1 Terms of Reference (TOR) For Development of a Public Oversight Guide REFERENCE NUMBER: TIK/001/ALAC/2018 PROJECT TITLE: Public Oversight for Integrity for County Governance ASSIGNMENT PERIOD: 15 Working Days LOCATION: Machakos and Uasin Gishu Counties DEADLINE FOR SUBMISSION: 1200HRS 20th April, INTRODUCTION Transparency International Kenya (TI-Kenya) is a not-for-profit organization founded in 1999 in Kenya with the aim of developing a transparent and corruption-free society through good governance and social justice initiatives. TI-Kenya is one of the autonomous chapters of the global Transparency International movement that are all bound by a common vision of a corruption-free world. The vision of TI-Kenya is a corruption free Kenya. The mission is to champion the fight against corruption by promoting integrity, transparency and accountability. Transparency International Kenya s strategic objectives are as follows: To increase the number of responsive and accountable citizens and leaders through promoting civic engagement and leadership integrity To support the existence and enforcement of appropriate policy, legal and institutional frameworks through influencing, partnership building, and capacity development. To contribute to greater social justice and economic accountability at all levels through advocacy and development/promotion of supportive systems. To consolidate its position as a dynamic, relevant and associated vices. The Project s overall goal is to enhance the capacity of citizens and leaders serving in elective or public institutions effectively participate in accountability processes for requisite reforms for enhanced transparency. 1

PROJECT DESCRIPTION Building citizens capacity for social vetting and to report cases of electoral offences and malpractices is key and following the social vetting exercises undertaken under the Voter Education for Integrity Project before the 2017 elections, there is need to continue holding the elected leaders accountable for political accountability at the county level. TI-Kenya thus seeks to scale up the Voter Education project in Uasin Gishu and Machakos counties, and at the national level through media advocacy. This project will build upon the successes and lessons learnt from the previous voter education and social vetting project conducted in 2013 and subsequently in 2017 by the organization. TI-Kenya will scale up the project in 2018 to 2020 by further empowering the public on election matters, mainstreaming voter education in existing structures through ToTs, and capacity building of the elected members of the County Assembly to provide requisite oversight and uphold integrity in undertaking their daily duties. 3. RATIONALE FOR THE GUIDE To offer basic rules of engagement between citizens and leaders serving in elective or public service. Concept The Constitution of Kenya (2010), which is premised on good governance, integrity, transparency and accountability, gives Kenyans the tools with which to progressively grow into an active citizenry that demands transparency and accountability from their leaders, government and service delivery institutions. In the past, elections have been marred by an array of issues some of which include: 1. Allegations of voter bribery during party nominations and campaigns 2. Allegations of manipulation of lists by parties 3. Rigging allegations 4. Voter intimidation and violence TI-Kenya thus seeks to contribute to the generation of knowledge that can help citizens build political capital that will allow them to contribute towards ensuring that leaders serving in elective or public institutions carry out their duties with integrity and in a transparent and accountable manner whilst ensuring that the principle of public participation (a key pillar in the Kenyan Constitution and is one of the national values and principles of governance) is adhered to. The guide will be useful in building public oversight capital through education and awareness to enable citizens continue to hold public office duty bearers and elected officers to account and ensuring that integrity in leadership is maintained. 2

3 The guide will therefore be vital in providing citizens with an overview of how to effectively play their Public oversight role. It will also inform the training of ToTs, vital in mainstreaming voter education during public outreach activities. TI-Kenya will also use the guide to develop voter education programmes for enhanced citizen s capacity to influence integrity and accountability amongst elected leaders and public office duty bearers. Specifically: Free, fair and peaceful elections The role of Kenyans in ensuring transparency in electoral processes Social vetting Information on electoral laws including but not limited to: CoK 2010, Election Campaign Finance, Elections, Independent Electoral and Boundaries Commission, Political Parties and Leadership and Integrity laws. How can citizens influence integrity and accountability as the benchmarks for Public Office duty bearers? Consultancy start and end dates 7 th to 25 th May, ROLES AND RESPONSIBILITIES Transparency International Kenya will be responsible for: 1) Supporting the design and printing of Public Oversight guide. Specific deliverables for the consultant: 1) Drafting and submitting a Public Oversight guide within 15 working days after award of contract. This should include: a. A detailed work plan for the execution of the consultancy b. A draft guide (for review by TI-Kenya) c. Final guide incorporating feedback from TI-Kenya. 3

EXPERIENCE AND ACADEMIC QUALIFICATIONS OF THE CONSULTANT Candidates for this consultancy should possess the following minimum qualifications: 1) A post graduate degree in social sciences, project management, strategic management or any other relevant field. 2) A minimum of 5 years experience in conducting research in governance and specifically electoral issues and civic engagements. 3) Knowledge of the legislative framework in Kenya, electoral laws, including the current developments, policies and practices. 4) Have demonstrable experience in working with the various arms of Governments related to the subject matter. 5) Strong communications skills (interviewing, written and presentation skills among others). 6. TERMS OF PAYMENT The consultancy fees will be paid on such terms as stipulated on the contract upon award. 7. SUBMISSION OF BIDS The following should be included in the bid submitted: 1. Detailed Expression of interest for the Development of the Public Oversight guide based on the information above, including the proposed work plan with timelines. 2. Consultant s CV with at least 3 professional referees. 3. Budget (Financial Proposal) well itemised per your understanding of deliverables. 4. Evidence of previous relevant studies / work undertaken. 5 8. COMPLAINTS PROCESS This call for Expression of Interest does not constitute a solicitation and TI-Kenya reserves the right to change or cancel the requirement at any time during the EOI process. TI-Kenya also reserves the right to require compliance with additional conditions as and when issuing the final solicitation documents. Submitting a reply to a call for EOI does not automatically guarantee receipt of the solicitation documents when issued. Invitations to bid or requests for proposals will be issued in accordance with TI- Kenya rules and procedures. Any grievances and or complaints arising from the evaluation process and final tender award can be addressed, in writing, to the Executive Director and copied to the TI-Kenya Tender Complaints Committee. 5
