DETAILS OF THE PPP FOLLOWED TO DATE Licebo Environmental and Mining (Pty) Ltd has been appointed by Mpisi Trading 143 (Pty) Ltd to undertake environmental authorisation for the proposed Mpisi Colliery planned at Ntambanana in the City of umhlathuze local municipality. The application was relodged on 7 th February 2017 and initial scoping phase was undertaken. The scoping report submitted to the department of Mineral resources was accepted however a directive was issued on the 26 th of April 2017 for Mpisi trading to conduct more detail consultation and supporting studies. A new scoping report was undertaken by a newly appointed EAP (that is Licebo Environmental and Mining (Pty) Ltd). This PPP include comments received on the initial scoping report submitted in March 2017 and the newly undertaken scoping to be submitted on the 27 th of July A PPP provides stakeholders, who are affected by or interested in the project, with an opportunity to partake in the EIA process freely. Moreover, through the process, concerns and local knowledge will be identified; needs and values are understood and can be taken into consideration as part of the EIA process. The PPP objectives for the environmental regulatory process have been set out below: To ensure that I&APs are informed about the proposed project; To provide I&APs opportunity to engage and provide comment on the proposed project; To draw on local knowledge by identifying environmental and social concerns associated with the proposed project; To involve I&APs with identifying methods in which concerns can be addressed; To verify that stakeholder comments have been accurately recorded; and To comply with the legal requirements. As part of the PPP three (3) main phases, during which I&APs are engaged as part of the environmental regulatory process, are detailed below: 1.1. Scoping Phase During the Scoping Phase, the following core PPP activities will be undertaken: Stakeholder identification and continuous update of the database; 2 Page

3 Background Information Document (BID) and letter was distributed together with the placement of adverts and site notices; Availability of the DSR and associated documentation is available for public comment; and Consultation with I&APs will be undertaken to obtain suggestions and concerns Identification of Stakeholders To ensure a proper representation of stakeholders interested in or affected by the proposed project, the following identification methods are used to develop a stakeholder database: Windeed and desktop searches were conducted in and around the project area to verify landownership and obtain contact details; Utilisation of existing stakeholder databases from previous application (PPP done by Licebo consultants); Responses from the newspaper advertisement and site notices placed; Responses from the BID and notification letter made available to stakeholders; and Networking with stakeholders to identify additional stakeholders interested in or Affected by the proposed project. Stakeholders for the proposed project are grouped into the following categories: Government: National, Provincial, District and Local authorities; Landowners: Directly affected and surrounding landowners; Land occupiers: Directly affected and surrounding land occupiers; Communities: Surrounding communities; Non-Governmental Organisations (NGOs): Environmental and social organisations; Agriculture: associations or organisations focussed on agricultural activities; Parastatals: semi-government institutions; and Business: small and medium enterprises and formal organisations. A stakeholder database has been compiled which will be updated throughout the environmental regulatory process. 3 Page

4 Public Participation Media Considering legislative requirements and good practice the following media will be utilised to make information about the proposed project available to stakeholders. BID: includes the location and a description of the proposed project, the legislative processes and requirements that will be followed, the specialist studies to be conducted, the competent authorities and the consultation and registration process including contact details of the responsible person representing the independent EAP. Newspaper Advertisement: an English and isizulu newspaper advert was placed in one local newspaper. The advertisement included a brief project description and location, information about the required legislation, the competent authorities, details of the appointed EAP, information about availability of the DSR for public comment and details about the Public Meeting to be held. Site Notices: English site notices were put up at various places as indicated in Table 1. The site notices contained a brief project description and location, information about the required legislation, the competent authorities, and details of the appointed EAP and information about availability of the DSR for public comment and details about the Public Meeting. Letter with Comment and Registration Form: a letter was sent in English which contained information about the proposed project, applicable legislation and competent authorities, information on availability of the DSR for public comment and details of the Public Meeting. A Registration and Comment Form was also provided for stakeholders to use for formal registration as I&APs or to submit comments. SMS: notification to stakeholders will also be done be means of SMS distributed to I&APs having mobile numbers available. Presentation: a PowerPoint presentation will be used as medium to convey information about the proposed project and to engage in open dialogue with stakeholders Consultation with Stakeholders A formalised stakeholder meetings were held on the 13 th July 2017 (City of umhlathuze Local Municipality) and 14 th July 2017 (Bhucanana Hall), during the 30-day public comment period in the form of a Public Meeting and stakeholders on the database were informed and invited. Comments raised by stakeholders were captured in a Comment and Response Report (CRR). Stakeholder comments were closely considered and addressed by the project team, where applicable, to inform the scope for specialist studies to be undertaken. Responses are provided to the comments raised by stakeholders and will be updated in the CRR throughout the PPP. 4 Page

5 As part of the directive sent by DMR on the 15 August 2017 to Mpisi Trading, A meeting with Ezemvelo KZN wildlife is planned for the 06 th of September 2017, meetings with Thula Thula private reserve, Sophomo Tribal Authority and other affected parties have been proposed for the 07 th and 08 th September 2017, LEM is still awaiting response from stakeholders. The updated Scoping Report will be made available to stakeholders, once it has been submitted to the DMR, on Licebo Environmental Website ( a 21 day comment period and notification will be distributed to inform stakeholders PPP Scoping Phase Activities In Table 1 more detail is provided about the PP activities undertaken thus far, together with referencing materials included as Appendices. The premise of activities is to adhere to various legislative requirements for PPP and that a single, integrated process is followed. This will limit stakeholder fatigue and ensure that stakeholders are presented with a single view of the full project and EIA information. It is envisaged that the process of engagement will commence in November/December 2017 during which another Public Meeting will be held. Stakeholder comments gathered during the Scoping phase and outcomes from the engagement will be closely considered for further PPP activities and inclusion for specialist studies (where applicable). The main emphasis of engagement with stakeholders as part of this phase will be so share results of the specialist impact studies completed and the associated suggested mitigation measures and recommendations Decision Making Phase During this phase the decision made by the DMR will be communicated to stakeholders by means of letter distribution via , post and SMS and advertisement placement. The information provided will also include the legislated appeals procedure available should stakeholders wish to appeal the decision. 6 Page

The mining activities will involve the mining of the anthracite coal seams and the construction of related mining infrastructure such as haul roads, workshops, offices, Pollution Control Dams (PCD), Coal Crushing and Screening Plant and water management infrastructure. PURPOSE OF THIS DOCUMENT The purpose of this document is to provide a brief overview of the proposed environmental authorisation and water use licence approval processes associated with the proposed mining activities. This document provides Interested and Affected Parties (I&APs) with an opportunity to comment on the proposed changes. It also provides I&APs with initial information on the proposed project and information on how they can get involved and what the benefits are of being registered as Interested and Affected Parties. I&APs will have an opportunity to comment and raise issues of concern and suggestions for enhanced benefits. OVERVIEW OF THE PROPOSED PROJECT This application process serves as the application for the environmental authorisations required in terms of the National Environmental Management Act, 1998 in respect of listed activities that have been triggered by applications in terms of the Mineral and Petroleum Resources Development Act, 2008 as amended, the National Environmental Management Waste Act, Act 59 of 2008 and the National Water Act, This application is undertaken to support the section 22 mining right application for the proposed Mpisi coal mining operations to be carried out by Mpisi Trading 143 (Pty) Limited with respect to the farms Lot 306 Empangeni No , Lot 304 Empangeni, No , Lot 302 Empangeni, No , Remainder and Portions 2 and 4 of Lot 272 Empangeni, No , Portion 1 and Remainder of Lot 310 Empangeni, No , Lot 286 Empangeni, No , Portion 1 and Remainder of the farm Lot 287 Empangeni, No , Portion 1 and Remainder of the farm Lot 311 Empangeni, No , the farm Lot 308 Empangeni, No , the farm Lot 307 Empangeni, No , the farm Lot 254 Empangeni, No , the farm Lot 278 Empangeni, No , Portion 1 of the farm Dube Ridge No , Portion 1 and Remainder of the farm Windy Ridge No , which is situated in magisterial district of Lower Umfolozi in City of umhlathuze (ex Ntambanana) Local Municipality within the Inkosi Cetshwayo (Uthungulu) District Municipality, KwaZulu Natal Province.. Mpisi Trading 143 (Pty) Ltd is the holder of the mining right KZN 30/5/1/2/2/10071 MR. Mpisi Trading 143 (Pty) Ltd intends to apply for a section 22 in terms of the MPRDA. This NEMA application is undertaken to support the proposed mining operations in terms of section 22 mining right application in respect to the above mentioned farm portions. The proposed Mpisi Coal Mining Project area comprises 61 farms, and is located approximately 30km northwest of Richards Bay and 20km north of Empangeni, and immediately east of the town Ntambanana, within the Inkosi Cetshwayo (Uthungulu) District Municipality, KwaZulu-Natal. The R34 road passes through the southern portion of the Mpisi Coal Mining Project study area. The Mpisi Coal Mining Project area itself consists of three facets, namely the Prospecting Area, Mining Area, and the Priority Area. These farms are located north west of the town of Empangeni and south west of the Hluhluwe Mfolozi Game Reserve, in an area of 29,523Ha. However, the focused mining area is the historical Heatonville Mine comprising three farms, namely Lot 272 Empangeni (12922), Lot 278 Empangeni (14015) and Lot 254 Empangeni (14014), comprising a total of Ha. The mining right was granted in terms of Section 22 of the Mineral and Petroleum Resources Development Act, 2002 (Act No.28 of 2002) by the Department of Mineral Resources on 17 November According to Historical data provided by, Mr.D.W.Thompson and Mr. Rod White limited mining did take place at the Heatonville Mine from , but indications are that only around 15,000 tons were mined until structural stability issues terminated mining. A number of outcrops do present themselves near the old Heatonville Mine and these need to be further explored to pursue opportunities for open cast mining. Outcrops are indicated around the old Heatonville Mine situated in the south western portion of farm 1405 along the banks of the Ntambana River. Boreholes 5, 8 and 9 in the Priority area exhibit multiple dolerite intrusions ranging from 2m to 30m thick in the borehole intersections. Borehole number 4 10 Page

11 appears to be situated at an elevation below the main sills as no dolerites were intersected. The dip of the strata in the Mining area varies from 10 to 30 degrees. It should also be noted that the old Heatonville Mine was situated between two of the main sills. The structural stability issues experienced at the old mine may have been due to a weathered roof from mining at such shallow depths. However, modern opencast mining methods from where the underground adits will be developed. Once the adits to the underground are developed, these will be more efficient in extraction and should present more favourable roof conditions for deeper mining interventions. Considerable environmental impacts were done to the area by the previous mining permit holder as no rehabilitation or proper closure according to the DMR requirements was done. The study area is situated in the Grassland Biome, Mesic Highveld Grassland Bioregion, Paulpietersburg, Moist Grassland Vegetation Type and Altitude of m. The proposed Mpisi Colliery development will comprise of: A new Opencast (Adit box-cut) and Underground Mining Area (covering area of approximately ha) Access and haul roads Pollution Control Dam Topsoil stockpiles Overburden stockpiles Softs (subsoil) stockpiles Stream and wetland crossing Mine offices ROM and product coal stockpiles Workshops and associated infrastructure Washbay Weighbridge Conveyor belt Coal Handling Processing Plant Water storage tanks Security guard house and entrance gate Water Management (Canals, berms, sumps, pump station, pipelines) Fuel and lubrication facilities Water supply, rescue, geological and monitoring boreholes Electricity supply network Changehouse and ablution facilities Sewage treatment plant The new proposed activities will be triggering Government Notice Regulation 983, Regulation 984 and related waste management activities which require that a scoping and environmental impact report (S&EIR) must be conducted, compiled and submitted to the Department of Mineral Resources in KwaZulu Natal Province. Also a water use licence will be applied for identified water use activities as required in terms of the NWA. The below listed activity has been identified as those that might need to be authorised based on the current available information. As mentioned above, for this proposed to continue, an application for environmental authorisation process will be followed to include the following proposed identified listed activities in terms of the environmental impact assessment regulations issued on 04 December 2014: - Government Notice Regulation GNR 983 GNR 984 GNR 985 GNR 332 GNR 633 Applicable listed activities Environmental listed activities numbers: 9, 10, 12, 13, 14, 19, 24 and 25; Environmental listed activities numbers: 15, 17 and 21. Development of proposed mining operations and construction of associated infrastructure within 500m of watercourses. Water use activity to dispose water containing waste into a pollution control dam associated with the proposed mining area. Water use activities to dispose coal into a coal Run of Mine coal stockpile associated with the proposed mining area. Water use activities to dispose overburden and mid-burden into dumps associated with the proposed mining area. Water use activities to use mine affected water for dust suppression along the access roads and haul roads associated with the proposed mining area. Water use activities to remove underground water from the proposed Mpisi mining activities. The next step is to compile the integrated Scoping and the Environmental Impact Report (S&EIR) that will be submitted to the DMR and the compilation and submission of the water use application form and technical report that will be submitted to the DWS for consideration and approval. ENVIRONMENTAL AUTHORISATION PROCESS As mentioned above, the proposed project will require an integrated Scoping and Environmental Impact Assessment (S&EI) process as well as an Environmental Management Programme report (EMPr) and the Waste Management Licence (WML) to be submitted for authorisation. These documents will need to reflect the proposed project processes and management measures associated with all proposed project related activities. Furthermore, Mpisi Trading 143 (Pty) Ltd is required by law to appoint an independent Environmental Assessment Practitioner (EAP) to undertake the S&EI Assessment, the EMPr and the WML to assess the potential biophysical and social impacts of the proposed project. Licebo Environmental and Mining (Pty) Ltd will evaluate and identify potential environmental and social impacts of the project and provide mitigation and management measures to minimise negative impacts and enhance benefits, within the context of the project situational analysis. PUBLIC PARTICIPATION PROCESS Public Involvement is seen as an integral part of the Environmental Authorisation Process and will aim to include I&APs in the process by notifying them of the proposed project and inviting them to raise issues and concerns that they may identify. This will aid the EAP to gather local knowledge on the area and identify the common issues and concerns. The following section details the methodology that LEM has proposed to undertake the Public Participation Process during the Environmental Impact Assessment Process: Notification of I&APs A announcement letter and SMS notification will be sent to all registered stakeholders and identified stakeholders. This will be done in order to ensure that all stakeholders are notified of the proposed project. In addition, I&APs will be notified of the project and opportunities for interaction by means of: Distribution of BIDs (this document) to identified I&APs. Interaction with Interested and Affected Parties It is important that I&APs are afforded enough opportunity to understand the technical issues associated with the project so they can add valuable contributions to the S&EIR Process. 13 proposed: Invitation to all identified I&APs to register; Scoping Report will be made available for public review and comment for a 30 day period starting from 23 of August 2017 to 22 September 2017; Comments received during this period will be considered and incorporated into the Scoping Report that will be submitted to DMR and the water use technical report which will be submitted to the DWS; Also the relevant comments will also be considered as part of the Environmental Impact Report which will also be made available for a period of 30 days public review. The concerns and comments from I&APs will be incorporated into the final EIR and will then be submitted to DMR and the final water use licence technical report which will be submitted to the DWS for decision making. The following entities have been currently identified as key stakeholders in the project thus far and notification letters will be forwarded to them including previously identified stakeholders: City of umhlathuze Local Municipality; Inkosi Cetshwayo District Municipality; Department of Agriculture and Rural Development (DARD). KwaZulu Natal Province Land Claims Commissioner; The Department of Mineral Resources (DMR); The Department of Water and Sanitation (DWS); Department of Public Works, Roads and Transport; Department of Co-operative Governance and Traditional Affairs; Department of Economic Development, Tourism and Environmental Affairs; Department of Human Settlements; Department of Public Works; Department of Transport; Department of Social Development, Inkosi Cetshwayo District; The South African Heritage Resources Agency (SAHRA); South African Police Service, Ntambanana; Ezemvelo KwaZulu Natal Wildlife; Richards Bay Industrial Development Zone; Tourism KwaZulu-Natal; South African Heritage Resources Agency; South African National Biodiversity Institute (SANBI); Land owners and occupiers; Adjacent land owners and occupiers; Other identified surrounding community members; Current registered Interested and Affected Parties; Non-Governmental Organisations and etc. Additional I&APs will be identified during the course of the Public Participation Process. 14 Feedback Feedback will be provided to I&APs via written letters or s or fax or telephonic messages. The Public Participation for the S&EIR process has been designed to ensure that interaction with I&APs is focused and yet comprehensive. Feedback will be provided to registered I&APs during the S&EIR phases as well as after the final decision has been made by the competent authority. After the receipt of I&AP comments on the EI Report, the report and associated documentation will be submitted to the competent authority for a decision on the project. Once a decision has been made, registered I&APs will be notified of the outcome as well as the procedure to appeal the decision, should they wish to do so. WHAT WILL THE PROCESS ENTAIL FOR I&APS? The process is as follows: Notification of competent authority about the project; Compilation and submission of the environmental authorisation application form to DMR; A notice of the application for the proposed development will be placed in a local newspaper; Site notices will be placed on site and different locations; A public meeting will be held with I&APs to discuss the findings of the Scoping Report; A detailed database of all I&APs and stakeholders have been developed and will be updated on regular basis as new I&Aps register; This Background Information Document (BID) will be distributed to the registered Interested and Affected Parties, Affected land owners and adjacent landowners, local communities, relevant NGOs, also the relevant government department, the Local Municipality and the elected ward councillors; Notification of relevant stakeholders regarding this project; A register of comments and responses will be opened and maintained. All comments and issues of concern raised by stakeholders and I&APs will be clearly recorded and taken into consideration and will be consolidated into the supporting document as part of the S&EIR that will be submitted to the relevant authorities as part of the approval process phases; Compilation of the final integrated Environmental Impact Report for final decision making by the competent authority; and Once a decision has been reached by the competent authority with regards to the proposal, all registered I&APs will then be informed about the outcome of the decision, the appeal process and the way forward. Ralph Repinga: The legal set buffer zone for blasting to infrastructure and settlement area is 500 meters. Blasting and movement of vehicle will result in dust generation, dust can be mitigated by suppression haul roads and using electronic blast which produces less dust and low vibrations. Mr Biyela raised a point of dissatisfaction with the 2019 time frame. May I have a copy of the presentation? Action taken by initial scoping phase and later followed with environmental impact assessment phase. Specialist studies cannot be undertaken without stakeholder engagement and involvement into the plan of study. As part of the environmental and public participation process, stakeholders have the right to raise concerns/comments and suggest where the specialist should focus on in order to make sure that all aspects are covered. SMS notifications will be sent to all stakeholders for future meetings. RR indicated that the 2019 time frame is only an estimation to allow authorities enough time to review and make decision on the proposed project. Sharin indicated that the mine should comply with the Municipal Systems Amendment Act with specific to the umhlathuze Land Use Scheme and the IDP. Siyabonga indicated that dust suppression model must be included. How much traffic will be generated during operation? Will all the coal be exported? Will roads be affected? B. Strachan Ntambanana has good agricultural potential and that the municipality has plans on developing the agricultural activities within the area. Strachan raised a question that how can Mpisi work with the communities in order to ensure that the Action taken by will be constructed within the mining area and no coal stockpile is planned outside the mining area. He noted the compliance to NEM: AQA and indicated that an Air Quality Assessment will be undertaken as part of the studies. RR noted these requirements and indicated that the mine will apply for rezoning and ensure that any developmental activities will be done in line with the municipalities IDP.
