1 VILLAGE OF CANAL FLATS Regular Council Meeting MINUTES Monday May 9, 2005 at 6: 00 pm Canal Flats Civic Centre Centre, 8909 Dunn Street, Canal Flats 1. Call to Order at 6:03 pm Present: Mayor E. Third Reading and Adoption of Village of Canal Flats Canal Flats Official Settlement Plan Bylaw, Amendment Bylaw No. 28, 2005 (Hoesing) # Moved by Councillor Doherty seconded by Councillor Juras and RESOLVED THAT Village of Canal Flats Canal Flats Official Settlement Plan Bylaw, Amendment Bylaw No. 28, 2005 (Hoesing) be read a third time. # Moved by Councillor Juras seconded by Councillor Woodske and RESOLVED THAT Village of Canal Flats Canal Flats Official Settlement Plan Bylaw, Amendment Bylaw No. 28, 2005 (Hoesing) be finally adopted. 4 # Moved by Councillor Juras seconded by Councillor Cartwright and RESOLVED THAT the Village of Canal Flats Administrator prepare a letter to Mr. & Mrs. Tim Pickering summarizing Councils discussion and the measures that will be taken to calm traffic in the Richardson Cresent/ Grainger Road area. c) Receive for information only 1) Letter from Ministry of Water, Land & Air Protection re: Beach Park/ Thunderhill Park 2) Letter from Mayor Mark Shmigelsky, District of Invermere re: Reed Family Tragedy 3) Jaws of Life Training Letter received from Instructors complimenting the Fire Chief and Firemen 4) Letter from UBCM- re: West Nile Study Grant approval 5) Natural Hazard Mitigation Grant application Council discussion followed each letter that was introduced. # Moved by Councillor Cartwright seconded by Councillor Woodske and 9. Reports RESOLVED THAT all letters listed above be received for information only. a) For council resolution or action 1) Re-zoning application-sterzer # Moved by Councillor Doherty seconded by Councillor Juras and RESOLVED THAT staff be directed to draft Official Settlement Plan and Zoning Bylaws for Council s consideration for a proposed Official Settlement Plan amendment and rezoning of proposed Lot 1, DL 110, Kootenay District of Parcel B (see XC9450) Block 2, Plan 2580, DL 110, Kootenay District, with the Official Settlement Plan designation to be changed from TC Town Centre Commercial to R1 Low Density Residential and the zoning to be changed from C1 Community Commercial to R1 Single Family Residential. 5 2) Re-zoning application- Kootenay River RV Park # Moved by Councillor Woodkske seconded by Councillor Doherty and RESOLVED THAT staff be directed to draft Official Settlement Plan and Zoning Amendment Bylaws for Council s consideration for a proposed Official Settlement Plan amendment and rezoning of proposed Lot 1, Plan 5329, DL 110, Kootenay District with the Official Settlement Plan designation to be changed from CG Campground to CS Service Commercial and the zoning to be changed from RES-1 Recreation Accommodation to C-2 Service Commercial. b) Receive for information 1) Report from Councillor Cartwright on the tour he conducted to the Source of the Columbia River for Wings Over the Rockies. Councillor Cartwright stated that 19 participants registered to take the tour and 18 attended. Cam Gilles was the Bird Interpreter. The tour also expanded to the Old Canal and the remains of the Lock. Councillor Cartwright said they received many compliments on the tour and felt it was very successful. 2) Report from Councillor Cartwright on Columbia River Greenways Alliance Meeting he attended April 26, 2005 and latest update on the pathway funding. Councillor Cartwright gave a brief report on the last Greenways Meeting he attended and gave update on the funding of the pathway/boardwalk. 3) Report from Councillor Cartwright on Wildfire Interface Mitigation that Tembec is conducting. Councillor Cartwright gave a brief report on Wildfire Interface Mitigation which is being carried out by Tembec. Councillor Cartwright stated he felt some of the interface clearing could be done jointly with the Village and Tembec. Page 5

Councillor Trish Doherty excused herself from the Regular Council meeting at 7:40 pm due to a perceived conflict of interest. 7) 1 st Reading of Bylaw No. 35, 2005 Village of Canal Flats- Canal Flats Official Settlement Plan Bylaw, Amendment Bylaw No. 35, 2005 (Doherty and BC Ltd.) # Moved by Councillor Cartwright seconded by Councillor Woodske and RESOLVED THAT Village of Canal Flats Canal Flats Official Settlement Plan Bylaw Amendment Bylaw No. 35, 2005 (Doherty and BC Ltd.) be read a first time. New business, Motions and Notices of Motion Mayor Morin noted scheduled Special Council Meeting, Thursday May 12, 2005 at the Village Office, 6 pm with Planning & Priority Meeting to follow. Mayor Morin noted Village received an anonymous donation to be distributed to the following clubs: Beach Society $50/ Columbia Alliance for Literacy $50 / Canal Flats First Aid Society $300. A tax receipt was issued from the Village Office and a thank you on behalf of the Clubs. Page 8

9 Derelict Vehicle Program # Moved by Councillor Juras seconded by Councillor Doherty and RESOLVED THAT Village of Canal Flats will pay Wrenchbender Towing $25.00 per vehicle for derelict vehicles towed to RDEK dump site at owners request until June 30, Public Hearing Minutes # Moved by Councillor Juras seconded by Councillor Cartwright and RESOLVED THAT Public Hearing Minutes of May 1, 2005 Fritz & Linda Kobza and Ron & Denise Hoesing be received. 12.
