1 January 11, 2017 Page 1 of 6 minutes Wednesday, January 11, :00 pm Middlesex Centre Municipal Office MINUTES The Municipal Council of the Municipality of Middlesex Centre met in Regular Session in the Council Chamber on January 11, 2017 at 4:00 pm. COUNCIL PRESENT: Mayor Edmondson - Chair presiding, Deputy Mayor DeViet, Councillors Harvey, Brennan, Silva and Berze. REGRETS: Councillor McMillan STAFF PRESENT: Michelle Smibert CAO, Stephanie Troyer-Boyd Clerk, Arnie Marsman Director of Planning and Development Services, Brian Lima Director of Public Works and Engineering, Scott Mairs Director of Community Services, Tiffany Farrell Director of Corporate Services, Ben Puzanov Senior Planner. ALSO PRESENT: Members of the public and press. 1.0 CALL TO ORDER Mayor Edmondson calls the meeting to order at 4:00 pm. 2.0 ADOPTION OF THE ADDITIONS TO THE AGENDA There were no additions to the agenda on January 11 th, BUSINESS FOR WHICH PREVIOUS NOTICE HAS BEEN GIVEN 3.1 Notice of Motion to be considered at the January 25 th, 2017 Meeting of Council (Councillor Silva) THAT staff prepare a report on the ramifications of lowering the minimum water and wastewater usage rates in 2018 by 2.5%, 5% and 10%. 4.0 DISCLOSURE OF PECUNIARY INTEREST AND THE GENERAL NATURE THEREOF The Municipal Conflict of Interest Act requires any member of Council declaring a pecuniary interest and the general nature thereof, where the interest of a member of Council has not been disclosed by reason of the member s absence from the meeting, to disclose the interest at the first open meeting attended by the member of Council and otherwise comply with the Act. 2 January 11, 2017 Page 2 of 6 minutes Council Minutes 2 January 11, ADOPTION OF THE MINUTES R Motion by Councillor Berze and Councillor Harvey THAT the December 7th, 2016 minutes be adopted as printed; and FURTHER THAT the December 14th, 2016 Minutes be adopted as printed. 6.0 CONSENT AGENDA Items listed under the Consent Agenda are considered routine and may require discussion but no action on the part of Council. Consent items are received in one motion. Council members may request that one or more item be removed for further action. R Motion by Deputy Mayor DeViet and Councillor Harvey 1. THAT CPS Tax Rate Analysis 2017 be received. 7.0 STAFF REPORTS 7.1 CPS Budget Estimates and Tax Rates 2017 Councillor Silva asked what the purpose of the gravel pit reserve fund was. Brian Lima explained that the fund is to account for costs of rehabilitation when the pits have expired. Councillor Brennan questioned the amount budgeted for the Prince Andrew Park. Tiffany Farrell noted that the funds are going into a reserve. Councillor Brennan stated that he still has a significant concern with the tax rate increase and how that will affect farm properties given the assessment increase on farmland. Councillor Berze noted that reducing the farmland ratio below the present 25% would cripple other municipalities in the county. He stated that the issue needs to be considered by the province and that it isn t solely a Middlesex Centre problem. Councillor Brennan stated that he understands this but he believes in this municipality, we need to be aware of the issue and a 2.38% tax increase is too much. Deputy Mayor DeViet stated that the municipality is battling higher costs with hydro, Conservation Authority increases while trying to build reserves and this increase is quite small considering the other factors. Councillor Brennan suggested spreading out some projects over more than one budget year. Director of Corporate Services, Tiffany Farrell stated that in this reassessment year, the municipality is not seeing any growth reassessment dollars. She noted that it is significantly lower than 2016 assessment growth. As this is the first year in the 4 year assessment cycle, will see higher assessment numbers. Councillor Berze stated that the budget isn t just about today or 2017, it s about the future as well. Council should not just hammer down and keep an increase at an arbitrary rate which would require cutting from reserves and projects without considering how it will affect the future financial picture of the municipality.

3 January 11, 2017 Page 3 of 6 minutes Council Minutes 3 January 11, 2017 R Motion by Councillor Silva and Deputy Mayor DeViet THAT By-Law to adopt the current budgetary estimates for the year 2017 be approved; and FURTHER THAT By-Law to establish a levy for the year 2017, to adopt tax rates for 2017 and to provide for penalty and interest in default of payment and the collection thereof be approved. 7.2 CPS Ontario Regulation 2017 Budget Impacts R Motion by Councillor Berze and Councillor Silva THAT the compliance report for expenses excluded from the 2017 budget outlined in report CPS as a requirement of Ontario Regulation 284/09 passed under the Municipal Act, 2001 be adopted. 7.3 CPS Accessibility Policy R Motion by Councillor Silva and Councillor Berze THAT the updated Accessibility Policy dated January 2017 be approved. 7.4 BLD Animal Control By-Law Amendment R Motion by Councillor Silva and Councillor Berze THAT By-law be revised to require that impounded dogs be retained for a minimum of three days excluding the day of seizure and holidays. 7.5 PWE Oxbow Drive Reconstruction Tender Results R Motion by Councillor Harvey and Deputy Mayor DeViet THAT the 2017 Oxbow Drive Reconstruction Project be awarded to the lowest tender bid submission received from Titan Group Construction Inc. in the amount of $1,446, (excluding HST); and FURTHER THAT the Municipality s current engineering services provision agreement with AECOM Canada Ltd be extended to include contract

4 January 11, 2017 Page 4 of 6 minutes Council Minutes 4 January 11, 2017 administration and site supervision for the 2017 Oxbow Drive Reconstruction Project in the amount of $87, (excluding HST); and FURTHER THAT exp. Services Inc. be retained to conduct a geotechnical investigation in conjunction with the 2017 Oxbow Drive Reconstruction Project in the amount of $11, (excluding HST); and FURTHER THAT the Mayor and Clerk be authorized to execute the necessary contract documents. 7.6 PWE Single-Axle Truck Tender Results R Motion by Councillor Berze and Councillor Silva THAT the purchase, supply and delivery of one (1) single-axle truck complete with combination dump body including snow & ice removal equipment be awarded to the lowest tender bid submission received from Team Truck Centres in the amount of $261, (excluding HST). 7.7 PWE Four Wheel Drive Tractor Tender Results R Motion by Councillor Harvey and Deputy Mayor DeViet THAT the purchase, supply and delivery of one (1) four wheel drive articulating tractor complete with attachments be awarded to the tender bid submission received from Work Equipment Ltd. in the amount of $194, (excluding HST). 7.8 PWE Vibratory Soil Compactor Tender Results R Motion by Councillor Harvey and Councillor Silva THAT the purchase, supply and delivery of one (1) vibratory soil compactor be awarded to the lowest tender bid submission received from Toromont CAT in the amount of $152, (excluding HST). 7.9 PWE kg Single Cab Truck Tender Results R Motion by Councillor Harvey and Councillor Silva THAT the purchase, supply and delivery of one (1) 7,485 kg single cab truck with aluminum dump box be awarded to the lowest Request for Quotation submission received from Mt. Brydges Ford Sales Ltd. in the amount of $65, (excluding HST).

Brydges Ford in the amount of $165, (excluding HST). 8.0 IN CLOSED SESSION R Motion by Deputy Mayor DeViet and Councillor Harvey THAT Council move in to closed session at 4:51 pm to discuss advice that is subject to solicitor-client privilege, including communications necessary for that purpose (Edgewater Subdivision Kilworth); in accordance with Section 239(2)(f) of the Municipal Act, S.O. 2001, c.25 as amended.
