Sayles indicated that he has checked municipal and state criminal records. To the best of his knowledge, with the available information, the character, record and reputation are satisfactory and he has not objection to the agent appointed. Assistant City Attorney Bruce asked Mr. Cegelski to reaffirm his understanding that he can be personally held responsible for any violations that occur on the property, even when he is not physically present on the premises. Mr. Cegelski stated that yes, he understands his responsibility. Moved by Tara Tinder Seconded by Shelly Cronin to recommend approval of the change of agent as presented. To the best of his knowledge, with the available information, the character, record and reputation are satisfactory and he has not objection to the agent appointed. Mr. Whiteman stated that yes, he understands his responsibility. Items 5.b-5.e were taken in one motion due to the four businesses seeking to change their agent all to Jeff Whiteman. 6 CITY OF BELOIT REPORTS AND PRESENTATIONS TO ABLCC Topic: Application for a Class B Beer and Reserve Class B Intoxicating Liquor License for Velvet Buffalo, LLC, located at 419 Pleasant Street, Jeffrey Whiteman, Agent. Date: July 10, 2018 Presenter: Lorena R. Stottler Department: City Clerk-Treasurer Overview/Background Information Velvet Buffalo, LLC is making an application to establish their business to be located at 419 Pleasant Street and has applied for a Class B Beer and Reserve Class B Liquor License for the license period ending June 30, Key Issues 1. Velvet Buffalo, LLC, is opening a restaurant in the City of Beloit and is requesting to establish the business with a Class B Beer and Reserve Class B Liquor License for the license period ending June 30, A complete application with fees has been submitted to the Clerk s office and is being referred to the ABLCC for their July 10 th agenda by the City Council on June 18 th via the consent agenda. 3. The ABLCC will review the application to assure conformity with existing rules, regulations and zoning ordinances of the city and state and will make a recommendation to the Council based on their review. 4. This application will return to the City Council for final action at the July 16, 2018 regular meeting. 17 CITY OF BELOIT REPORTS AND PRESENTATIONS TO ABLCC Topic: Status update related to the Class B Beer and Class B Liquor License for Truk T, located at 443 E. Grand, Jeffrey Whiteman, Agent. Date: July 10, 2018 Presenter: Lorena R. Stottler Department: City Clerk-Treasurer Overview/Background Information Truk T, LLC was granted a Class B Beer and Class B Liquor License located at 443 E. Grand Avenue, Beloit at the Regular City Council meeting January 16, The license has not been issued due to construction not being complete. City Ordinance 31.04(3) states that Where the City Council has granted a license, but the license has not been issued because construction, renovation or code compliance is not completed in 6 months, the City Council may rescind the license at a regular Council meeting after notice to the licensee and opportunity for the licensee to be heard. Since Construction has not been completed, they are seeking a 6 month extension from the ABLCC in order to complete the construction, comply with inspections and open the restaurant. Key Issues 1. Truk T, LLC was granted a Class B Beer and Class B Liquor License located at 443 E. Grand Ave, Beloit for the license period ending June 30, They have renewed their annual license for but the license has not been issued as construction is not complete. 2. Ordinance 31.04(3) states: Where the City Council has granted a license, but the license has not been issued because construction, renovation or code compliance is not completed in 6 months, the City Council may rescind the license at a regular Council meeting after notice to the licensee and opportunity for the licensee to be heard. 3. It has been past precedent that if the 6 month window expired, the applicant would appear before the ABLCC to present a status update and seek an extension if necessary. The ABLCC would hear the update and make a recommendation to the Council on whether or not an extension was warranted. Truk T is seeking a 6 month extension from the ABLCC. 4. Staff recommends granting an extension to accommodate completion of this business. Grand Avenue, Donta Evans, agent. Date: July 10, 2018 Presenter: Lori Stottler Department: City Clerk/Treasurer Overview/Background Information Evans Group LLC, d/b/a Royalty Lounge, located at 530 E. Grand Avenue, Donta Evans, agent, has submitted an application to amend the Class B Fermented Malt Beverage & Intoxicating Liquor License Outside Premises Extension. This extension of premise should be conditional to meeting the 8 conditions and restrictions that are defined within the CUP granted June 18, Key Issues 1. Evans Group, LLC, d/b/a Royalty Lounge, Donta Evans, agent, has submitted a complete application for renewal of their Class A Beer and Class A Intoxicating Liquor License. 2. The applicant is seeking to amend their premise description from Main Floor and Bar Area to Main Floor and Bar; and outdoor seating area per Conditional Use Permit granted A Conditional Use Permit to allow an outdoor seating area with the possession, sale & consumption of alcoholic beverages in the CBD-1 Central Business District-core, for the property located at 530 E Grand Avenue was approved by the City Council on June 18, Any recommendation to the Council from the ABLCC should be contingent upon meeting the conditions defined within the CUP that includes obtaining architectural review and building permits, relocation of dumpsters, installation of two security cameras and two wall-mounted lights. 5. The outdoor seating area has a maximum seating capacity of 6 persons. 6. Upon recommendation of the ABLCC, this item will go before the City Council for action at its July 16, 2018 meeting.
