1 CITY OF REVELSTOKE MINUTES OF THE REGULAR COUNCIL MEETING HELD ON TUESDAY, DECEMBER 22, 2015 IN COUNCIL CHAMBERS COMMENCING AT 3:00 PM Councillors: PRESENT Mayor M. McKee T. English, L. Nixon, A. Armstrong, Revelstoke Adventure Park *Attended a portion of the meeting only 1 CALL TO ORDER Mayor McKee called the meeting to order at 3:00 pm 2 PUBLIC HEARING a) Zoning Amendment Bylaw 2093 (Vacation Rental) Cashato Crescent - Zuzanna Driediger Being a bylaw to amend the zoning designation of: Lot 2 Section 22 Township 23 Range 2 W6M Kootenay District Plan NEP22528 from Single Family Residential (R1) to Single Family Residential Vacation Rental District (R1v). The Mayor advised that the purpose of the Public Hearing is to provide the public with an opportunity to make representations to Council who believe that their interests are affected by the proposed bylaw. D. Levesque, Director of Corporate Administration advised that due process was followed. Mayor McKee thanked those present for coming out and called for comments from individuals on the Speakers List, attached.

2 Council Regular Minutes Tuesday, December 22, 2015 P a g e 2 Terry Marshall Nichol Road Ms. Marshall requested that staff look at alternate ways to do vacation rentals in order to protect relationships with good neighbours. Ms. Marshall is against the application due to previous noise and parking issues which impeded snow removal. Mayor McKee called for speakers a first time. Mayor McKee called for speakers a second time. Terry Marshall Ms. Marshall inquired about the sort of recourse neighbours will have if adopted then continued problems with noise and parking. Mayor McKee advised that the City can revoke the business license and/or issue fines to the property owner(s) for bylaw infractions. Deb Munroe Cashato Crescent Ms. Munroe questioned who they should call if there are issues after hours? D. Strachan, Manager of Development Services advised to call the RCMP, who in turn will contact the property owner at the 24 hour on call number listed on the business licence. Terry Marshall Ms. Marshall asked for clarification on parking with respect to egress for vehicles. D. Strachan, Manager of Development Services advised that parking requirements are different for Bed and Breakfasts where more than one party stays at a home. Vacation Rentals are for one group. Rosetta Bernava Nichol Road Ms. Bernava asked if other applicants in the area automatically be granted Vacation Rental status? Mayor McKee advised that each applicant will be required to go through the same process which includes a Public Hearing and notification to surrounding property owners. Mayor McKee called for speakers a third and final time. Upon hearing none, the following resolution was made: THAT the Public Hearing for Zoning Amendment Bylaw 2093 close at 3:15pm. THAT Zoning Amendment Bylaw No be read a Third time. Opposed: Mayor McKee & Councillor Orlando THAT Zoning Amendment Bylaw No be Adopted.

3 Council Regular Minutes Tuesday, December 22, 2015 P a g e 3 Opposed: Mayor McKee & Councillor Orlando b) Zoning Amendment Bylaw 2091 (Vacation Rental) - Rural Residential 2 Hectare District; and Zoning Amendment Bylaw 2092 (Vacation Rental) Cedar Street - Scott Duke Zoning Amendment Bylaw 2091 Being a bylaw to include vacation rental use subzone to the Rural Residential 2 Hectare District; and Zoning Amendment Bylaw Being a bylaw to amend the zoning designation of: Lot 9 Block 17 Section 35 Township 23 Range 2 West of the 6th Meridian Kootenay District Plan 636K Except Part Included in Plan R257 from Rural Residential, 2 Hectare District (RR2) to Rural Residential, 2 Hectare, Vacation Rental District (RR2v). The Mayor advised that the purpose of the Public Hearing is to provide the public with an opportunity to make representations to Council who believe that their interests are affected by the proposed bylaw. D. Levesque, Director of Corporate Administration advised that due process was followed. Mayor McKee thanked those present for coming out and advised that no names were added to the Speakers List, attached. Mayor McKee called for speakers a first time. Michael Brooks-Hill Cedar Street Mr. Brooks-Hill stated that he supports the application. Mayor McKee called for speakers a second time. Mayor McKee called for speakers a third and final time. Upon hearing none, the following resolution was made: THAT the Public Hearing for Zoning Amendment Bylaws 2091 & 2092 close at 3:30pm. THAT Zoning Amendment Bylaw No. 2091, being a bylaw to include vacation rental use subzone to the RR2-2 Hectare Zoning District, be read a Third time. THAT Zoning Amendment Bylaw No. 2092, being a bylaw to allow for vacation rental use, be read a Third time.

4 Council Regular Minutes Tuesday, December 22, 2015 P a g e 4 3 ANNOUNCEMENTS FROM THE MAYOR Mayor McKee stated that: A Public Information Session for the Big Eddy Water Service Upgrades was held on December 14, He encouraged Big Eddy residents to support the project by signing the petitions which were mailed out last week; He was extremely happy with Councils accomplishments this year. He was proud of the new Councillors and their dedication to the City; He thanked staff and the media for providing information and process; and He wished everyone a Merry Christmas and Happy & Healthy New Year. 4 ADOPTION OF AGENDA THAT the agenda be adopted as presented. 5 ADOPTION OF MINUTES a) Regular Council Minutes - December 8, 2015 THAT the Minutes of the Regular Council Meeting on December 8, 2015 be adopted as read this day and that such Minutes as read set out all the business before Council that day and fully and properly record all the resolutions passed and adopted by Council at that meeting. 6 BUSINESS ARISING FROM THE MINUTES - Nil 7 DELEGATIONS & PRESENTATIONS - Nil 8 OLD BUSINESS a) Administration - Records Management Bylaw THAT Records Management Bylaw 2085 be Adopted. 9 NEW BUSINESS a) Administration - Public Participation Policy A-23 THAT the City of Revelstoke Public Participation Policy (Policy A-23) be Received.

5 Council Regular Minutes Tuesday, December 22, 2015 P a g e 5 b) Administration - Okanagan Regional Library Board Council Appointment Moved by Councillor Sulz THAT Council appoint Councillor Nixon to the Okanagan Regional Library Board of Directors to represent the City of Revelstoke and further to appoint Councillor Orlando as an Alternate. c) Administration - Website Redesign Agreement THAT the agreement for the redesign of the City of Revelstoke Website with CivicPlus be approved. Opposed: Councillor Orlando d) Administration - Big Eddy Local Area Service Bylaw 2094 THAT Big Eddy Local Area Service Bylaw No be read a First, Second and Third time. e) Administration - Big Eddy Water Utility Services Loan Authorization Bylaw 2095 THAT Loan Authorization for Big Eddy Water Utility Service Bylaw No be read a First, Second and Third time. f) Administration - Big Eddy Water System Local Area Service Petition for City of Revelstoke Owned Parcels THAT the Corporate Officer be authorized to sign the City owned land petitions for 1805 and 1815 Griffiths Road in favour of the Local Area Service for the Big Eddy Improvement District. g) Administration - Development Approval Procedures Bylaw 2097 and Delegation Bylaw 2098 THAT Development Approval Procedures Bylaw No be read a First, Second and Third time. THAT Delegation Bylaw No be read a First, Second and Third time.

6 Council Regular Minutes Tuesday, December 22, 2015 P a g e 6 h) Development Services - Official Community Plan Amendment, Land Use Contract Discharge and Rezoning Applications - Selkirk Land and Cattle THAT the property owner for the Official Community Plan Amendment, Land Use Contract Discharge, and Rezoning Applications for a Portion of Remainder of Northwest Quarter of Section 24, Township 23, Range 2, West of the 6th Meridian, KD, Except Parts Included in Plans 6130, 6131, and be requested to provide the following reports for the subject property: 1. Preliminary Geotechnical Report Identifying limiting features such as steep slopes and hazards. 2. Preliminary Registered Professional Biologists Report Identifying features such as streams, water courses, wetlands, wildlife features and sensitive ecosystems. 3. Preliminary Civil Engineering Report Initial infrastructure servicing plans for proposed subdivisions including preliminary traffic impact analysis. AND THAT the Official Community Plan Amendment, Land Use Contract Discharge, and Rezoning Applications be referred back to the Advisory Planning Commission for their review and recommendation once the reports have been completed. i) Development Services - Zoning Amendment Bylaw 2096 Vacation Rental Cedar Street - Scott Duke THAT the application to rezone Parcel A (See I) of Lot 8 Block 17 Section 35 Township 23 Range 2 W6M Kootenay District Plan 636K except part included in Plan R257 (410 Cedar Street) from RR2 Rural Residential 2 Hectare District to RR2v Rural Residential 2 Hectare Vacation Rental District be approved. THAT Zoning Bylaw No be read a First and Second time and staff be directed to schedule a Public Hearing. j) Development Services - Crown Referral - Revelstoke Adventure Park Licence of Occupation THAT staff provide a response to the crown referral stating no objection to approval of the project subject to conditions outlined in the referral response text below: This proposal falls in line with the City of Revelstoke's Official Community Plan goal to "Expand community tourism capacity to attract, host and satisfy visitors from many parts of the world." While the proposed development is located outside the City of Revelstoke, the development will draw on the City's emergency services. For this reason we ask that the applicant be required to work with the local emergency service providers (BC Ambulance Service, RCMP and Fire Rescue Services) throughout the development of the Revelstoke Adventure Park. The existing safety concerns of the RCMP have been attached for information.

7 Council Regular Minutes Tuesday, December 22, 2015 P a g e 7 k) Economic Development - Revelstoke Food Security Strategy - Potential Impacts on City Departments THAT the report prepared by the Director of Community Economic Development dated December 14, 2015 on the potential impacts of the Revelstoke Food Security Strategy on City Departments be received as information. l) Finance Property Tax Sale THAT Council declare that a manifest error was made in the sale of the property located at 218 Ninth St E (roll #848000), during the 2015 Property Tax Sale and order that the purchase price, plus interest, be returned to the purchaser and the taxes outstanding on the property be restored as they were before the tax sale. m) Finance - Personal Use of City Vehicles THAT the report written by the Deputy Director of Finance dated December 10, 2015, regarding the personal use of City vehicles, be received for information. n) Fire - Revelstoke Mountain Resort Fireworks Authorization Request THAT Revelstoke Mountain Resort (RMR) be authorized to set off professional grade fireworks following any terms and conditions relating to life safety as determined by the Fire Chief. AND THAT RMR follows all requirements of the Federal Explosives Regulations, 2013, Part 18 Display Fireworks. o) Public Works - Vehicle/Equipment Purchase Moved by Councillor Sulz THAT the previously approved budget for account # for a Hiab/Boom Truck be altered for the purchase of a flat deck truck. AND THAT the purchase of the flat deck truck in the amount of $41,720 be approved. AND THAT the wording in the Financial Plan be changed to match the physical description as required, to receive approval from the Municipal Financing Authority.

8 Council Regular Minutes Tuesday, December 22, 2015 P a g e 8 p) Public Works - Garbage Collection and Disposal Bylaw 2080 Moved by Councillor Sulz THAT Garbage Collection and Disposal Bylaw No. 2080, being a Bylaw to provide for and to regulate the collection and disposal of garbage, be Read a First, Second and Third Time. AND THAT owners of buildings or Strata s containing greater than four residential units, who are affected by changes to the Bylaw, receive a letter indicating the changes to the Bylaw and are given the opportunity to provide comment on or before January 18, q) Public Works - Vehicle / Equipment Purchase Moved by Councillor Sulz THAT the purchase of the New Way Cobra with a Freightliner Chassis M2-106 rear loading refuse truck from Falcon Equipment in the amount of $197, incl. taxes be approved. NOTE: Mayor McKee recused himself from the meeting at 4:20 pm for New Business Item 9r due to a conflict as a family member is an owner of the property in question and for New Business Item 9s due to a conflict as a family member is an owner of the local Telus store. NOTE: Councillor Sulz assumed the chair at 4:20 pm. r) Development Services - Municipal Boundary Extension for Annexation of Two Properties into the City of Revelstoke & 3452 Catherwood Road - P. Bernacki, M. Bell, R. Mickle & D. Evans THAT the Municipal Boundary Extension to bring Legal Subdivision 12 & 13, both of Section 12, Township 23, Range 2, West of the 6th Meridian, Kootenay District (3304 and 3452 Catherwood Road) into the City of Revelstoke be supported: AND THAT the referral responses received from the Columbia Shuswap Regional District (CSRD), City Departments, Provincial Agencies and First Nations be received and forwarded to the Province; and AND THAT the Financial Impact Analysis for servicing and infrastructure maintenance costs for the proposed annexation is received and forwarded to the Province. s) Telus - CRTC Regulation of Fibre Support Request Letter - December 10, 2015 THAT the letter from Telus dated December 2015 regarding the CRTC ruling be received. NOTE: Mayor McKee returned to the meeting and resumed the Chair at 4:30 pm.
