This application for Special Exception is to permit the establishment of a +/- 991 sq. ft. liquor store on the ground floor of a parking garage near the corner of Assembly and Main Streets. The proposed liquor store is zoned C-5, -DD (Central Business District in the Design Development Overlay, as are the properties to the north, south, and east of the property. Across Assembly Street to the west is the C-4 district (Central Area Commercial. The general vicinity hosts a variety of office, hospitality, retail, and residential uses. The nearest liquor store is Green s Beverages at 400 Assembly Street, about 1.3 miles away. Rosewood Liquor and Wine is at 2910 Rosewood Drive (1/2 mile. The nearest Elementary School is at St Peter s Catholic Church on Assembly Street (630 feet, which is also the nearest church. First Baptist church is also about 775 feet away. Should the Board be inclined to approve this request, staff asks that you consider the following item as a condition of your approval: Following vacancy, abandonment, or discontinuance of this use for a period of 12 consecutive months, the special exception shall be considered completed and shall expire. This is scheduled to be considered next week at the Board of Zoning Appeals to be considered for a special exception to allow this use. I do not believe it would be positive for downtown due to its proximity to other residential and community uses as well as being co located next to check cashing businesses and a convenience store which already sells wine, beer, and lottery tickets.
