The Cost Report together with the Programme Plan and the Technical Design Report (TDR) will be basis for the ESS governing bodies final decision to embark upon the construction of ESS. Industry are key partners in building and opera.ng, and using ESS. The costing and planning for ESS has been made with a lifecycle approach, and as such includes a the different phases of the facility s lifetime. The phases included in the costing and planning are th Pre-construction, Construction, Operation and Decommissioning Phases. The total lifecycle cost is shown in Figure 1 below. 5 An industrial partner aims for a successful, and profitable, partnership with ESS. What are the requirements? What s the schedule? How many resources do I have to plan for this? How will quality be controlled and assured? Is this a good investment in our company s.me? Do other companies have an unfair advantage? What are success criteria for ESS? 12 The Industrial Liaison Officer (ILO) Network The ILO Network is not a decision making body for ESS, but a privileged channel of informa.on for the organisa.on and for maturing business opportuni.es related to ESS. Each partner will cover the respec.ve personnel, infrastructure, travels and other expenses. It is a long- term ac.vity covering the construc.on and the opera.onal phases. 12

14 Legal basis and Policy for ESS Procurement ESS procurement is guided by European Procurement Direc4ve 2004/18/EC on public procurement, implemented through the Swedish Public Procurement Act (LOU), and the following principles: Open compe..on, accessibility to Industry, accountability, transparency and equal treatment Efficient, effec.ve and ethical use of resources, sustainability Objec.vity and clarity in ESS procurement business process All tenders over EUR207K published on EU tender website EU compe..ve procedures - open, restricted, nego.ated, compe..ve dialogue Use of up- to- date e- tools (ERP, E- commerce, etc.) 14

16 Change from ESS AB to ESS ERIC Procurement under the ERIC framework An ERIC has legal personality based on EU law (Ar.cle 171 of the EC Treaty). Its main tasks are to establish and operate a research infrastructure. The ERIC is an easy- to- use legal instrument providing: A truly European venture (also allowing the par.cipa.on of non- European countries) A legal personality recognised in all EU Member States Flexibility to adapt to the specific requirements of each infrastructure some privileges/exemp.ons allowed for intergovernmental organisa.ons An ERIC can benefit from exemp.ons from VAT and excise duty in all EU Member States and it may adopt its own procurement rules, which have to respect the principles of transparency, non- discrimina3on and compe33on but are not subject to the EU direc3ve as such. ESS ERIC statutes including procurement rules are under development 16

27 Summary ESS is already underway and very schedule driven. Industrial Partners should view ESS long- term, as a development opportunity, and with an eye to other research infrastructure. The project is a major European collabora.on of the public and private sector. Much of ESS will be built by in- kind partners all over Europe so its important to understand how we are organized to iden.fy the right customer in the project. 27
