2 2 G. RECONSIDERATION Moved by Councillor D. Pratt Seconded by Councillor A. Loney RESOLVED THAT Council Reconsider Recommendations 1 and 3 of Motion No. 23, which reads as follows: 1. The implementation of a 70km/h speed limit on West Hunt Club Road/Hunt Club Road (Regional Road 32) between Cedarview Road (Regional Road 23) and a point 660 m east of Bowesville Road; 3. The implementation of a 70 km/h speed limit on Hunt Club between a point 110 metres east of Cahill Drive and Hawthorne Road (Regional Road 32). H. MOTION TO INTRODUCE COMMITTEE REPORTS COMMUNITY SERVICES COMMITTEE REPORT NO CORRESPONDENCE FROM THE CO-OPERATIVE HOUSING FEDERATION OF EASTERN ONTARIO S AS AMENDED 1. That Council support the Co-operative Housing Federation of Canada's suggested motion to "call upon the federal government to give serious consideration to the proposal put forward by the co-operative housing sector to administer the federally-assisted co-operative housing portfolio through a new, non-profit non-governmental organization established for that purpose". 2. That the RMOC urge the Federal Government not to download the jurisdiction of social housing to the Provinces until the Ontario Provincial Government s intentions towards municipalities are made clear.

3 3 2. POTENTIAL IMPACT OF MEGA-WEEK ANNOUNCEMENTS CONCERNING FUNDING OF LONG TERM CARE S That Regional Council: 1. Ask the Province of Ontario, in light of the announcement that municipalities fund 50% of long term care, to rescind the decision to create an independent Community Care Access Committee in Ottawa-Carleton and transfer responsibility for the management of the Home Care and Placement Coordination Services to the Region; 2. Ask the Province to recognize the full partnership role of the Region in decision- making and approval of any changes in the long term care system for which the Region has funding responsibility. 3. IMPACT OF CHANGES TO WORKERS COMPENSATION ON REGIONAL TAXPAYERS S AS AMENDED WHEREAS the Ontario government has introduced Bill 99, legislation which rewrites the Workers Compensation Act; and WHEREAS Bill 99 limits or outlaws compensation for certain disabilities compensated under the current Act; and WHEREAS traditional sickness and accident insurance programs view these disabilities as work-related and are thus not likely to take responsibility for them; and WHEREAS the health care system and social assistance programs will be expected to provide care and income for those workers whose work-related disabilities are not recognized by either workers compensation or private insurance plans; and WHEREAS Queen s Park s downloading means regional government will have an expanded role to play in funding these programs, including social assistance disability payments, home care and long-term care; and

4 4 WHEREAS previous changes by senior governments have had dramatic impacts on local budgets -- for example, tightened eligibility for Unemployment Insurance led to increases in regional welfare costs; BE IT THEREFORE RESOLVED THAT before changes are enacted to workers compensation legislation, the provincial government commission a comprehensive study to examine the impact on municipal expenditures and guarantee to provide local government with the necessary funding to cover all expenses which may be downloaded to regional property taxpayers; and FURTHER THAT public hearings on Bill 99 be held in Ottawa-Carleton in order that municipalities, citizens and community organizations have an opportunity to address these changes; and FURTHER THAT copies of this resolution be circulated to all Ottawa-Carleton MPP s, the Minister of Labour and all provincial party leaders. CORPORATE SERVICES AND ECONOMIC DEVELOPMENT COMMITTEE REPORT NO GLEN CAIRN WATER RESERVOIR MODIFICATIONS CONTRACT CW CONTRACT AWARD That Council approve the award of Contract No. CW-6137 to Modern Mechanical Inc., Kanata, for modifications to the existing Glen Cairn Reservoir for a total contract provision of $359,944.

5 5 2. ORLEANS SOUTH WATERMAIN PROJECT PROPOSED AGREEMENT WITH URBANDALE CORPORATION AND MINTO DEVELOPMENT INC. S AS AMENDED That Council approve: 1. That the Region enter into an agreement with Urbandale Corporation, Minto Developments Inc. and Queenswood Land Associates to transfer to them previously reserved water capacity from the existing East Urban Area in Cumberland west of Trim Road to the East Urban Centre Expansion area in Cumberland south of Innes Road subject to letters of credit being provided to the Region; 2. That funds in the amount of $350,000 for Phase I E.U.C. Feedermain Needs Engineering Design and Easement Acquisition be transferred from the 1995 Watermain Rehabilitation Programme Account No SECURITY BOND SECTION 92 (3) MUNICIPAL ACT R.S.O. 1990, CHAPTER M.45 That Council receive this report for information. 4. APPOINTMENT: OTTAWA CONGRESS CENTRE BOARD OF DIRECTORS S That Council approve: 1. The re-appointment of the Regional Chair, Peter Clark, as one of the Region s three representatives on the Board of Directors of the Ottawa Congress Centre, for a three-year term beginning 1 January 1997 and ending 31 December 1999;

6 6 2. The appointment of Mr. Mark Moore, General Manager of Novotel Ottawa and President, Ottawa Hoteliers de l Outaouais Inc. (OHOI), to the Ottawa Congress Centre Board of Directors, for a three year term effective 1 January 1997 and to expire 31 December CORPORATE SERVICES AND ECONOMIC DEVELOPMENT COMMITTEE NO WATERMAIN OVERSIZING REPAYMENT WATERMAIN CONSTRUCTION REPAYMENT KANATA CENTRUM PHASE II - PENEX KANATA LTD. That Council approve the payment to Penex Kanata Ltd., Nepean, for the oversizing costs of the 610 mm watermain in Castlefrank Road from Campeau Drive to Earl Grey Drive in the amount of $55, and the construction costs of the 406 mm watermain in Terry Fox Drive from the Goulbourn Side Road to Roland Michener Drive in the City of Kanata in the amount of $97, for a total amount of $152, MUNSTER HAMLET LAGOON REHABILITATION AND UPGRADE PROGRAMME CONTRACT EXTENSION, CONTRACT NO. CC-2058 DETAILED ENGINEERING DESIGN SERVICES That Council approve the next phase to Contract CC-2058 with Totten Sims Hubicki Associates, Kanata, to provide detailed Engineering Design services for the rehabilitation and expansion at the Munster Hamlet sewage treatment lagoons in the amount of $467,342.25, bringing the revised total contract provision to $856,

7 7 3. ROBERT O. PICKARD ENVIRONMENTAL CENTRE DIGESTER GAS UTILIZATION CONTRACT NO. CG-164 CONTRACT EXTENSION - FIELD SERVICES That Council approve an increase in scope to Contract No. CG-164 with CH2M Gore and Storrie Limited to provide construction contract administration and field supervision services for the supply and installation of Cogeneration Facility equipment at the R.O. Pickard Environmental Centre in the amount of $324,600, bringing the revised total contract provision to $693, PERMANENT SEWER FLOW MONITORING SERVICES CONTRACT NUMBER CS-7806 That Council approve the appointment of Delcan Corporation, Ottawa, to implement a permanent sewer flow monitoring network for a total contract provision of $783, SNOW AND ICE CONTROL ROUTE PLANNING AND OPTIMIZATION That Council approve Phase II of the assignment with PSR Group Limited, Nepean, for the engineering services for Snow and Ice Control Route Planning and Optimization, in the amount of $50,000, bringing the revised contract total to $75,000.

8 8 6. WATER EXTENSION OF SERVICES GOULBOURN - CYPRESS GARDENS S That Council approve: 1. That water supply be extended by the Region to Cypress Gardens North in conjunction with the local improvements being installed by the Township of Goulbourn; 2. That the construction of the watermains and the services to the lot line be financed through a water works rate, pursuant to the Municipal Act, section 221, based on the percentage of the rateable frontage of the properties; 3. That the water works rate be amortized over 10 years with the option to the property owner to pay the entire rate initially upon completion of the construction of the watermain; 4. That debentures be issued, at the market rate of interest, up to the amount of $314,500 and that the Finance Commissioner be authorized to pay all expenses and carry out such procedures as may be required to successfully finalise the debenture sale, and; 5. That the Corporation of the Township of Goulbourn be appointed as the agent of the Region and enter into an agreement for the installation of watermains and water services. 7. PLAZA BRIDGE METCALFE STREET EXTENSION LANDS RMOC - FEDERAL AGENCIES NEGOTIATIONS S That Council: 1. Accept the transfer of the Plaza Bridge from Public Works and Government Services Canada (PWGSC), the National Capital Commission (NCC) and the Minister of Canadian Heritage to RMOC;

9 9 2. Accept a contribution in the amount of $20,000,000 from PWGSC towards rehabilitation of the Plaza Bridge and maintenance for 15 years to RMOC standards; 3. Acquire a parcel of land known as the Metcalfe Street Extension for a nominal consideration of $1.00; 4. Authorize finalization of agreements with PWGSC, the NCC, Minister of Canadian Heritage and the Region, substantially in accordance with the conditions outlined in the body of this report. 8. CARP AIRPORT OPERATION AND MANAGEMENT S AS AMENDED That Council approve the following: 1. That for the interim, Regional Council request the current Airport Authority to continue its management of the airport under contract; 2. That the longer term operation of the Carp Airport be carried out on the basis of a contractual arrangement with the Ottawa Macdonald-Cartier International Airport Authority and that staff be authorized to enter into an agreement with the Ottawa Macdonald-Cartier International Airport Authority; 3. That the Planning and Development Approvals Department in association with Ottawa-Carleton Economic Development Corporation and the Township of West Carleton prepare a development strategy for economic development at Carp Airport. 9. RESPONSIBILITY FOR ANIMAL CONTROL AND POUND FUNDING IN OTTAWA-CARLETON S That Council: 1. Endorse the principle that animal pound services is a fundamental and integral component of animal control;

10 10 2. That the Area Municipalities, as the agency responsible for animal control, assume complete responsibility for pound services funding effective January 1, 1998; 3. That the Humane Society of Ottawa-Carleton s 1997 grant allocation for $357,000 be approved. 10. REALIGNMENT OF DUE DATES FOR THE REMITTANCE OF PAYMENTS FROM THE AREA MUNICIPALITIES FOR THE RMOC S TAX LEVY S AS AMENDED That Council approve: 1. The realignment of the Regional tax levy due dates to coincide with each Area Municipality s property tax bill due dates (with the exception of Provincial payments in lieu, sewer surcharge and fire supply charge), effective January 1, 1998; 2. That the Regional levy requirements be apportioned equally over the number of property tax due dates for each municipality; 3. That Recommendation No. 3 as follows be deleted: That these levy due dates be no later than the 1996 levy due dates; 4. That the RMOC s share of payments in lieu become due within 5 business days from when they are received by the Area Municipality; 5. The restatement of the Regional mill rates to adjust for the difference in revenue.

11 ADMINISTRATION REGIONAL DEVELOPMENT CHARGES APPEALS S AS AMENDED That Council confirm that: 1. Regional Development Charges are payable by Brookside Manor (Kanata) Inc. in respect of a seniors retirement home for 23 dwelling units at the two bedroom apartment rate ($4,323) for a total amount of $99,429; 2. That the proposed redevelopment at 207 MacLaren Street be charged for 2 apartments at the one bedroom rate of $2,676 for a total amount of $5, SALE OF SURPLUS PROPERTY CARILLON STREET - CITY OF VANIER S That Council: 1. Declare the property described as being part of Lot 26, Registered Plan 113, formerly Township of Gloucester, now City of Vanier, consisting of square metres and shown as Parts 1 and 3, Plan 4R-11167, surplus to Regional needs; 2. Approve the sale of Part 1, Plan 4R to Jean-Claude and Jeannine Jobin Dompierre for the amount of $1, pursuant to an agreement of Purchase and Sale that has been received; 3. Approve the conveyance of Part 3, Plan 4R to the City of Vanier as part of Carillon Street. 13. CARLETON UNIVERSITY S INSTRUCTIONAL TELEVISION CHANNEL That Council support Carleton University s application to the Canadian Radio and Telecommunications Commission for a broadcast license in order that Carleton University may continue to provide its instructional television channel.

12 APPOINTMENTS TO TRANSITION TEAMS RE: PROVINCIAL ANNOUNCEMENTS ISSUED DURING MEGAWEEK That Council endorse that the Association of Municipalities of Ontario (AMO) be the approving body for the municipal transition teams regarding the Provincial announcements during Megaweek. 15. COMMUNICATION OF INFORMATION TO OTTAWA-CARLETON RESIDENTS RE: IMPACT OF PROVINCIAL ANNOUNCEMENTS ISSUED DURING MEGAWEEK Whereas the Provincial Government has announced its intention to shift the responsibility for funding certain services to the property tax base (herein called Megaweek ); Whereas Ottawa Carleton residents require full and complete information on the impacts of Megaweek on the property tax base; Be it Resolved that Council approve that $250,000 from the Region Wide Capital Reserve Fund be identified and allocated for the purposes of research and communicating information on Megaweek MANAGEMENT BOARD REPORT NO PUBLIC AWARENESS CAMPAIGN AS AMENDED That Council receive this report for information.

13 13 PLANNING AND ENVIRONMENT COMMITTEE REPORT NO THE WATER AND SEWAGE SERVICES IMPROVEMENT ACT 1997, SEPTIC SYSTEM REGULATION S That Council: 1. Approve the following comments addressed to the Ministry of the Environment and Energy concerning the Water and Sewage Services Improvement Act, 1997 (Bill 107); 2. Recommend to the Ontario Legislature amendments to the first reading version of Bill 107 assigning responsibility for the Part VIII Program to the upper tier municipalities; 3. Recommend that all local municipalities in Ottawa-Carleton enter into an agreement with the Region providing for the performance of the local municipality s responsibilities pursuant to section 75.1(6) of Bill 107, should the proposed legislation not be amended by the legislature, and; 4. Approve the further delegation of these responsibilities to the Conservation Authorities who presently perform these functions. 2. SUMMARY OF ASSIGNED FUNCTIONS OFFICIAL PLAN AMENDMENTS, SUBDIVISIONS, CONDOMINIUMS, PART LOT CONTROL BY-LAWS, ZONING BY-LAWS, SITE PLANS AND SEVERANCES That Council receive this report for information. Included in this report is one appeal of a subdivision application under Bill 20 by an outside source (see Annex V).

14 14 TRANSPORTATION COMMITTEE REPORT NO USE OF REGIONALLY OWNED RAILWAY CORRIDOR LANDS S AS AMENDED That Council: 1. Adopt the policies outlined in this Report to permit specified interim uses; 2. With respect to third party use of those railway corridor lands acquired by the Region, use of the lands be made the subject of an agreement, in terms described generally in this Report; 3. That these agreements be signed by the Commissioner of Planning and Development Approvals or his delegate on behalf of the Region. 4. That Item 7 of Rail Corridor Land Use be amended to read as follows: That the Ward Councillor be notified in advance of any initiative and that it be the RMOC s practice that, on request of the Councillor, the application come to Committee and Council for approval.

15 15 TRANSPORTATION COMMITTEE REPORT NO MODIFICATIONS TO TOWNGATE SHOPPING CENTRE ACCESS ON BANK STREET 80 M SOUTH OF HUNT CLUB ROAD S AS AMENDED That Council approve the installation of traffic control signals at the access to the Towngate Shopping Centre on Bank Street 80 m south of Hunt Club Road, subject to a public hearing if required and subject to the owner: 1. paying the total cost of the signal installation, related road works and the modifications to the existing signals at the intersection of Bank and Hunt Club. Should traffic at the Bank Street or Hunt Club Road intersection be hampered by the proposed new traffic control signal, the entrance to the shopping centre will be reinstated to its original condition at full cost to the developer. 2. executing a legal agreement with respect to 1. above; I. MOTION TO ADOPT COMMITTEE REPORTS J. MOTION TO INTRODUCE BY-LAWS THREE READING 1. Being a By-law to authorize the levy of sums required for the repayment of debenture number 97-2 issued in the amount of $17, (to aid in the construction of tile drainage works in The Corporation of the Township of Osgoode and The Corporation of the Township of Rideau). 2. Being a By-law to provide for the use of both official languages on prescribed forms, notices, forms (other than prescribed forms) and other information provided under the Municipal Elections Act, Being a By-law to authorize the levy of sums required for the repayment of debenture number 97-3 issued in the amount of $63, (to aid in the construction of tile drainage works in The Corporation of the Township of Cumberland, The Corporation of the City of Gloucester, The Corporation of the Township of Osgoode and The Corporation of the Township of West Carleton).

MOTIONS (OF WHICH NOTICE HAS BEEN PREVIOUSLY GIVEN) 1. Moved by Councillor B. McGarry Seconded by Councillor A. Loney WHEREAS many models of local governance have been and are being proposed, each with their own merits; and WHEREAS a process is clearly required to allow these models to be investigated, analyzed and debated by the public and to ensure that a made in Ottawa-Carleton solution is arrived at; and WHEREAS the ongoing nature of uncertainty over governance is demoralizing municipal staff, destabilizing inter-municipal relations and preventing local government from focusing on the considerable fiscal and social challenges we face. THEREFORE BE IT RESOLVED that the Council of the Regional Municipality of Ottawa-Carleton request that the Minister of Municipal Affairs and Housing undertake, on behalf of the Citizens of Ottawa-Carleton, the following: 1. Repeal the Regional Municipality of Ottawa-Carleton Act, effective December 1, 1998 in order to replace it with a new structure developed locally. 2. That to facilitate the establishment of a new act, the Minister delay the upcoming municipal election until November 9, 1998, with the registration/nomination day being March 31, The new council or councils would take office on December 1, 1998.

That the Minister immediately establish a panel of Ottawa-Carleton citizens, nominated by the councils of the Regional Municipality of Ottawa-Carleton and local municipalities, to hear submissions from politicians and, to identify guiding principles, to investigate all models of governance being proposed, hold public hearings across the region, undertake research on different political and administrative structures/models and produce a report by August 31, The Panel report is to be submitted to the 12 local councils with the object being to obtain the formula required by the Ministry of Municipal Affairs and Housing to implement a made-in-ottawa-carleton solution (a majority of local councils representing a majority of the population, plus a majority of Regional Council) by October 31, That members of the Citizens Panel sign a pledge that they will not be candidates in the 1998 municipal election. 5. That, in the event that the local solution falls short of the triple-majority, the Minister appoint a Commissioner to resolve the issue. FURTHER BE IT RESOLVED THAT this motion be forwarded to the Minister of Municipal Affairs and Housing for his immediate consideration and circulated to all area municipalities for endorsement. 2. Moved by Councillor A. Cullen Seconded by Councillor B. McGarry WHEREAS the Provincial Government has indicated that municipalities in Ontario will be restructured and reduced in number; WHEREAS municipalities in Ottawa-Carleton are currently examining various models of municipal governance for the region; WHEREAS there exists an opportunity to present to the public a range of choices in municipal structure, in order to elicit their preference, through placing a question (or series of questions) on the ballot for the 1997 municipal elections; WHEREAS one municipality in Ottawa-Carleton has indicated its interest in placing such a question on its ballot for the 1997 municipal elections; WHEREAS in order to assure full and fair debate across the region, and the participation of all electors throughout the region, on the matter of the most appropriate municipal

18 18 governance for Ottawa-Carleton, it is preferable that a common question (or series of questions) be placed on the ballot for all municipalities in Ottawa-Carleton for the 1997 municipal elections; THEREFORE BE IT RESOLVED THAT the Regional Municipality of Ottawa-Carleton endorse the concept of a common question (or series of questions) on the topic of municipal governance for Ottawa-Carleton to be placed on the ballot for all the municipalities in Ottawa-Carleton for the 1997 municipal elections; THAT this position be communicated to all municipal councils within Ottawa-Carleton, inviting their participation in developing a common question (or series of questions) on this matter; THAT such a question (or series of questions) should include (at least) reference to one-tier government, other forms of possible municipal governance (i.e. 3 cities, etc.), and the status quo; AND THAT the Regional Chair report to Regional Council on progress made in this regard no later than the first Regional Council meeting in December, L.
