for the responsibilities of persons entrusted with financial management in those governments; and To provide for matters connected therewith.

7 TOEPASLIKE WETGEWING/APPLICABLE LEGISLATION SOUTH AFRICAN SCHOOLS ACT, 84 OF 1996 Section 16A(2) (2) The principal must: (h) assist the governing body, the management of the school s funds, which assistance must include- Provision of information Provision of advice to the governing body relating to financial implications of decision taken (i) Take all reasonable steps to prevent financial maladministration or mismanagement by any staff member or by the governing body (j) Must be member of the finance committee or delegation of the governing body or manage any matter that has financial implications (k) Report any maladministration or mismanagement of financial matters to the governing body and to the Head of Department (3) The principal must assist the governing body in the performance of its functions and its responsibilities, but such assistance and participation must not be in conflict with: (a) Instructions of the Head of Department; (b) Legislation or policy; (c) An obligation that he she has towards the HOD or MEC
