1 TENDER ANNOUNCEMENT FOR THE PROCUREMENT OF 6-UNIT C-BAND DOPPLER WEATHER RADAR FOR AEGEAN, MEDITERRANEAN AND EASTERN BLACK SEA REGIONS C-Band Doppler Weather Radars shall be procured. GENERAL DIRECTORATE OF STATE METEOROLOGICAL WORKS (TURKISH STATE METEOROLOGICAL SERVICE) 6 (SIX)-UNIT C-BAND DOPPLER WEATHER RADAR FOR AEGEAN, MEDITERRANEAN AND EASTERN BLACK SEA REIGONS SHALL BE TENDERED BY APPLYING THE OPEN TENDER PROCEDURES. The goods which are the subject of the tender; a) Characteristics, Type and Quantity: 6 (Six)-Unit C-Band Doppler Weather Radar for Aegean, Mediterranean and Eastern Black Sea Regions. b) Place(s) of Delivery: Sites for the installation of radars in Antalya, İzmir, Adana/Hatay, Muğla, Trabzon/Rize, Samsun as defined en detail in the Technical Specifications. c) Date of delivery : If the Contractor is a domestic company, Adana/Hatay, Muğla, Trabzon/Rize, Samsun Radars shall be ready for the temporary acceptance within 40 (forty) months after signing the contract while Antalya and İzmir Radars shall be ready for the temporary acceptance within 15 (fifteen) months after signing the contract; If the Contractor is a foreign company, Adana/Hatay, Muğla, Trabzon/Rize, 1

2 Samsun Radars shall be ready for the temporary acceptance within 40 (forty) months after transferring the first free allocation to the L/C (Letter of Credit) account while Antalya and İzmir Radars shall be ready for the temporary acceptance within 15 (fifteen) months after transferring the first free allocation to the L/C (Letter of Credit) account. 3. General information regarding the Tender: a) The place of the tender: Devlet Meteoroloji İşleri Genel Müdürlüğü-Muamelat Şube Müdürlüğü (General Directorate of State Meteorological Works-Documentation Branch Office) (The tender shall be held in the meeting room of the General Directorate at 10:30 a.m. on 03 November 2008) b) Date - time : :30 a.m. 4. The requirements for participating in the tender and required documents, and the criteria to be applied for the qualification evaluation: 4.1. The requirements to participate in the tender and required documents: The address declaration for notification, and phone and fax number and electronic mail Address, if available, for the communication, Certificate from the Chamber of Commerce and/or Industry, or relevant Profession Association where the bidder is registered according to the relevant legislation, If the Bidder is a natural person, the document confirming the registration at the Chamber of Commerce and/or Industry, or at relevant Professional Association obtained in the same year of the first announcement of the tender, or in the year of the tender, If the Bidder is a legal person (entity), the document obtained from the Chamber of Commerce and/or Industry obtained in the same year of the first announcement of 2

3 the tender, or in the year of the tender, to demonstrate that the legal person is recorded in the registry, Statement of signature or list of authorised signatures demonstrating the authorisation to submit the bid for the tender, The statement of signature certified by a Notary in case of being a natural person, Commercial (Trade) Registry Gazette indicating the most recent state of the sharers, members or founders together with the officers in the management of the company, or the documents prove those issues, and a list of authorised signatures of the legal entity approved by Notary, A written engagement declaring that the bidder is not in a situation stated in the articles (a),(b),(c),(d),(e),(g) and (i) of Item 10 of The Public Procurement Law (number 4734), The bid letter as defined in the Administration Specification as the format and content, The bid bond as defined in the Administration Specification as the format and content, If the Bidder is consortium, the consortium statement as defined in the Administration Specification as the format and content, The Bidders shall state the parts of the works to be realized by sub-contractors, The document demonstrating the purchasing the tender documents by the bidder, Depending on being natural person or legal person, the statement regarding the partnership in the sole proprietorships, and partnership with more than half of the share capital in the stock corporations, 3

4 Statement (Declaration) regarding that the work experience certificate submitted by the legal person shall not be allowed to be used by another legal person if the work experience document belongs to the partner of the same legal person that the same legal person possesses more than half of the capital of the company Documents regarding the economic and financial qualification, and the criteria that these documents should bear: Documents to be obtained from the banks: Documents to be obtained from local or foreign banks evidencing the financial status of the bidder as the unused liquid loan, or letter of unused credit, or free deposits in the banks in the amount to be decided by the bidder but not less than 5 % of the bid price Financial statement (balance sheet) or equivalent documents of the bidder: Bidder s end of year financial statement (balance sheet) or the necessary parts belong to the previous year of the tender, if not available, the documents equivalent to those documents. Followings are the qualification criteria for the Bidders, and these criteria should be met together; a) The current rate (current assets/short term liabilities) should be minimum 0,50 b) The equity rate (equity capital / total assets) should be minimum 0,10 c) The ratio of the short term bank liabilities to the equity capital should be less than 0,75 The bidder who cannot meet these criteria for the previous year can submit the documents of two years ago together with the document of previous year. In such a case, it will be evaluated if the bidder meets the minimum values over the average of these two years of which the documents are submitted. 4

5 According to the values stated in the summary of self-employment income book drawn up and approved in accordance with the related legislation presented by the self-employed, the last year value of the ratio of total income/total expenditure should be minimum (1,25). In such a case, financial statement mentioned above or the rate to be calculated over the necessary parts are not sought. For the companies founded in the year of the tender, it is sufficient to submit the opening balance sheet which meets the balance sheet (financial statement) rates stated in the (a), (b) and (c) clauses above Documents evidencing the volume of the business of the bidder: The documents evidencing the total turnover of previous year before the tender year, or the work amount under his liability or already completed regarding works subject to this tender. The amounts in these documents should not be less than 15 % of the bid price for the total turnover, and not be less than 10 % of the bid price for the total sales income. It is accepted as sufficient for the bidders to meet one of these criteria. The bidder who cannot meet these criteria for the previous year can submit the documents of two years ago together with the document of previous year. In such a case, it will be evaluated if the bidder meets the qualification criteria over the average of these two years of which the documents are submitted. It is sufficient for the companies founded in the year of the tender to submit the documents indicating the total turnover or total sales income until the date of the tender Documents regarding the Professional and Technical Qualification, and the criteria that these documents should bear: Work Experience Certificates: The documents evidencing experience of the bidder regarding the procurement (work) subject to that tender or similar procurement (work) defined in the tender document, which have been accepted as perfect and free from defects by the 5

6 contracting authority, as realized by the bidder for the public or private sector at home or abroad within the last five years. A work experience certificate according to the characteristics of the work subject of that tender as of one single contract belong to the procurement (work) in relation to the subject of that tender or similar procurement (work) defined in the tender document shall be submitted at a rate of 25% of the bid price Documents for determining the manufacturing, manufacturing capacity and research-development activities: a) If the bidder is a manufacturer, documents evidencing that the bidder is a manufacturer. b) If the bidder is an authorized vendor, documents evidencing that the bidder is an authorized vendor, and industry registration certificate of the manufacturer and documents evidencing that it is a manufacturer. c) If the bidder is a manufacturer or authorized vendor performing activities in free zones in Turkey, the free zone activity certificate together with the documents mentioned above The certificates given by the quality control agencies accredited in accordance with the international regulations. The Bidder shall have ISO 9001:2000 Quality Management Certificate and attach this to the bid. It is compulsory that those documents and certificates should be issued by the certification agencies accredited by Turkish Accreditation Agency or by the certification bodies accredited by the national accreditation agencies included in the International Accreditation Forum for Mutual Recognition Agreement. 6

7 4.4. As similar work in this tender, within the scope of the Public Procurement Law and related regulations (legislation); installation and commissioning of Radar or Radar Network together with the hardware, software and infrastructure works; or upgrade process of an existing Radar or Radar Network as hardware or software, supplied for the Public or Private Agencies and Institutions in last five years, shall be accepted as similar work. 5. The most advantageous bid from the economical point of view shall be determined based on the lowest price. 6. The tender is open to all bidders. A price advantage of 15% shall be applied for the bidders who offer good item/items accepted as the domestic good within the regulations determined by the Public Procurement Authority. 7. The tender document can be reviewed at the address of Devlet Meteoroloji İşleri Genel Müdürlüğü-Levazım ve İkmal Şube Müdürlüğü (General Directorate of State Meteorological Works-Procurement and Supply Division), and can be obtained from the Tender Service of General Directorate of State Meteorological Works- Procurement and Supply Division by submitting the receipt of payment of 500 YTL to be received from the Central Accounting Office of the Ministry of Environment and Forestry. It is compulsory to purchase the tender document for participating in the tender. 8. The bids can either be submitted to Devlet Meteoroloji İşleri Genel Müdürlüğü- Muamelat Şube Müdürlüğü (General Directorate of State Meteorological Works- Documentation Branch Office) by 10:30 a.m. on 03 November 2008 (The tender shall be held in the meeting room of the General Directorate at 10:30 a.m. on 03 November 2008), or can be sent via registered mail. 9. The bidders shall submit their bids for the good item/items based on the unit prices. At the completion of the tender, the contract shall be prepared based on the total amount determined by multiplying the unit price and work items. The bid shall be submitted for the whole work in this tender. 7

8 10. The Bidders shall submit a bid bond with an amount determined by themselves but not less than 3% of the bid price offered. 11. The validity period of the bids submitted should be 150 (one hundred and fifty) calendar days minimum as from the tender date. 12. Consortiums can submit bid for the tender The parts of the works which require expertise: 1-Supply of 6 (six) Radar System as defined en detail in the Technical Specifications. 2-Construction of radar Tower and Buildings as defined en detail in the Technical Specifications Similar works regarding these works: 1- Within the scope of the Public Procurement Law and related regulations (legislation); installation and commissioning of Radar or Radar Network together with the hardware and software; or upgrade process of an existing Radar or Radar Network as hardware or software, supplied for the Public or Private Agencies and Institutions in last five years, shall be accepted as similar work. 2- Within the scope of the Public Procurement Law and related regulations (legislation), B/II and A/V or D/I or D/II or E/IV group works, for the Public or Private Sectors in last fifteen years, included in the bulletin (communiqué) regarding the similar works to be evaluated for work experiences in the construction Works, shall be accepted as similar work. 8
