4 Legal Basis - Regulation (EU) No 1290/2013 ARTICLE 13 - PROPOSALS "A proposal which contravenes ethical principles or any applicable legislation, or which does not fulfil the conditions set out in Decision No 2013/743/EU, in the work programme, in the work plan or in the call for proposals may be excluded from the evaluation, selection and award procedures at any time." ARTICLE 14 - ETHICS REVIEW 1. The Commission shall systematically carry out ethics reviews for proposals raising ethical issues. That review shall verify the respect of ethical principles and legislation and, in the case of research carried out outside the Union, that the same research would have been allowed in a Member State. 2. The Commission shall make the process of the ethics review as transparent as possible and ensure that it is carried out in a timely manner avoiding, where possible, the resubmission of documents.

5 Legal Basis - Regulation (EU) No 1290/2013 Article 18 Grant Agreement The grant agreement shall, where appropriate, contain provisions ensuring the respect of ethical principles, including the establishment of an independent ethics board and the right of the Commission to carry out an ethics audit by independent experts. Article 23 - Implementation of actions Participants shall comply with national legislation, regulations and ethical rules in the countries where the action will be carried out. Where appropriate, participants shall seek the approval of the relevant national or local ethics committees prior to the start of the action.

6 Legal Basis - Regulation (EU) No 1290/2013 ARTICLE 34 - ETHICS The beneficiaries must carry out the action in compliance with: a) ethical principles (including the highest standards of research integrity and including, in particular, avoiding fabrication, falsification, plagiarism or other research misconduct) b) applicable international, EU and national law. Funding will not be granted for activities carried out outside the EU if they are prohibited in all Member States. The beneficiaries must ensure that the activities under the action have an exclusive focus on civil applications. ARTICLE 39 PROCESSING OF PERSONAL DATA The beneficiaries must process personal data under the Agreement in compliance with applicable EU and national law on data protection (including authorisations or notification requirements).

9 Ethics Review in practice Ethics review process: Pre-screening for proposals with no declared ethics issues (if ethics issues identified after pre-screening, screening should be done at the same time) confirmation of no ethics issues= "ethics clearance" Screening : The screener should confirm and check if all ethics issues are adequately addressed Assessment (RTD) if serious or complex ethics issues requiring in-depth analysis (exception: use of hesc: should directly undergo an ethics assessment) The ethics review may lead to ethics requirements in the Grant Agreement (Annex I)

10 Ethics Review in practice The Ethics Screening Report must contain an opinion on the proposal: ethics clearance Proposals that are 'ethics-ready' (i.e. respect ethical principles and applicable laws) receive ethics clearance. conditional ethics clearance The clearance is subject to conditions that must be included as 'ethics requirements'. The requirements become contractual obligations and are consequently included in Annex 1 of the Grant Agreement unless it is considered that the requirements should be fulfilled before the Grant signature. These conditions may include: regular reporting to the Commission/Executive Agency the appointment of an independent ethics advisor or ethics board that may be tasked to report to the service/executive Agency on the compliance with the ethics requirements an Ethics Check or Audit and their most suitable timeframe submission of further information/documents necessary adaptation of the methodology to comply with the ethical principles and relevant legislations

11 Ethics Review in practice ethics assessment recommended The experts may list additional information that the applicants should provide prior to the ethics assessment to facilitate its conduct. no ethics clearance ( negative ethics opinion ) Reasons for the negative ethics opinion must be stated.

12 Ethics Review in practice When some or all of the research activities are carried out outside the EU, the applicants must confirm that the proposed research is compatible with the Union and International legislation and could have been legally conducted in one of the EU Member States. This compatibility can be confirmed by an appropriate EU national ethics structure. If there are no appropriate national structures to give a positive opinion for the proposed activities, the conclusions of the Ethics Review will be the binding opinion. The signature of the Grant can only take place after the Ethics Review and when the conditions that should be fulfilled before the signature are met.

15 Ethics in proposal Any subject can rise ethical issues Clinical study on humans especially if involving hhsc or embryos or foetal tissues/cells Study involving animals for every reason especially if primates Any study that involves human participants especially children and fragile people Projects that can harm environment and climate Projects that request personal data collection especially if healthcare or data protected by privacy Do not underestimate the ethical issues that your proposal can rise
