19 RECEIVED November 12, 2012 VAUGHAN COMMITTEE OF ADJUSTMENT Page 1 of 2 DATE: November 12, 2012 TO: Todd Coles, Committee of Adjustment FROM: Grant Uyeyama, Director of Development Planning Development Planning Department MEETING DATE: November 22, 2012 OWNER: Vishnu and Mona Prajapati FILE(S): A349/12 Location: Proposal: 175 Golden Orchard Road, Vaughan Ward 4, Vicinity of Major Mackenzie Drive and Keele Street The Owner is requesting permission to maintain a deck with the following variances: Variance Proposed Required 1 Minimum rear yard setback to a deck 2.14 m 5.7 m 2 Minimum interior side yard setback 0.49 m 1.2 m Official Plan: Comments: The subject lands are designated Low Density Residential by in-effect OPA #600 (Carrville Urban Village 2) and Settlement Area by in-effect OPA #604 (Oak Ridges Moraine Conservation Plan). The subject lands are also designated Low-Rise Residential by the new City of Vaughan Official Plan 2010, which is subject to approval from the Ontario Municipal Board. The proposal conforms to the policies of the Official Plan. The Development Planning Department conducted a site visit with photo documentation on November 6, The subject lands are developed with a two-storey single detached dwelling located on the south side of Golden Orchard Road. The Owner is requesting permission to maintain an open and unenclosed deck with an interior side yard setback of 0.49m and a rear yard setback of 2.14m. The deck, as-built, contains an upper and lower tier that measures 1.79m and 0.78m, respectively. The lower tier of the deck maintains a 1.2m interior side yard setback, which is permitted as-of-right. The requested 0.49m interior side yard setback is for two risers that project into the southerly interior side yard. On this basis, the Development Planning Department is of the opinion that the requested 0.49m interior side yard setback maintains the intent of the Zoning By-law and is considered minor in nature. The Development Planning Department has no concerns with the open and unenclosed portion of the deck, as this Department has supported a minimum rear yard setback of 2.1m to an above-grade deck on similar lots. Accordingly, the Development Planning Department is of the opinion that the proposal is minor in nature, meets the intent of the Zoning By-law, and is desirable for the appropriate development of the land.
