Soady-Easton Absent: Regional Councillor D. Zimmerman 1. Call to Order The Mayor called the meeting to order at 7:00 p.m. 2. Disclosure of Interest a) Alderman Mullins declared a conflict of interest with agenda item 7c) A By-law to authorize a Condominium Assumption Agreement between Marz Homes (Niagara) Inc. the Corporation of the Town of Grimsby, Niagara North Common Elements Condominium Corporation and the Royal Bank of Canada for Block 3, Plan 30M- 412 (Azure Subdivision), in the Town of Grimsby. Alderman Mullins is an employee of the Royal Bank of Canada. Alderman Mullins did not participate in voting on By-laws.

Approval of Committee Minutes a) Grimsby Public Library, September 10, 2014 C Moved by Alderman Johnston; Seconded by Alderman Seaborn; Resolved that the Grimsby Public Library meeting minutes of September 10, 2014 be received. b) Committee of Adjustment, October 7, 2014 C Moved by Alderman Seaborn; Seconded by Alderman Johnston; Resolved that the Committee of Adjustment meeting minutes of October 7, 2014 be received and filed. c) Planning & Development, October 14, 2014 C Moved by Alderman Seaborn; Seconded by Alderman Johnston; Resolved that the Planning & Development meeting minutes of October 14, 2014 be approved. d) Committee of Adjustment, October 21, 2014 C Moved by Alderman Johnston; Seconded by Alderman Seaborn; Resolved that the Committee of Adjustment meeting minutes of October 21, 2014 be received and filed.

Reports a) TM Committee Selection 2014 C Moved by Alderman Seaborn; Seconded by Alderman Johnston; Resolved that Report TM dated October 31, 2014 regarding Committee Selection 2014 be received. 6. Correspondence a) Members of the Board of Directors for the Pulmonary Hypertension Association of Canada - request to declare November as Pulmonary Hypertension Month C Moved by Alderman Finch; Seconded by Alderman Mullins; Resolved that the correspondence from the Pulmonary Hypertension Association of Canada requesting that November be declared as Pulmonary Hypertension Month be received. b) Niagara Community Foundation - request to declare November 15th as National Philanthropy Day C Moved by Alderman Kadwell; Seconded by Alderman Finch; Resolved that the correspondence from the Niagara Community Foundation requesting that November 15th be declared as National Philanthropy Day be received. c) Robert Bouvier, President, Teamsters Canada - Rail Safety Regulations C Moved by Alderman Finch; Seconded by Alderman Kadwell; Resolved that correspondence from Robert Bouvier, President, Teamsters Canada with reference to Rail Safety Regulations be received.

Bylaws a) To Amend By-Law 14-45, as amended (42 Ontario Street) b) To amend By-Law 14-45, as amended (133 and 137 Main Street East) c) To authorize a Condominium Assumption Agreement between Marz Homes (Niagara) Inc., the Corporation of the Town of Grimsby, Niagara North Common Elements Condominium Corporation and Royal Bank of Canada for Block 3, Plan 30M-412 (Azure Subdivision), in the Town of Grimsby 8. New Business C Moved by Alderman Kadwell; Seconded by Alderman Finch; Resolved that leave be given to introduce By-law Nos to inclusive and that the same be read a first time. a) Alderman DiFlavio advised members of Council that the West Niagara 2nd Stage Housing dinner at Cibo's has been cancelled. Alderman Johnston stated that batteries in smoke alarms and carbon detectors should be changed. Carbon detectors are now mandatory under the law. Alderman Johnston advised members of Council that the 22nd annual Museum Fundraiser will take place at the Casablanca Winery Inn on November 15. Climatologist David Philips is the guest speaker. The tickets are $95/ and are available at the Museum. There is a Chamber of Commerce Business Excellence Awards dinner on November 26 at the Casablanca Winery Inn.

Next Meeting Alderman DiFlavio advised that the Livingston Avenue extension will be discussed at the Planning & Development Committee meeting scheduled for Tuesday, November 11 at 7 p.m. Alderman Kadwell attending a fundraising dinner in support of Riley Dunda. Walter Gretzky attended along with Peach King alumni. Alderman Kadwell submitted a Notice of Motion to be considered at the November 17, 2014 Council meeting. Alderman Mullins asked for an update on the Jordan Ontario Municipal Board (OMB) hearing. Town Manager Keith Vogl stated that the hearing went for 9 days and concluded on October 27. The Board members reserved the decision for 6 to 8 weeks. Mr. Vogl gets the sense that it will be into the New Year before a decision is made. The lawyers for the Town felt the case went well but there is no ability to predict the outcome. Mayor Bentley advised members of Council that the fundraiser, Curling for Big Brothers and Big Sisters of Grimsby is sold out. Mayor Bentley attended the Grimsby Secondary School (GSS) graduation on Saturday, November 1. GSS are considering moving the graduation ceremony to June in 2015 in order to accommodate graduates that move out of the area. a) The next Council meeting is scheduled for Monday, November 17, 2014 at 7:00 p.m. in the Town Hall Council Chambers, 160 Livingston Avenue, Grimsby. 10. Closed Session a) Closed Session under Section 239(2)(b) of the Municipal Act, 2001 C Moved by Alderman Mullins; Seconded by Alderman Finch; Resolved that Council meet in Closed Session under Section

6 Page 6 of 6 239(2)(b) of the Municipal Act, 2001, personal matters about an identifiable individual including municipal or local board employees - Town Manager Employment Agreement C Moved by Alderman Kadwell; Seconded by Alderman Finch; Resolved that Council return to Open Session. 11. By-laws a) To confirm the procedures of the Council meeting of November 3, 2014 C Moved by Alderman Mullins; Seconded by Alderman Kadwell; Resolved that leave be given to introduce By-law Nos to inclusive read a first time now be read a second and third time and finally passed; that the Mayor and Town Clerk do sign and seal the same any rule of Council to the contrary notwithstanding. 12.
