1 BOROUGH COUNCIL MEETING MINUTES SEPTEMBER 12, 2018 Meeting called to order at 7:00_ P.M. Pledge of Allegiance Moment of Silence for Senator John McCann, the Innocent lives at 9/11, Carol Cressman, Steven Getsinger. Robert Swartman, Anthony Girgenti, Sr. Mayor Campbell announced the Opening Statement All the notice requirements of the Open Public Meeting Act have been complied with in full. Jehl, Borough Solicitor Gregory Fusco, Borough Engineer FIRST ORDER OF BUSINESS: INTRODUCTION OF POLICE CANDIDATE BRIAN M. HART Mayor Campbell appoints Brian M. Hart as a full time officer to the Gibbsboro Police Department at the police contract rate for a one year probationary period. Motion to ratify the Mayor s appointment Councilman Bonsall, Second Councilman Deichert SWORN IN BY MAYOR EDWARD CAMPBELL RESOLUTION APPOINTING BRIAN M. HART AS A REGULAR FULL TIME POLICE OFFICER TO THE GIBBSBORO POLICE DEPARTMENT FOR A ONE YEAR PROBATIONARY PERIOD BE IT RESOLVED that Mayor and Council of the Borough of Gibbsboro, County of Camden, State of New Jersey as follows: 1) THAT BRIAN M. HART is hereby appointed as a Regular Police Officer to the Gibbsboro Police Department at the probationary rate of $14.56/hour.

2 2) THAT the appointment carries a probationary period of one year, during which the appointee is not considered a permanent employee as provided in N.J.S.A. 40A: ) THAT this appointment is further conditioned upon the satisfactory completion of a background investigation by the Chief of Police, physical examination, psychological evaluation (if deemed necessary), completion of agency training, successful firearms qualification on the department's weapons, satisfactory completion of K-55 radar training and any other training deemed necessary by the Chief of Police to function as a Gibbsboro Police Officer. 4) THAT the failure of the appointee to comply with any of the conditions of appointment or if at any time during the probationary period the conduct or capacity of the appointee has not been satisfactory, the appointee may be terminated by Resolution of the Governing Body without trial. The appointee shall be served with a copy of such Resolution terminating the services of the appointee. LEVY WHEREAS, the Mayor and Borough Council of the Borough of Gibbsboro have been advised by Anne D. Levy, RMC, Borough Clerk, that she has decided to retire effective June 1, 2019; NOW THEREFORE BE IT RESOLVED by the Mayor and Borough Council of the Borough of Gibbsboro, County of Camden, State of New Jersey that the resignation for the purpose of retirement of Anne D. Levy, Borough Clerk is hereby accepted and that upon retirement, the Borough of Gibbsboro shall pay for supplemental health insurance and Part D Medicare and that authorization is hereby granted to advertise for the position of Deputy and Payroll Clerk RESOLUTION AUTHORIZING THE MAYOR TO SIGN AN ACCESS AGREEMENT FOR BLOCK 59.01, LOT 3.02 WITH SHERWIN-WILLIAMS COMPANY TO DO AN ENVIRONMENTAL INVESTIGATION AND THE BOROUGH OF GIBBSBORO, CAMDEN COUNTY, STATE OF NEW JERSEY NOW, THEREFORE, BE IT RESOLVED by the Mayor and Borough Council of the Borough of Gibbsboro, State of New Jersey, County of Camden that the Mayor is hereby authorized to execute a ACCESS AGREEMENT FOR BLOCK 59.01, LOT 3.02 with Sherwin- Williams Company to do an environmental investigation NOT USED RESOLUTION OF THE BOROUGH OF GIBBSBORO, COUNTY OF CAMDEN, STATE OF NEW JERSEY CANCELLING TAXES ON BLOCK 15, LOT 1.02, AKA LAKEVIEW DRIVE WHEREAS, Block 15, Lot 1.02 was acquired by the Borough of Gibbsboro on April 17, 2018; and WHEREAS, the 2 nd, 3 rd and 4 th quarter taxes for Block 15, Lot 1.02 totals $5, should be cancelled as the property is now owned by the Borough of Gibbsboro; and NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Council of the Borough of Gibbsboro, County of Camden, State of New Jersey, as follows: 1. That the Mayor and Council hereby authorize the Tax Collector to cancel the 2 nd, 3 rd & 4 th quarter taxes for

BLOCK LOT TAXES FULL ASSESSMENT $8, $154, RESOLUTION OF THE BOROUGH OF GIBBSBORO, COUNTY OF CAMDEN, STATE OF NEW JERSEY CANCELLING TAXES ON BLOCK 18.05, LOT 27, AKA LAKEVIEW DRIVE WHEREAS, Block 18.05, Lot 27 was acquired by the Borough of Gibbsboro on June 26, 2018; and WHEREAS, the 3 rd and 4 th quarter taxes for Block 18.05, Lot 27 totals $1, should be cancelled as the property is now owned by the Borough of Gibbsboro; and NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Council of the Borough of Gibbsboro, County of Camden, State of New Jersey, as follows: 1. BLOCK LOT TAXES FULL ASSESSMENT $2, $50, RESOLUTION AUTHORIZING THE AWARD OF A CONTRACT (BID A- 27/2018 UNDER THE CAMDEN COUNTY COOPERATIVE PRICING SYSTEM BY AND BETWEEN THE COUNTY OF CAMDEN (DEPARTMENT OF BUILDINGS AND OPERATIONS) AND VARIOUS VENDORS FOR COPY, COMPUTER PAPER AND ENVELOPES AND THE BOROUGH OF GIBBSBORO NOW, THEREFORE, BE IT RESOLVED by the Mayor and Borough Council of the Borough of Gibbsboro, State of New Jersey, County of Camden that an award of a contract (Bid A- 27/2018 is hereby authorized between the County of Camden (Department of Buildings and Operations) and various vendors to provide copy, computer paper and envelopes under the Camden County Cooperative Pricing System for the Borough of Gibbsboro. BE IT FURTHER RESOLVED that the commencement will be September 1, 2018 through February 28,

5 RESOLUTION AUTHORIZING GRANT SUBMISSION FOR THE GOVERNOR S COUNCIL ON ALCOHOLISM AND DRUG ABUSE WHEREAS, the Governor s Council on Alcoholism and Drug Abuse established the Municipal Alliances for the Prevention of Alcoholism and Drug Abuse in 1989 to educate and engage residents, local government and law enforcement officials, schools, nonprofit organizations, the faith community, parents, youth and other allies in efforts to prevent alcoholism and drug abuse in communities throughout New Jersey. WHEREAS, The Borough Council of the Borough of Gibbsboro, County of Camden, State of New Jersey recognizes that the abuse of alcohol and drugs is a serious problem in our society amongst persons of all ages; and therefore has an established Municipal Alliance Committee; and, WHEREAS, the Borough Council further recognizes that it is incumbent upon not only public officials but upon the entire community to take action to prevent such abuses in our community; and, WHEREAS, the Borough Council has applied for funding to the Governor s Council on Alcoholism and Drug Abuse through the County of Camden; NOW, THEREFORE, BE IT RESOLVED by the Borough of Gibbsboro, County of Camden, State of New Jersey hereby recognizes the following: 1. The Borough Council does hereby authorize submission of a strategic plan for the Berlin-Gibbsboro-Voorhees Municipal Alliance grant for FY19 July 1, 2018 to June 30, 2019 in the amount of: DEDR $36, Cash Match $ 9, In-Kind $27, The Borough Council acknowledges the terms and conditions for administering the BGV Municipal Alliance grant, including the administrative compliance and audit requirements RESOLUTION APPROVING BINGO LICENSE , ON-PREMISE 50/50 RAFFLE RL AND MERCHANDISE RAFFLE FOR ST. ANDREW THE APOSTLE CATHOLIC CHURCH BE IT RESOLVED by Mayor and Council of the Borough of Gibbsboro, County of Camden, State of New Jersey that an application for the above Bingo and Raffles has been submitted to the Borough of Gibbsboro by St. Andrew the Apostle Catholic Church for their event to be held on October 27, 2018 and BE IT RESOLVED by the Mayor and Council that said licenses are hereby granted to St. Andrew the Apostle Catholic Church; and 5

6 BE IT FURTHER RESOLVED that said license are for the benefit of ministries of St. Andrew the Apostle Catholic Church RESOLUTION APPROVING CHANGE ORDER NO 1 TO CHARLES MARANDINO, LLC FOR RECONSTRUCTION OF VARIOUS ROADWAYS, BIKEWAYS AND SIDEWALKS WHEREAS, it was necessary to make changes in the scope of work to be done in completing the Construction of Multi-Purpose Path along the Northside of Haddonfield-Berlin Road (County Route 561), from the Existing Path on the Northeast Corner of Eastwick Drive and Haddonfield-Berlin Road (County Route 561), funded through the NJDOT Municipal Aid Program FY2016 in the Borough of Gibbsboro, Camden County, New Jersey. WHEREAS, Change Order No. 1 was developed to itemize and authorize those changes. WHEREAS, certification has been received by the Borough Treasurer/Finance Director that sufficient funds have been allocated for this Change Order; NOW, THEREFORE, BE IT RESOLVED by the Borough of Gibbsboro that Change Order No. 1 is hereby authorized and approval is hereby granted to revise the contract amount from is authorized to revise the Contract Amount from $227, to $227, RESOLUTION AMENDING THE BOROUGH OF GIBBSBORO 2018 YEAR MUNICIPAL BUDGET BY THE INSERTION OF A SPECIAL ITEM OF REVENUE AND APPROPRIATION FROM THE STATE OF NEW JERSEY DMV INSPECTION FUND WHEREAS, N.J.S.A. 40A:4-87 provides that the Director of the Division of Local Government Services may approve the insertion of any special item of revenue in the budget of any county or municipality when such items shall have been made available by law and the amount thereof was not determined at the time of the adoption of the budget, and WHEREAS, said Director may also approve the insertion of an item of appropriation for an equal amount, and WHEREAS, the Borough of Gibbsboro has been awarded $ from the DMV Inspection Fund and wishes to amend the 2018 Budget to include said amount as an item of revenue; NOW, THEREFORE, BE IT RESOLVED that the Township Council of the Borough of Gibbsboro hereby requests the Director of the Division of Local Government Services approve the insertion of a special item of revenue in the budget for the year 2018 in the sum of...$ which is now available as a revenue from: Miscellaneous Revenues: 6

10 MINUTES: Motion to dispense reading and approve minutes of 8/8/18 Councilman Deichert, Second Councilman MacFerren REPORT OF MUNICIPAL OFFICERS: Borough Clerk _X Police Department _X Construction Official _X Sewer Clerk _X Tax Collector _X Court Clerk _X Treasurer _X Engineer _X Compliance/Zoning Officer _X Fire Official _X Risk Manager _X COUNCIL COMMITTEE REPORTS: PLANNING BOARD/PUBLIC WORKS COUNCILMAN BONSALL Councilman Bonsall reported that a very well attended planning board meeting was held last night. Brandywine Realty presented applications for major subdivision and major site plan. Both applications were declared complete. The subdivision received preliminary approval with conditions. The hearings will continue. A variance for a swimming pool on Eastwick Drive was Approved. Public works is transitioning to prepare for the leaf collection and winter. PUBLIC EVENTS COUNCILMAN BROWN Councilman Brown reported that the Halloween Parade will be held 10/27/18 and the Tree Lighting Ceremony will be held 12/4/18. POLICE/LIBRARY COUNCILMAN DEICHERT Councilman Deichert reported that police candidates were interviewed by the Police Committee and Officer Hart was appointed tonight. TRASH & RECYCLING/HEALTH COUNCILMAN DETERDING Councilman Deterding reported collected for August was 91 tons of trash and 19 tons of recycling was collected. The trash contract will be up next September and it s time to review all the options. RECREATION/L&I COUNCILMAN MACFERREN Councilman MacFerren reported that for L&I Councilman MacFerren received a few calls on properties for abandoned cars and trash. He relayed it to the Compliance officer to review the complaints. $92,029 of construction was done for August and $1,700 was collected in permit fees and inspections. INSURANCE/ENVIRONMENTAL COUNCILMAN FLYNN Councilman Flynn reported that there were no insurance claims for August. The 10

11 Environmental Commission and Community Garden it is reported that the Garden purchased the parts necessary to fix the gate at Pole Hill Park. The Harvest BBQ will be held on 9/29/18 at the Senior Center. Tickets are $6.00. MAYOR S REPORT MAYOR CAMPBELL Mayor Campbell reported that Engineer Fusco and the Mayor are working on the sewer calculations associated with Brandywine and trying to get part of the U.S. Avenue tract restored to sewer service. Several years ago the DEP took the entire United States Avenue tract out of sewer service. The Borough contested the action. The DEP ignored us. The Mayor has had several meeting and is trying to get at least a piece restored to sewer service. The reason is eventually the Borough will have to deal with the balance of the third round for affordable housing. The benefit for the Borough is it is owned by the Borough and the Borough could put a value on it and sell it and raise a lot of money. Regarding the Brandywine application, there are a hand full of issues with the subdivision lines that will need to be worked out. There are a number of detail agreements that are close to being worked out. Motion to put written reports on file for one year Councilman MacFerren, Second Councilman Bonsall CORRESPONDENCE: TO: Borough of Gibbsboro dated 8/14/18 FROM: Michelle Laubach, Block Party Planning Committee RE: Wynnewood Homeowners Association block party 10/20/18 1:00-6:00 p.m. ACTION: Motion made by Councilman MacFerren and second by Councilman Bonsall to approve request and to advise the Police Chief and Public Works to place barrels. OLD BUSINESS: 1. TAYLOR PROPERTY Mayor Campbell reported that he communicated with the Taylors and they are interested in the transaction. They would like to discuss what land and the subdivision line. The price will be determined by state based on the appraisals. They will then have to decide whether to accept it. A meeting with the Taylors will be scheduled. NEW BUSINESS: 1. TRASH RENEWAL CONTRACT 2019 Mayor Campbell stated that the trash contract will be up next year and the bidding process must begin six month before end of contract. Engineer Fusco will prepare specs, but we need to start 11

12 talking about it. To continue trash collection the way we have been doing it is expensive. One of the things to look at is the automated arm. If we have the automated arm, we can then look at other towns as a shared service. Engineer Fusco indicated that their specs cover every aspect so that bidding is on every possible option. The decision has to be made by early next year so the process can begin WEST ROAD (SWEENEY PROPERTY) Mayor Campbell commented that some remediation is associated with the residential properties that are to be cleaned up as indicated by the EPA. In the process of surveying the property, Sherwin discovered that part of the residents improvements is actually on the borough s property. The Borough executed a release to clean up. The rest will be in the future when they do the Hilliards Creek area. There has been an encroachment on our property and we need to notify the owners to meet and negotiate a resolution. It cannot be a continuing encroachment on the Borough s property. INFORMATIONAL: 1. Next regular council meeting is October 10, Halloween parade is 10/27/18 3.
