1 CITY OF BIG BEAR LAKE CITY COUNCIL MINUTES FOR A REGULAR MEETING MARCH 14, 2016 A Regular Meeting of the City Council of the City of Big Bear Lake was called to order by Mayor David Caretto at 6:32 p.m., on Monday,, at the Civic Center, Big Bear Boulevard, Big Bear Lake, California. 2 Page 2 CONSENT CALENDAR Motion by Mayor Pro Tem Jahn, seconded by Councilmember Putz, to approve the Consent Calendar as follows: City Council 1.1 APPROVAL OF DEMANDS CHECK ISSUE DATE 02/17/16 THROUGH 03/04/16 IN THE AMOUNT OF $273, Approved. 1.2 APPROVAL OF MEETING MINUTES FROM THE FEBRUARY 22, 2016 SPECIAL WORKSHOP MEETING OF CITY COUNCIL Approved. 1.3 APPROVAL OF MEETING MINUTES FROM THE FEBRUARY 22, 2016 REGULAR MEETING OF CITY COUNCIL Approved. 1.4 LETTER OF OPPOSITION TO AB 1707 Council consideration of authorizing the Mayor, and/or his designee, to sign a letter of opposition to AB 1707 related to the California Public Records Act. Approved. The balance of the Consent Calendar was approved by the following vote: AYES: NOES: ABSTAIN: ABSENT: Jackowski, Jahn. Herrick, Putz, Caretto ITEMS REMOVED FROM THE CONSENT CALENDAR.

3 Page 3 2. PUBLIC HEARINGS Any person may appear and be heard in support or opposition to the proposal at the time of the meeting. If you challenge the action in court, you may be limited to raising only those issues which you or someone else raised at the public meeting described in the notice, or in written correspondence delivered to the City at or before the public meeting. 2.1 BIG BEAR LAKE TOURISM BUSINESS IMPROVEMENT DISTRICT (BBLTBID) PUBLIC HEARING AND RESOLUTION OF FORMATION Council consideration of holding a public hearing, declaring results of the majority protest proceedings and adopting a Resolution resulting in the formation of the BBLTBID and the levy of assessments on lodging and ski resort businesses. At the hour of 6:45 p.m., Councilmembers Putz and Herrick recused themselves due to conflicts of interest. Jeff Mathieu, City Manager, began a presentation regarding the public hearing and formation of the BBLTBID. Michael Perry, Consultant, continued the presentation regarding the progress, updates, and upcoming meetings regarding the BBLTBID, and gave an overview of the BBLTBID Board formation. Mayor Pro Tem Jahn asked if nominations for Board members are closed, and if the City can review the bylaws that were approved by the Visitor s Bureau. Michael Perry responded. Councilmember Jackowski asked if Board members will have the proper training to ensure they are compliant with the Brown Act, why the mountain resorts have been given a seat on the Board, when results of the Board elections will be available, and how the results will be made public. Michael Perry responded. Mayor Caretto asked for clarification on the distribution of election ballots. Pam Scannell, Director Big Bear Chamber of Commerce, addressed Council regarding the election ballots and explained the Chamber s role in the process. Councilmember Jackowski asked for clarification regarding Board member terms. Michael Perry responded.

4 Page 4 Mayor Caretto noted the date in the Management District Plan (MDP) on page 103 of the Agenda Packet that must be corrected to April 1, At the hour of 7:09 p.m., Mayor Caretto opened the public hearing. Bob Pool, Lodge Owner: Addressed Council regarding what separates the BBLTBID from other cities TBIDs, and that smaller groups will have a larger voice in how the BBLTBID operates. Bill Young, Big Bear Village Lodge: Addressed Council regarding his opposition to the BBLTBID and noted several major events that the City has lost. Councilmember Jackowski asked Bill Young why the events he referenced were lost. Bill Young responded. Jeff Ballinger, City Attorney, addressed Council regarding the legality of TBID protest laws and processes. Aaron Armstrong, Big Bear Cool Cabins/Big Bear Charter Fishing: Addressed Council regarding his support of the BBLTBID and his hopes to be elected to the Board. Brandon Kidd, Big Bear Getaway: Addressed Council regarding a fishing event from 2013 that was cancelled due to a lawsuit, and then withdrew his other comments. Greg Schick, Vintage Resorts: Addressed Council regarding his opposition to the BBLTBID and read a protest letter he previously sent to Council. Michael Sterling Eaton, Big Bear City: Addressed Council regarding his experience in marketing and branding resorts, and expressed his support of the BBLTBID. Charlie Brewster, Big Bear Lake: Addressed Council regarding some of the issues the public spoke about, and expressed his view on how to move forward with the Board. At the hour of 7:37 p.m., hearing no further comments, Mayor Caretto closed the public hearing. City Attorney gave an overview of the voluntary protest agreement, the TBID laws, and how voting works.

5 Page 5 Kathleen Smith, COO/Acting City Clerk, announced the protest results and, based on those results, stated that the BBLTBID may be passed/formed. Mayor Pro Tem Jahn expressed that although he supports the BBLTBID, he is concerned with the quality and commitment of marketing efforts, and suggested bringing on a professional marketing team to assist with TBID events. Nick Lanza, Visitor s Bureau President, and Charlie Brewster responded. City Attorney noted that bringing in a professional marketing team would need to be added to the MDP. Mayor Pro Tem Jahn asserted that the intent of the TBID is to support Big Bear s shoulder seasons, and that it does not conflict with community events that Council already supports. Charlie Brewster responded. Councilmember Jackowski expressed his support of the TBID and reaffirmed Mayor Pro Tem Jahn s previous comment about bringing in a professional marketing team to assist with the TBID. Mayor Caretto expressed his happiness to see the interest and participation in forming the new Board, echoed Mayor Pro Tem Jahn s comments about bringing in a professional marketing team, addressed the importance of the opinions of those who protest the TBID, and concluded that the TBID will help support offseasons in Big Bear. Motion by Mayor Pro Tem Jahn, seconded by Councilmember Jackowski, to approve staff s recommendation of declaring results of the majority protest proceedings and forming the BBLTBID and the levy of assessments on lodging and ski resort businesses, and to correct the following items in the MDP, the date on page 103 and to include additional language on page 100 of the Agenda Packet regarding marketing, and to adopt the following Resolution entitled: RESOLUTION NO A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BIG BEAR LAKE DECLARING RESULTS OF MAJORITY PROTEST PROCEEDINGS FOR FORMING AND ESTABLISHING THE BIG BEAR LAKE TOURISM BUSINESS IMPROVEMENT DISTRICT

6 Page 6 Said motion was approved by the following vote: AYES: NOES: ABSTAIN: ABSENT: Jackowski, Jahn, Caretto Putz, Herrick At the hour of 7:58 p.m. Mayor Caretto called a short recess of the meeting. At the hour of 8:08 p.m., Mayor Caretto reconvened the meeting, and Councilmembers Putz and Herrick returned to the meeting. 3. DISCUSSION/ACTION ITEMS 3.1 TDA ARTICLE 3 GRANT PROGRAM Council consideration of receiving a presentation regarding staff s application for San Bernardino Associated Governments (SANBAG) TDA Article 3 Grant Program for the proposed Stanfield Cutoff Connectivity Project; accepting the grant in the amount of $325,000; and directing staff to seek supplemental funding from potential sources. David Lawrence, Public Works Director and City Engineer, gave a presentation of both the existing and proposed plan view of the Stanfield Cutoff Connectivity Project and discussed grant funding for the proposed plan. Mayor Caretto asked how many fishing pop-outs are proposed in the plan. Councilmember Herrick asked how deep the fishing pop-outs will be. Councilmember Jackowski asked if the pop-out dimensions would be the entire provision for fishing. Staff responded to Council questions. Mayor Caretto asked if the pop-outs will be on piers, and if the fill area will impact the nearby marina. Mayor Pro Tem Jahn asked if other potential projects around Stanfield Cutoff will be independent from this proposed plan. Mayor Caretto asked if the rebuilding of Stanfield Cutoff is a planned project.

7 Page 7 Councilmember Putz asked about the strength, longevity, and stability of the structure. Mayor Caretto asked about guard rails on the cross section, and also asked how parking around the school would be affected. Mayor Caretto asked where the City would get the additional grant money for the proposed plan. Councilmember Putz asked about putting up interpretive signage for the pop-outs. Councilmember Herrick asked if Measure I funding is available to draw from. Motion by Councilmember Herrick, seconded by Councilmember Putz, to approve staff s recommendation of accepting the grant in the amount of $325,000; and directing staff to seek supplemental funding from potential sources.
