1 SHAMOKIN DAM BOROUGH COUNCIL COUNCIL MEETING MARCH 3, 2014 The regular monthly meeting of the Shamokin Dam Borough Council was held on Monday in the municipal building located at 42 W. 8 th Avenue, Shamokin Dam beginning at 7:00 P.M. President David Herbert presiding. MEMBERS PRESENT: Robert Herbert, Andrew Bickhart, Mark Benner, Rue Rothermel, Donald Musser, and David Herbert were present. MEMBERS ABSENT: Malcolm Fleming was absent. OTHERS PRESENT: Solicitor Robert Slivinski, Manager Ed Hovenstine, Mayor Joseph McGranaghan, Secretary LaDawn Leitzel, Mike Beiter, Bill McCormick, Jim Casale, Jesse Herman, Chris Sheaffer, Joshua Herb, and Peter Geipel were present. The meeting was opened with the Pledge of Allegiance. PREVIOUS MEETING MINUTES: A motion was made by Vice President Bickhart to approve the minutes of the February 3, 2014 meeting of Council as presented, seconded by Councilman Benner, and approved by all. COMMUNICATIONS: Municipal Leader Meeting - The Borough received correspondence from Representative Lynda Schlegel Culver regarding a Municipal Leaders Meeting at Degenstein Community Library on Thursday, March 27, 2014 at 9:00 AM to discuss issues effecting municipalities and working toward making improvements. Anyone interested must reply no later than Tuesday, March 25, Liquid Fuels The Borough received a notice that the liquid fuels tax fund payment has increased due to the transportation bill from $37, to $41, and will be direct deposited on. MAYORS REPORT: The Mayor reviewed the February police report. The State Mayor s Association has been working on allowing municipal police to use radar for traffic enforcement in Pennsylvania. The bill has been submitted to the State Senate and the State Legislators.

2 Shamokin Dam Borough Council Page 2 OTHER BUSINESS: Clothing Allowance Manager Hovenstine reviewed a proposed amendment to the Employee Manual regarding clothing allowance. An increase from $ to $ clothing allowance per year, per employee to purchase work related clothing. Jeans and thermal underwear would be items included in the clothing allowance. Additionally, the Borough will also match dollar for dollar an additional $50.00 for a total allowance of $ per employee. A motion was made by Councilman Rothermel to amend the Employee Manual regarding the clothing allowance as discussed, seconded by Vice President Bickhart, and approved by all. Alternate for Zoning Hearing Board Dorcas Dailey, Tim Minori and June Stark are the primary board members. Manager Hovenstine suggested an alternate member for the Zoning Hearing Board when a primary member would be absent. Solicitor Slivinski explained that an alternate member would vote only if it was necessary for a quorum. Councilman Musser suggested posting committees/commissions vacancy on the website (media-facebook page, etc.) and bulletin board/newsletter. Council agreed moving forward to inform residents of any vacancy on committees/commissions. A motion was made by Councilman Musser to appoint Elaine Herbert as an alternate member of the Zoning Hearing Board, seconded by Councilman Benner, and approved. Councilman Herbert abstained, because Elaine Herbert is his wife. Snyder County Tax Collection Commission The Snyder County Tax Collection Commission met on Wednesday, February 19, 2014 for annual meeting. Secretary Leitzel reported that the Commission will be contacting Berkheimer, who is the collection agency for earned income tax, for the possibility of a group quote and the possibility of collecting the local service tax and the delinquent per capita tax of the municipalities. No action was taken at this time. Spring/Summer Newsletter The Spring/Summer Newsletter was presented to Council with anticipation of mailing in March. The newsletter will be posted on the website. Councilman Musser suggested a seasonal newsletter. Council agreed to seasonal newsletters beginning in the fall. Fire Company Lease President Herbert reviewed the proposed Fire Company lease, terms are as follows: One year lease, Automatic renewal with same terms unless sixty day renegotiation notice, $ per month lease payment paid quarterly, Gambling proceeds 40% administrative (utilities and liability insurance) and 60% contribution, or as amended by state law, to fire fighters paid quarterly, Membership dues collected would be paid to fire fighters, A unified budget presented to Council by September, subject to an audit beginning year 2014 at the fire company expense. Councilman Musser suggested that the lease payment be paid to the Borough to use towards fire fighter equipment. Manager Hovenstine suggested opening a separate account for the transactions. Councilman Benner suggested that the lease state that prior leases become null and void. Councilman Rothermel mentioned that the lease would be retroactive to January 1, MANAGERS REPORT: Consumer Confidence Report The 2013 CCR, a mandated EPA report, will be distributed in March.

3 Shamokin Dam Borough Council Page 3 Audit Forgett & Kerstetter, the auditors, will begin the audit on Wednesday, March 5, Truck Update The Borough received the 2014 truck on February 7, PMRS Report PMRS 2013 Information The Borough received the GASB-25 Information for 2013, which had a funded ratio of 144% for the Police pension plan and a funded ratio of 105% for the Non-uniform pension plan. PMRS would not make recommendations unless the funded ratio would be below 90%. The Borough s pension plans are well funded. Borough Signs Manager Hovenstine recommended replacing the Friendly Community signs that were installed at least fifteen years ago. The Manager received a quote from Ace of Signs with three options: refurbish existing signs - $2, for the pair, Ace of Signs suggested a new architectural sign - $3, for the pair, and cut vinyl sign - $ each. A motion was made by Councilman Rothermel to replace both signs with the new architectural sign with a cost of $3,315.60, seconded by Councilman Musser, and approved by all. Councilman Musser asked about the installation of the letters at the marquee at the Orchard Hills entrance. Manager Hovenstine mentioned that the Borough crew will clean the marquee and then install the individual letters. President Herbert questioned whether the change of the federal regulations regarding stop signs and street signs had a timeframe. Manager Hovenstine answered that the street signs are in compliance and that the stop signs are replaced as needed. Recent Water System Challenges The water treatment plant had challenges due to the water runoff. DEP was called in for guidance and assistance and the issue was corrected without any corrective actions required by DEP. Manager Hovenstine also reported that the instrument recording chlorine residual at the reservoir was not functioning properly, and had to be recalibrated. China House Grease Trap Manager Hovenstine will meet tomorrow morning to review the final design of the outside grease trap to be installed for China House Buffet by the end of April. Comprehensive Plan Mayor McGranaghan mentioned that the main idea would be to review and update the Zoning Ordinance as needed. President Herbert suggested that the zoning be reviewed piece by piece and that an inventory of the ordinances be done. The Mayor suggested that a planning consultant from SEDA COG review the existing ordinances for updates. Solicitor Slivinski recommended that the Planning Commission review the Comprehensive Plan as a guide, because the plan will change with the bypass project. Manager Hovenstine will contact SEDA COG for information on the possibility of a planning consultant. Solicitor Slivinski will contact another municipality that is in the process of reviewing their existing comprehensive plan for contact information of their planning consultant. SOLICITOR REPORT: Council directed Solicitor Slivinski to advertise the billboard ordinance for adoption at the April 7, 2014 Council meeting.

4 Shamokin Dam Borough Council Page 4 Solicitor Slivinski asked whether the grease trap regulation ordinance should be advertised. Manager Hovenstine requested that advertisement be delayed, because the Manager forwarded a copy to John Abromitis for review. Solicitor Slivinski sent correspondence on December 7, 2013 to CIBC Foundation, property located at 34 Chestnut Street and Joseph Dingley/Beverly Senavitis, property located at 2753 North Old Trail. CIBC Foundation registered with the Borough under the landlord ordinance requirements. Beverly Senavitis contacted the Solicitor and asked whether registration was necessary, because her daughter and grandchild are living at the property, and would she need to list it under the landlord requirements because the property is not owner occupied. Solicitor Slivinski mentioned that the subject of family members occupying the residence was tabled in the past and never revisited. Manager Hovenstine mentioned that in other municipality ordinances there are exclusions for that circumstance. Solicitor Slivinski mentioned that other ordinances mention family occupied with definitions of family (parents and children). Council agreed that the occupants would need to be registered. The Borough received a letter regarding two ordinances relating to parks and recreation areas that appear to be in violation of Pennsylvania law. (No person in attendance at a park shall carry any firearm unless permission has been granted by the Borough Manager in designated areas and It is unlawful for any person to carry onto or possess in any park, a shotgun or rifle or pistol or firearm of any make or kind unless specific permission is granted for a designated area by authority of the Borough Manager). Solicitor Slivinski stated that there is a state statute that preempts possession of firearms, so that the Borough cannot have a blanket ordinance for the possession of firearms, such as you cannot possess firearms in the Borough. The Borough can say that you cannot hunt in the Borough parks, where the Borough owns. The Solicitor mentioned that the Police Chief should be aware of the state statue. You have the right to carry a firearm as long as you are licensed and unless specified in the state law. The Solicitor received information of a class action suit resulting from the purchase of municipal derivatives from the Bank of America from January 1, 1992 through August 18, Manager Hovenstine will check with the auditors regarding this matter. PLANNING COMMISSION: Chris Sheaffer with Larson Design requested a conditional approval of the preliminary land development plan submitted by Calvary Fellowship Susquehanna Valley church, which was recommended by the Planning Commission. Councilman Benner asked whether there was a provision for a fire hydrant in the access road. Mr. Sheaffer answered that a fire hydrant is not required with the phase I at this time. Councilman Benner asked whether there would be a consideration for a fire hydrant. Manager Hovenstine mentioned that if a fire hydrant would be installed in the right of way, then the church would dedicate it back to Borough; but if a fire hydrant would be installed on the church s property, then the church would own the fire hydrant. Peter Geipel is working with property owner s William Steimling and Eugene Kardohley for property easements. A motion was made by Councilman Musser to conditional approve, upon the Snyder County Planning Commission comments, the Snyder County Conservation District comments, the Waiver to DEP for the type crossing, and an ESCRA sewage module, the

5 Shamokin Dam Borough Council Page 5 preliminary land development plan submitted by the Calvary Fellowship Susquehanna Valley church, seconded by Councilman Benner, and approved by all. COUNCIL WORKSHOP: No workshop is scheduled in March. PAYMENT OF BILLS: General Fund bills in the amount of $18,272.44, Water and Sewer Fund bills in the amount of $136,932.20, PLGIT Local Service Fund in the amount of $15, and Local Service Tax Refund in the amount of $88.00 were presented for payment. A motion was made by Councilman Rothermel to pay the bills as presented, seconded by Vice President Bickhart, and approved by all. ADJOURNMENT: The meeting was adjourned at 8:20 PM.
