Members Absent: McManus, Phillips, Miner, Jasperse. Ex-Officio Members Present: Geiger, Klein, Vujea. Ex-Officio Members Absent: None. Carr called the meeting to order at 5:30 p.m. Carr led the JPA members and the public in attendance in the recitation of the Pledge of Allegiance. Carr asked for comments regarding the minutes of the November 10, 2015 special meeting of the JPA, the draft minutes of the November 18, 2015 and December 16, 2015 meetings of the Joint Planning Commission, the draft agendas for the December 2, 2015 and January 6, 2016 meetings of the Rutland Township Planning Commission, and the draft minutes of the December 7, 2015 and January 4, 2016 meetings of the City of Hastings Planning Commission. No comment was forwarded. Motion by Redman, second by Brown to approve the minutes of the November 10, 2015 meeting of the JPA, and to receive and place on file the draft minutes of the November 18, 2015 and December 16, 2015 meetings of the Joint Planning Commission, the draft agendas for the December 2, 2015 and January 6, 2016 meetings of the Rutland Township Planning Commission, and the draft minutes of the December 7, 2015 and January 4, 2016 meetings of the City of Hastings Planning Commission. Motion carried. Carr asked for any suggested additions to the agenda for tonight s meeting. Carr asked that election of officers for the JPA for 2016 be added to the agenda under New Business. No other suggestions were forwarded. Motion by Haywood, second by Graham to approve the agenda for tonight s meeting as amended. Motion carried. Carr asked for comments from the public. 1

2 Vujea thanked Rutland Township for hosting the recent seminar on Tax Increment Financing. Carr asked for additional comments from the public. No comments were forwarded. Carr asked for reports regarding activities in the participating jurisdiction. Mansfield reported that the Hastings Planning Commission had approved a site plan for a new facility for the Barry County Community Mental Health Authority on Barfield Drive, and a site plan and special use permit for the open air sale of motor vehicles from a facility on Woodlawn Avenue. Carr and Haywood reported that the Rutland Township Planning Commission had approved a special use permit for the sale of maple syrup from a facility. Carr stated that progress was being made on the agreement creating a larger urban service district along West M-37 / 43. Carr stated that he and Mansfield would be meeting with the owner of a large parcel in the proposed district to discuss various questions that owner had. Carr announced the Mike Hallifax had been recently appointed by the Township Board to fill the vacancy left by the recent resignation of Trustee Dorothy Flint. Carr announced that the JPC would be holding a public hearing in two days to solicit comment regarding the draft JPC Zoning Ordinance and Zoning Map. Carr invited those present to attend the public hearing. Carr stated that the City s and Township s Attorneys were finishing work on the final details of the second Urban Services and Economic Development Agreement (USEDA) between the two parties. Mansfield stated that the two units of government expected to hold a joint public hearing to solicit comment on this draft agreement in the near future. Mansfield questioned the status of the design work for the utility extensions to serve properties within the Urban Service District created under the proposed USEDA. Carr stated that he had requested that Prein and Newhof begin preliminary work on the design of these utility systems, but that he would move this work ahead in an expedited fashion. Carr asked Mansfield and Brown to report on the status of the draft Urban Service Agreement allow the City to provide municipal services to properties currently located in Hastings Township and located west of the City. Brown reported that Hastings Township s Board had granted tentative approval of the draft agreement. Mansfield reported that the draft agreement would be presented to the City Council at their next meeting on January 25 th to seek their tentative approval. Mansfield explained that once both boards granted tentative approval of the agreement, public hearings would be scheduled to solicit public comment on the agreement. Mansfield explained that following the public hearing, a referendum period of 30 days was required prior to final execution of the agreement by the parties. Mansfield stated that the City was also working on related property ownership transfer agreements per the Township s request. Carr asked Mansfield to report on the latest meeting of the M-37 Corridor Committee. Mansfield explained that the M-37 Committee had convened a meeting to consider a proposal from the 2

3 representatives working on behalf Aldi for approval of a site plan for an Aldi Store to be located on West M-37 and the installation of a traffic signal at the intersection of M-37/M-43 and Cook Road. Mansfield stated that MDOT requested additional information from Aldi and questioned some of the data contained in a traffic study prepared by consultants working for Aldi. Mansfield stated that the M- 37 Corridor Committee tentatively approved the site plan as presented by Aldi and the installation of the traffic signal at M-37 / M-43 and Cook Road, subject to further review and approval by MDOT. Mansfield stated that the M-37 Corridor Committee recommended that Aldi work with the City to pursue the extension of Apple Street west from Industrial Park Drive to serve their site and connect to the extension of Cook Road. The Committee also recommended that an easement or location for a non-motorized trail be included along or near the former railroad ROW to the far westerly line of the proposed Aldi site. Mansfield reported that he was meeting with Jill Brown of Metro Recycling Solutions this week to discuss possible amendments to Metro Recycling s proposal to provide services as a recycling coordinator for Barry County. Mansfield explained that the Barry County Solid Waste Oversight Committee wished to see Metro s proposal revised to better reflect the requirements in the RFP for recycling coordinator services. Mansfield stated that Jill Brown had previously served on the BCSWO Committee and understood what the Committee was looking for from a recycling coordinator, but that the Committee wished to have better defined deliverables and measures for performance. Mansfield stated that the Committee hoped to retain Metro Recycling in the near future to provide recycling coordinator services using funds from the reserves in the County s Solid Waste Fund. Mansfield stated that there was nothing new to report related to the construction of an emergency services facility at this time. Mansfield stated that the City hoped to work with BIRCH to identify a funding strategy for this facility in the near future. Geiger reported that Barry County planned to issue and RFP for development of a new website in the near future. Carr introduced discussion regarding election of officers for the JPA for Motion by Redman, second by Haywood to retain the current slate of officers (Carr Chairman, Brown Vice-chairman, Mansfield Secretary) for Motion carried. Vujea stated that she would be joining Carr and Brown in meeting with MEI in the near future to discuss options for the provision of additional broadband services in the Townships. Carr stated that MEI had agreed to consider placing fiber optic cables in areas where sufficiently dense development existed. Mansfield stated that the City had recently elected to join a consortium organized by the Grand Valley Metro Council to explore the installation of distributed antenna systems (DAS) in communities under the provisions of the Metro Act. Mansfield explained that a vendor had recently installed such a system in Hastings under the Metro Act, and that the City knew little about this vendor. Vujea stated that MEI had informed her that they did not use DAS systems for the provision of their services. Vujea invited Mansfield to attend the meeting with MEI to learn more about their possible proposal to provide additional services in the Townships. 3

Geiger stated that the County was close to taking final action on the ordinance to regulate ORVs. Geiger stated that it was likely that the County Commission was likely to pursue an approach that assisted local units of governments with their own ordinances to control ORVs. Carr asked for a moment of silence in honor of the late Dave Jasperse. Carr asked for comments regarding the minutes of the January 18, 2016 special meeting of the JPA, the draft minutes of the January 20, 2016 meeting of the Joint Planning Commission, the draft agenda for the April 6, 2016 meeting of the Rutland Township Planning Commission, and the draft minutes of the February 1, 2016, March 7, 2016 and April 4, 2016 meetings of the City of Hastings Planning Commission. 8 Vujea introduced Travis Alden, newly hired President of the Barry County Economic Development Alliance and Chamber of Commerce. Carr asked for additional comments from the public. No comments were forwarded. Carr asked for reports regarding activities in the units of government participating in the JPA. McManus stated that Mensch Manufacturing on South Hanover Street in Hastings Township was adding a warehouse on their site and would be presenting a site plan for the facility to the County Planning Commission in May. Mansfield reported that Aldi would be presenting a site plan to the City Planning Commission for their proposed facility on West State Street in May, and that the City would consider approval of that site plan contingent upon the City accepting jurisdiction for the property from Hastings Township and establishing zoning authority. Mansfield stated that the grand opening for the new Thornapple Plaza would be held on Thursday, April 28 th at 12:45 p.m. and that all were welcome to attend. Klein reported that the City Planning Commission was reviewing requests to allow additional types of residential development in the industrial and commercial zones. Klein reported that the Barry Roubaix bicycle race held this past Saturday was well attended and a success. Carr and Haywood stated that there was currently nothing new to report in Rutland Township. Carr stated that the Rutland Township Board had received a number of comments from property owners in the proposed Urban Services District. Carr stated that several of the owners of parcels located in the outlying areas of the USD had indicated that they had concerns related to the impact of including their property in the USD. Carr stated that these concerns had been expressed within 36 hours of the public hearing held by the Township on this matter, and that he (Carr) had not had an opportunity to meet with all of the property owners to discuss their concerns. Carr stated that he had recommended after the public hearing that the proposed USD be reduced by the Township Board to include only four parcels. Carr stated that the revised USD would include two buildings that needed public utilities as soon as possible, and a third proposed building that would need public utilities prior to construction. Carr stated that the proposed USD differed from what had previously been reviewed and approved by the JPA. Mansfield stated that it appeared that the revised USD would still meet all of the requirements envisioned in the Joint Future Land Use Plan approved by the JPA such as contiguity and frontage along both sides of the street. Mansfield stated that he believed that the City Council would therefore likely agree to the revised USD. Mansfield stated that the City and the Township had developed a process and standard terms for provision of municipal services by the City to properties located in the Township as property owners in the Township needed and requested those services. Mansfield noted that the USD could be enlarged in the future through approval of additional USEDAs as the owners of properties in the Township desired those services. Mansfield stated that the City Council would hold its public hearing on the current USEDA at the next Council meeting on April 25 th. 2

9 Mansfield stated that the smaller USD would require revision of the draft JPC Zoning Map to reflect the reduced area of JPC s zoning authority, and may require amendment of the JPC Zoning Ordinance. Mansfield stated that it was also his understanding that Rutland Township wished to discuss possible amendment of the process for establishing property assessment values for parcels in future USDs created under future USEDAs. Carr introduced discussion regarding the status of the draft Urban Service Agreement allow the City to provide municipal services to properties currently located in Hastings Township and located west of the City. Mansfield stated that both Hastings Township and the City of Hastings had held their public hearings on the proposed City Hastings Township USEDA, and that the 30 day referendum period was now running for both. Phillips stated that the Hastings Township Board had voted to tentatively approve the proposed USEDA following their public hearing. Phillips stated that the Board had not received any objections to date related to the proposed USEDA. Mansfield stated that the City s Planning Commission would be considering approval of a site plan for the new Aldi Food Store on West State Street at their May meeting. Mansfield stated that it was likely that the USEDA between the City and Hastings Township would not be fully executed at that time, so any approvals of the Aldi project by the City would have to be contingent upon the USEDA and other related transactions occurring. Mansfield stated that all of this work appeared to be progressing as expected at this point. Carr asked McManus to report on the latest meeting of the M-37 Corridor Committee. McManus stated that the Committee had not met recently, but stated that Mansfield may have additional information related to the Aldi project and its approval by the M-37 Corridor Committee. Mansfield stated that the representatives from Aldi had indicated that MDOT was still considering whether a traffic signal would be allowed at the intersection of M-37/M-43 and Cook Road. Mansfield stated that Aldi had indicated that they intended to construct their new store regardless. Mansfield stated that the City s Planning Commission would review the need for extension of West Apple Street to serve the proposed facility. Geiger arrived at 5:52 p.m. Mansfield reported that the Barry County Solid Waste Oversight Committee hoped to enter into an agreement in June with Metro Recycling to serve as a recycling coordinator for the County. Mansfield stated that the BCSWOC would likely come before the County Commission in the coming weeks to report on this project. Mansfield stated that there was nothing new to report related to the construction of an emergency services facility at this time. Mansfield stated that the City hoped to work with BIRCH to identify a funding strategy for this facility in the near future. Carr asked if there was anything to report on collaborative efforts related to contractual services. No comment was forwarded. Carr questioned the status of the Parks and Recreation Plans prepared by various agencies and units of government in Barry County. Those present reported the status of various plans. Consensus of 3

10 those present was to advocate joint preparation of Parks and Recreation Plans in the future. Klein to explore the status and term of the current Park and Recreation Plans. Carr asked for additional comment from the public. No comment from the public was forwarded. Carr asked for comments from the members of the JPA. McManus stated that there would be increased focus on soil erosion control permits and compliance this year. Geiger welcome Travis Alden to the community. Mansfield stated that the City would be installing a new box culvert under East State Road between First Street and Wilson Street this year using MDOT and local funds. Mansfield stated that this culver would carry Butler Creek beneath State Road. Mansfield stated that there would be a detour around this area at various times as Consumers and MDOT s contractors completed work related to the project. Carr asked for comments regarding the minutes of the October 17, 2016 meeting of the JPA, the draft minutes of the October 19, 2016 meeting of the Joint Planning Commission, the draft minutes of the October 7, 2016 meeting of the Rutland Township Planning Commission, and the draft minutes of the November 7, 2016 meeting of the City of Hastings Planning Commission. 27 Carr stated that he had previously been appointed to the JPA to serve in that capacity, and had asked Watson to replace him in that capacity on the JPA. Watson asked for comments from the public. No comments were forwarded. Watson asked for reports regarding activities in the units of government participating in the JPA. McManus stated that he had recently attended that annual Planning Conference. McManus stated that topics covered at the conference included sign ordinances, medical marijuana and communication antennas. McManus stated that the County would like be working on their sign ordinances in the near future, but that the County could not adopt regulations applying to medical marijuana. McManus stated that the responsibility for regulating medical marijuana fell to local units of government. Geiger stated that the County was getting ready to open the Mellon Building (former Hastings Public Library) for use by the County and the public. Geiger stated that the building would be open in December. Mansfield stated that the City Planning Commission had recently granted approval for an expansion of the building housing JMJ on Enterprise Drive. Mansfield stated that the Planning Commission had also tentatively approved a Bicycle Master Plan and recommended approval to the City Council. Mansfield stated that the Planning Commission was also working on ordinance amendments to possibly allow balconies in the downtown, allow duplex residential units in more areas of the City, provide appropriate regulations applying to the review of public school projects, and to protect open spaces and natural areas in the City. Mansfield stated that the West Michigan Mountain Bike Allinance had recently held a work session for the new trail on Hammond Road, and that approximately 50 people had attended. Carr reported that a site plan had been submitted for the proposed Hastings Fiberglass Products facility, but that the site plan lacked required information. Carr stated that he was working with the engineer, and expected the site plan to be ready for review at the next meeting of the Rutland Township Planning Commission. Carr stated that the Planning Commission would also review a site plan for a project at the Glass Creek Winery, and for a self-storage facility on West State Road near Algonquin Lake. Brown stated that the Aldi Food Store was expected to open in early December. Watson asked for other comments from those present regarding projects in their jurisdictions. No other comments were forwarded. 2

28 Watson asked Mansfield to provide a report regarding the current work of the JPC. Mansfield stated that the JPC had recently approved the revised By-laws prepared by Attorney Rolfe, and had received reports on the pending USEDAs and proposed Hastings Fiberglass Products Facility at their recent meeting. Graham stated that the JPC had held a public hearing and approved amendments to the JPC zoning map. Graham stated that the JPC had recommended several revisions to the proposed sidewalk and trail improvements included in the sidewalk / trail master plan currently being prepared by Prein and Newhof. Waston asked for a report on the status of the second USEDA between the City and Rutland Township. Carr reported that this USEDA was ready for withdrawal from escrow for final execution. Carr stated that he would contact Rolfe to ensure all of the required documents were now in place. Carr stated that he and Watson had recently met with Dave Baum of Hastings Fiberglass to discuss options for funding of the infrastructure to serve his proposed facility. Carr stated that that parties were currently exploring options for funding that would not require the establishment of a special assessment district. Watson noted that the sidewalk and trail master plan had been discussed during the JPC report. Watson introduced discussion regarding the formation/re-purposing of a committee to pursue community improvement initiatives. McManus stated that the committee had recently met with local realtors to discuss impediments to housing development in the County. McManus stated that there appeared to be great demand for ranch style homes in the $150,000 - $180,000 price range. McManus stated that the group intended to also meet with builders and bank representatives. McManus reported that BCEDA had suggested measures for gap financing, and intended to pursue a commercial and residential market study. Mansfield stated that the group also intended to seek ways to improve the perception of the local school system. Watson asked McManus to discuss the recent activities of the M-37 Committee. McManus stated that the M-37 Corridor Committee had not met in the recent past. Watson asked Mansfield to provide a report on the Barry County Solid Waste Committee s County wide recycling initiative. Mansfield stated that the Barry County Solid Waste Oversight Committee (BCSWOC) intended to seek support and authorization for the expenditure of funds for a recycling consultant at the next meeting of the County Commission. Watson asked Mansfield to report on the status of the Fire Station / Emergency Services Facility. Mansfield stated that the City hoped to work with BIRCH to explore potential sources of funding for his facility in early Mansfield stated that Klein was pursuing new sources of funding based on the City recent reclassification as a low / moderate income community. Watson asked for any comments or suggestions related to additional collaboration efforts between any of the governmental units participating on the JPA. No comments were forwarded. 3

Klein invited those present to attend the upcoming Jingle and Mingle events in Hastings, and distributed a pamphlet listing the activities to be held.
