3 Spring of 2011 The Beginning The Workplace Safety ARC (ARC) was created by the Office of Regulatory Reinvention (ORR) in accordance with Executive Order

4 Purpose The purpose of the ARC was to evaluate and make recommendations for changes to Michigan s workplace safety regulations, including existing administrative rules, non rule regulatory actions, regulatory processes, and as necessary, statutes. 4

5 Seven Factors 1. Health or safety benefits of the rules. 2. Whether the rules are mandated by any applicable constitutional or statutory provision. 3. The cost of compliance with the rules, taking into account their complexity, reporting requirements and other factors. 4. The extent to which the rules conflict with or duplicate similar rules or regulations adopted by the state or federal government. 5

6 5. Extent to which the regulations exceed national or regional compliance requirements or other standards. 6. Date of last evaluation of the rules and the degree, if any, to which technology, economic conditions or other factors have changed regulatory activity covered by the rules since the last evaluation. 7. Other changes or developments since implementation that demonstrate there is no continued need for the rules. 6

8 Findings 9 Recommendations 1. Eliminate Construction Safety, General Industry Safety, and Occupational Health Safety Standards Commissions. 2. Clear and convincing need for exceeding federal standards. 3. Facilitate OSHA Standards Improvement Project. 8

9 Findings 9 Recommendations 4. Requirements for qualifications, training and permits should be revised to performance based requirements. 5. Confined spaces in Agriculture. 6. Pursue a review of state rules, once the federal government has completed its review. 9

10 Findings 9 Recommendations 7. Retract currently proposed rules which exceed Federal requirements. 8. Several current rules formally adopted into the Michigan Administrative Code. 9. Combine current diving standards into one standard not to exceed Federal standard. 10

11 Findings Construction 22 Construction Safety standards were affected. 2,238 individual rules, or paragraphs within a rule, were affected. 693 individual rules, or paragraphs within a rule, were eliminated. 11

12 Findings General Industry 46 General Industry standards were affected. 4,051 individual rules, or paragraphs within a rule, were affected. 168 individual rules, or paragraphs within a rule, were eliminated. 12

13 Findings Occupational Health 39 Occupational Health standards were affected. 498 individual rules, or paragraphs within a rule, were affected. 166 individual rules, or paragraphs within a rule, were eliminated. 13
