Carried 6. County Warden s Welcome and Remarks Warden Bain welcomed the members and noted that he had attended the following events: The Windsor Essex Regional Chamber of Commerce (WERCC) hosted an event called Small Business, Too Big to Ignore. The event recognized the importance of small businesses being essential to the economic prosperity of Ontario. Windsor Essex Economic Development Commission hosted a contingent from South Korea with the intention of reducing Red Tape where opportunities for importing and exporting exist. Representatives from the City of Guro South Korea signed on along with Windsor and Essex County. Essex Region Conservation Authority hosted a grand reopening of the Devonwood Conservation Area in Windsor. Attended an event at the Hotel-Dieu Grace Hospital, outlining the West Windsor Community Hub Project. Meetings with Ministry representatives regarding disaster relief funding following the storm event and flooding took place in Tecumseh, Windsor and Lakeshore. The Migration Festival. The University of Windsor graduation ceremonies with some area leaders in attendance. The Ruthven Apple Festival Page 7 of 119

Carried Lori Wightman presented a petition to County Council regarding the Essex County Library services. Ms. Wightman discussed the previous petition submitted to Council as well as the current petition. She noted that the names of supporters on these petitions were from Library supporters and not only residents of Essex County. B) Deborah Lesperance, Essex County resident Deborah Lesperance was not able to be in attendance and sent Teresa Lister to make a statement on her behalf Moved by Mr. Fazio Seconded by Mr. Antaya That Ms. Lister be permitted to address County Council. - Carried Ms. Lister read a statement in support of libraries in general as community hubs, reading and book appreciation and noted the importance of getting libraries open again as soon as possible. C) Cindy Lemieux, Essex County resident Moved by Mr. Bachetti Seconded by Mr. McNamara That Mrs. Lemieux be permitted to address County Council. Carried Page 8 of 119

She noted a general appreciation for literature. She expressed concern regarding the library labour disruption and the costs associated with this and expressed her hope libraries would soon be open again Moved by Mr. Santos Seconded by Mr. Bachetti That County Council receive the petition regarding the Essex County Library Labour Disruption as information; and That a copy of the petition be forwarded to the Essex County Library Board. -Carried 8. Carried E) New Essex County Council Code of Conduct Council considered Report Number 2016-R009-CS MB, dated October 19, 2016 from Mary Brennan, Director of Council Services/Clerk. Ms. Brennan discussed the content of the report noting in particular the role of the Integrity Commissioner and Complaint/Investigation/Reporting process Moved by Mr. Fazio Seconded by Mr. Queen That County Council repeal By-Law and adopt a new Code of Conduct for Essex County Council as set out in By-Law Carried F) Essex County Library Board Member Vacancy Council considered Report Number 2016-R010-CS MB, dated October 19, 2016 from Mary Brennan, Director of Council Services/Clerk Ms. Brennan explained that the resignation of Ms. MacDonald from the Essex County Library Board had left a vacancy on the Board since May and provided an overview of some options for the Board to appoint a member to fill the vacancy. Discussion took place with regard to the options available. Page 11 of 119

12 Essex County Council Minutes Regular Meeting Page 7 of 10 October 19, Moved by Mr. Bachetti Seconded by Mr. Meloche That Deputy Warden Antaya be appointed to the Essex County Library Board for the remainder of the Term. - Carried G) Financial Information Requests Essex County Library Operations for 2016 Council considered Report Number 2016-R019-FIN RM, dated October 19, 2016 from Rob Maisonville, Director of Corporate Services/Treasurer. Mr. Gregg discussed the details of the report and noted that the financial information contained therein were only projections and the actual financial position of the Library operations would not be available until the end of the labour disruption. He recommended that discussion of any refunds of surplus library funds for 2016 be deferred until the actual financial data is available. He further noted that the County has no mechanism in place to make direct refunds to ratepayers, so any refunds would have to be made to the local municipalities and then it would be up to each individual municipality to determine if and how they would provide those refunds to ratepayers Moved by Mr. Antaya Seconded by Mr. McNamara That County Council receive the report number 2016-R019-FIN RM, as information; and That discussion of the disposition or use of any surplus funds from the 2016 operations of the Essex County Library be deferred to the 2017 budget deliberations. Carried 11. Unfinished Business A) County Road Work Leamington Mr. Paterson questioned the status of the Environmental Assessment for County Road 20 road work within the Leamington area. 13 Essex County Council Minutes Regular Meeting Page 8 of 10 October 19, New Business It was noted by Administration that a public information session regarding the County Road 20 Environmental Assessment was planned for November 15, A) Public Reporting of Closed Meeting A Closed Meeting of Essex County Council was held at 6:15 p.m., prior to the regular Council meeting this evening, pursuant to Section 239 (2) (d) of the Municipal Act, Administration provided Council with an update on the status of contract negotiations with various bargaining units. B) Flooding Mr. McNamara expressed gratitude to the various municipalities who aided affected areas following the rain storm event of recent weeks. He stated it had been a difficult process for impacted residents and the community in general. C) County Road Work Mayor McNamara raised some concerns related to traffic on Banwell Road near the Tecumseh Vista School with Banwell experiencing heavy traffic at times in addition to all the school buses. He further asked about the status of road improvements at the County Road 19 / County Road 22 intersection. Mr. Bateman replied that a safety review was previously conducted at the intersection of Banwell and Shields that did not indicate improvements were required at that time. He indicated that they would conduct a study to update the traffic counts and revisit the traffic signal warrants and other options to mitigate the concerns where possible. He further noted that CR 22 / CR 19 is currently undergoing detailed design for the intersection improvements to accommodate the double left turn Page 13 of 119

Construction schedules have been impacted by property acquisition requirements and efforts are being made to advance some preliminary work at the Jamsyl intersection this year. 19 Click here for Microsoft Word version Essex County living wage employers to be recognized in Leamington during living wage week WINDSOR, ON October 25, 2016 International living wage week kicks off on Monday, October 31 and in recognition, the Leamington District Chamber of Commerce and Pathway to Potential are hosting a luncheon to publicly recognize the newest county living wage employers. We accomplish this by engaging the community to identify and remove barriers to social and economic resources through education, research and advocacy. P2P is funded by the City of Windsor and County of Essex. P2P participates in a network with other communities across Canada through Vibrant Communities Canada. About Living Wage Windsor-Essex The living wage is a call to employers from all sectors to pay wages that are sufficient to provide for basic needs of families. Windsor-Essex is just one of many communities across Canada responding to the increasingly high levels of low-wage workers living in poverty. The basis of the living wage is that families and individuals should earn an income sufficient to pay for the basic necessities of life, so they can live with dignity and participate as active citizens in our society. The push to provide a living wage is spearheaded by Pathway to Potential, the poverty reduction strategy for Windsor-Essex. The proposals described in the Blueprint were developed in consideration of the recommendations from the Standing Committee and input from fall 2014 discussions with stakeholders, lndigenous commun t es and organ zat ons. The comments and the recommendations rece ved were considered in the development of this proposed Bill. This information will also be considered in the development of future changes to regulations and policy. The proposed bill is the first step in a phased process that will modemize and strengthen the way aggregate operations are managed in Ontario. Should the bill pass, Ontario would move fonruard with public consultations on any future proposed regulatory and policy changes under the revised act, including future proposals related to changes to fees and royalties. Background In 2000, the court administration, court support functions and prosecutions under Part I of the Provincial Offences Act was transferred by the Province under agreement, to the City of Windsor as the Municipal Partner. The City of Windsor entered into an intermunicipal agreement with municipalities making up the Windsor/Essex Court Service Area, which included all municipalities within the geographic area of the City of Windsor, County of Essex and Pelee Island. The purpose of the intermunicipal agreement was to establish terms and conditions for the use of employees of the City of Windsor for purposes of POA Court administration and support, conducting prosecutions, apportionment of costs and revenue, composition of a liaison committee, dispute resolution mechanism and Program structure. The agreement was automatically renewed for the additional 5 year period, with an expiration date of December 31, 2011 (Appendix C). At that time, upon recommendation of the POA Liaison Committee, all municipalities in the Windsor/Essex Court Service Area agreed to enter into a Renewal Agreement for a 5 year period from January 1, 2012 to December 31, All terms and conditions and schedules of the Original Agreement continued, save and except for the right of automatic renewal. Discussion The Intermunicipal Provincial Offences Court Services 1 st Renewal Agreement will be expiring at the end of The POA Liaison Committee members were requested, in the spring of 2016 by the City of Windsor POA Administration, to review the Agreement and provide requests for changes to the Agreement. The City of Windsor POA Court Administration and members of their legal staff also reviewed the agreement to determine if they wished to make any changes to the original agreement. The only changes proposed relate to the frequency of the POA Liaison Committee Meetings and the quarterly payment dates. These changes were discussed at the September POA Liaison Committee Meeting and all were in favour of recommending approval of the renewal agreement as proposed (Appendix A). If any municipality in the Windsor/Essex POA Court Service area determined that they did not wish to continue to have the City of Windsor provide POA Court Services on their behalf, the alternative options would be to enter into a Municipal Partner Agreement with the Province to administer the POA Court function on their own, or contract with the next closest POA Court Service area, being Chatham-Kent. Section 2.7 of the Original Agreement shall be deleted in its entirety and replaced with the following: The Committee shall meet at least two (2) times a year and otherwise at the call of the Chair or any two (2) members of the Committee. The first meeting shall be within the first two (2) months for the relevant fiscal year of the Program. The weighted assessment proportions shall be determined for that fiscal year based upon the final recent data available from the assessment authorities. 4. The quarterly distributions, as set out in section 8.3(a) of the Original Agreement, shall be as of the following dates of each fiscal year of the Program: Q1 = As of April 30 th Q2 = As of July 31 st Page 40 of 119

All terms, conditions and schedules of the Extended Agreement shall apply to the 2 nd Renewal Term mutatis mutandis, save and except that there shall be no further right of renewal, of either an automatic or discretionary nature. However nothing in this Agreement prevents the parties from further renegotiating and/or extending the Agreement. 6. The parties hereby specifically acknowledge the indemnity provisions as contained in Article 15 Indemnity of the Original Agreement. 7. This Agreement may be executed in one or more counterparts, each of which shall be deemed to be an original and both of which together shall constitute one and the same instrument. To evidence its execution of an original counterpart of this Agreement, a Party may send a copy of its original signature on the execution page hereof to the other Party by facsimile transmission and such transmission shall constitute deliver of an executed copy of this Agreement to the receiving Party as of the date of receipt thereof by the receiving Party or such other date as may be specified by the sending Party as part of such transmission. Notwithstanding the foregoing, either Party may demand a fully executed single copy of this Agreement. 8. All terms used herein which are denoted with an initial capital letter shall have the meanings assigned to them in the Extended Agreement, unless amended herein. This Agreement and everything in it shall enure to the benefit of and be binding on the parties hereto, and their respective successors and assigns.
