1 SOUTH PLAINFIELD BOROUGH BOROUGH COUNCIL MEETING MINUTES NOVEMBER 5, 2012, 7:20 P.M. PUBLIC MEETING CALL TO ORDER: Mayor Anesh called the meeting to order at 7:20 p.m. Mayor Anesh read the sunshine statement and announced that same is being held pursuant to the Open Public Meetings Act of 1974 and all provisions of that Act have been met with adequate notice of this meeting having been provided to the Borough s two official newspapers and also published on the Borough s website. The roll call was administered by Clerk Antonides as follows: COUNCIL Present Absent Late Councilman White ALSO PRESENT Administrator Cullen Clerk Antonides Attorney Rizzo Engineer Miller FLAG SALUTE: was led by Mayor Anesh and led the invocation. Proclamation: Pancreatic Cancer Awareness Month - Mayor Anesh read the proclamation in full. No one was in the audience at this time to accept the proclamation. Approve Council Minutes: October 15 - Agenda October 15, Public Councilman White Public Comment For Agenda Items Only: Mayor Anesh opened the floor for public comment. With no comments made from the public, Mayor Anesh closed the floor. ORDINANCE FIRST READING BY TITLE was read by Clerk Antonides. Ms. Antonides advised that the public hearing is set for November 19, 2012 ORDINANCE NO.1969 AN ORDINANCE PROVIDING FOR THE COMPENSATION OF EMPLOYEES OF THE BOROUGH OF SOUTH PLAINFIELD AND THE METHOD OF PAYMENT OF SUCH COMPENSATIONFOR THE YEARS 2011 THROUGH 2014 The ordinance #1969 read by title upon first reading herewith has been introduced at the meeting of the Mayor and Borough Council of the Borough of South Plainfield, held on November 5, 2012, and the public hearing where further consideration will be made will be held on November 19, 2012 at 7:00 p.m. at the Municipal Building located at 2480 Plainfield Avenue, South Plainfield, NJ. A full complete copy of this ordinance shall be provided until adoption, free of charge, to all those who request said copy at the Borough Clerk s office during normal business hours of 8 a.m. to 4 p.m. A copy is also placed on the municipal bulletin board for viewing.

2 Introduction of Ordinance #1969: November 5, 2012 Councilman White VOTE: 5 0 RESOLUTIONS: RESOLUTION AUTHORIZING THE MUNICIPAL CLERK TO ADVERTISE AND ACCEPT THE 2013 PROFESSIONAL SERVICE CONTRACTS PURSUANT TO THE PROVISION OF N.J.S.A. 19:44A-20.5 authorization is hereby given for the Municipal Clerk to advertise and accept the 2013 Professional Service Contracts pursuant to the provisions of N.J.S.A. 19:44A-20.5 Councilman White RESOLUTION AUTHORIZING THE MUNICIPAL CLERK TO ADVERTISE AND ACCEPT THE 2013 CITIZEN LEADERSHIP FORMS TO FULFILL VACANCIES ON VARIOUS BOARDS, COMMISSIONS, COMMITTEES authorization is hereby given for the Municipal Clerk to advertise and accept the 2013 Citizen Leadership Forms to fulfill vacancies on various boards, commissions and committees. Councilman White RESOLUTION AUTHORIZING WAIVER OF FIRE PERMIT FEES FOR INSPECTION OF A REPLACEMENT FIRE DOOR AT HOLY SAVIOR ACADEMY authorization is hereby given to waive all permit fees for the Holy Savior Academy for the replacement of a fire door at their facility.

3 Councilman White RESOLUTION AUTHORIZING WAIVER OF FIRE PERMIT FEES FOR A CHRISTMAS CONCERT TO BE HELD ON NOVEMBER 25, 2012 FOR THE CHURCH OF THE SACRED HEART authorization is hereby given to waive all permit fees for the Church of the Sacred Heart for their Christmas Concert to be held on November 25, Councilman White RESOLUTION # AUTHORIZING THE RELEASE OF PERFORMANCE BOARD IN THE AMOUNT OF $25, AND ACCEPTANCE OF A TWO YEAR MAINTENANCE BOND IN THE AMOUNT OF $3, FOR FISCHER GROUP, LLC PERTAINING TO BLOCK 401, LOT 4 KNOWN AS 2237 HAMILTON BLVD WHEREAS, the Borough of South Plainfield is in possession of a Performance Bond from Fischer Group LLC for the Improvements located at Block 401, Lot 4; and WHEREAS, Fischer Group LLC has submitted a Maintenance Bond in the amount of $3,773.70; and WHEREAS, the Borough Attorney and the Borough Engineer have given approval of the form and content of the aforementioned Maintenance Bond. NOW, THEREFORE, BE IT HEREBY RESOLVED, by the Mayor and Council of the Borough of South Plainfield, that the Borough Clerk is hereby authorized to accept the aforementioned Maintenance Bond and release the Performance Bond held for the Public Improvements located at Block 401, Lot 4. 4 RESOLUTION AUTHORIZING THE HIRING OF TEMPORARY PART-TIME HELPERS FOR THE PUBLIC WORKS DEPARTMENT BE IT RESOLVED by the Borough Council of the Borough of South Plainfield, County of Middlese, in the State of New Jersey, that it hereby confirms the hiring of the following: Peter Adorna Nick Graves Matthew Sieder Sean Cullen Chris Papianni Gil DaSilva Jeffrey Pellegrino Sal Esposito Ricky Zekas as temporary part-time helpers for the Public Works Department effective date of employment as the onset of Hurricane Sandy clean-up, and BE IT FURTHER RESOLVED that the salary for this position is an hourly rate as set by Ordinance. BE IT FURTHER RESOLVED that a copy of this Resolution be forwarded to the following: 1. Glenn Cullen, CFO 2. Robert Capparelli, Public Works Supervisor 3. Marie Dudek, Payroll 4. Amy Antonides, Municipal Clerk Councilman White RESOLUTION AUTHORIZING THE MAYOR AND MUNICIPAL CLERK TO EXECUTE THE COLLECTIVE BARGAINING AGREEMENT WITH AFSCME 3970 authorization is hereby given for the Mayor and Municipal Clerk to eecute the Collective Bargaining Agreement with AFSCME Councilman White VOTE: 5 0 RESOLUTION AUTHORIZING REFUND OF $75.00 TO VINCENT AND KATY VACA OF 144/146 PINE STREET FOR A CONSTRUCTION PERMIT FOR WORK THAT WAS NOT DONE WHEREAS, the Construction Official confirms that construction work was not done and thus the applicant has requested a refund of their $75.00 construction permit fee; NOW THEREFORE BE IT RESOLVED by the Governing Body of the Borough of South Plainfield that the Chief Financial Officer is hereby authorized to issue a refund check(s) in the amount(s) of $75.00 to the following: Vincent & Katy Vaca Pine Street South Plainfield, NJ (Permit #120498)

5 Councilman White RESOLUTION NO AUTHORIZING CHANGE ORDER OF ORIGINAL CONTRACT WITH STILO EXCAVATING INC. WHICH WAS $349, TO INCREASE IT IN AN AMOUNT NOT TO EXCEED AN ADDITIONAL $50, FOR THE PURPOSE OF EXTENDING THE SCOPE OF PROJECT TO INCLUDE ROAD IMPROVMENTS TO INCLUDE JOHN STREET AND BORMAN ROAD WHEREAS, the Governing Body of the Borough of South Plainfield has entered into a contract with Stilo Ecavating for $349, for a project entitled 2012 Road Improvement Program ; and WHEREAS, the Governing Body of the Borough of South Plainfield would like to etend the limits of the project to include milling and repaving of John Street and Borman Road; and WHEREAS, the etra work will be performed at the unit prices in the current contract; and WHEREAS, the work will be paid for based on the actual as-built quantities at a price not-to-eceed $50,000.00; and WHEREAS, funds for said purpose have been certified by the Chief Financial Officer and are available through capital funding; NOW THEREFORE BE IT RESOLVE by the Governing Body of the Borough of South Plainfield that authorization is hereby given to increase the original contract amount of $349, an additional $50, to an adjusted contract amount of $399, to etend the scope of the project to include the milling and repaving of John Street and Borman Road. Councilman White RESOLUTION AUTHORIZING AWARD OF CONTRACT TO JEN ELECTRIC INC. FOR EMERGENCY TRAFFIC LIGHT REPAIR AND REPLACEMENT AT NEW MARKET AVENUE, CLINTON AVENUE, DURHAM AVENUE AND HADLEY ROAD IN AN AMOUNT NOT TO EXCEED $33, BE IT RESOLVED, by the Borough Council of the Borough of South Plainfield that it hereby approves of the emergency contract with Jen Electric Inc. for the repair and replacement of traffic lights at New Market Avenue, Clinton Avenue, Durham Avenue and Hadley Road in an amount not to eceed $33, of which funds are available and shall be charged to account # as certified by the Chief Financial Officer BE IT FURTHER RESOLVED that a copy of this Resolution be forwarded to the following: Glenn Cullen, CFO Amy Antonides, Municipal Clerk James Parker, Chief of Police Jen Electric Inc.

6 Councilman White RESOLUTION No AUTHORIZING 2012 APPROPRIATION TRANSFERS IN THE AMOUNT OF $130, FOR THE CURRENT FUND PURSUANT TO N.J.S.A. 40A:4-58 WHEREAS, in accordance with N.J.S.A. 40A:4-58 permits appropriation transfers during the last two months of the fiscal year, for the purposes specified and in ecess of sums appropriated in the Budget; and WHEREAS, such transfers must be approved by a vote of not less than two-thirds of the full membership of the governing body. Councilman White RESOLUTION RESOLUTION EXTENDING THE GRACE PERIOD FOR THE PAYMENT OF FOURTH QUARTER 2012 PROPERTY TAXES WHEREAS, the Mayor and Borough Council of the Borough of South Plainfield, upon recommendation of the Ta Collector, deems it appropriate to etend the grace period for the payment of 2012 fourth quarter taes without interest because of the impact that Hurricane Sandy has imposed on the Borough of South Plainfield s residents; NOW THEREFORE BE IT RESOLVED by the Governing Body of the Borough of South Plainfield that the grace period for payment of 2012 fourth quarter is hereby etended from November 10, 2012 to the close of business on November 16, 2012 and BE IT FURTHER RESOLVED that any and all fourth quarter 2012 property taes due and owing after November 16, 2012 shall bear interest retroactive to November 1, 2012 at the rates heretofore fied by the Ta Collector of the Borough of South Plainfield. Councilman White ACCEPTANCE OF CORRESPONDENCE BE IT RESOLVED THAT THE FOLLOWING CORRESPONDENCE BE AND ARE HEREBY ACCEPTED BY THE BOROUGH COUNCIL OF SOUTH PLAINFIELD AND AUTHORIZATION IS HEREBY GIVEN TO FILE ALL CORRESPONDENCE RECEIVED: South Plainfield Recycling Monthly Report September, 2012

7 Councilman White SOUTH PLAINFIELD BOROUGH APPROVAL OF BILLS AND CLAIMS WHEREAS, The Chief Financial Officer has certified and submitted a consolidated bill list for the payment of claims; and WHEREAS, all vouchers listed herewith have been encumbered and sufficient funds are available for payment; and WHEREAS, the required signatures of the Department Head and/or the Finance Chairperson, the Vendor, and the Chief Financial Officer, have all been obtained on each voucher on the attached list. NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Borough Council of South Plainfield Borough that the voucher list submitted is hereby approved for payment in the total amount of $1,550, BE IT FURTHER RESOLVED that a copy of this approval be forwarded to the following: Municipal Clerk Glenn Cullen, Chief Financial Officer Dotty Paradiso, Supervisor of Accounts Councilman White vote: 6 0 COUNCIL REPORTS: Borough Attorney Rizzo, Esq. had no report for this evening. Administrator Cullen thanked everyone, especially this Council and the employees for all their effort and support after the storm to help clean the town. Right now there remain about fifty residents still without power and we have not forgotten them. We are doing all we can to help them. Our public works department has done a fantastic job getting up all the debris in an epedient manner. Everyone has worked tirelessly to help those in need. Engineer Miller briefed the Council on the status of the road improvement projects. Fisher contracting has completed his job and all the speed bumps are in place now. Stilo Ecavating is still making progress, weather permitting. Clerk Antonides advised that there is now full power back after Hurricane Sandy in all election polling locations and that tomorrow s General Election will be business as usual. Thanked the EMS, Fire, OEM, Police, fellow Council members, employees, DPW for all their time and effort put forth to clean up our town after such a detrimental storm. Mr. Barletta said that one person in particular really stood out in going the etra mile and worked tirelessly to help do all he could to get the communication flowing to our residents and to get our power back and that is Glenn Cullen. He really worked hard and did all he could. He did a really commendable job. On a side note, Mr. Barletta warned home owners to beware those trying to capitalize on this storm recover. Homeowners need to make sure that before they hire someone to do repairs to their home that they are fully licensed and insured. advised how proud he is of everyone who went the etra mile in helping each other out. Neighbor helping neighbor is what it is all about. echoed everyone s appreciation for all the time spent in cleaning up our town after such a large storm. Everyone worked really hard to bring normalcy back to our community as quickly as possible. Mr. Bengivenga advised that moments ago he received notice of a fire at the Middlese Pump Station resulting in a boil water advisory will now need to commence immediately and should be only be temporary. Mr. Bengivenga advised that we will be doing a reverse 911 call to all residents to alert them of this as well as post a notice on our website and Facebook account.

8 Councilman White also thanked everyone involved in assisting in any way they could. Mr. White said that we all came together to do what we needed to make things right for our community. Mr. White etended a special word of appreciation to the PBA and Senior Center for all their help and assistance with those residents in need. Thanked all Police, Fire, EMS, and DPW for all their long hours spent on assisting with this Hurricane. The DPW has been out since before the storm began and has worked non-stop since. They have been kept from their own families for a very long period of time now. Mr. McConville further thanked the Council for all the hours they all put in assisting residents, picking up debris, among many other things. was also assisting us in driving one of the trucks to help pick up the debris around town. etended a special word of appreciation to Glenn Cullen for the outstanding job he did as well as his devotion to the community. Mr. Rusnak said he just wished everyone knew how much Glenn Cullen did before, during and after this storm. Mr. Rusnak epressed further appreciation to Bob Capparelli who worked tirelessly to help our community. Mr. Rusnak said how proud he is of the Police Chief who did an outstanding job of leading his department. Mr. Rusnak advised how proud he is to be a part of this governing body who also spend many hours doing all they could do to help. To conclude, Mr. Rusnak informed everyone of how while going door to door to assist residents he came upon a husband and wife who feared running their generator because they would soon be out of gasoline. went out and brought gasoline back to them so they could keep their generator running. Mayor Anesh also echoed everyone s words of appreciation to all who helped during the storm, especially Glenn Cullen who worked around the clock to do all he could. Mayor Anesh also epressed his appreciation to his Secretary, Anne Daley, for coming in on the weekend and taking a countless number of phone calls. At this time Administrator Cullen advised that the just took a cell phone call notifying him that the section of Delmore Avenue just got their power back. COMMENTS FROM THE PUBLIC: Mr. Alan Pearlman Esq. thanked the Council for their cooperation in assisting the bond release that was on this evening s agenda. Mr. Pearlman advised he is from Scotch Plains and their town is still not doing well with no power in a majority of their town. Ms. Libby Barski of 45 Jones Street asked if there is a boil water advisory in effect. Mayor Anesh said yes there now is as we were just advised of this during this meeting. Mayor Anesh said after this meeting concludes we will be doing all we can to get the word out to our residents via a reverse 911 call, posting on Facebook as well as our website. Only those effected utilize the Middlese Pump Station. Ms. Debbie Boyle of Van Fleet, thanked everyone for coming out to the Taste of South Plainfield event. Over $3,000 was raised and will go toward high school scholarships. The Health and Safety Fair was also a big success. To conclude, Ms. Boyle thanked the Mayor and Council, DPW, Police, Fire, EMS, OEM for all their effort during the storm recovery and said she hopes that the residents appreciate all that has been done. Mr. Bob Jones said ditto what Ms. Boyle just said. Mr. Jones said that Mr. Glenn Cullen did an amazing job during the storm recovery and that Mayor Anesh really showed outstanding leadership. Mayor Anesh must have received calls a day and he returned each and every one of them. It really was a job well done. Mr. Anthony Burilla said he lives net door to the Drake House and questioned if WTCT AM was kept informed of the status of our storm recovery. Mayor Anesh eplained. Mr. Burilla advised that he would like to see transport for seniors to the shopping center take place on Thursdays between 9am and noon. Also, Mr. Burilla said he would like to see auiliary police. Mayor Anesh eplained that we utilize CERT members instead of auiliary police. With no further comments from the public, Mayor Anesh closed the floor. At this time, 7:55 p.m., Mayor Anesh advised that they will be going into Eecutive Session and everyone is welcome to stay for their return back into public session. ADJOURNMENT Without further comment, Mayor Anesh called for a motion to adjourn. Councilman White made a motion to adjourn at 8:20 p.m., seconded by and unanimously carried.
