1 February 21, 2018 Page 1 of 10 minutes Wednesday, February 21, :00 pm Middlesex Centre Municipal Office MINUTES The Municipal Council of the Municipality of Middlesex Centre met in Regular Session in the Council Chamber on February 21, 2018 at 4:00 pm. COUNCIL PRESENT: Mayor Edmondson - Chair presiding, Deputy Mayor DeViet (4:28 pm), Councillors Harvey, Brennan, McMillan, Silva (4:27 pm) and Berze. REGRETS: STAFF PRESENT: Michelle Smibert CAO & Acting Clerk, Colin Toth Director of Fire and Emergency Services, Tiffany Farrell Director of Corporate Services, Brian Lima Director of Public Works and Engineering, Scott Mairs Director of Community Services, Kelly Henderson Planner, Wayne Ysebaert Deputy CBO. ALSO PRESENT: Members of the public and press. 1.0 CALL TO ORDER Mayor Edmondson called the meeting to order at 4:00 pm. 2.0 DISCLOSURE OF PECUNIARY INTEREST AND GENERAL NATURE THEREOF The Municipal Conflict of Interest Act requires any member of Council declaring a pecuniary interest and the general nature thereof, where the interest of a member of Council has not been disclosed by reason of the member s absence from the meeting, to disclose the interest at the first open meeting attended by the member of Council and otherwise comply with the Act. 2 February 21, 2018 Page 2 of 10 minutes Council Minutes 2 February 21, DELEGATIONS AND PRESENTATIONS 5.1 Government Municipal Drain No. 2 Court of Revision Members: Councillors Silva, Brennan and Berze R Motion by Councillor Harvey and Councillor Berze THAT Council Recess for Court of Revision with members being Councillors Harvey, Brennan and Berze. Carried The Clerk advised that no appeals have been submitted. The Director of PWE noted that it has been agreed to by all parties that the previous work completed on this drain will be incorporated into this work. Therefore it is the decision of the Court of Revision to adopt the revised assessment schedule as prepared by the engineer. The revised assessment schedule is to be used moving forward. R Motion by Councillor Harvey and Councillor Brennan. THAT the Assessments as revised as levied by GM Blue Plan Engineering dated January, 2018 and adopted by Provisional By-Law to pay for drainage works known as the Government Drain No. 2 be confirmed. Carried R Motion by Councillor McMillan and Councillor Harvey THAT Council reconvene. Carried 7.1 Report CPS Council Grants Program 2018 There was some discussion regarding the archives request for funding and the space they are working out of and Council requested that a representative of the archives group attend a future meeting. R Motion by Councillor Berze and Councillor McMillan THAT the request from the London and Middlesex Heritage Museum Fanshawe Pioneer Village be approved in the amount of $5, in accordance with the Council Grants Policy; and FURTHER THAT the request from the Tri-County Heritage Club be approved in the amount of $1, in accordance with the Council Grants Policy; and FURTHER THAT the request from the Middlesex Centre Archives be approved in the amount of $5, in accordance with the Council Grants Policy; and FURTHER THAT the request from Komoka Railway Museum be approved in the amount of $1, in accordance with the Council Grants Policy; and

4 February 21, 2018 Page 4 of 10 minutes Council Minutes 4 February 21, 2018 FURTHER THAT the request from Del-Ko-Brydge Canada Day be approved in the amount of $1, in accordance with the Council Grants Policy; and FURTHER THAT the request from Poplar Hill Picnic be approved in the amount of $1, in accordance with the Council Grants Policy; and FURTHER THAT the request from Optimist Club of Bryanston-Birr Inc. be approved in the amount of $1, in accordance with the Council Grants Policy; and FURTHER THAT that staff be directed to prepare correspondence and issue payment to the above noted organizations. Carried 7.2 Report PWE Ministry of Transportation Community Transportation Grant Program R Motion by Councillor Berze and Councillor Harvey THAT Council endorse the funding application being submitted by the Municipality of Middlesex Centre to the Ministry of Transportation Community Transportation Grant Program Municipal Stream for a five-year period for Community Transportation projects that propose long-distance scheduled transit routes. Carried 7.3 Report PWE Municipal Class Environmental Assessment Review At this point in the meeting, both Deputy Mayor DeViet and Councillor Silva arrived. R Motion by Deputy Mayor DeViet and Councillor Berze THAT the following resolution be adopted by the Municipality of Middlesex Centre Council: WHEREAS a coalition of the Municipal Engineers Association (MEA) and the Residential and Civil Construction Alliance of Ontario have successfully applied to have a review of the Municipal Class Environmental Assessment process conducted under Part IV (Section 61) of the Environmental Bill of Rights Act, 1993 (EBR Act); AND WHEREAS impact studies and public meetings required by the MCEA process often take two years or more to complete before construction can commence; AND WHEREAS the MCEA requirements to evaluate alternatives are often not well aligned with prior or municipal land use planning decisions; AND WHEREAS analysis by the Residential and Civil Construction Alliance of Ontario (RCCAO) has demonstrated that the time to complete an EA rose from 19 months to 26.7 months and costs went from an average of $113,300 to $386,500;

5 February 21, 2018 Page 5 of 10 minutes Council Minutes 5 February 21, 2018 AND WHEREAS the Auditor General of Ontario has tabled recommendations for modernizing the MCEA process; AND WHEREAS in spite of written commitments made by the Ministry of the Environment between , no action has been taken; AND WHEREAS local projects that do not have the necessary approvals could lose out on the next intake of Build Canada funding; THEREFORE BE it resolved that Municipality of Middlesex Centre requests that the Minister of the Environment and Climate Change take immediate steps to expedite the response process for Part II Orders or Bump-Up requests, as part of the s.61 review to improve MCEA process times and reduce study costs; AND FURTHER that the Minister of the Environment and Climate Change support changes to better integrate and harmonize the MCEA process with processes defined under the Planning Act; AND FURTHER that the Minister of the Environment and Climate Change amend the scope of MCEA reports and studies to reduce duplication with existing public processes and decisions made under municipal Official Plans and provincial legislation. Carried 7.4 Report - CAO Ilderton Community Improvement Program The CAO noted that some correspondence had been received about the program and it looks likes the funding monies can be directed to CIP programs or other downtown programs identified by other plans. R Motion by Councillor Harvey and Councillor Silva THAT staff be authorized to proceed with the 2018 Ilderton Community Improvement Program. Carried 10.0 COMMITTEE OF ADJUSTMENT R Motion by Councillor Silva and Deputy Mayor DeViet

6 February 21, 2018 Page 6 of 10 minutes Council Minutes 6 February 21, 2018 THAT Council adjourn its regular meeting at 7:00pm in order to sit as a Committee of Adjustment under Section 45 of The Planning Act R.S.O., 1990, as amended. Carried 10.1 Application for Minor Variance (A-1/2018) Allen and Sharon Bourgeois Nairn Road Chair McMillan read aloud the procedure for the committee of adjustment hearings. There were no conflicts noted from the members on this application. The applicant appeared before the committee to review her application and there wasn t anyone in the gallery to speak to this application. The planner then presented her report. R Motion by Councillor Harvey and Councillor Silva THAT Minor Variance Application A-1/18, filed by Allen and Sharon Borgeois for relief from the Comprehensive Zoning By-law s minimum front yard setback requirement of 38.0 metres from the centreline of the County road, whereas the owners are proposing to construct a front porch, breezeway and garage attached to the existing single detached dwelling with a minimum setback of 28.0 metres.; for a property legally described as Part of Lot 12, Concession 8 (geographic Township of Lobo); Parts 1, 2 and 3, RP 33R-5971, Municipality of Middlesex Centre; be granted. FURTHER THAT Minor Variance Application A-1/18 not be subject to any conditions. AND FURTHER THAT the reasons for granting Minor Variance Application A-1/18 include: - The request complies with the general intent and purpose of Middlesex Centre s Official Plan; - The request complies with the general intent and purpose of Middlesex Centre s Comprehensive Zoning By-law; - The request is minor in nature; and - The request represents appropriate development on the subject property. Carried 10.2 Application for Minor Variance (A-2/2018) Aldo Caranci, on behalf of Jordan Caranci, Ilderton Road Chair McMillan asked if there were any conflicts and the members did not disclose any. Mr. Caranci appeared before the committee and he noted that he had just heard of the issues on Friday. He asked to meet with the building inspector on this matter and was told that nothing could be done. No one from the gallery spoke to this application and the Planner provided her report. Councillor Harvey asked if there was anything that could be done to deal with this situation and staff said that it was made clear during the consent application process that the shed was too close to the lot line and that it would have to be removed or moved to comply with the zoning by-law.

7 February 21, 2018 Page 7 of 10 minutes Council Minutes 7 February 21, 2018 R Motion by Councillor Brennan and Councillor Berze THAT Minor Variance Application A-2/18, filed by Aldo Caranci, on behalf of Jordan Caranci for relief from the Comprehensive Zoning By-law s interior side yard setback requirement of 1.5 metres, whereas the owners are proposing to permit a detached garage with a minimum setback of 0.44 metres; for a property legally described as Part of Lot 26, Concession 11 (geographic Township of London); Municipality of Middlesex Centre; be denied. AND FURTHER THAT the reasons for denying Minor Variance Application A-2/18 include: - The request complies with the general intent and purpose of Middlesex Centre s Official Plan; - The request does not comply with the general intent and purpose of Middlesex Centre s Comprehensive Zoning By-law; - The request is not minor in nature; and - The request does not represent appropriate development on the subject property. Carried 10.3 Application for Minor Variance (A-3/2018) Jim Sheffield (Nicholson Sheffield Architects Inc.) on behalf of Ontario Ltd, 30 Doan Drive. Chair McMillan asked about any conflicts and no members disclosed any. The agent was in attendance and provided an overview of the proposal. The Planner then provided her report. R Motion by Councillor Berze and Mayor Edmondson THAT Minor Variance Application A-3/18, filed by Jim Sheffield (Nicholson Sheffield Architects Inc.) on behalf of Ontario Ltd for relief from the Comprehensive Zoning By-law s minimum front yard and rear yard setback requirement of 10.0 metres, whereas the owners are proposing to expand the existing commercial building with a front yard setback of 5 metres and a rear yard setback of 3 metres; for a property known municipally as 30 Doan Drive, be granted. FURTHER THAT Minor Variance Application A-3/18 not be subject to any conditions. AND FURTHER THAT the reasons for granting Minor Variance Application A-3/18 include: - The request complies with the general intent and purpose of Middlesex Centre s Official Plan; - The request complies with the general intent and purpose of Middlesex Centre s Comprehensive Zoning By-law; - The request is minor in nature; and

Carried 11.0 PUBLIC MEETINGS R Motion by Councillor Berze and Councillor Harvey THAT Council move into Public Meeting at 7:22 p.m. under Section 53 & 34of the Planning Act, R.S.O. 1990, c. P13, as amended. Carried 11.1 Colbert Surplus Farm Severance R Motion by Councillor Silva and Deputy Mayor DeViet THAT Consent Application B1/18, filed by James and Mary Colbert in order to sever a surplus farm residence on a lot with a frontage of approximately 75 metres along Eight Mile Road and an area of approximately 0.99 hectares (2.4 acres); from a property legally described as Part of Lot 5, Concession 8 (geographic Township of London), Municipality of Middlesex Centre and known municipally as Eight Mile Road be amended in order to sever a surplus farm residence on a lot with a frontage of approximately 75 metres along Eight Mile Road and an area of approximately 0.57 hectares (1.4 acres) be deferred so that the applicant can meet with staff about altering the application/size of parcel. Carried 11.2 Application for Zoning By-Law Amendment; Leslie Miller, 3528 Woodhull Road R Motion by Deputy Mayor DeViet and Councillor Harvey THAT the Zoning By-law Amendment application, filed by Leslie Miller in order to permit two single-detached dwellings on one property for up to two years while a new residence is being constructed on the land, be approved, and that the Owners be required to enter into a Temporary Use Agreement with the Municipality and submit a deposit of $10,000 to ensure that the removal of the existing residence occurs. Carried 12.0 NOTICE OF MOTION 12.1 Councillor Silva Recording of Middlesex Centre Council/Committee Meetings R Motion by Councillor Silva and Councillor McMillan WHEREAS Municipality of Middlesex Centre staff are currently assessing new software solutions to compile and deliver digital council and committee meeting agendas,

9 February 21, 2018 Page 9 of 10 minutes Council Minutes 9 February 21, 2018 THAT Municipality of Middlesex Centre staff be directed to research, assess, and incorporate a live streaming solution into the final recommendation, where the live streaming solution will be used to record, broadcast, and archive audio and video recordings of all Middlesex Centre committee and council meetings. Carried 13.0 CORRESPONDENCE - Resolution - OBC Amendments, Township of Norwich - Offering School Property to Municipalities, Essex - Bluewater Recycling Association Board of Directors Meeting - OCIF Top-Up Application Component R Motion by Councillor Harvey and Councillor Silva THAT the above noted correspondence be received and that Middlesex Centre support the Town of Essex letter regarding the offer of school properties to municipalities. Carried 14.0 COUNTY COUNCIL UPDATE 15.0 OTHER BUSINESS Deputy Mayor DeViet provided an update as it related to the Health Unit matter. County council would like to ensure that any changes to the location of the Health Unit Office will better support the services offered to the residents of the County Councillor Harvey Council Discussion regarding input into Thames Valley District School Board system wide planning consultation meeting Councillor Harvey reviewed some correspondence from the Rural School Board Alliance with the members of Council in hopes of gathering a common message from Middlesex Centre when approaching school board issues. Councillor Harvey will report back to Council following the consultation session with the Thames Valley District School Board later in the month Councillor McMillan Sale of Former Coldstream Fire Station Councillor McMillan noted she has had some feedback/concerns from the community regarding the potential new use of the former Coldstream Fire Station property. The lot is a small one with the building that is close to the road within a residential area. The CAO noted concern raised by a real estate agent regarding the selection of the real estate agent and indicated that the procurement by-law is being followed. The CAO noted that given the above concerns, if council is looking at a different method to sell the fire station then this would be the time to do so. The Council felt that the rezoning process will help to deal with the new or future use of the lands and there was no change in direction to sell the property by real estate agent.
