Aube, Daily Press Public: 4 1 DECLARATION OF PECUNIARY INTEREST - None Declared 2 PUBLIC MEETING NOTICE a) Public Notice - Timmins Trinity Christian School Society - Z The proposed zoning by- law amendment is to rezone Lot 10, Plan M- 241 Cochrane, Parcel WT, known as 228 Huot Street, South Porcupine, from Institutional ( NA- IN) to General Commercial ( EA- CG) to facilitate the development of a retail trade establishment offering equipment, parts and office space in two existing buildings along with the development of one accessory dwelling unit. Objections were received from the following: Eileen and Roy McKay, 219 Front Street, South Porcupine Ingrid Rasmussen, 220 Huot Street, South Porcupine Kulta- Koti, Timmins Finnish Seniors' Home Inc., 231 Huot Street, South

2 160 Porcupine Concerns expressed included lack of sidewalks for excessive pedestrian traffic, heavy vehicular traffic, contractor parking ( Carabelle Inn), no highway access from proposed business, lack of parking on subject property, area is primarily an educational/ residential area, deterioration of roadway, hindering of snow removal, safety for school children, increased noise, increased traffic volume including heavy equipment, lack of parking and lack of driveway for turnaround. A recommendation will be presented to Council on July 22, REPORTS a) Source Water Protection Plan Risk Management Official The Province of Ontario has made safe drinking water a priority by implementing several pieces of legislation to ensure delivery of safe drinking water from the source to the tap. The additional measure that was created to ensure safety and compliance and protect all sources of municipal drinking water, was the Clean Water Act. For the City of Timmins, the Mattagami Region Source Protection Plan, identified eleven significant threats, located in Protection Zone 1 and Protection Zone 2. It is the responsibility of the RMO and RMI to manage those threats and monitor them on an on- going basis. It is also the responsibility of the RMO and RMI to develop Risk Management Plans for the existing properties identified with significant threats. At the present time, four (4) risk management plans will be developed once we receive ministerial approval of our Source Protection Plan. In addition, new developments within the protection zones will require a review by the RMO to ensure the safety of the municipal source of water. To further support this legislative requirement, the City of Timmins Official Plan and Zoning Bylaws include all necessary provisions and schedules of the Clean Water Act and the Mattagami region Source Protection Plan. The responsibility to undertake this regulatory function has been mandated by the province and is assumed by municipalities. Future costs are expected to be assumed by the municipalities. For the City of Timmins, the work of the RMI has been assigned to an existing position within our structure. The Environmental Coordinator has received all necessary training to perform all tasks associated with the function of the RMO and RMI. Council' s approval is required for the appointment of Scott Tam and Luc Duval as Risk Management Officials ( RMO) and further designate Scott Tam as a Risk Management Inspector ( RMI) under Part IV of the Clean Water Act, 2006.

3 161 b) Approval of the NOHFC application for the Airport Road Development The Community Development Committee and a local developer, agreed to prepare a funding application for a new commercial development taking place on Airport Road ( intersection of Westmount and Airport Road). At the present time, the site has been selected for the construction of a new Best Western Hotel and foundation work is underway. This request for funding is specifically earmarked to the intersection improvements that are required on Airport Road. These improvements include, widening of Airport Road, construction of turning lanes and the installation of traffic signals. In addition, the scope of work will include the replacement of a municipal storm sewer that crosses Airport Road at this location. The total value of the intersection improvements are estimated at $ 1. 1 million. The City' s portion of this project (storm sewer) is estimated at $200,000. The other $900, 000 belongs with the developer. Should we be successful in getting an approval for this grant, the City of Timmins project cost would be reduced by 50%. A resolution of Council is required to attach to the NOHFC application and receive funding consideration from the governing body ( Stage 2 review). C) Contract Award - Timmins Asset Management Plan In 2013, the provincial government announced that future capital funding for Ontario municipalities will be contingent on providing an asset management plan. Funding was made available to enable smaller municipalities to take part in this activity. The City of Timmins did qualify for funding and received 31, from OMAFRA, to help in defraying some of the costs to complete this exercise. From the provincial perspective, the key assets that require a comprehensive asset review include: Roads Bridges Water Filtration Plants Water Pollution Control Plants Piping networks ( water, sewer and storm) For the City of Timmins' perspective, our comprehensive Asset Management Plan also includes the following assets: Buildings Parks

4 162 Traffic Signals and Street Lights Fleet The province is moving towards standardization and consistency in municipal asset management. The first step is requiring any municipality seeking provincial capital funding to prepare a detailed asset management plan and show how its proposed project fits within it. As part of this process, municipalities will need to demonstrate how they themselves are assisting financially with the proposed project, including engaging with Infrastructure Ontario. A detailed guide has been developed by the Ministry of Infrastructure and establishes the minimum requirements of a municipal asset plan. The City of Timmins Asset Management Plan Proposal addresses all of the requirements of the plan. A total of four (4) proposals were received on May 15th, 2013 by 2: 00 p. m. The proposals were reviewed and scored independently by a committee of five employees working in various departments ( Planning, Engineering, Accounting and Public Works). The final scoring has resulted in a recommendation to award the project to Watson and Associates at a cost of$ 181, d) Request for Encroachment Agreement for St Mary' s Gardens Autumnwood Mature Lifestyle Communities constructors of St. Mary' s Gardens are requesting an overhead encroachment of ten feet nine and a half inches by twenty-nine feet six and a half inches to be able to construct a balcony for their residents use. That part of Fifth Avenue dead- ends onto Autumnwood property. The request is reasonable and is similar to one granted to Bucovetsky' s ( Tweed and Hickory) many years ago except this encroachment is more out of the way. Autumnwood will be required to pay a fee of$ plus add the City to their liability insurance. e) DSBONE Site Plan Control Agreement - 53 Croatia Avenue The purpose of this report is to obtain approval to enter into a Site Plan Control Agreement with District School Board Ontario North East regarding their new corporate office at 153 Croatia Avenue, Schumacher, ( RP CR Part 28, North Part of Lot 8, Concession 2 Tisdale Township, PCL 3941, WT, City of Timmins District of Cochrane. The applicant proposes to develop a single storey corporate board office to replace the original office which was destroyed by fire. The proposed 1, 750 metre2 ( 18, square foot) single storey corporate board office meets all the requirements and provisions of the Zoning By- law.

5 163 f) Chartrand Power Sports & Marine Site Plan Control Agreement - Riverside Drive Approval of Council is required to enter into a Site Plan Control Agreement with ONT INC # ( Chartrand Power Sports & Marine) regarding their development at 2480 Riverside Drive for a proposed 1, m2 ( 10, ft2) showroom/ repair shop which meets all the requirements and provisions of the Zoning By- law. g) Dubroy Temporary Use By-Law Caron Road A Zoning By- law amendment is being requested on the north part of Lot 12, Concession 2, Mountjoy Township, Parts 8, 9 and 10, 6R- 4130, Parcel 21253, SEC, located municipally at 503 Caron Road, Timmins, to allow two dwelling units, within a portion of a detached accessory building, as a temporary use. The proposal would establish two second dwelling units, to be located on the second storey, within an accessory building ( detached garage) to the existing main dwelling for a period of up to 9 years. The temporary units would be made available to the proponents immediate family members. See Special Meeting minutes of this date. h) Hollinger Park Food and Beverage Concession Council' s approval is being requested for the approval of a lease agreement with Boogy' s Diner Inc. for the operation of a temporary concession stand in the Hollinger Park from mid July to mid September (2013). Subsequent lease terms will run from mid May to mid September (2014 through 2017). See Special Meeting minutes of this date. i) Encroachment Agreement with Exsics Exploration re: Christopher' s Coffee House Council' s approval is being requested to permit an encroachment of fascia and signage for Christopher's Coffee House located at 35 Pine Street South for purposes of constructing fascia, signage, moldings, lighting and a window that will encroach onto Pine Street South 16 inches. 4 ADJOURNMENT - 6: 43 p. m.
