There were no requests by members for site inspections for the planning applications for consideration at this meeting. 558 DEVELOPMENT CONTROL (SITE VISITS PANEL 20 DECEMBER MINUTES The Chairman allowed the following persons to speak on the applications indicated below prior to the consideration of the applications by the Committee at this meeting: Speaker Mr Scates (objector Mrs Baldock (objector Councillor Ellis (a Ward member Application number and site CA/07/01140/CAN (Land adjacent to Knotts Lane and King Street, Canterbury CA/ /CAN ( Sturry Road, Canterbury

2 Mrs Baldock (objector Mrs S A Stupple (objector Councillor Ellis (a Ward member Mr R Crapper (objector Parish Councillor Peter Topley (Sturry Parish Council Mr M Jagger (for the applicant CA/07/01513/CAN ( Sturry Road, Canterbury CA/07/0911/STU (60-62 Sturry Hill, Sturry Mr Welch (objector Mr Dean (the applicant CA/07/01318/HBA (Land adjacent to 19 Ivanhoe Road, Herne Bay Following a debate on planning application No CA/07/01140/CAN (Land adjacent to Knotts Lane and King Street, Canterbury a proposal to refuse planning permission for the proposed development described in that application was put to a vote and LOST. The Committee then agreed to grant planning permission for the proposed development and its decision on the application forms part of the resolution (a below. Following a debate on planning application No CA/07/01513/CAN ( Sturry Road, Canterbury, subject to discussion with the applicant to secure the amendment of the application by changing the proposal for a café bar to a café only, the Committee agreed, as indicated in resolution (b below, to delegate power to the Head of Development Services to grant planning permission for the amended application, subject to the conditions recommended by the Development Control (Site Visits Panel for that application. Following a debate on planning application No CA/07/00911/STU (60 and 62 Sturry Hill, Sturry a proposal to grant planning permission for the proposed development described in that application was put and LOST. A proposal to refuse planning permission for the proposed development for application No CA/07/00911/STU was then put to a vote and LOST. The Committee then agreed, as indicated in resolution (c below, to delegate power to the Head of Development Services to grant planning permission for the development described in that application. RESOLVED (a (b (c That, subject to (b and (c below, the minutes of the meeting of the Development Control (Site Visits Panel held on 20 December 2007 be received and the recommendations contained therein on the planning applications specified be approved and adopted. That the Head of Development Services be, and is hereby authorised, pursuant to Section 101 of the Local Government Act 1972, subject to the applicant agreeing to amend the application by changing the proposal for a café bar to a café only, planning permission be granted for application No CA/07/01513/CAN ( Sturry Road, Canterbury subject to the same conditions as recommended by the Development Control (Site Visits Panel for that application. That the recommendation of the Development Control (Site Visits Panel to grant planning permission for the development described in planning application No CA/07/00911/ STU (60 and 62 Sturry Hill, Sturry be approved

3 on the basis of the Head of Development Services being delegated power, pursuant to Section 101 of the Local Government Act 1972, to grant planning permission for that application subject to satisfactory negotiations to secure the protection of the trees at plot 5 at the site. (In accordance with the Code of Conduct for Members - Councillor Mrs Law declared a personal interest in planning application No CA/07/01140/CAN (Land adjacent to Knotts Lane and King Street, Canterbury because she knew the public speaker for the application at this meeting. Councillor Mrs Law also declared a personal interest in planning application No CA/07/0911/STU (60 and 62 Sturry Hill, Sturry because she knew the three public speakers for this application at the meeting. Councillor Eden-Green also declared a personal interest in that application because he knew the agent. Councillor Mrs McCabe also declared a personal interest in the application because she knew Mr Jagger, one of the public speakers, through his previous employment with the City Council. The Chairman advised that some of the other Members of the Committee in attendance for the meeting also knew Mr Jagger. 559 LIST OF PLANNING APPLICATIONS AND PROPOSALS The Committee considered the planning applications received, the observations thereon of interested parties and the views and recommendations of the Head of Development Services and comments made at this meeting by the following persons in respect of the applications specified: Speaker Alison Letts (objector Parish Councillor Stewart Ross on behalf of Blean Parish Council and the Westfield Residents' Association Elizabeth Russell-Southwork (objector Mr P Cotton (the applicant Application No and site CA/07/00147/BLE ((39 Blean Common Road, Blean CA/07/00903/WHI (101 Herne Bay Road, Whitstable Mr S Rose (for the applicant CA/07/01590/WHI (138 Tankerton Road, Whitstable RESOLVED That decisions on the applications be made as set out on pages inclusive to these minutes. to (In accordance with the Code of Conduct for Members, Councillor Thomas declared a prejudicial interest in respect of planning application No CA/07/00903/WHI (101 Herne Bay Road, Whitstable because he owned a property near the application site and he knew some of the objectors to the application. Councillor Thomas vacated the Chair and left the meeting for the consideration of the application. Councillor Mrs McCabe took the Chair for the consideration of that application.

4 560 TREE PRESERVATION ORDER NO 4, 2007 (NEW CLOSE, CONYNGHAM LANE, BRIDGE Prior to the consideration of the report of the Chief Executive regarding the above Order, the Chairman allowed Mr Cowley (who supported the proposed Order and Mrs T Jones (who objected to the proposed Order on behalf of the land owner to speak on this item. The Committee then considered the report of the Chief Executive which advised that a provisional Tree Preservation Order had been made on 21 September 2007 to protect a large Wellingtonia on land in the Bifrons Park, (Bekesbourne with Patrixbourne/Bridge Conservation Area at New Close, Conyngham Lane, Bridge. The Order remained in force for a provisional period of six months, but would lapse on 20 March 2008 unless it was confirmed by that date. The report advised upon a letter which had been received from the owner of the land objecting to the Order and eight letters and s from local residents in support of the Order. The Head of Development Services reported a late representation which had been received from the owner/occupier of a property near the land in question who supported the Order. The report indicated that the tree was an important feature in the landscape and of historic and cultural importance to the village. Also, in the absence of any evidence, other than its height, that the tree posed a heightened risk of failure, the Committee had been recommended that the Tree Preservation Order be confirmed. RESOLVED That, having considered the report, together with the letters of objection and support, now reported, the Tree Preservation Order No 4, 2007 (New Close, Conyngham Lane, Bridge be confirmed. 561 PLANNING APPEALS DECISIONS The Committee received a report by the Head of Development Services regarding the decisions on various planning appeals. RESOLVED That the report be noted. 562 MEMBER PLANNING TRAINING SEMINAR The Head of Development Services advised that it was necessary to arrange a new date for the training seminar which had been scheduled for 20 February He advised that the suggested alternative date was either 28 February or 6 March 2008, commencing at 9.15am at a venue to be advised, and that he would write to Members to check whether they could attend. 563 RESIDENTIAL DEVELOPMENT PROPOSALS IN THE PARHAM ROAD AREA, CANTERBURY Arising from the determination of two planning applications, earlier in the meeting, for development at Sturry Road, Canterbury, a Member requested that future applications for residential development in that area should be brought to the Committee for consideration. The Head of Development Services advised upon the proposal and the Committee

5 RESOLVED That each and every application involving development proposals for new housing or the loss or provision of parking areas off Parham Road, Canterbury and the adjoining area, be reported to the Development Control Committee for consideration. 564 COMMENCEMENT TIME OF THE NEXT MEETING OF THE COMMITTEE ON 5 FEBRUARY 2008 The Chairman asked Members to consider an earlier commencement time for the next meeting in the event of there being a large number of planning applications for consideration at that meeting. The Committee discussed the issue and RESOLVED That the Head of Development Services be allowed discretion to decide whether the commencement time of the next meeting of the Committee on 5 February should be brought forward to an earlier time. (The schedule of decisions on the planning applications made by the Committee under delegated powers are set out on pages to inclusive to these minutes There was no other business and the meeting closed at 10.50pm.
